Opis:
According to recent statistical research the index of literacy in the population of Belarus is very high in comparison with other European countries. Higher education is a key element in the development of the economy and sustainability of the cultural and intel- lectual potential of the nation. Belarus is a young independent country that is passing through years of integration and international cooperation. This paper describes the development of higher education in Belarus starting from the collapse of the Soviet Union. Using a comparative approach the author focuses on legislation regulating the higher educational system and its development. A few aspects of international coop- eration are explored along with the reasons behind exclusion of the country from the Bologna process and its consequences on society.

The aim of the paper is an analysis of a broadly understood legislation of general councils which took place in an important period for the development of the then educational system and culture – at the height of the Middle Ages (12th–13th c.). While analysing the written records of synodal and council acts, several interesting aspects can be considered: the regulations related to the education of clergy (the diocesan ones, as the same issues concerning monastic orders were regulated by the inner legislation of general chapters), the organization of schools and teaching programmes, the records telling about the moralizing influence on the community of the faithful, and finally, the attitude of the Church toward the question of general access to education, including the functioning of universities. The presented study demonstrates a significant role of ecclesiastical school legislation for the development of the educational system in mediaeval Poland. Also, it can be noticed that all changes in this matter were the result of legislative activity of the Church but also responded to the educational needs of the contemporary society. The latter, in turn, stemmed from a general civilizational development of Latin Europe, the part of which were the lands being under the rule of the Piast dynasty.

The official reception of the conciliar legislation in medieval Poland was greatly influenced by the papal legates, ambassadors endowed with papal authority, who brought conciliar canons to the country ruled at the time by the Piasts and made them public at councils convened with the participation of papal legates, closely monitored the observance of Canon Law and its scope expansion, concurred statutes of Polish provincial and diocesan councils, approved or rejected nominations of bishops, etc. They also acted as intermediaries in personal interventions of popes in their involvement in the functioning of the Church in Poland. Their duties also included inspections in dioceses. Visits of papal legates in Poland were relatively frequent and their main goal was to enforce and implement ecclesiastical reforms in the country. In some instances, a strict relationship between a stay of a papal representative in Poland and the process of the creation and spread of schools is clearly observable. The article examines source accounts concerning the visits of papal legates in Poland, as well as analyses the available statues of legate councils in terms of the provisions included in them regarding education of representatives of the clergy and laymen alike.

Jedną z najważniejszych form aktywności Polaków na obczyźnie było od wieków tworzenie własnych instytucji oświatowych. Prawie we wszystkich ośrodkach polonijnych tworzono uzupełniające szkółki przedmiotów ojczystych. Niejednokrotnie powoływano również własne szkoły o pełnym zakresie ogólnego nauczania. Jeśli społeczności polonijnej nie stać było na tworzenie szkół, to organizowano chociaż lekcje religii w języku polskim, organizowano kursy języka ojczystego, czy też rozwijano pozaszkolną działalność oświatową służącą podtrzymaniu tradycji ojczystych. Obecnie obowiązująca ustawa z dnia 7 września 1991 roku o systemie oświaty (t.j. DzU z 2004 r., Nr 256, poz. 2572 ze zm.) pozwala na wspieranie polskiego szkolnictwa poza granicami kraju poprzez: kierowanie nauczycieli do pracy za granicą, przekazywanie niezbędnych podręczników i pomocy dydaktycznych, organizowanie w kraju i za granicą doskonalenia zawodowego nauczycieli prowadzących nauczanie języka polskiego, historii, geografii, kultury polskiej oraz innych przedmiotów nauczanych w języku polskim , organizowanie kolonii i innych form letniego wypoczynku dzieci i młodzieży polonijnej. Kierunki działań resortu edukacji zmierzają również do otwarcia nowych obszarów wspierania wspomnianego szkolnictwa. Oświata polonijna powinna cieszyć się szczególnym zainteresowaniem polskich władz oświatowych, gdyż to dzięki niej jest możliwe podtrzymywanie polskości w środowiskach polonijnych, jak też wśród Polaków czasowo przebywających poza granicami kraju. Pozytywnie należy ocenić wspomniane działania. Wydaje się, że najbardziej pozytywnym ich przejawem jest próba koordynacji i ujednolicenia wspomnianego szkolnictwa. Ważnym elementem jest wprowadzenie również właściwego systemu motywującego nauczycieli do podejmowania wyjazdów do pracy w środowiskach polonijnych.
One of the most important forms of Poles’ acitivity abroad has for ages been the establishment of their own educational institutions. Almost in all Polish centres schools were made to teach about Poland. Very often normal schools were established with a complete agenda of general tuition. If the Polish communities aborad could not afford a school, then at least religious instruction was organised in Polish, Polish language courses, or else extramural tuition to maintain traditions of the homeland. At the moment the law of 7 September 1991 on the system of education (i.e. DzU of 2004, No 256, pos. 2572 with change.) provides conditions for the support of Polish education abroad by sending teachers to work abroad, dispatching necessary manuals and didactic aid, organising special courses at home and abroad for teachers who conduct Polish language teaching, history, geography, Polish culture, and other subjects teaught in Polish, organising summer holidays for Polish children and adolescents from abroad. The ministry of education is is going to open new areas in which to support education. Polonia education should cherish a special concern on the part of the Polish educational authorities, for as long as it exists it is possible to maintain the Polish spirit in Polonia’s centres and among Poles who temporarily sojourn abroad. We should think in positive terms about the above mentioned activities. It seems that their most positive manifestation is an attempt to coordinate and unify education. It is important to introduce a proper system of motivation for teachers to go abroad to work in Polonia centres.

The Ukrainian system of education has had remarkable achievements and notorious traditions of schooling. However, at this very stage our society requires the changes that have been focused on by the author of this paper. The changes are necessary for the successful development of human recourse in the country in its struggle for the European integration. The mechanisms for the changes are to be introduced in the updated educational legislation. We do not really have time. We should unite and, instead of passively expecting changes, become the explorers and agents of the reform in education.

The Salesian Society runs several schools in Poland. They represent a significant part of Catholic schools in the national educational system. The education is characterized by the preventive system of St. John Bosco. Polish educational law offers possibilities to integrate the educational objectives set out by Fr. Bosco, and pursue them in a manner appropriate to today's time and society. This article presents the main objectives of the Salesian educational pedagogy and presents the educational records of the Polish educational law, which offers space for their appropriate implementation.

The article discusses the issue of the possibility of regulating matters concerning higher education and its institutions in executive and internal acts. It presents the acceptable limits of delegating matters relating to higher education to regulations, as well as internal acts of higher education institutions. These limits are described taking into account the principle of autonomy of higher education institutions, as well as the rules on the creation of law, in particular the rules for issuing regulations. It was also pointed out that the incorrect division of matter between act of parliament (statute) and a regulation violates constitutional rules of law creation. It is also contrary to the protection of entities’ trust in the state and law and the principle of division and balance of power. Faulty formation of the higher education system is not good to the quality of education and conducting scientific research. It hinders the implementation of the freedom of science.

The EU membership requires introduction of significant changes in the agricultural sector. Such changes will not be possible without investments in human capital. The aim of the paper is to make an attempt at presenting the coincidence of three factors conducive to the development of lifelong learning process in rural areas: 1) EU and Polish legislation concerning the cross-compliance rule enforcement; 2) EU financial support for human capital development in the EU second programming period; 3) new banking product connected with financing adult education (Individual Learning Accounts, ILA).

This text is an appeal to Polish Members of Parliament - members of National and Ethnic Minorities Committee visiting Pomeranian Region in July 2010 to take notice of the social usefulness of Folk High Schools. The author recalls the contributions of those institutions in the development of Polish rural areas, and shows - on the example of Kashubian Folk High School - how important those institutions of adult education can be in building local democracy outside big agglomerations also today. The appeal, in a form of a typical gloss, once again tries to encourage the members of the Parliament of the Republic of Poland to make the effort of providing comprehensive regulation of legal and organizational situation of Polish Folk High Schools and other adult education entities of non-commercial character.

Opis:
The article deals with the subject of disciplinary responsibility of female and male students from the perspective of discriminatory behaviour. Anti-discrimination legislation in Poland, apart from the employment sphere, does not provide protection against discrimination. The Act on the implementation of certain provisions of the European Union in the field of equal treatment introduces broad protection of only some legally protected features. Universities, in the sense of responsibility for the safety and protection of the academic community, introduce internal anti-discrimination regulations, emphasizing important values and principles that every male and female student should follow. Socio-political conditions may influence the disciplinary proceedings of male and female students. Assessment of the breach of the student’s dignity as one of the premises of disciplinary liability encounters many difficulties and more and more often may refer to the conflict of freedom of speech and the right to equal treatment.

Pedagogika prawa jest działem teorii i filozofii prawa, który zajmuje się wychowawczym oddziaływaniem prawa, poszukiwaniem optymalnych rozwiązań legislacyjnych, badaniem obowiązującego lub projektowanego prawa pod względem jego zgodności z prawem naturalnym, a także pod-noszeniem świadomości prawnej i rozwiązywaniem konfliktów. Opiera się na założeniach prawno-naturalnych i personalistycznych. Przedmiotem niniejszego opracowania są wybrane zagadnienia dotyczące pedagogiki prawa kościelnego, w szczególności prawa partykularnego. W toku rozważań podjęte zostały podstawowe zagadnienia aksjologiczne, teleologiczne i prakseologiczne, problemy stałości prawa i dyscypliny kościelnej, rodziny i przygotowania do małżeństwa oraz wybrane zagadnienia społeczno-ekonomiczne.
The Pedagogy of Law is a branch of law theory and philosophy which focusses on the educational function of law, seeking the best-possible legislative solutions, analysing the existing or draft laws in terms of their compliance with natural law, and also increasing legal awareness and resolving conflicts. The Pedagogy of Law is based on legal and natural assumptions, and also personalistic foundations. The article deals with selected issues related to the Pedagogy of Canon Law, especially particular Law. It discusses basic axiological, theological and praxeological issues, topics associated with the permanence of Canon Law and discipline, the family and preparation for marriage, and also selected socio-economic problems.
