The article raises the issue of public interest concept as understood by E. V. Vaskovsky. In particular, it is demonstrated that the scientist proceeded from an idea that such a phenomenon as law exists within social benefit. He associated development of many institutions of law specifically with social needs. The article also provides insight into certain aspects of how E. V. Vaskovsky interpreted the social meaning of various civil law institutions, as well as different restrictions of legal rights to the shared benefit. It is shown that the scientist believed that court activities related to justice administration are of particular social importance. It is also underlined that E. V. Vaskovsky did not equate public and state interests. The author’s reflections on E. V. Vaskovsky’s views and the relevance of his ideas to date are also provided.

In addition, the author demonstrates whether legislation on hunting is a protective and is essential to the functioning of the State and society.

The principle of freedom of construction is considered as a fundamental rule in the Polish Construction Law. In the search for its prescriptive basis, reference should be made primarily to the provisions of the Basic Law. The Polish Constitution does not include such terms as „freedom of construction” and “right to build-up a plot” arising under it. The lack of literal references to the abovementioned terms does not prejudge the intentions of the legislator to ensure the protection of freedom of construction by law. The local spatial development plan, which serves as an act of local legislation, affects primarily the exercise of proprietary rights. Limitation on the right to buildup a plot is evident mainly in the prohibition of land-use by the owners in a manner that conflicts with the agreed spatial development plan. The limits of the planning authority in the context of guaranteeing the safeguarding.

Opis:
The article suggests the reinterpretation of classical international law terms: the codification and progressive development, in order to carry out an in-depth analysis of the development processes in international space law. Since no new global treaties in this regard have been made since 1979, an instrument which seems to allow for substantial changes in international space law is soft law norms. In this context, codification in international space law can also be understood as enhancement of the normative importance of standards that are mainly contained in the resolutions adopted by the  General Assembly. Consequently, codification may be considered as a systematisation of guidelines which create no controversies in fields where there has already been extensive State practice in place. Similarly, progressive development of international space law can be understood as a preparation of drafts of standards on subjects not yet regulated by soft law documents. At the same time, the failure of the initiative of the International Code of Conduct for Outer Space Activities shows that the soft law method of regulation cannot be considered as a universal remedy to address the difficulties of international communities in the process of norm creation.
Artykuł przedstawia możliwość reinterpretacji klasycznych pojęć prawa międzynarodowego – „kodyfikacja” oraz „postępowy rozwój” – w celu głębszego zrozumienia procesów rozwoju zachodzących w międzynarodowym prawie kosmicznym. Ponieważ po 1979 r. brak nowych globalnych regulacji traktatowych w tym zakresie, instrumentem, który pozwala w pełni dostrzec zmiany zachodzące w międzynarodowym prawie kosmicznym, są normy o charakterze soft law. W tym kontekście proces kodyfikacji w międzynarodowym prawie kosmicznym może być postrzegany również przez wzrost znaczenia normatywnego standardów funkcjonujących przede wszystkim na podstawie rezolucji Zgromadzenia Ogólnego NZ lub innych niewiążących uzgodnień o charakterze międzynarodowym. Kodyfikacja stanowiłaby zatem swoistą systematyzację wytycznych, niebędących przedmiotem zasadniczych kontrowersji, w obszarach, w których istnieje już gruntowna praktyka państw. Natomiast postępowy rozwój międzynarodowego prawa kosmicznego jest rozumiany jako przygotowanie projektów standardów w przedmiocie, który jeszcze nie był regulowany przez dokumenty soft law dotyczące tego działu prawa. Równocześnie przykład niepowodzenia inicjatywy międzynarodowego kodeksu postępowania dotyczącego działań w przestrzeni kosmicznej pokazuje, że metoda regulacji w drodze rozwijania soft law nie stanowi uniwersalnego panaceum na trudności normotwórcze społeczności międzynarodowej.

The subject of this paper are the main features of scientific development of professor Andrzej Stelmachowski as a rural lawyer. It considers the role that he has played in granting autonomy and developing of rural law science, the characteristics of his scientific work, his attitude as a researcher and the message he has passed through his achievements. According to the Author, the conceptual findings of professor Stelmachowski have been crucial for rural law science development and have constituted the fundamental basis for autonomy of this branch of law within the legal order. They also have been a great source of inspiration. If not this intellectual contribution and inspiration, the rural regulations that have been growing since the late fifties would have remained just a section of legislation, and the rural law science would still be at its formative stage. The analysis are concluded with the messages deriving from professor’s Stelmachowski accomplishments for the future generations of rural lawyers and the general estimation of his life attitude and scientific achievements.

This paper discusses the question of regulation in the area of property rights that limit the transaction costs associated with real estate development externalities. Regulations in the field of civil and administrative law, even if essentially fulfilling the same role in resolving potential conflicts between the owners of real estate located in the same area, involve different approaches and legal tools. The civil law limits the scope of claims available due to local conditions on case-by-case basis, the nature of the nuisance and its intensity. However, the regulations of administrative law restrict ownership of the property in terms of its development, in particular through regulations on spatial planning and development. Transaction costs related to the internalization of externalities of property management vary depending on what procedure this management occurs. In administrative law the costs include expenses associated with the adoption of the local development plan and the implementation of its provisions, and issuing decisions on individual zoning and land use. Transaction costs in civil law, however, cover due evidence in a complicated procedure for determining whether and to what extent there has been a violation of property. At high transaction costs − both in terms of Kaldor-Hicks, and Carl J. Dahlman – the adoption of appropriate solutions in the field of administrative law is more effective. The intervention of the civil law is, however, possible and effective when transaction costs have already been reduced by the application of administrative rules.

This article is about concepts, circumstances, the impact of technology upon life, the emergence of new problems which bring new challenges to our peoples and our planet in our pursuit of sustainable development. New challenges call for new solutions and different ways of using already existing resources, tools and mechanisms. So we revisit and compare bibliography through time; recall the work (and product of) of several ILA International Committees on the subject and especially its New Delhi Declaration of Principles of International Law as Relating to Sustainable Development; turn to new initiatives, namely, the Earth System Governance Project and Future Earth. And conclude on the urgency of bridging “hard” and “social” sciences in the quest for these solutions, given the holistic character of the problem, if we expect them to be democratic and sustainable – bearing in mind, always, that politics creates and law consolidates.

One of important moral problems that priests in confessional encounter is the question of using contraception. The Church has always taught us that contraception is an intrinsically evil action and moral offenses in this area are objectively speaking seriously sinful. There are such spouses who want to be faithful to the teachings of the Church, but they cannot meet their requirements. This is particularly true when there appear difficult and exceptional situations that disrupt the regularity of the intercourse, when natural family planning is hindered or seems to be impossible. A confessor, while meeting in the confessional Catholic spouses who experience difficulties in a sexual sphere, but who honestly want to keep the teachings of the Church, should give them advice which will gradually encourage them to move forward on their way to sanctity of their married life. Giving them advice, he should apply the pastoral law of gradualness which will make them aware that having the determination to break with sins and constant, though gradual aspiration to achieve full reunification with the requirements of God’s will, despite a moral decline, they are still on their way to God.

Celem artykułu jest próba wykazania, że przyczyną kryzysu inkluzywnego rozwoju społeczeństwa obywatelskiego w Polsce jest to, że w ramach tych samych przepisów mogą zapadać odmienne decyzje przesądzające o nierówności wobec prawa i prowadzące do naruszenia standardów i praw człowieka, utrudnienia udziału w życiu społecznym, gospodarczym. W naukach prawnych niemal nie podejmuje się problematyki wypracowania kryteriów rozstrzygania wątpliwości dotyczących treści prawa, a nie są one przedmiotem regulacji prawnej i mogą powstać jako prawo tylko spontanicznie. W odniesieniu do spontanicznego powstawania prawa praktycznie nie są realizowane badania naukowe, co utrudnia ustalenie, jakie dokładnie obowiązują reguły, zasady, wskazówki wykładni i stosowania prawa. Nie są więc w ten sposób gwarantowane podstawowe warunki rozwoju inkluzywnego. Wyjaśnienie tego problemu jest swoistą nowością z punktu widzenia przyczyn kryzysu danego rozwoju i przyczyn kryzysu systemu prawnego. W artykule wykorzystano metodę analizy lingwistycznej i ekonomicznej analizy prawa.
This article is trying to show that the cause of the crisis of inclusive development of civil society in Poland is that there are different decisions being rendered based on the same regulations, which prejudge inequality before the law, lead to violation of human rights and standards, and impede participation in social and economic life. In legal sciences, the issue of elaborating criteria for resolving doubts about the content of the law is almost never undertaken, and they are not subject to legal regulation and can only be established spontaneously as a law. With regard to the spontaneous creation of law, scientific research is practically not carried out, which makes it difficult to determine exactly what rules, principles, guidelines for interpretation and application of law apply. Because of the foregoing, the basic conditions for inclusive development are not guaranteed. The explanation of this problem is a novelty from the point of view of the causes of the crisis of a given development and causes of the crisis of the legal system. The article uses the method of linguistic analysis and economic analysis of law.

The primary function of the local development (spatial) plan is to determine the destination of the area covered by it, including various destinations of its individual fragments. Such plan is the act of local law, generally applicable on a given territory. Consequently, it becomes the basis for many decisions relating to the use of the real estates, which also means that it becomes an instrument of environmental protection. Detailed requirements of the legal system of environmental protection frequently stipulate that decisions determining the scope and manner of such protection must be in accordance with the local development plan. In fact, local development plan while specifying the destination of the covered area, also determines the legal scope and use of the environment. In practice, these requirements function only to a limited extent. This is because: – as a principle, adopting the local development plan is not compulsory, and as a result of a complex and expensive planning procedure only a part of the country territory is covered by such plans, – many local plans have numerous failures, primarily because of the conflict with the acts of parliament defining the detailed requirements to be met by such plans or because of the use of extremely imprecise terminology, – there is no effective mechanism for implementing the solutions of the public interest of a supracommunal character to the local development plans. For certain types of investments, this problem is solved by specific acts of law defining the detailed rules for the implementation of projects covered by them, while excluding requirements of spatial planning system.

The aim of this paper is to provide an overview of the application of competition law in the Slovak Republic since it became a member of the European Union 10 years ago. Special emphasis is placed on selected problems and questions which arose in the application of European competition rules and the need for an adjustment of Slovak competition legislation to EU requirements. The paper presents the relevant amendments in the Slovak Competition Act and analyses in detail their background. Slovak competition law has undergone many changes in the past 10 years, not always without problems. The aim of this paper is to identify the most important of those difficulties and explain why they have occurred. The correct application of national and EU competition rules by Slovak courts has proven to be one of the biggest challenge here, ultimately even causing the European Commission to intervene as amicus curiae. The actions taken by the European Commission in relation to competition matters within the Slovak Republic, and its resulting recommendations, will also be considered. The paper will outline how Slovak competition law has been step-by-step increasing its harmonisation with EU competition law over the last 10 years. Indeed, it is now possible to claim that Slovak competition legislation is fully harmonised with the rules of the European Union. The paper will thus mainly focus on those elements of Slovak law which can give a clear picture of the state of convergence of both legal systems. Nevertheless, the end of the road has not yet been reached. Further harmonisation of selected current topics within Slovak competition law will need to be assessed also. It will also be necessary to analyse which direction should Slovak competition law take in the future with regard to current EU trends. These issues include the need to find a balance between the protection of business secrets and the right of procedural parties to due process, especially in connection with the protection of leniency documents.
Cette contribution vise à fournir un aperçu de l'application de la loi sur la concurrence de la République slovaque au cours des 10 dernières années - depuis l'époque d’adhésion de la Slovaquie à l'UE. L’accent particulier est mis sur certains problèmes et questions qui se posent dans l'application des règles de concurrence de l'UE et sur la nécessité d'une adaptation du droit slovaque de la concurrence aux exigences de l'UE. Cet article présentera les changements pertinents dans la Loi slovaque sur la concurrence aussi qu’un analyse détaillé de l'arrière-plan de ces changements. Au cours des 10 dernières années, la loi slovaque de la concurrence a subi de nombreux changements – pas toujours sans problèmes. Le présent article tentera d'identifier les problèmes principaux et donner au lecteur une explication quant à la raison pour laquelle ils ont eu lieu. Dans ce sens-là, l'un des plus grands problèmes est la bonne application des règles nationales et communautaires de concurrence par les juridictions slovaques au moment de décider sur des affaires relatives à la concurrence. Cela a même abouti à la nécessité pour la Commission européenne d'intervenir comme un amicus curiae. Cet article vise également à fournir une analyse des actions de la Commission européenne en ce qui concerne les questions de concurrence en Slovaquie et les recommandations qui en découlent. Le présent article tente de présenter la manière dont le droit slovaque de la concurrence a suivi, étape par étape, un chemin vers l'harmonisation avec le droit communautaire de la concurrence au cours des 10 dernières années. Aujourd'hui, nous pouvons déjà affirmer que la réglementation juridique slovaque de droit de la concurrence est entièrement harmonisée avec la réglementation juridique de l'UE. Par conséquent, nous concentrerons notre attention sur les points dans la loi slovaque qui peuvent donner une image claire de la convergence de ces deux règlements juridiques. Néanmoins, nous ne sommes pas encore à la fin de la route. L'harmonisation supplémentaire de certains sujets actuels dans le droit slovaque de la concurrence devra être évaluée et il sera nécessaire d'analyser la direction vers l'avenir, en particulier ce qui sera le meilleur pour le droit de la concurrence slovaque en ce qui concerne les tendances actuelles dans le droit de la concurrence de l'UE. Parmi ces questions, il y a une nécessité d'un équilibre entre la protection des secrets d'affaires et le droit des participants à la procédure de concurrence pour un procès équitable, en particulier dans le cadre de la protection des documents de clémence.

The answer to these questions will be used to verify the adopted hypothesis which indicates that maritime governance is a dynamic process consisting of interdependent areas of legal regulations, blue economy, security and environmental elements. Their horizontal and vertical interdependence and interrelation while dealing with oceans make maritime governance necessary instrument for super and regional powers to attain their interests. Based on the presented assumptions and purpose, the following structure of the article was adopted. The introduction highlights the role of oceans in the world affairs and presents research questions and hypothesis. In the second part of the article main stages of discourse on maritime governance are discussed and characterized, putting emphasis on the process of shaping its conceptual and terminological framework. Methodological differences and similarities in defining maritime governance are explored. The third part indicates the operational dimension of the concept of maritime governance, presenting the stages of the process of institutionalization of maritime cooperation between states. Finally, the case study of the Integrated Maritime Policy of the European Union is presented to serve as an exemplification of the modern maritime governance. The conclusion of the article contains answers to the research questions posed.

The article examines a new tendency in the Polish system of local spatial planning and development, i.e. the microplan of spatial development. The aim of the work is to verify whether the above-mentioned tendency is entirely compliant with the rules expressed by the lawgiver in the Act on spatial planning and development, as well as the basic principle of the planning activities – spatial order. Furthermore, the author focuses on the theoretical views on the construction of a local spatial development plan in the context of a microplan. The analysis also includes the relation between the above mentioned tendency and the rules governing the planning of self-governance as the entitlement exercised by the municipality.

Opis:
With regard to the municipal spatial policies, the issue of flood protection, and hence the directions of development of flood-endangered land seem rather significant, given the possible social and economic consequences of a wrong decision. Currently, there is no legal obligation, within the statutory activities of flood protection institutions, to implement guidance documents prior to the works on the municipality development. It is determined by the local government in the planning documents, which are in accordance with the applicable regulations, acts of local law. Space management, through planning development and land use or the landscape protection, requires the access to comprehensive and reliable information. GIS technology, 3D models and mathematical models using neural networks in spatial analysis and monitoring changes in space to protect flood risk land, give the possibility of collecting the information that constitutes the basis of knowledge on the area, which helps to make decisions regarding a purpose and a method of the land use. The data obtained in this way are a valuable source of knowledge on the stage of preparation of planning documents that determine the directions of municipal spatial development. Under the Act of 27 March 2003 on spatial planning and development [spatial planning and development act 2003], these documents are a municipal study of the conditions and directions of the spatial planning and a local zoning plan.
