    Opis:
    The main aim of the paper is to discuss legal frames of disciplinary liability of students under the Higher Education and Science Act of 20 July 2018. Assuming that disciplinary liability constitutes a type of sensu largo penal liability, the stress is put on the shortcomings of current regulations in terms of the limits of this kind of legal responsibility. Since the definition of ‘disciplinary misconduct’ is partial, the author concentrates on whether the provision requiring disciplinary bodies to apply – mutatis mutandis – the provisions of the Code of Criminal Procedure in matters not governed by the Higher Education and Science Act, enables (or even obliges respective authorities) to apply provisions contained in chapters I-III of Criminal Code.

    Opis:
    The article deals with the subject of disciplinary responsibility of female and male students from the perspective of discriminatory behaviour. Anti-discrimination legislation in Poland, apart from the employment sphere, does not provide protection against discrimination. The Act on the implementation of certain provisions of the European Union in the field of equal treatment introduces broad protection of only some legally protected features. Universities, in the sense of responsibility for the safety and protection of the academic community, introduce internal anti-discrimination regulations, emphasizing important values and principles that every male and female student should follow. Socio-political conditions may influence the disciplinary proceedings of male and female students. Assessment of the breach of the student’s dignity as one of the premises of disciplinary liability encounters many difficulties and more and more often may refer to the conflict of freedom of speech and the right to equal treatment.

    The paper deals with the disciplinary responsibility of judges for obvious and flagrant legal misconduct. A model of the aforementioned responsibility in the Polish law has been presented. The problems deliberated upon include: the moral justification of punishing judges for mentioned disciplinary delicts and critical evaluation of Supreme Court view about this responsibility. A question is asked about reconsidering the interpretation of obvious and flagrant legal misconduct according to modern times and the complicated social and law reality.

    Opis:
    The aim of the study it to discuss the issue of disciplinary proceeding in the context of entity subject to disciplinary liability, the subject matter, the autonomy and the purpose. The author focuses on the ruling of the Supreme Court passed on January 24th 2013, which suggests the application of the rules of criminal proceedings as more appropriate for the subsidiary application of the disciplinary proceedings. Nevertheless the Supreme Court draws attention to another, equally important issue which became apparent in connection with the above – the diversity and lack of consistency of solutions used by the legislature pursuant to a disciplinary proceedings.

    The article presents considerations about the physician’s obligation to pay membership fees for the professional self-government and the consequences of failure to fulfill the obligation that a representative of this profession may suffer in the sphere of professional liability. The analysis of the legal grounds for conducting proceedings in terms of professional liability for this type of the offence was presented against the Supreme Court order of February 11, 2016 (SDI 71/15) and in relation to similar solutions operating in other (selected) groups of public trust professions, performance of which is connected with an obligatory membership in a self-government and participation in its financing.
    W opracowaniu przedstawione zostały rozważania na temat ciążącego na lekarzu obowiązku opłacania składek członkowskich na rzecz samorządu zawodowego oraz konsekwencji niedopełnienia wskazanej powinności, jakie może ponieść przedstawiciel tej profesji w sferze odpowiedzialności zawodowej. Analiza podstaw prawnych prowadzenia postępowania w przedmiocie odpowiedzialności zawodowej za tego rodzaju przewinienie ukazana została na tle postanowienia SN z dnia 11 lutego 2016 r. (SDI 71/15) oraz w odniesieniu do zbliżonych rozwiązań, funkcjonujących na gruncie innych (wybranych) zawodów zaufania publicznego, których wykonywanie wiąże się z obligatoryjną przynależnością do samorządu i partycypowaniem w jego finansowaniu.
