    The main aim of the article is to discuss the issue of the liability of an editor for a press offence, according to Article 49a of the press law. The analysis begins with a historical overview which shows the evolution of liability for offences committed in print by press outlets. To this end, the author introduces the concepts of the right of anonymity or the responsible editor. These two institutions, characteristic of the interwar period, performed two extremely different functions. The former allowed to conceal the identity of the author of the printed material, while the latter was instituted in order to ensure that the victims were sufficiently protected. The analysis of the current provisions of the press law showed that the legislator introduced two separate legal definitions: that of an editor and that of an editor in chief. The following part of the article discusses those two categories in more detail, paying particular attention to the decoding of their definitions as introduced in the press law from a practical standpoint. Moreover, it has been emphasized that each editor in chief is also an editor, but not vice versa, since some regulations are addressed specifically to the editor in chief. Bearing in mind that assigning liability for a press offence is dependent on determining the moment from which a person can be considered an editor in chief, the author discusses the registration system for journals and periodicals. As a result, the author determines three distinct periods of time which determine the possibility of considering a particular person as an editor in chief. The last part of the article is devoted to the rules and circumstances of prosecution of the editor for publishing a press article. The author points to the differences which stem from assuming a different subject party of the offence. In the cases of assuming negligence, it results in liability under Article 49a of the press law, whereas in the cases of assuming intentionality results in liability for an intentional offence of another type committed in complicity.

    Redaktorzy dzienników i czasopism ponoszą odpowiedzialność wobec autorów, którzy dostarczają treści czasopism, właścicieli/wydawców czasopism oraz ogółu społeczeństwa za to, co pojawia się w jego dzienniku. Aby ustanowić i utrzymywać wysokiej jakości zawartość czasopisma, redaktor powinien przed przyjęciem stanowiska otrzymać wyraźne pisemne oświadczenie właściciela czasopisma, określające obowiązki i autonomię redaktora. Redaktorzy naczelni, a nie inne osoby, które nie mają wpływu na całokształt publikowanych materiałów, powinni być w pełni odpowiedzialni za decyzje redakcyjne dotyczące poszczególnych rękopisów. Prawo redaktora do wolności redakcyjnej powinno zostać uzgodnione zarówno przez redaktora, jak i właściciela/wydawcę czasopisma.
    Editors of daily newspapers and magazines have responsibilities toward the authors who provide the content of the journals, the owners/publishers of the journals, and the public as a whole for what appears in his or her journal. To establish and maintain high-quality journal content, an editor should, prior to accepting a position, receive an explicit written statement from the journal’s owner that defines the editor’s responsibilities and autonomy. Editors should be given full responsibility for editorial decisions on individual manuscripts. The editor’s right to editorial freedom should be agreed on by both the editor and the journal owner/publisher.

    Opis:
    The personal archive of Adam Tarn (1902–1975), the first editor-in-chief of the Dialog monthly and a translator, critic, novelist, and playwright, includes notes with loose ideas for plays, notes to his unfinished book on Chekhov, and minor literary attempts, which he corrected, set aside and later expanded. This material, which Tarn’s heirs kindly offered me for study, constitutes a valuable proof the creative process and the evolution of the writing of the Dialog’s editor-in-chief. In the context of Obraz ojca w czterech ramach [Father’s Image in Four Frames] (1934), Tarn’s début novel and the only one he completed, the novel Kameleon [Chameleon] is an intriguing item in the author’s collection of unfinished works. In this article I shall discuss the material contained in Tarn’s personal archive. This study offers an insight into his “internal laboratory” of writing and enables one to read it from, e.g., the biographical perspective. The dating of the collected material can be only approximated. The earliest surviving prose attempt written in French probably came from the interwar period, while the final notes were composed during his émigré period after 1968, when Tarn was working on his unfinished book on Chekhov.
    W archiwum osobistym Adama Tarna (1902–1975) – pierwszego redaktora naczelnego miesięcznika „Dialog”, tłumacza, krytyka, powieściopisarza, dramaturga – znajdują się zapiski z luźnymi pomysłami do utworów dramatycznych, notatki do nieukończonej książki o Czechowie, a także niewielkie próby literackie – poprawiane, odkładane i na powrót rozwijane. Materiały te udostępniane dzięki uprzejmości spadkobierców są cennym świadectwem procesu twórczego i ewolucji pisarstwa redaktora naczelnego „Dialogu”. W kontekście debiutanckiej i jedynej ukończonej powieści Tarna Obraz ojca w czterech ramach (1934) intrygującym utworem jest zachowana w archiwum nieukończona powieść Kameleon. Artykuł charakteryzuje materiały znajdujące się w archiwum osobistym Tarna. Pozwala wniknąć w jego „wewnętrzne laboratorium” pisarskie i odczytać je m.in. w perspektywie biograficznej. Datowanie zgromadzonych materiałów można przyjąć jedynie orientacyjnie. Najwcześniejsza zachowana próba prozatorska zapisana po francusku pochodzi prawdopodobnie jeszcze z okresu międzywojennego. Ostatnie zapiski pochodzą z okresu emigracyjnego po 1968 roku, kiedy Tarn pracował nad nieukończoną książką o Czechowie.

    Celem badań było przybliżenie portretów redaktorek naczelnych dwóch najpoczytniejszych w okresie pierwszej fazy transformacji systemowej (1989‒1992) tygodników: „Przyjaciółki” oraz „Kobiety i Życia”. Pisma łączyła przynależność do segmentu prasy dla kobiet, podejmowana problematyka, wysoki wskaźnik czytelnictwa, a także charyzma i przedsiębiorczość redaktorek naczelnych – Ewy Łuszczuk-Marek oraz Anny Szymańskiej-Kwiatkowskiej. Za istotne uznano zweryfikowanie kompetencji, zainteresowań, aktywności pisarskiej redaktorek w okresie zarządzania redakcją. Zasadna była też odpowiedź na pytania: 1) w jaki sposób redakcje zabiegały o lojalność czytelników?, 2) czy perturbacje polityczne oddziaływały na zmianę na stanowisku redaktora naczelnego?, 3) czy redakcje były stroną w sporze politycznym (o charakterze ideologicznym)?
    The aim of the research was to present the portraits of the editors-in-chief of the two most widely read weeklies during the first phase of the systemic transformation (1989–1992): Przyjaciółka [Best Friend] and Kobieta i Życie [Woman and Life]. The magazines were linked by belonging to the women’s press segment, the issues they dealt with, a high readership rate, as well as the charisma and entrepreneurship of the editors – Ewa Łuszczuk-Marek and Anna Szymańska-Kwiatkowska. It was considered important to verify the competences, interests and writing activity of the editors during the editorial management period. It was also justified to answer the following questions: 1) how did editorial offices strive for the loyalty of readers? 2) did political perturbations influence the change in the position of editor-in-chief? 3) were the editorial offices a party to a political dispute (ideological)?

    Jerzy Turowicz’s “Tygodnik Powszechny” and literature. The almost perfect mediumThe subject of the discussion is Jerzy Turowicz’s attitude to the issues of literature (based on queries in the decades when he was the editor-in-chief of “TP”, i.e. in the 1945-1995 half-century). The special position occupied by the journal from Krakow on the map of the communist-era Polish press is stressed. Since its establishment, this journal enjoyed wide and long-time support from the professor communityof the Jagiellonian University, as well as other academies of Krakow. Assorted accounts from poets and prose authors, including Marek Skwarnicki, Jan Józef Szczepański, Jan Twardowski and others, were discussed. Attention was paid to Turowicz’s outstanding merits in discovering and advocating of literary talents (with an example of Father Jan Twardowski and Maria Jarczyńska-Bukowska). Turowicz seldom wrote on poets and poetry, but he continuously monitoredboth domestic and emigrationliterature on this subject. He also had an extraordinary aesthetic sense which allowed him to selecttalented poets as his collaborators, and published authors whose fame wentmuch further than the borders of Poland (cases of Father Karol Wojtyła, Czesław Miłosz, Stanisław Lem and others). Only under Turowicz, Polish literature had such a wide and competent coverage in “TP”. Thanks to this, readers could acquaint themselves with the foremost pens of literary criticism and were becomingthoroughly oriented in the Polish and world’s literature. It seems that since Turowicz’s passing, “Tygodnik Powszechny” has not played such a role in this regard anymore.
