Following the case of the disappearance of the 43 Ayotzinapa students, the Pandora’s Box was opened: pits filled with bodies, corruption, impunity and institutional weakness of a state where politicians, police and authorities at all three government levels have been infiltrated by the organized crime. In Mexico, corruption and drug trafficking are common and the economic reforms are not enough if they do not go together with an effective program of combating corruption and the society is not the main beneficiary of the reforms.This article will explain the background of the Ayotzinapa case, the characteristics of the Mexican political system that allow cases like Ayotzinapa, the consequences of the fight against organized crime launched by ex-President Felipe Calderon, the behavior of a sleeping civil society tired of the reduced economic results and where the state does not have the monopoly of the authority and does not guarantee security.

Opis:
O objetivo deste artigo é historicizar os usos dos testemunhos como estratégia de denúncia da violência estatal na Argentina, principalmente durante a última ditadura civil-militar (1976-1983). Nos interessa reconstruir suas lógicas de produção e circulação no país, partindo de questões como: quem testemunhava; quais organismos de direitos humanos recebiam seus relatos; como eles circularam; e como eles eram usados na produção de documentos diversos. Buscamos, assim, compreender os usos que os atores locais fizeram das linguagens e práticas então disponíveis na cultura dos direitos humanos internacional, adaptando-as à realidade concreta do país durante a última ditadura e à urgência de produzir suas próprias estratégias frente à adoção dos desaparecimentos como principal modalidade repressiva.
The aim of this article is to historicize the uses of testimonies as a strategy of denounce state violence in Argentina, particularly during the last civil-military dictatorship (1976-1983). We are interested in reconstructing their logics of production and circulation in Argentina, starting from questions such as: who testified; which human rights organisms received and produced testimonies; how they circulated; and how they were used for the production of various documents. We thus seek to understand the uses that local actors have made of the languages and practices that were available in the international culture of human rights, adapting them to the concrete reality of the country during the last dictatorship and the urgency to produce their own strategies in the face of the adoption of disappearances as the main repressive modality.

The article concerns the wartime history of Peru and examines both topdown and bottom-up practices of accounting for the internal conflict of 1980–2000, which were initiated in the background of the warfare. The aim of the article is to discuss the connections I observed between the phenomena referred to in the title: return migrations of the inhabitants of the central-southern province, their search for the victims of forced disappearances, as well as the exhumation challenges emerging since the beginning of the war. In other words, the text constitutes an attempt to contextualise the above-mentioned issues given competing versions of memory about political violence in the Andes, with particular focus on their top-down determinants in the Fujimorism era.

Opis:
The prohibition on enforced disappearances is one of the fundamental norms of con-temporary international law which is intended to protect the individual from state re-pression. Under certain circumstances, a violation of the prohibition is recognized as a crime of international law. There are no exceptions to the implementation of the norm. Since the prohibition is a treaty, States must expressly agree to be bound by it. Not all States have done this, but some have, including Argentina. Despite this, Roberto Agustín Yrusta disappeared. His enforced disappearance was preceded by numerous and elaborate forms of evil, cruel and humiliating treatment. This paper seeks to answer the question of how international law can ensure effective enforcement of the prohibition on enforced disappearance.

Prawo do prawdy powszechnie funkcjonuje we współczesnym dyskursie prawnomiędzynarodowym, zwłaszcza w kontekście praw ofiar poważnych naruszeń praw człowieka i dyskusji o sprawiedliwości okresu przejściowego, jej celów i mechanizmów. Bezpośrednio przyczyniła się do tego działalność międzynarodowych organów ochrony praw człowieka, które rozstrzygając sprawy dotyczące naruszeń zakazu tortur, bezprawnego pozbawiania wolności i wymuszonych zaginięć, stwierdzały, że państwo jest zobowiązane do ujawnienia prawdy o przeszłych wydarzeniach, a jednostkom przysługuje prawo do żądania pełnych i prawdziwych informacji o losach ich bliskich. Celem niniejszego artykułu jest analiza statusu prawa do prawdy we współczesnym prawie międzynarodowym. Z tego względu zbadano, jak ta koncepcja rozwija się w międzynarodowym prawie praw człowieka, jaki jest zakres prawa do prawdy, kto jest podmiotem uprawnionym i jakie są środki jego realizacji.
The right to truth is extensively recognized in the contemporary legal discussion, especially within the context of the rights of serious human rights violations’ victims and a broader debate on transitional justice, its aims and mechanisms. This right has directly resulted from the activities of international human rights protection bodies. Human rights courts, while dealing with the cases of torture, arbitrary detention and enforced disappearances has established that states are obliged to disclose the truth about past events, and individuals has the right to require a comprehensive and accurate information on the fate of their next of kin. The aim of this article is to analyse the standing of the right to truth in the contemporary international law. Therefore, it describes the development of this concept in international human rights law and examines what is the actual scope, who is entitled to and what are the means of execution of the right to truth.

This article is intended to provide a legally sound explanation of why and how the contemporary International Humanitarian Law and International Human Rights Law legal frameworks offer tools to address the uncertainty, lack of information, and the consequences thereof in relation to missing persons and victims of enforced disappearances in the context of armed conflicts which predated the adoption of such frameworks. To this end, three scenarios will be examined: the contemporary claims of the families of those who were killed in the Katyń massacre in 1940; the claims for information and justice of the families of thousands who were subjected to enforced disappearances during the Spanish Civil War between 1936 and 1939; and the identification efforts concerning those reported missing while involved in military operations in the context of the 1944 Kaprolat/Hasselmann incident which took place during the Second World War. The analysis of these scenarios is conducive to the development of more general reflections that would feed into the debate over the legal relevance of the distant past in light of today’s international legal framework.
