Under art. 33 it. 6 of Hunting law cases of different nature are heard before a regional court. It is the subject matter of specific proceedings that is decisive in determining which procedural regulations will apply as the above provision refers to different legal relations. The first one refers to the membership in the Polish Hunting Association, which is granted in a way that allows us to recognize it as a civil law occurrence, and therefore the request before a common court for the protection of the membership may be considered a civil action. The second one is related to disciplinary liability which due to repressive nature of sanctions falls within penal liability in its broad sense. In this case, the proceedings before a common court exercised as a result of making an appeal against the decision ending disciplinary proceedings within the structures of the Polish Hunting Association constitute continuation of the disciplinary procedure. The nature of this liability calls for the court appeal control to be conducted on the basis of the same rules pertaining to the law of criminal procedure, on which disciplinary proceedings within the organization were based, and for the procedure ensuring the defendant as far-reaching proceedings security as possible to be applied.

However for last 40 years disciplinary liability was generally out of scope of doctrine, recently it is noted constant increase of interest of that part of law. There are many reasons for that, including involving new professional groups and respective strictness and inconsistence of disciplinary provisions. The latter is aggravated by heterogenicity in various corporations and governing by substatutory regulations. Unfortunatelly, an unification of criminal law, being applied mutatis mutandi, is only partial remedy. In that elaboration author analyzed regulations between various corporations to extract basic and common rules and to denominate differences. The complexity augments fact that not only acts have binding effect, but also delegated regulations. That creates sophisticated network of law and professional knowledge, with additional problem of overlapping lex generalis and lex specialis in uncommon proportion. Above mentioned differences concern not only substantive law but also, if not even wider, procedural one. Interestingly, what author depicts, there is even not identical wording used in description of analogical names or definitions. Disciplinary liability, as cumulative to the criminal one, tends to protecting rights of accused person, as generally rule ne bis in idem is not in force. It concerns basic rights, like dignity and equality under the law. It is necessary strict cooperation and open discussion between professionals and legislator, as proper disciplinary liability rules need both protect society and allow to realize freely duties of practitioners.

Due to the amendments to the Act on the Supreme Audit Office of 23 December 1994, apart from the fundamental change of the audit procedure, chapter 4a was added that set out basic regulations related to the disciplinary procedure. While with regard to issues that are not regulated in the Act on NIK, it refers to respective application of the Code of Criminal Procedure. The disciplinary procedure related to nominated auditors of NIK has been discussed in various studies, but none of them has referred to the contents of the complaints principle on the basis of the Act on NIK. In his article, the author presents his views on the contents and consequences of the complaints principle in the disciplinary procedure with regard to nominated auditors, which is of vital importance in the judicature practice of the Disciplinary Commission and the Appeal Disciplinary Commission at NIK.

Przedmiotem artykułu jest rozwiązanie legislacyjne przewidziane w art. 275 ust. 1a ustawy z 20 lipca 2018 r. – Prawo o szkolnictwie wyższym i nauce o treści: „Nie stanowi przewinienia dyscyplinarnego wyrażanie przekonań religijnych, światopoglądowych lub filozoficznych”, które wprowadzono w dniu 10 grudnia 2021 r. Autor omawia okoliczności towarzyszące wprowadzeniu tej regulacji wobec nauczycieli akademickich, a następnie prezentuje cel jej wprowadzenia, zarówno krytykując nieprecyzyjne przesłanki zastosowania tego rozwiązania legislacyjnego, jak i omawiając praktyczne problemy proceduralne stosowania wskazanego przepisu. Natomiast w konkluzjach domaga się uchylenia wprowadzonego przepisu. Autor krytykuje nowe rozwiązanie, gdyż pozwala ono wyłączyć odpowiedzialność dyscyplinarną nauczycieli akademickich, a w końcowej części swoje rozważania ilustruje danymi statystycznymi na temat stosowania art. 275 ust. 1a omawianej ustawy.
The main subject of consideration in the article is the legislative solution provided for in Art. 275 sec. 1a of the Act of July 20, 2018. Law on Higher Education and Science with the following content: “It is not a disciplinary offense to express religious, ideological or philosophical beliefs”, which was introduced on December 10, 2021. The author exhaustively discusses the essence and axiology of disciplinary proceedings against academic teachers, and then presents the purpose of introducing the indicated regulation, criticizing both the imprecise premises for the application of this legislative solution, as well as discussing practical procedural problems, in the conclusions demanding the repeal of the introduced provision. The new provision may in practice drastically limit the disciplinary liability of academic teachers, and in the final part it illustrates its considerations with statistical data on the application of Art. 275 sec. 1a of the Act in question.

This article considers mediation in disciplinary matters against academic teachers, PhD students and students. The analysis was carried out against the background of the new Act of 20 July 2018 – Law on Higher Education and Science and the Regulation of the Minister of Science and Higher Education of September 25, 2018 on the detailed mode of conducting mediation, explanatory proceedings and disci- plinary proceedings in matters of disciplinary liability of academic teachers, and also the way of disciplinary penalties and their seizure. In the first part of the ar- ticle, through the confrontation of the function and the importance of disciplinary responsibility with the functions of mediation proceedings, the legitimacy of the adopted legislative solutions in this area was assessed – introduction of media- tion to disciplinary proceedings against academic teachers and the lack of such a solution in the case of disciplinary liability of students and doctoral students. Then, there is a detailed analysis of the provisions relating to the mediation pro- ceedings allowed for the display of noticed errors and defects in legal regulations.

Members of disciplinary bodies (disciplinary ombudsmen and members of disci plinary commissions) are at risk of being held liable for compensatory damages arising in connection with their duties (i.e. for procedural failures in disciplinary proceedings). The lack of regulations concerning the liability for compensation by the members of disciplinary bodies is also a factor which is unfavourable for those who suffered damage as a result of disciplinary proceedings. As can be seen from the resolution of the Supreme Court of 27 September 2012 analysed in this study, for procedural violations committed in the course of discipli nary proceedings, members of disciplinary bodies are personally liable, jointly and severally with the higher education institution in which they are employed. The conclusions of the analysis of the case law therefore also point to the need to address this problem in a systematic manner. This objective has been partially achieved in the draft of the new Act on Higher Education and Science, which includes for the first time a provision on the optional coverage of members of disciplinary bodies with a third party liability insurance. Nevertheless, it could be argued that this regulation ought to be improved by introducing a compulsory third party liability insurance of members of disciplinary bodies, specifying, preferably in the imple- menting regulation, the minimum amount guaranteed, and elements such as the scope of the third party insurance and the date of commencement of the insurance cover (e.g. the day preceding the commencement of the function of disciplinary ombudsman or member of a disciplinary committee). Such a solution is supported by the analysis of regulations concerning obligatory third party insurance applica- ble to selected professions which has been carried out in the present study. In the case of these professions, the solution that was applied is the one that clarifies the regulations related to the obligatory third party insurance covering the performance of these professions.
