Opis:
This paper focuses on the question whether Polish law offers an adequate legal framework for dual representation, as required by Article 10 of the EU Directive 2013/48 and Article 5 of the EU Directive 2016/1919. It explores both perspectives: dual representation in proceedings concerning execution of EAW conducted by Polish authorities as well as the right to appoint a lawyer in Poland by the requested person in a case where the EAW is issued by the Polish authorities. The scope of the ensuing analysis is confined to EAWs issued for prosecution of the requested person. Although both above mentioned provisions of EU Directives have not been transposed into Polish national law, their direct application may ensure full exercise of the requested person’s right to dual representation. Thanks to the fact that, in Poland, the requested person is treated as a quasi-defendant in criminal proceedings, the Code of Criminal Procedure offers a legal framework allowing for appointment of the defence lawyer in Poland as the issuing state.
W artykule podjęto próbę udzielenia odpowiedzi na pytanie, czy prawo polskie oferuje możliwość tzw. "podwójnej reprezentacji", jak tego wymaga art. 10 dyrektywy unijnej 2013/48 oraz art. 5 dyrektywy unijnej 2016/1919. Analiza obejmuje obie perspektywy, to znaczy zbadano zarówno możliwość realizowania prawa do "podwójnej reprezentacji" w postępowaniu w sprawie wykonania Europejskiego Nakazu Aresztowania prowadzonym w Polsce, jak i prawo do wyznaczenia obrońcy w Polsce jako kraju wydania tego nakazu. Rozważania dotyczą jedynie Europejskich Nakazów Aresztowania wydanych w celu ścigania. Chociaż oba wymienione przepisy dyrektyw nie zostały wdrożone do prawa krajowego, ich bezpośrednie stosowanie może zapewnić pełne korzystanie przez osobę ściganą z prawa do "podwójnej reprezentacji". Dzięki temu, że prawo polskie traktuje osobę ściganą jak oskarżonego w postępowaniu karnym, Kodeks postępowania karnego oferuje podstawy prawne do ustanowienia/wyznaczenia osobie ściganej obrońcy w Polsce jako kraju wydania Europejskiego Nakazu Aresztowania.

This article argues that the arrests and expulsion of large numbers of Roma carried out by the French government in 2010 violated the European Union’s human rights principles because non-French Roma were targeted collectively for removal. In response to the expulsions, the European Commission initiated infringement proceedings against France for procedural violations of European Union Directive 2004/38 (the Free Movement Directive). However such racially discriminatory state action should be challenged more properly as a substantive violation of Directive 2000/43 (the Racial Equality Directive). Because the European Union does not have its own separate body of human rights law that is binding within Member States, using the Racial Equality Directive to offer protection to vulnerable minorities by challenging discriminatory state practices may be an alternative method of achieving human rights objectives within Member States. Moreover, since the Racial Equality Directive lacks interpretation, a situation of race-based expulsion of EU migrants would be an opportunity to clarify and develop the scope and meaning of the Directive.

Services sum up to 70 % of EU’s GDP, and just 20 % of cross-border trade of the European Union – partly due to the unjusti! ed regulatory and administrative burdens implied on different levels of member states administration. The existence of those barriers has stimulated the works on the directive freeing the service sector and implementing a number of rules that may potentially become milestones of integration, compared only to such “history making” moments as Single European Act or Maastricht Treaty."The freedom to provide service outside the country of establishment’ principle, previously known as the ‘country of origin’ rule, carries this revolutionary impetus. It will allow a service provider be settled in one EU member state and deliver a service (personally or by delegated employees) in another one with all the legal consequences, especially: some aspects of taxation and social security contributions. Unsurprisingly, it has become one of the most controversial legal acts debated in the last decades Europe-wide. This principle may, to a large extend, undermine the foundations of welfare state, especially in the Western part of continental Europe, as it may force the regulated capitalism oriented countries (like Scandinavian ones) to verify their social policies accordingly to competition pressure coming from lower social standards member states. This may, as it is speculated in this paper, fuel the harmonising of social policies on Community level. Free movement of services was introduced fifty years ago, however it has been usually interpreted from the consumers’ perspective: free access to the service by service consumer relocation or trans-border trading. Service provider relocation was tolerated only when accompanied with establishment in the consumer’s country. The Service Directive, following the logic of previous European Court of Justice verdicts, introduces – on the secondary law level – the freedom to be established in another country than the country where the service is provided. This practical challenge is examined theoretically on the grounds of neofuncionalist rationale, as the discussed directive, by its supporters called: the greatest improvement of the internal market since its creation, can act as an empirical proof of neofunctionalism theory applicability. Implementing this approach, especially the revitalised spillover mechanism, is an efficient theoretical vehicle showing satisfactory exploratory power, as well as allowing speculations about the future development on the edge of politics and economy within European integration process. It also highlights the behaviour of supranational actors creating ‘stress among the states’ to progress the integration into the desirable direction (cultivated spillover). The deliberations in this paper are rooted in exempli! cations of so far practices infringing the free movement of services rule, as well as enriched with some argumentation for and against this form of directive (transformative decisions and legitimacy / democracy de! cit). The arguments used are deeply rooted in ! nal version text of the directive accompanied by interpretation of major principles. In the conclusive part author summarises that theoretical legacy of neofunctionalism – in the case of the Service Directive – seems to be adequate and the deductive argumentation based on it positively veri! es the potential of the theory.

The 2008 issue of YARS contained an overview of EU law developments in the period of time from 2004 to 2007. This overview covers the years 2008-2009. It confirms that State aid cases remained numerous (6 in total) and that the Commission’s enforcement activities in the area of State aid control continued at a similar pace as before. With respect to other areas of competition law and policy, the overall picture shows a relatively high level of scrutiny in mergers (5) and antitrust cases or inquiries (2). Moreover, EU Courts adopted several decisions in Polish cases, notably in the regulatory field (electronic communications) and State aid control (partial annulment in Huta Częstochowa (Operator) as well as the rejection of a request for interim measures in Technologie Buczek). The regulatory court cases show the Commission’s consistency in pursuing Member States in their failure to implement or to correctly implement the EU Electronic Communications package. In the state aid related Huta Częstochowa (Operator) judgement, the General Court (GC, formerly the Court of First Instance, CFI) partially annulled the scrutinised Commission decision since the Commission failed to identify the actual benefit related to the receipt of the aid in question. The jury is still out in the case concerning Technologie Buczek because the interim measures judgement says little about the potential outcome of the pending main appeals.
Le YARS de 2008 contenait un aperçu des développements du droit de l'UE pendant la période de 2004 à 2007, alors que celui-ci couvre les années 2008-2009. Il confirme que les cas d'aides d'État sont restés nombreux (6 au total) et que la mise en œuvre du contrôle des aides d'État par la Commission a continué au même rythme. En ce qui concerne les autres secteurs du droit de la concurrence et de la politique de concurrence, le nombre de contrôles des concentrations et des cas ou des enquêtes antitrust est relativement élevé (2). En outre, les cours de l'UE ont rendu plusieurs arrêts dans des cas polonais, notamment dans le domaine réglementaire (communications électroniques) et du contrôle d'aides d'État (l'annulation partielle dans Huta Częstochowa (opérateur) ainsi que le rejet d'une demande de mesures provisoires dans Technologie Buczek). Les arrêts dans le domaine réglementaire montrent la cohérence de la Commission dans les actions contre les États membres qui ont manqué à leur obligation de mettre en oeuvre, ou de mettre en œuvre correctement, le Paquet Télécom de l'UE. Dans l'arrêt Huta Częstochowa (opérateur) concernant les aides d'État, le Tribunal (précédemment le Tribunal de Première Instance, TPI) a partiellement annulé la décision de la Commission puisque la Commission n'a pas réussi à identifier l'avantage réel de la réception de l'aide en question. Le jury est toujours en train de délibérer dans le cas concernant Technologie Buczek parce que l'arrêt sur les mesures provisoires dit peu sur les résultats potentiels des appels principaux en cours.

This third overview of EU competition and sector-specific regulatory jurisprudential and case law developments with a nexus to Poland covers the years 2010 and 2011. This period of time is worth noting for several reasons. First, EU courts delivered a significant number of judgments in ‘Polish’ cases including an increased number of preliminary rulings. Second, 2010-2011 developments were dominated by judgments and decisions concerning telecoms. Finally, the Commission adopted only a handful of Polish State aid decisions following a formal investigation procedure under Article 108(2) TFEU. The main developments in telecoms relate to the Court of Justice's preliminary reference judgment in Tele 2 Polska focusing on the interpretation of Regulation 1/2003 and the PTC v UKE ruling that dealt with number portability charges. Relevant is also the antitrust prohibition decision issued by the Commission against Telekomunikacja Polska S.A. for its refusal to grant access to its wholesale broadband services. In other fields, the Court of Justice delivered three State aid judgments (including two appeals against pre-2010 judgments of the General Court) and two judgments in infringement proceedings (regarding pre EU Accession marketing authorisations for medicines and the reutilisation of data from the public sector). The General Court ruled on appeal in the butadiene rubber cartel case (e.g. in Trade-Stomil v Commission). Finally, the Commission dealt with a merger case with a truly Polish specificity (Kraft Foods/ Cadbury), approved subject to divestiture of the E. Wedel brand.
Ce troisième aperçu portant sur les développements de la réglementation relative au droit de la concurrence de l’UE et droit séctoriel, ainsi qu’à la jurisprudence ayant un lien imporatnt avec la Pologne, couvre les années 2010 et 2011. Cette période vaut l’intérêt pour plusieurs raisons. Premièrement, les tribunaux de l'UE ont délivré un nombre important d'arrêts dans les cas « polonais » dont un nombre croissant de questions préjudicielles. Deuxièmement, les développements en 2010-2011 ont été dominés par les jugements et décisions concernant les télécommunications (télécoms). Enfin, la Commission n’a adopté qu’un petit nombre de décisions sur les aides de l’État polonais à la suite d'une procédure formelle d'examen conformément à l'article 108 (2) du TFUE. Les développements principaux dans les télécoms se rapportent au renvoi préjudiciel de la Cour de justice dans le cas Tele 2 Polska portant sur l'interprétation du règlement 1/2003 et celui relatif au cas UKE v PTC sur les frais de portabilité des numéros. La décision concernant une infraction en application adoptée par la Commission contre Telekomunikacja Polska SA pour son refus d'accorder l'accès à ses services de gros de la large bande est également pertinente. Dans les autres domaines, la CJCE a rendu trois arrêts sur les aides d'État (deux recours contre les arrêts rendus par le Tribunal de première instance avant 2010) et deux arrêts dans une procédure d'infraction (en ce qui concerne les autorisations de marketing pour la médecine préalables à l'adhésion à l’UE et la réutilisation des données du secteur public). Le Tribunal de première instance a statué sur le recours dans le cas de cartel caoutchouc butadiène (par exemple le cas Trade-Stomil v Commission). Enfin, la Commission a traité un cas de fusion avec une spécificité typiquement polonaise (Kraft Foods / Cadbury), approuvé assujetti à la cession de la marque E. Wedel.

Celem artykułu jest omówienie zjawiska sygnalizacji (tzw. whistleblowing), czyli idei anonimowego zgłaszania w interesie publicznym informacji o nieprawidłowościach mających miejsce wewnątrz organizacji przez osobę, która jest lub była jej członkiem, w kontekście konfliktu wartości jaki zachodzi z punktu widzenia swobody prowadzenia działalności gospodarczej. Rozważania prowadzone są z uwzględnieniem przyjętej dyrektywy Parlamentu Europejskiego i Rady 2019/1937 z dnia 23 października 2019 r. w sprawie ochrony osób zgłaszających naruszenia prawa Unii Europejskiej, zwanej dyrektywą o ochronie sygnalistów, a także polskich regulacji prawnych.
The purpose of this article is to discuss the institution of whistleblowing, i.e. the idea of anonymous reporting in the public interest of irregularities taking place inside an organization by a person who is or was a member of the organization, in the context of the conflict of values that occurs from the point of view of the freedom to conduct business. The considerations are carried out taking into account the adopted Directive 2019/1937 of the European Parliament and of the Council on the protection of persons who report breaches of Union law, also called the Whistleblower Directive, as well as Polish regulations.

In this paper, we propose a directive triangular EBG antenna. This approach is derived from using an EBG surface near to a triangular patch with two grilles. The antenna frequency chosen is the 2.45GHz. The directive antenna is simulated by using HFSS and Electrical model. This proposed antenna presents a very high directivity.

Taking into account that terrorism has grown in recent years, the EU institutions decided to update the legal framework which provides for fighting this phenomenon. Consequently, the Council Framework Decision 2002/475/JHA was replaced by the EU Directive 2017/541 of the European Parliament and of the Council on combating terrorism, which should be implemented by the Member States by 8 September 2018. This new act contains a long list of terrorist offences, offences related to a terrorist group, and offences related to terrorist activities. It also stipulates penal sanctions for terrorist offences and provides measures of protection, support and assistance for terrorism victims. This article is a commentary on these groups of provisions and compares them to the previously binding ones. Thus, it indicates the legal changes introduced by the Directive which have to be taken into account by the Member States while implementing it. The comparison of these new provisions with the previously binding ones is also helpful in answering the question posed in the title: Can the Directive 2017/541 be treated as a new chapter in combating terrorism by the European Union?

A lot of changes have been made to the legislative regulations associated with geodesy during the implementation of the INSPIRE Directive in Poland (amongst others, the structure of databases). There have also been great changes concerning the basic map and the method of its creation and updating. A new concept for creating the basic map is presented in this article.
Dokonaliśmy wielu zmian w prawnych regulacjach dotyczących geodezji w trakcie implementacji Dyrektywy INSPIRE w Polsce (m.in. struktury baz danych). Bardzo duże zmiany objęły mapę zasadniczą i procedury jej tworzenia i uaktualniania. W artykule jest zaprezentowana nowa koncepcja tworzenia mapy zasadniczej.

In a recent judgment in ERGO Poist’ovňa, a.s. v Alžbeta Barlíková, the Court of Justice of the European Union attempted to clarify the ambit of Article 11 of Council Directive of 18 December 1986 on the coordination of the laws of the Member States relating to self-employed commercial agents, that is the circumstances where a commercial agent’s right to remuneration may be extinguished should a negotiated transaction not be executed between the principal and the client. Notably, the Court held that in the event of even partial non-execution of a negotiated contract between the principal and the third party client, provided it happened due to no fault on the part of the principal, the agent’s right to commission is proportionately extinguished. The paper discusses the judgment in the light of previous CJEU case law and the Polish transposition of the said European standards with a view to finding any potential divergences between the two. The paper notes two problems. First, Polish law, as opposed to Slovak law, does not recognize an automatic termination of an insurance contract in the event of default on the part of the customer. Conversely, whether such an effect eventuates is left to contractual discretion of the parties. Second, Polish courts have been recently willing to substitute unjust enrichment for contractual liability even where, it appears, complainants have valid claims under Article 7614 of the Civil Code.

The aim of the article is to show the sociological elements in the education process that are present in Korczak’s pedagogy, both in its scientific form as well as in his fiction aimed directly at children. Therefore, society with its educational institutions (family, school, boarding school) is recognized in this pedagogy as an important sphere of symbolic references and educational influences. The key role of society (as the most important educational institution) in shaping pupils is present in commonly known works on the sociology of upbringing (including Florian Znaniecki or Józef Chałasiński), while sociological threads in Korczak’s pedagogy have not been a popular topic of separate analysis so far, apart from one monograph devoted to the subject. Therefore, this topic requires in-depth analyses and afterthought. Janusz Korczak emphasizes the role of society in a child’s life, preparing them primarily for participation in social relations, through diverse forms of group life at school, whose most important achievement is the institution of student self-government. It is thus a bridge between student-oriented education and the traditional pedagogical message, involving the transmission of the requirements of specific social roles.
Celem artykułu jest ukazanie socjologicznych elementów w procesie wychowania, które obecne są w pedagogice Korczakowskiej, zarówno w jej naukowej postaci, jak również w twórczości beletrystycznej skierowanej bezpośrednio do dzieci. Zarówno społeczeństwo, jak i jego instytucje wychowawcze (rodzina, szkoła, internat) będą więc odnotowane w tej pedagogice jako ważna płaszczyzna odniesień symbolicznych, wpływów wychowawczych. Kluczowa rola społeczeństwa (jako najważniejszej instytucji wychowawczej) w kształtowaniu wychowanków obecna jest w powszechnie znanych pracach dotyczących socjologii wychowania (m.in. u Floriana Znanieckiego czy też Józefa Chałasińskiego), natomiast wątki socjologiczne w pedagogice Korczakowskiej nie były dotychczas popularnym tematem oddzielnych analiz, oprócz jednej przedmiotowej monografii. Dlatego też temat ten domaga się pogłębionych analiz i uzupełnień. Janusz Korczak uwypukla rolę społeczeństwa w życiu dziecka, przygotowując je przede wszystkim do uczestnictwa w relacjach społecznych poprzez zróżnicowane formy życia grupowego w szkole, której najbardziej doniosłym osiągnięciem jest instytucja samorządu uczniowskiego. Stanowi tym samym pomost pomiędzy wychowaniem zorientowanym na ucznia a tradycyjnym przekazem pedagogicznym, zakładającym przekaz wymagań określonych ról społecznych.

This elaboration is dedicated to analysis of access to a lawyer for a suspect at early stage of criminal proceedings in Polish criminal law in the light of directive 2013/48/EU. In particular, it emphasises the suspects right of access to  a lawyer during identity parade, confrontation and reconstruction of the scene of a crime. It considers whether the applicable legal provisions of the Polish Code of Criminal Procedure ensure, above all, appropriate scope of the right of the defence for the suspected person in view of the indicated evidentiary activities and whether this scope corresponds to the standards designated by the European Union directive 2013/48/EU.

Directive 2013/48/EU of the European Parliament and of the Council of 22 October 2013 on the right of access to a lawyer lays down minimum standards concerning access to a lawyer for suspects and the accused in criminal proceedings, as well as persons subject to the European arrest warrant proceedings. The present article focus on the subject of access to a lawyer at the earliest stage of criminal proceedings – in connection with arrest as well as during proceedings concerning the use of pre-trial detention. Author analyzes in sequence: subjective scope of the right to a lawyer, the right to a lawyer for the person deprived of liberty, confidentiality of communications between the person deprived of liberty and their lawyer. The main statement is that Poland does not meet that standard.

The Article deals with the opportunity for a suspected person and the passive party in the proceedings for offences to exercise the right of access to a lawyer and the right of legal counsel. The aim of the article is to provide a comparative legal analysis of the provisions of the Code of Procedure in Minor Offences against the background of the EU guarantees under Directives 2013/48/EU and 2016/1919/EU. Directive 2013/48/EU deals with one of the two aspects of the aforementioned right: namely the right of access to a lawyer for suspects and accused persons in criminal proceedings, while the right to legal aid and to state-guaranteed legal assistance in certain circumstances is regulated by Directive 2016/1919/EU.

The paper analyses access to documents in cartel-based damages cases from the EU and Croatian perspective. It considers all relevant EU and Croatian legislation and case-law primarily focusing on the expected impact of the newly enacted Damages Directive. It is argued that the new rules on access to documents provided by the Directive will not necessarily have a significant impact on damages proceedings following cartel decisions issued by the Commission. This is due to the introduction of an absolute ban on the disclosure of leniency statements and settlement submissions via a ‘maximum harmonization’ rule. This conclusion is drawn from statistic figures showing that EU cartel enforcement rests solely on the leniency and settlement procedures. With that in mind, it is concluded that the Directive’s general, permissive rules on access to documents (other than leniency and settlement procedures) will not be applicable in most damages cases following the cartel infringement decision issued by the Commission. However, it is also observed that the Damages Directive’s new rules on access to documents may have the opposite impact on private enforcement in cases following infringement decisions issued by National Competition Authorities (NCAs) which do not rely as much on leniency in their fight against cartels as the Commission. The Directive’s general rule on access to documents will apply in jurisdictions such as Croatia, where all of its cartel decisions so far have been reached within the regular procedure. It is argued that the general access rule, coupled with other rules strengthening the position of claimants in antitrust damages proceedings, might actually be beneficial for both public and private enforcement in such jurisdictions.
