Opis:: W zaprezentowanym opracowaniu Autor dokonał szczegółowej analizy kan. 64 KPK, w którym ujęto kwestię wpływu subrepcji na ważność reskryptów wydawanych przez dykasterie Kurii Rzymskiej (kan. 64 KPK). Wykazał po pierwsze, że zawarta w kanonie zasada jest implementacją zasady interpretacyjnej ujętej w kan. 63 § 1 KPK, dotyczącej wpływu subrepcji na nieważność reskryptu; po drugie, kan. 64 KPK posiada charakter ustawy uniezdalniającej (kan. 10 KPK). Dowiódł też, iż mimo że kan. 64 KPK posiada charakter ustawy uniezdalniającej, to jednak określona w nim regulacja nie ma charakteru bezwarunkowego. Odstępstwa od niej z jednej strony wiążą się ze szczególnymi pozycjami papieża oraz Penitencjarii Apostolskiej w kanonicznym porządku prawnym, z drugiej zaś niemożność poinformowania może wynikać z natury rzeczy (ex natura rei). Według Autora mogłoby to mieć miejsce, gdy wierny powtórnie wniósłby prośbę o reskrypt do tej samej dykasterii, a także, gdy po wniesieniu prośby równocześnie skierowałby tę samą prośbę do innej dykasterii.
In the presented study, the Author made a detailed analysis of can. 64 CCL, which codifies the issue of the influence of subreption on the validity of rescripts issued by dicasteries of the Roman Curia (can. 64 CCL). He showed, firstly, that the principle contained in the canon is an implementation of the interpretative principle contained in can. 63 § 1 CCL concerning the influence of subreption on the validity of a rescript; secondly, can. 64 CCL has the character of an disqualifying law (can. 10 CCL). He has also proved that, even though can. 64 CCL has the character of an disqualifying law, the regulation it lays down is not unconditional; exceptions to it, on the one hand, are connected with the special positions of the Pope and the Apostolic Penitentiary in the canonical legal order, while on the other hand, the impossibility to inform may be due to the nature of things (ex natura rei). According to the Author, this could happen when the faithful repeatedly brought a request for a rescript to the same dicastery, and also when, having brought the request in the meantime, he referred the same request to another dicastery.

Opis:: The Pontifical Council for Promoting the New Evangelization was established by Pope Benedict XVI in motu proprio Ubicumąue et semper (21 September 2010). The mission of evangelization is a continuation of the work of Jesus Christ – the first and supreme evangelizer. The duty of the Church to proclaim always and everywhere the Gospel of Christ cannot be overlooked. The Council, as a new dicastery of the Roman Curia, “pursues its own ends both by encouraging reflection on topics of the new evangelization, and by identifying and promoting suitable ways and means to accomplish it” (art. 2). The purpose of this article is to show the genesis, structure and competences of the Pontifical Council for Promoting the New Evangelization. The Council is directed by an archbishop president, assisted by a secretary, by an under-secretary and by an appropriate number of officials. The dicastery will have its own members and may avail itself of its own consultors. The competences of the Council – indicated in Ubicumąue et semper – are: l) to examine the meaning of the new evangelization, 2) to promote and to foster of the papal Magisterium related to the new evangelization, 3) to make known and to support initiatives linked to the new evangelization, 4) to study and to encourage the use of modern forms of communication, 5) to promote the use of the Catechism of the Catholic Church (art. 3). Furthermore, Pope Benedict XVI in motu proprio Fides per Doctrinam (16 January 2013) transferred the competence for catechesis from the Congregation for the Clergy to the Pontifical Council for Promoting the New Evangelization.

Dicastery for Promoting Integral Human Development will be particularly competent in matters concerning migration, the necessitous, the ill and the excluded, the marginalized and the victims of armed conflicts and natural catastrophes, the prisoners, the unemployed and victims of any form of slavery and torture. The goal of this article is to show the structure and jurisdiction of the newly created Dicastery, which is a part of the pope’s wide plan to reform the Roman Curia in a way that, by answering the needs of the times and the place, allows it to accomplish its main goal of helping the bishop of Rome in dealing with the matters of the universal Church (can. 360). The main goal of the Dicastery is to integrate different nations of the Earth.

Opis:: Rapid technological changes, which are mainly the result of the progress in computer technology, in the last decades of the twentieth century, have touched every area of life and have enforced numerous innovations. Modern ways of communication and exchange of information, especially the development of social media, have led to a significant and complex transformation of the traditional media. Practically all media companies around the world, in order to maintain their position on the market, have had to make decisive modifications of their ways of working. On one hand they remained available to the users of traditional media, but on the other hand, they look for effective ways of reaching all those who are using only new ways. Similarly, the Vatican media could not remain indifferent to the issues mentioned above. For several years the Vatican has initiated a process of preparation for a general reform of its media institutions. However, these works have accelerated at a great rate during the pontificate of Pope Francis.The reform of the Vatican media is not an easy task. It concerns several independent institutions. Each one of them has their own history and way of announcing the Gospel. The widespread computerization, especially the development of the internet and social media, has also forced the Vatican to reflect on new ways of communicating. Among many questions, the most important were about the effectiveness of evangelization through the media, the ways of spreading the Pope’s message around the world to as many faithful as possible, and about the costs of necessary investments that would allow further, dynamic development and effective functioning of the Vatican media.After the resignation of Pope Benedict XVI, the problems of the reform of the Roman Curia and the necessary savings were raised again during the discussions of the cardinals on the congregations preceding conclave. It became clear that the structural changes in the Vatican would be one of the challenges which would face the next successor of St. Peter. As from the very start of his pontificate, Pope Francis emphasized the necessity of the deep reform of the Roman Curia. The evaluation of the entire media structure of the Vatican was one of the first reforms to be tackled.The reform of the Vatican media has already begun. In the Apostolic Letter as a Motu Proprio, published on June 27, 2015, Francis set up the new Vatican dicastery: The Secretariat for Communication. The plan of changes in the Vatican media prepares for the possibility of any difficulties and turbulences. A four‑year restructuring process was planned. The year 2015 was dedicated to the creation, elaboration and consolidation of the new Vatican media structure. And it really happened. During the next year, 2016, a common administration for the two major institutions which depended on the new dicastery: the Vatican Radio and the Vatican Television Center, was established. During the year 2017 a similar restructuring process is expected in the next four Vatican media institutions: the Vatican Printing Press, the Photo Service, “L’Osservatore Romano” and the Vatican Publishing House. The process of restructuring of the Vatican media is expected to be completed by the end of 2018. Many details of these changes are raising many questions and concerns, especially among the employees of existing media entities. However, the real questions concern the effectiveness of the new system.

Opis:: W artykule Autor dokonuje analizy norm dotyczących nakłaniania penitenta do grzechu przeciw szóstemu przykazaniu Dekalogu (sollicitatio ad turpia). Czyn ten, którego może dopuścić się spowiednik w sakramencie spowiedzi, z jej okazji lub pod jej pretekstem, jest przestępstwem kanonicznym. Jest to działanie zagrożone suspensą, zakazami lub pozbawieniami, a w poważniejszych przypadkach wydaleniem ze stanu duchownego. Jego osądzanie, kiedy nakłanianie ma na celu grzech z samym spowiednikiem, jest również zarezerwowane Dykasterii Nauki Wiary. W opracowaniu dokonano omówienia norm materialnych pod kątem podmiotu kontekstu, materii, typu, formy i celu przestępstwa. Ukazane zostały także konkretne przypadki praktycznej aplikacji przepisów prawa kanonicznego dotyczących deliktu solicytacji.
In the article, the Author analyzes the norms regarding solicitation a penitent to sin against the sixth commandment of the Decalogue (sollicitatio ad turpia). This act, which may be committed by a confessor in confession, or on the occasion or under the pretext of confession, is a canonical crime. This action is punishable according to the gravity of the offence, with suspension, prohibitions and deprivations. In the more serious cases is punishable by dismissed from the clerical state. If it is directed to sinning with the confessor himself, the judgment is also reserved to the Dicastery for the Doctrine of the Faith. The study discusses material norms in terms of the subject, context, matter, type, form and purpose of the crime. The author presented also the specific cases of practical application of the norm regarding the canonical delict of solicitation.

W artykule zwrócono uwagę na jedną z nowo utworzonych dykasterii: Dykasterię ds. komunikacji. Powstanie tej dykasterii poprzedziło utworzenie w 2015 r. Sekretariatu ds. Komunikacji. Dykasteria ds. Komunikacji jest tym urzędem Kurii Rzymskiej, który w ostatnich czasach rozwinął się chyba najbardziej dynamicznie, ponieważ zarządza całym obszarem komunikacji papieża i Stolicy Apostolskiej.
Pope Francis’ reform of the Roman Curia in 2022 has been expected since the beginning of his pontificate. In the article, we focus on one of the newly created dicasteries: the Dicastery for Communication. The establishment of this Dicastery was preceded by the creation of the Secretariat for Communication in 2015. The Dicastery for Communication is an office of the Roman Curia that is developing probably the most dynamically in recent times, as it manages the entire area of communication between the Pope and the Apostolic See.

Opis:: Church history is also the history of a specific pastoral care for migrants. A great witness of concern for the people on road is the Apostolic Constitution "Exsul Familia" of Pius XII, which in essence, with its solutions, initiated the discussion on migrants during the Second Vatican Council and, consequently, forced many new indications and solutions described in details in conciliar and post-conciliar documents. While maintaining the right to religious freedom, each migrant poses a challenge to the Church to share with them the goods of the Church. A newcomer often requires an integral care and multifaceted support. A dicastery for. Integral Human Development, appointed on 08.17.2013. is tasked to indicate that migration is a structural phenomenon of the contemporary world. The migrants reflect all the problems of contemporary injustices, wars and hatred, shortcomings of medical services and non-compliance with fundamental human rights. Liquidation of the four Pontifical Councils taking up contemporary social problems and the appointment of the Dicastery is supposed to meet the problems people are facing today, regardless of their creed and religion, skin color, political view and language.

Opis:: Cel artykułu: Charakterystyka genezy organów Stolicy Apostolskich w latach 1948–2018, właściwych w sprawach mediów, na tle przemian ustroju Kurii Rzymskiej; ukazanie ewolucji instytucjonalnej „resortu mediów” – od komisji papieskiej powołanej ad experimentum, przez radę papieską mającą status dykasterium o charakterze ekspercko-promocyjnym, po dykasterium na prawach analogicznych do statusu kongregacji. Metoda badań: Analiza historyczno-normatywna oparta na legislacji papieskiej i kompetentnej literaturze przedmiotu. Wyniki i wnioski: Analiza doprowadziła do sformułowania wniosku, że cechą przemian było systematyczne podnoszenie rangi instytucji właściwych w sprawach ładu medialnego oraz ich integracja funkcjonalna i organizacyjna. Wartość poznawcza: W artykule podjęto problem tradycji i modernizacji ustroju naczelnych organów Stolicy Apostolskiej, którego elementem jest projekt reformy Kurii zapoczątkowany przez papieża Franciszka i wdrażany od 2014 roku. Wątek ten stanowi relatywnie nowy i mało rozpoznany przedmiot analiz naukowych.
Scientiﬁc objective: To characterize the genesis of the institutions of the Holy See in the years 1948–2018, competent in media matters, against the background of changes in the Roman Curia’s system; showing the institutional evolution of the “media department”—from the Papal Commission established ad experimentum by the Council, having the status of an expert and promotional dicastery, to the dicastery with rights analogous to the congregation. Research method: Historical and normative analysis based on papal legislation and the literature on the subject. Results and conclusions: The analysis led to the conclusion that a feature of the changes was the systematic raising of the rank of institutions competent in matters of media and their functional and organizational integration. Cognitive value: The paper addresses the problem of tradition and modernization of the constitution of the Holy See’s primary organs, of which the Curia’s reform project initiated by Pope Francis and implemented since 2014 is a key element. This thread is a relatively new and little recognized subject of scientiﬁc analysis.

Opis:: The Second Vatican Council valued the families, the lay people, and their apostolate by emphasizing that the lay faithful are the part of the Church that is the community of the People of God, and they participate in the triple mission of Christ, the grace of the common priesthood is granted to them and they have their own proper vocation. On the canvas of this teaching, John Paul II established the Pontifical Council for the Laity and the Pontifical Council for the Family, which Pope Francis transformed into the Dicastery for the Laity, the Family and Life. This department directs the contemporary the apostolate of the laity and families in the Church.
Sobór Watykański II dowartościował rodziny i świeckich i ich apostolstwo, podkreślając, że świeccy stanowią Kościół – wspólnotę Ludu Bożego, uczestniczą w potrójnej misji Chrystusa, są obdarowani łaską kapłaństwa wspólnego i mają właściwe sobie powołanie. Na kanwie tego nauczania Jan Paweł II ustanowił Papieską Radę Świeckich i Papieską Radę ds. Rodziny, które papież Franciszek przekształcił w Dykasterię ds. Laikatu, Rodziny i Życia. Dykasteria ta kieruje współczesnym apostolstwem świeckich i rodzin w całym Kościele.
