Opis:
Access to weapons has always raised controversy. Different legal systems regulate this issue differently. In some countries the right to possess weapons results directly from the constitutional right to defence. In others, for various reasons, it is close to impossible to obtain a weapons licence necessary from the point of view of legality. It is not an easy task for the legislator to make the regulations not to be too liberal or too restrictive. This publication aims to present existing solutions of the Polish legislator in the substantive scope and to establish the comprehensiveness of the said regulations and the possibility to improve them. The study employs a number of research methods: doctrinal, comparative, historical and analytical method.

Taxing discretion disrupts the dichotomous nature of tax law provisions, especially if it concerns tax liabilities. This institution may even be considered arbitrary and deemed not applicable in the Czech Republic. An analysis of English and German law indicates that taxing discretion is inevitable but may be effectively limited, e.g. by introducing a legal doctrine stating that exercise of taxing discretion is bound by the purposes of an act of Parliament granting taxing discretion and by judicial review. In the Czech Republic, taxing discretion is limited by administrative guidelines and judicial review, but further improvements are advisable. This would allow to reintroduce tax cancellation based on taxing discretion into Czech law.

Purpose: We propose and test a new leadership model. Our model is an extension of the leaderplex model which proposes that leader cognitive and social complexities are linked with leader effec tiveness indirectly, in a mediation scheme, through behavioral complexity. We enhance the leader plex model with a leader’s degree of managerial discretion as the moderator of the links in this mediation format. Methodology: We test our model with a moderated mediation approach (Baron-Kenny four-step procedure and Preacher-Hayes bootstrapping methods). Findings: We use results of interviews with top leaders in Poland and demonstrate that a leader’s managerial discretion is a moderator affecting the mediation scheme assumed in the leaderplex model. Limitations: The sample size is only 29 leaders. To preserve the respondents’ anonymity, their opinions were evaluated by only one researcher who interviewed them directly. The results may be country specific (Poland). Originality: We define new boundary conditions for the leaderplex model by showing importance of a leader’s real position (managerial discretion) in an organization. Specifically, we show that the nature of the relationships between the variables of interest will change when a leader operates in one physical environment (e.g., high managerial discretion) rather than another (e.g., low managerial discretion). null

Over the several decades of her scientific activity, Professor Teresa Rabska played an outstanding role in the formation of Polish administrative law, particularly during the political and economic transformations of the late 1980s, when Prof. Rabska was actively involved in the field. Within public economic law, the role of the state and its tools for influencing the economy have evolved fundamentally. In this area, the administrative sanctions with which administrative bodies were equipped have developed profoundly and taken on an important function. Undoubtedly, the European Union plays a significant role in the development of administrative penalties. Penalties are imposed in the form of administrative decisions, issued according to procedures governed by the Code of Administrative Procedure. This Code and other laws enumerate the prerequisites for assessing a penalty. Among these, the omission of the element of guilt must be a cause for concern. Consequently, particularly in the case of penalties imposed on individuals, the penalty may be imposed on a person to whom no fault can be attributed in the violation of the law that caused the punishment. The system of fines thus arouses great dissatisfaction among market participants. An analysis of the system of administrative penalties in Poland raises the issue of harmonizing solutions on the scale of the European Union, as it is expected that penalties should be of similar size in all member states. However, the statutory enshrinement of high penalties in the current legislation does not prejudge the practice of imposing them. Given the smaller revenues generated in Poland, the penalties imposed should be proportionately lower. Moreover, the law does not categorically require the imposition of high penalties. The legislation often uses the word “may,” from which some people draw conclusions about the imposition of penalties under administrative discretion, which is not legitimate.

In the presented study, the author characterises the specifics of investigating and proving domestic violence, or crimes associated with it. The study is processed in connection with implementation of the project APVV-19-0090 “Legal methodology for the era of legal pluralism”. The content of the study reflects on the clear need to specify the individual elements that relate to the given topic. The author’s primary goal is to manifestly and clearly interpret the specifics of investigating and proving domestic violence and the most common crimes associated with it. The results of the study are also processed through the use of scholarly methods, specifically, a search of professional literature, case law, scientific outputs, in addition to an analysis of the scholarly knowledge gained from theoretical but also applied practice, synthesis, observation, induction, deduction, and methods of abstraction and generalisation. For verifying the hypotheses, guided interviews and the evaluation of a short questionnaire on the perception of signs and forms of domestic violence by selected persons were also used. The study has not been published elsewhere.

A number of changes to the Agricultural System Structuring Act were introduced by the provisions of the Suspension of Sale of Properties from the Agricultural Property Stock of the State Treasury Act of 11 April 2003. The changes were intended to improve the protection for family farms in Poland and increase their development. Unfortunately, the new regulations are imprecise. They contain many harsh and underdetermined expressions. They also give too much discretion to the administration authorities that take decisions on agricultural property. All that undermines the sense of security and the principle of legal certainty. Consequently, it weakens the protection for family farms that it intended to improve.

Artykuł powstał z okazji 10-lecia „Głosu Prawa”. Autor, czyli docent Wolnej Wszechnicy Polskiej był stałym współpracownikiem „Głosu”. Temat podjęty przez Autora jest żywo dyskutowany w literaturze przedmiotu od XIX w. Gustaw Taubenschlag był prawnikiem związanym z Łodzią, ale pochodził z Przemyśla, gdzie urodził się 13 listopada 1891 r. w rodzinie Bernarda i Cecylii z d. Goldhard, pochodzącej z Brodów. Był bratem słynnego romanisty i papirologa Rafała Taubenschlaga (1881-1958). Ukończył I Gimnazjum w Przemyślu w 1910 r. następnie studiował prawo w Wiedniu. Stopień doktora praw uzyskał także na Uniwersytecie Wiedeńskim. Studiował też na Wydziale Filozoficznym Uniwersytetu Jagiellońskiego (1917-1918). Wykładał w łódzkim oddziale Wolnej Wszechnicy Polskiej na stanowisku docenta. Najbardziej znanym jego dziełem twórczym był zbiór przepisów i komentarz z 1924 r. pt. „Polskie prawo karno-administracyjne" (ss. 264). Pracę tę uzupełnił o rozważania teoretyczne i wydał ponownie w 1930 r., w wydaniu trzecim w 1937 r. (ss. 494). W 1925 r. wydał też „Rekurs administracyjny. Komentarz do ustawy o środkach prawnych od orzeczeń władz administracyjnych" (Dz. U.: 91/23 poz. 712). Zamordowany został najprawdopodobniej w 1942 r. w Bełżcu. The article was written on the occasion of the 10th anniversary of “The Voice of Law”. The author, an associate professor at the Free Polish University, was a regular collaborator of "The Voice". The topic taken up by the author has been vigorously discussed in the literature on the subject since the 19th century. Gustaw Taubenschlag was a lawyer associated with Łódź, but he came from Przemyśl, where he was born on November 13, 1891 to the family of Bernard and Cecylia née Goldhard, from Brody. He was a brother of the famous Romanist and papyrologist Rafał Taubenschlag (1881-1958). He graduated from the 1st Junior High School in Przemyśl in 1910, and then studied law in Vienna. He obtained a doctorate in law from the University of Vienna, and studied at the Faculty of Philosophy of the Jagiellonian University (1917-1918). Taubenschlag lectured at the Łódź branch of the Free Polish University as an associate professor. His most famous creative work was a set of regulations and the 1924 commentary entitled "Polish criminal and administrative law" (pp. 264). He supplemented this work with some theoretical considerations and published it again in 1930, and in the third edition in 1937 (pp. 494). In 1925, he also published "The Administrative Recourse. Commentary to the Act on Legal Measures Against Decisions of Administrative Authorities" (Journal of Laws: 91/23 item 712). Most probably he was murdered in 1942 in Bełżec.

Il 10 marzo 1992 il turno rotale /in III istanza/ c. Colagiovanni ha pronuziato /in causa Parisien./ La sentenza definitiva con la quale il matrimonio delle parti /G. - L./, celebrato il 24 giugno 1978 é stato dichiarato nullo “ob gravem defectum discretionis iudicii” dalla convenuta. La parte “in iure” della sentenza espone la dottrina e la giurisprudenza rotale a proposito del can. 1095. n. 2 del “Codex luris Canonici”, invece nella parte “in facto” si presenta le prove provenienti dalle testimonianze dei testimoni e le opinioni dei periti, chiamati durante il processo nella prima e nella terza istanza. Come la causa del grave difetto di discrezione di giudizio é stata indicata l’immaturità psico-emotiva della convenuta.

A serious lack of evaluative discernment, as regards essential marital rights and obligations arises from a serious disruption of a cognitive, critical, evaluative, consideration act or an act regarding choice – as regards essential marital rights and obligations. As far as intellectual acts are concerned, a serious lack of evaluative discernment results in dysfunctions of cognitive and critical acts, that is evaluative ones, which prevent from correct cognition and proper evaluation of essential marital rights and obligations; as regards an act of will, its lack results from dysfunction of volitional act, which destruct freedom of choice. In proving a serious lack of evaluative discernment as far as essential marital rights and obligations are concerned, all evidence determined in CIC and Dignitas connubii Instruction are used, and the Rota decrees give the greatest attention to direct evidence, which are evidence of experts.

The essay treats on a legal-theoretical project of ‘iuriscentrism’, proposed by Polish legal philosopher Artur Kozak. It begins with an exploration of theoretical and axiological foundations of this theory, which are, first and foremost, sociological institutionalism (as for a social ontology), philosophical transcendentalism (as for a theory of knowledge and action), and affirmative approach towards axiological foundations of the legal order. Subsequently, the article focuses on practical consequences of the above choices, which are a limitation of the judicial discretional power, and a unique way of legitimating the legal practice. According to iuriscentrism, the law is said to play a focal role in the contemporary, ethically pluralist and functionally differentiated societies; for those reasons a special approach to the legal order, the one termed as ‘a faith in law’ or ‘a patience to the law’, is necessarily required.
