It is widely recognised that the first binding legal act regarding the protection of personal data of an international nature is Convention 108, adopted on 28 January 1981. By virtue of the Convention, the Parties are required to apply in their domestic legal order the principles introduced by the Council of Europe to ensure guarantees for the fundamental human rights of all individuals with regard to the processing of personal data. This paper refers to Convention 108 as the foundation for European and international data protection laws in a number of European countries. It has influenced policies and legislation far beyond Europe’s borders. However, due to the development of ICT tools that permit establishing new data-driven business models based on data-processing systems, Convention 108 has become subject to modernisation. At the same time, intensive negotiations were conducted in the EU concerning a new data-protection package to reform the data-protection system, and many other countries around the world have introduced provisions related to the processing of personal data. This paper analyses the impact of the standards set out in Convention 108 on the decision-making process and its global dimension.

The following elaboration has been produced following the analysis of the problem regarding the protection of privacy and private life as well as the personal data themselves under the circumstances of life-threatening situations or the state of emergency. The solutions stipulated by the domestic and EU legislation have been analysed with emphasis put over accessing processes to personal data , both indispensible and proportional ones, carried out with an intention to secure public safety, including the protection of human life especially as a reaction to natural disasters or catastrophes caused by humans, protection of other important objectives that lie within general public interest, for instance when data processing remains necessary for humanitarian purposes, including the monitoring of epidemics and their dispersion. Personal data are characterised by various degrees of sensitivity and criticality. Some of them may require an additional level of protection and special treatment. GDPR makes it possible for the Member States to clarify their provisions , including such ones regarding the processing of personal data of special categories ( also referred to as sensitive data), they do not exclude an option to specify in the legislation of a Member State the circumstances of precise situations related to data processing , including the precise clarification of conditions which decide whether data processing remains compliant to the law. Personal data processing under extraordinary circumstances may imply, as an exception, the necessity to transfer the data if such action is required by important public interest set forth by the EU legislation or the relevant provisions of a Member State or if such transferring occurs from the register established by law and intended to provide an insight for the general public or persons maintaining legally valid interest, for instance public health units in order to establish infectious contacts in case of infectious diseases outbreak. A subsequent part of the article focuses on the issues related to the course of actions under state of emergency, i.e. it presents the proceedings to be carried out in emergency state and specifies the concerns on emergency call processing, including the personal data.

The reform of the EU’s personal data protection regulations introduces the institution of the Data Protection Officer, assigning it a key role in the new personal data protection system thereto. Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, builds the personal data protection model, wherein the main responsibility for adequate assessment of the risk associated with the processing of personal data and for the implementation of internal procedures to assure compliance of the referenced operations with the personal data protection regulations rests with a database administrator. Simultaneously, a database administrator should be capable of proving that he/she has duly met the requirements under the regulations, thus following the crucial rule for the processing of personal data, i.e. data accountability. The EU regulations describe the means and mechanisms to be used by a data processor to a lesser extent than those in force hitherto, focusing more on ensuring the standard of the protection of individual rights through data controllers' ethical and responsible activities. The key part in the new personal data protection model will be played by the institution of the Data Protection Officer, intended to become a real guarantor of due observance of the personal data protection regulations. In this context, the appointment of the Data Protection Officer by database administrators, not bound to do so by law, should be judged a sign of the organization's corporate social responsibility for the impact of its decisions and activities on society through transparent and ethical conduct. It is therefore essential to emphasize the important function to be performed, the authority to be had, and the necessary preparatory action to be taken by the Data Protection Officer to that effect. The new regulations should be regarded as a chance to professionalize both the individuals, serving as information security officers and, in the near future, the data controllers, as well as the entire occupational group.

The Personal Data Protection Act was enacted in 1997; it imposed some obligations on all the administrators of personal data regardless if acting as private or public establishments. The Act was intended to guarantee the safety of personal data and to ensure the right to controlling the data processing. However, since the enacting of the Act, there have been reported instances of its infringement, especially by private entrepreneurs. The numerous appealed complaints show that the entrepreneurs neglect their duty of ensuring the safety of personal data (e.g. documents or media with such personal data), which results in unauthorised revealing the data to third parties. An especially serious case of the infringements of the Act and the rights of the persons concerned is selling the data without a person’s consent. In many cases the administrator only seemingly informs about the purposes of processing the data and then, in this or any other insidious way (among them an inacceptable presumption of consent), beguiles the necessary acceptance. The occurrences of neglecting duties imposed by the Act are to be considered not only as infringement of law, but also as unethical actions resulting in undermining customers’ confidence in entrepreneurs. For example: The unprotected data can be viewed and used by unauthorised parties to the detriment of the persons concerned (e. g. identity theft). The selling of the data is also a source of an unjustifiable profit for an entrepreneur and makes controlling of the processing of personal data impossible. Even if there are no negative consequences for the customer, the cases of infringement the Personal Data Protection Act bring about to undermine confidence not only in the entrepreneur (the source of personal data) but also in private establishments in general.

Each member of the information society generates, often quite involuntarily, noticeable amounts of data being closely related to them. The range of such data may be extremely extensive as it may encompass the details on the geographical positioning, the data regarding the network behaviours or the data on ID numbers for the devices used. Hence, there exists a more and more intensified and permanent risk of the right for privacy , one of the most fundamental human right, being infringed on. Data controllers attempt to enter any personal data which are easily accessible due to the operational peculiarities applicable to various technological solutions. Such actions may infringe on the rights included into the charter of fundamental rights, namely the right for privacy and the right for personal data protection. Consequently, the data controllers remain under obligation to carry out a series of duties within the area of personal data protection that are related to appropriate technical and organisational means being applied in order to achieve full legal compliance on the matter. Privacy protection remains a complicated process involving the interactions from various areas including the law, software engineering, cycle management or ethics. One of the legal solutions to be introduced by the general data protection regulation is , the so called, “privacy by design” model. The following publication is intended to present the privacy by design model on the ground of the general data protection regulation.

The glossed ruling covers two key issues concerning the application of the autonomous and comprehensive rules of the protection of natural persons with regard to the processing of personal data applied by organisational units of the Catholic Church in the territory of the Republic of Poland. The first issue concerns the possibility of further application of these autonomous, comprehensive rules after the GDPR came into force. The second issue concerns the ability to designate and grant a legal status to an independent separate supervisory authority: the Ecclesiastical Data Protection Officer. Approving the stance presented in the ruling of the Supreme Administrative Court, the gloss presents arguments confirming the fact that when the GDPR came into force, a regulation concerning the processing of personal data existed in the Catholic Church (it was primarily contained in the standards of the Code of Canon Law of 1983), which the Catholic Church, by the time specified in Article 91(1) GDPR, harmonised with the provisions of that legal act. Moreover, the mode of operation, the manner of designating or dismissing the Ecclesiastical Data Protection Officer does not have to be derived from the universally binding law. It may arise from the internal law of the Catholic Church, provided that the requirements laid down in Chapter VI GDPR, i.e. independence, fulfilment of general conditions concerning data protection supervisory authorities, secrecy, performance of tasks and exercise of the powers laid down in the GDPR (relevant competences), are met. This argument originates from the principle of autonomy and independence of churches and other religious organisations, guaranteed by the provisions of the Constitution of the Republic of Poland. The reasoning is also confirmed in recital 165 of the GDPR preamble, which states that “This Regulation respects and does not prejudice the status under the constitutional law of churches and associations or religious communities in the Member States, as recognised in Article 17 TFEU”.

Aim/purpose–The paper contains descriptive exploratory research on the implementation of General Data Protection Requirements (GDPR) in a group of Polish public administration offices. The purpose of this research is to investigate the current state of personal data protection in the entities surveyed.Design/methodology/approach–The diagnostic survey method using the Computer Assisted Web Interview was employed. The survey was conducted in local government administration offices a year and a half after the GDPRimplementation.Findings–All marshal offices and the majority of districts (about 80%) confirmed that they comply with all the GDPR requirements. The situation was slightly worse in municipal offices – about 23% of them declared that they do not complywith all the GDPR requirements. In officials’ opinion this situation may be improved by conducting training for employees, employee engagement, and appropriate support of the office manage-ment. Another aspect that draws attention is a very small budget dedicated to the GDPR implementation and maintenance in most of the offices surveyed.Research implications/limitations–The limitation of the findings is the relatively low responsiveness of the questionnaire survey.Originality/value/contribution–The research concerns a relatively new subject. The state of personal data protection in public administration in Poland after 18 months of the GDPR implementation was analyzed. So far, there is no comprehensive research that has been conducted into this field in local government administration.

Opis:
Telecommunications technology is making its way into operating rooms by new developments in e-health. However, conflicts arise with existing legal principles regarding data protection. This paper deals with key elements of the interactions between data protection and evolution in e-health. The scope will be the digital operating room, where different health services and activities converge through networked technology, raising a number of privacy-related issues. For instance, the patient's health records and tools for recording surgical procedures could be integrated within the same platform, potentially leading to sensitive personal data linkage. Also the possible duration and reason of storage of surgical recordings, is a matter that remains largely unresolved in current practice. First, this paper will analyze the data exchanges of the digital operating room. As these will include personal patient data, it must be assessed whether and how the European framework on data protection can apply. Second, the regulatory regime of the manufacturers of the devices of the digital operating room will be analyzed. Can the current legal framework relating to e-health provide for suitable regulation for such devices? Drawing from experience gained in research projects, this paper aims to provide practical answers to often theoretical questions.

W artykule podjęto problem reformy systemu ochrony danych osobowych w kontekście zmian, nowych zadań i wyzwań stojących przed europejskimi organami ochrony danych, w szczególności Europejskim Inspektorem Ochrony Danych, Grupą roboczą art. 29 czy też krajowymi organami nadzorczymi. Przedłożone w ostatnich latach przez Komisję Europejską projekty aktów ogólnych odnoszących się do omawianych zagadnień, jak i szczególnych, regulujących funkcjonowanie agencji UE zajmujących się walką z przestępczością, wyraźnie pokazują, że zaproponowane zmiany mają służyć zwiększeniu roli tych organów zarówno w wymiarze unijnym, jak i krajowym, poprzez zapewnienie skuteczniejszego egzekwowania nowych przepisów. Temu też służyć ma planowane zacieśnienie współpracy między organami krajowymi i koordynacja ich działań.
The article discusses the problem of the reform of the system of the protection of personal data in the context of changes, new tasks and challenges faced by the European data protection authorities, in particular the European Data Protection Supervisor, Article 29 Working Group or the national supervisory authorities. The proposals of regulations and directives submitted in recent years by the European Commission related to data protection in general, as well as the specific rules governing the functioning of the EU agencies involved in the fight against crime clearly show that the proposed changes are intended to increase the role of these bodies at both the E. U. and the national level by ensuring a more effective implementation of the new rules. The planned strengthening of the relationship between the national authorities as well as the coordination of their activities also aims to meet this objective.

This study concerns the ethical problems of personal data protection at work. The aim of this project is the analysis of the law structures, which determine the range of protection personal data of the employee and the candidate to work and the rights of data collecting and processing by the employer. The employee privacy protection at work is the principle of labour law expressed in Article 11 of the Labour Code. However personal data protection problem is directly regulated by Article 22 of the Labour Code, which entitle employers to demand certain personal data from the employees and the candidates to work. The regulation determine the list of data, which may be the subject of legal actions by employer in the field of collecting and processing of personal data. The most important issue is connected with the treatment of sensitive information, such as health data, drug testing and genetic testing, sex life, racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership. Personal data protection means the necessity of cooperation between the employee and the employer not only in the field determined by the law but on the basis of ethical values as well. Hence the employer’s obligation to keep from actions which directly interfere in employee’s protected personal effects. But the employee is obliged to give true information about himself in order to protect his health and life at work.

In January 2014 two years passed since the European Commission presented a package of reforms of the system of personal data protection in the EU. Com‑ mission proposed to create, in its opinion, a uniform and consistent system across the EU. The idea of the paper is to answer the question whether the Commission’s proposal to adopt two separate acts (one as a general system, and the second for cooperation in criminal matters and police), should meet the proposed assumptions. In order to analyze that, first the treaty background is presented, then current legal status in the field of personal data in the EU, and finally a comparative analysis of the solutions of the two drafts. The analysis leads to the conclusion that there are serious concerns about the lack of consistency.

Due to the fact that EU regulations are directly applicable in the Member States’ legal systems, a number of obligations concerning personal data protection is based directly on the GDPR. Thus the governmental bill regulates such issues which have been passed to be regulated or modified by national law. In principle, the bill does not give rise to any legislative objections. However, the author points to some solutions which haven’t existed in the Polish legal system (e.g. one-instance proceedings before The Chairman of the Personal Data Protection Office), as well as to solutions which raise doubts regarding their conformity to the GDPR (such as a public authority’s decision being binding for common courts). Moreover it was pointed out that a whole evaluation of GDPR’s implementation would be possible with regard to all regulations in that matter, including a bill concerning amendments of specific statutes (which is in the process of governmental work).

The article deals with auditing of personal data processing by the body responsible for protection of personal data – the Inspector General for Personal Data Protection (GIODO). The analysis of this issue is preceded with a presentation of the system of personal data processing audit, on the basis of the act on personal data protection. The system comprises not only GIODO audits, but also audits conducted by entities that participate in data processing, data protection officers, persons whose data is concerned, and numerous organs of legal protection that, during their activities, make an assessment of the compliance of data processing with the regulations on data protection. In her article, the author discusses GIODO audits – their scope, stages, audit competence of inspectors, and audit documentation, as well as legal measures that aim to restore the state compliant with the law, and consequences for persons responsible for irregularities. Moreover, the article presents the issue of GIODO audits from a broader perspective, comprising issues related to the duties of data protection officers and their appointment, which have been recently regulated anew.

Most of the legal solutions proposed in the bill are in line with the standards of Directive 2016/680 in the context of the security of collection, storage, transmission and access to personal data, and guarantees data security. However, in a number of places, the reviewed bill includes solutions that do not guarantee the security of personal data. These are, among others, Article 19 of the bill, which has not been used to increasing the data security, or Article 17 of the bill, which does not protect against reverse pseudonymisation. Gaps regarding data protection lacunas also appear in the bill, inter alia, in its Article 41, which is too narrow in terms of the scope of data processing and authorization to processing.

Nowadays, effective protection of personal data is one of the fundamental issues of a democratic state under the rule of law. Therefore, the legislator should be very precise about the principles and standards of data processing. In the last few decades, in particular, the development of new technologies, digitalisation and the increase in the need for electronic communication has become evident, which leads to the adoption of appropriate regulations for the handling of personal data. In addition, the EU legislator has introduced the General Data Protection Regulation (GDPR) in order to harmonise the regulations of EU Member States regarding the protection of personal data. This provides a framework for the proper functioning of legal provisions across the European Union regarding the handling of personal data of its citizens.The aim of the article is to identify the legal changes resulting from the Personal Data Protection Regulation, with a particular focus on the persons to which they apply and then to analyse the regulation of ‘the right to be forgotten’. In the first part of the article, attention is drawn to the way personal data are processed and the scope of obligations incumbent on data controllers. This is because data controllers are, together with the personal data protection officer, responsible for recording data processing activities, including ongoing monitoring and responding to situations of inaccurate data processing. The second part focuses on the right to be forgotten and the assessment of this entitlement in the perspective of Regulation 2016/679. The research methods include an analysis of legal acts, at the same time using the subject literature.

In the author’s view, Article 71 of the Act on the National Remembrance Institute (IPN) it is a good legislative product which does not require changes. The possible establishment of supervision of the Inspector General for Personal Data Protection of the processing of personal data by the IPN would be a disproportionate obstacle to the Institute’s work, especially since the existing legal instruments of data protection and the rights of persons whose data are processed, has already formed an effective and tight system. According to the author, those regulations are consistent both with Article 51 of Poland’s Constitution and with EU law and the provisions of Article 8 of the Charter of Fundamental Rights, due to connections between the work of the Institute and the issue of protection of national security, that is a matter which remains the sole responsibility of Member States.

The provisions of the bill indicated in the opinion raise doubts from the in terms of their compliance with the directive and complementarity with the Regulation of the European Parliament and of the Council (EU) 2016/679. Among others the adoption of the act in the designed form will result in the fact that, within a specified time, the obliged entities will not be able to apply any of the basic security principles specified in the act, what creates a risk for the actual data security. The project disperses regulations regarding the security of personal data in many normative acts. There are no sanctions for breach of personal data security obligations, what may be considered as a lack of implementation of the requirement set out in the Directive.

This article deals with the issue of impact assessment for the protection of personal data. This is a new obligation for the controller. The article presents the essence of impact assessment (DPIA), exclusion from the obligation to carry it out, the prerequisite for mandatory DPIA, the role of the data protection officer and the powers of the supervisory authority. The analysis of legal provisions related to the impact assessment presented here does not refer to specific situations, due to the wide scope for interpreting specific phrases contained in the General Regulation. Nevertheless, the article discusses the issue of conducting data protection impact assessments as one of the most problematic obligations incumbent on the controller, who in practice raises many doubts. The DPIA has been imprecisely regulated by the EU legislator, thus leaving controllers plenty of leeway to interpret the terms used in the General Regulation. In addition, carrying out a DPIA in practice (as a new obligation on entities setting the purposes and means of data processing) can be problematic due to the lack of harmonized methods for conducting a data protection impact assessment. However, controllers cannot assign DPIA implementation to other entities involved in data processing, such as an entity processing personal data on behalf of another. Entities setting the purposes and methods of data processing should not only take into account the provisions of the General Regulation but also a list of data processing operations that are obligatorily subject to DPIA. Controllers fulfilling the obligation to carry out a data protection impact assessment will be obliged by the supervisory authority to demonstrate how to carry out a data protection impact assessment.

Rozwój nowych technologii spowodował, że znaczna część codziennego funkcjonowania jednostki przeniosła się do cyberprzestrzeni. Powszechność i łatwy dostęp do Internetu sprawiły, że społeczeństwo sprawnie używa Internetu zarówno w pracy i nauce, jak i realizując swoje hobby oraz życie towarzyskie. Niestety, w społeczeństwie nadal występuje niska świadomość zagrożeń w sieci i brak odpowiedniej ostrożności, co bezwzględnie wykorzystują cyberprzestępcy. Bazując na socjotechnice i tendencji użytkowników do umieszczania wielu informacji o sobie w sieci, w łatwy sposób przełamują oni proste zabezpieczenia i uzyskują dostęp do interesujących ich obszarów. Działalność cyberprzestępców to obecnie jedno z największych wyzwań, przed jakimi stają w swojej pracy inspektorzy ochrony danych. Artykuł ma na celu opisanie cyberprzestępczych mechanizmów i metod działania. Stanowi również próbę odpowiedzi na pytanie, jak skutecznie walczyć z tym zjawiskiem.
The development of new technologies has caused the situation that the significant part of the daily operation of an individual has moved to cyberspace. The Internet with its easy and common access has become an effective tool both at work and education process for the whole society. What is more people use the Internet to pursue a hobby and for their social life. Unfortunately, the society still has low awareness of the online threats and there can be observed a lack of proper caution, which is efficiently exploited by cybercriminals. Basing on social engineering and the tendency of users to place a lot of information about themselves on the web, the cybercriminals are able to easily break a simple security and gain access to the information they are interested in. Therefore cybercriminals activity is one of the biggest challenges for data protection officers. The article aims to describe cyber criminal mechanisms and methods of their operation and at the same time trying to answer the question how to successfully fight this phenomenon.

The General Data Protection Regulation (RODO), which replaced Directive 95/46/EC on the protection of personal data adopted over twenty years ago, has strengthened the position of the national body supervising personal data protection. The supervision body should now be completely independent of the government administration and have appropriate resources to effectively implement the provisions of RODO. The competence of the Polish supervision body are set forth in the Act of 10th May 2018 on the protection of personal data. In place of the General Inspector for Personal Data Protection (GIODO) a new body has been appointed – the President of the Personal Data Protection Office (PUODO). The Act also presents in detail the principles and course of control proceedings of PUODO, including, in the first place, the rights and duties of the entity subject to control.

Istnienie niezależnych organów nadzorczych powszechnie jest uznawane za jeden z najistotniejszych czynników na drodze do skutecznej ochrony danych osobowych. Europejski system ochrony danych jeszcze pod rządami poprzedniej dyrektywy obligował państwa członkowskie do powołania organów właściwych do badania zgodności procesów przetwarzania z obowiązującym prawem. Gruntowna reforma unijnego prawa ochro- ny danych osobowych, zwieńczona przyjęciem ogólnego rozporządzenia o ochronie da- nych wprowadziła szereg nowych instytucji związanych z szeroko pojęta ochroną prywatności. Co oczywiste zmiany te dotknęły również krajowych organów nadzorczych. Polski ustawodawca dostosowując przepisy krajowe do nowej sytuacji prawnej zadecydował o powołaniu nowego organu nadzorczego. Tym samym Prezes Urzędu Ochrony Danych Osobowych zastąpił dotychczasowego Generalnego Inspektora Ochrony Danych Osobowych. Lektura obecnie obowiązujących przepisów zrodziła jednak liczne pytania o miejsce Prezesa Urzędu w polskim porządku prawnym. W związku z powyższym celem niniejszego artykułu jest szczegółowa analiza przepisów unijnych i krajowych oraz próba zdefiniowania pozycji ustrojowej polskiego organu nadzorczego
Independent data protection authorities are of critical importance to the effective protection of personal data. Even under the previous Directive EU Member States were obligated to provide a designated supervisory authority. The fundamental reform of EU data protection law and adoption of General Data Protection Regulation has introduced a num- ber of changes in the data protection law area. It also affected the provisions on national data protection authorities. To adapt to the new regulatory regime Polish legislator has decided to establish a new supervisory authority. The President of Personal Data Protection Office has replaced the previous Inspector General for Personal Data Protection. However it needs to be noted that current provisions raised questions about the position of The President in the whole regulatory framework. Therefore the aim of this paper is to review current law and to define the legal position of Polish data protection authority.

After over twenty years of its existence, on 25th May 2018 the Bureau of the Inspector General for the Protection of Personal Data (GIODO) was transformed into the Personal Data Protection Office (UODO), which took over the staff, assets, obligations and liabilities of the Bureau. The reform significantly extended the tasks and competences of the UODO President. While GIODO was only the national body for personal data protection, the UODO President is tasked not only with personal data protection, but also serves as a supervisory body. The independence of the institution was also strengthened. At present, the mandate of the UODO President is regulated in as many as three legal acts (RODO, uodo and uodzzp). The article is dedicated to several key issues, in the light of the reforms and changes introduced with the new regulations, related mainly to the administrative and complaints proceedings.

Right to (information) privacy and right to personal data protection have many common contact points. However, the very act of developing data protection, as a younger right into the sui generis right shows that these two rights are not the same and that there are differences between them, huge enough to make them separate legal rights. The main trigger for noticing their different nature, purpose and background and for development of the data protection into the separate right was the revolution in the information technology solutions. This IT progress, for the first time, enabled massive and relatively cheap operations with the personal data and brought not only concern about the security of the personal data, but also unbelievable business possibilities. It was the turning point for the codification of the data protection right which started from 1970ies, aiming to create separate rules and legislation which will understand the importance of not only of protecting personal data but of their regulated and lawful usage. Despite all what was said, there is still certain confusion regarding these two rights, mainly because in the initial phase of the massive usage of the new IT solutions, when the data protection legislation still wasn’t developed, information privacy right served as the only legal protection of the data protection right and the relationship between these two rights is complex even today and deserves to be further researched

Działalność przedsiębiorstw jest regulowana wieloma przepisami prawa, z których w ostatnim okresie na pierwszy plan wysuwają się te dotyczące danych osobowych. Wprowadzenie RODO spowodowało, że ochrona danych osobowych nabrała nowego wymiaru i to niezależnie od pozostałych uwarunkowań prowadzenia działalności gospodarczej. W artykule przedstawiono próbę przybliżenia przepisów z zakresu ochrony danych osobowych, które dla wielu przedsiębiorców stanowią poważne wyzwanie. Ponadto skupiono się na problemach praktycznego funkcjonowania tych norm prawnych, które z założenia mają poprawić stan ochrony danych osobowych znajdujących się w dyspozycji przedsiębiorców nie tylko w naszym kraju.
The activity of enterprises is regulated by many legal provisions, from which personal data have been of the highest importance recently. The introduction of the GDPR meant that the protection of personal data has acquired a new dimension, regardless of the other conditions of doing business. The article presents an attempt to approximate the provisions on the protection of personal data, which are a serious challenge for many entrepreneurs. In addition, the focus was also on the problems of the practical functioning of these legal norms, which are intended to improve the protection of personal data at the disposal of entrepreneurs not only in our country.

Zmiany w zakresie problematyki ochrony danych osobowych związane z wejściem w życie przepisów RODO oraz ustawy o ochronie danych osobowych spowodowały nałożenie na Prezesa UODO szeregu różnorodnych zadań. Wiele z nich organ ten wykonuje korzystając z podstawowej prawnej formy działania administracji, jaką jest decyzja administracyjna, która w tym przypadku podejmowana jest w jednoinstancyjnym postępowaniu. Na tym tle podjęto kolejno analizę: statusu i zakresu zadań, w tym uprawnień nadzorczych Prezesa UODO oraz ram proceduralnych, w których są one podejmowane – w tym z wykorzystaniem formy decyzji administracyjnej. Za zasadne uznano też zbadanie, czy w konkretnych przypadkach forma decyzji administracyjnej stanowi adekwatny środek realizacji zadań powierzonych przez przepisy RODO Prezesowi UODO. W konkluzji autorki uznały za konieczne rekomendowanie, aby ustawodawca ściśle określił formę prawną, w jakiej powinny być wykonywane zadania Prezesa UODO. Nadto wskazały one, że ustawodawca zdaje się nie dostrzegać, że charakter powierzonych Prezesowi UODO zadań wskazuje, iż forma decyzji administracyjnej nie zawsze wydaje się być nie tylko najlepszą, ale wręcz odpowiednią. Szczególnie, gdy chodzi o działania tego organu związane z koniecznością wydania ostrzeżenia czy udzielenia upomnienia – forma decyzji administracyjnej nie wydaje się być zasadną.
Changes in the field of personal data protection related to the entry into force of the provisions of the GDPR and the Act on the protection of personal data resulted in the imposition of a number of different tasks on the President of the Personal Data Protection Office. Many of them are implemented by this authority using the fundamental legal form of administrative action – i.e. an administrative decision, which in this case is adopted in one-instance proceedings. On this basis, the following analysis was carried out: the status and scope of tasks, including the supervisory powers of the President of the Personal Data Protection Office, and the procedural framework in which they are undertaken – including the form of an administrative decision. It was also considered worth to examine whether, in specific cases, the form of an administrative decision constitutes an adequate means of implementing the tasks entrusted by the provisions of the GDPR to the President of the Personal Data Protection Office. In the conclusion, the authors considered it justified to recommend that the legislator should precisely define the legal form in which the tasks of the President of the Personal Data Protection Office should be performed. Moreover, they indicated that the legislator does not seem to notice that the nature of the tasks entrusted to the President of UODO indicates that the form of an administrative decision does not always seem to be not only the best, but even appropriate. Especially when it comes to the actions of this authority related to the need to issue a warning or issue a reminder – the form of an administrative decision does not seem to be justified.

Security implies a stable and relatively predictable environment, in which an individual or group may pursue its ends without disruption or harm and without fear or injury. This paper intends to summarize the place of private security in the Hungarian law enforcement system, arguing that it is a very important complementary element of the security mechanism. In our view, law enforcement is not only police administration; it covers a more complex activity, the implementation of which is shared between police service and other complementary law enforcement services. As such, private security is an important additional security mechanism in society and, together with other public and private policing/security organisations, part of contemporary plural policing family. However, despite the growing importance and need for prosperity and high-quality private security, the market suffers from several anomalies. First of all, the legislation suffers a considerable drawback, making it impossible for those in the trade to fulfil their duty. The Hungarian Chamber of Bodyguards, Property Protection and Private Detectives is supposed to play an important role in the private security as a professional representative organisation. However, since the cancellation of mandatory membership, it has lost significance. Another difficulty for private security companies and the whole sector is labor shortage. The number of certified agents is decreasing dramatically. Finally, we present how the current harmonization of the Act of Private Security with the GDPR might lead to legal uncertainty with regard to the use of electronic surveillance system.

The article aims to provide a comprehensive account of the legal regulations and mechanisms for the protection of personal data in Poland. In the last few years, considerable attention has been paid to this subject, which results in the wide-ranging character of the issues examined. The author classifies, based on sectors, the protection of personal data as a public policy and justifies such classification through the use of, among other tools, an institutional and legal method and factor analysis. The conclusions of the article are based on the analysis of the Polish legislation on the protection of personal data as well as on the analysis of the practical implementation of the solutions in companies, government and self-government institutions. Based on the results, it can be concluded that the protection of personal data falls within the scope of the public policy. However, it is necessary to take into account that some of its elements must be assigned to the policy of a party.

This article aims to present the cooperation between the President of the  Personal Data Protection Office and the independent supervisory authority appointed by the Catholic Church. Personal data transferring from the EU member states to third countries, i.e. such ones which are located outside the European Economic Area, is subject to separate provisions set forth in the provisions of the Directive on the protection of physical persons with regards to personal data processing and the free flow of such data as well as the act on personal data protection. A possibility to transfer the personal data to third countries occurs only on condition that an adequate degree of protection with regards to such data is provided. This means that protective measures applied within a given state at least equal those applied within the European Union. Legal norms binding in the United States do not guarantee the proper level of protection with regards to personal data. Applied sector regulations, introducing mostly the bans from personal data processing, give more freedom to the data administrators as far as personal data processing is concerned compared to the countries located within the European Economic Area. The year 2000 brought the introduction of the „safe harbour” programme which was supposed to ameliorate the transfer of personal data to the USA. The entities that joined the programme were qualified as the ones providing the proper level of personal data protection. Hence, such data could have been transferred to the servers located in the USA. Legality of personal data transferring to the USA has been questioned by Maximilian Schrems. Schrems addressed the Irish data protection authority. The dispute regarding the case was settled by the EU Tribunal of Justice. The objective of my research is to analyse the sentence C-362/14 passed in the case Maximilian Schrems against Data Protection Commissioner and the consequences of the said sentence over the possibilities to transfer the personal data to third countries and its potential impact on the final shape of the data protection enactment.

This article is an attempt to analyze the existing solutions in the field of the protection of personal data. Training and advisory materials on this subject prepared by numerous law firms (32) were analyzed, providing a valid explanation, understanding and implementation of the new obligations in the field of data protection. In addition the author conducted pilot interviews in accounting offices (17) concerning the protection of personal data to indicate the approach of service providers to the performance of the tasks in the field of personal data protection. The key findings of the study are: noticeable increase in the interest of the contracting parties in data protection issues, as well as presenting their positive aspects along with possible problems in their practical application. An important contribution of the author is also the presentation of the key points of agreements which the parties should pay attention to in order to avoid misunderstandings.

Digital transformation means radically change how we manage interaction with everything, including goods, persons and data flows. Cyberspace is by nature borderless and open to everybody, and any sensitive personal info passing through it should be appropriately managed to ensure the protection of the users' identity and other personal records. The Passenger Name Record (EU Directive 2016/681) impacts for travellers, e-wallets for online shoppers, medical e-records for patients, etc., which may contain personal information provided by the users and collected by the service providers during the on-line transaction. While such records need to be shared for the smooth operation of the provided service, evidence shows that such sharing does not always respect the privacy of the data subjects. This paper address this challenge by proposing a comprehensive solution to safeguard and protect such on-line info and to preserve and protect the users’ privacy (GDPR) in order to improve the cybersecurity aspects at EU level with a focus on transports and blockchain.

In the judgment in question, the Court of Justice of the European Union rules that Article 38 (3) GDPR does not preclude national legislation which provides that a termination of the employment contract of a data protection officer is allowed only with just cause, even if the termination is not related to the performance of that officer’s tasks, in so far as such legislation does not undermine the achievement of the objectives of that regulation. In the approving commentary, based on the theses contained in the judgment, the reasons related to the performance of the data protection officer tasks and other reasons for the inspector’s dismissal are discussed. Doubts related to the dismissal of the data protection officer due to the reorganization of the company are also highlighted. The issue of dismissal of the data protection officer is of great practical importance, the considerations and conclusions presented in the commentary may be helpful for many controllers.
W glosowanym orzeczeniu Trybunał Sprawiedliwości Unii Europejskiej orzekł, że art. 38 ust. 3 RODO nie stoi na przeszkodzie przepisom krajowym, które stanowią, że rozwiązanie umowy o pracę z inspektorem ochrony danych jest dopuszczalne tylko z uzasadnionej przyczyny, nawet jeżeli rozwiązanie stosunku pracy nie jest związane z wykonywaniem zadań tego inspektora, o ile takie uregulowanie nie zagraża realizacji celów tego rozporządzenia. W aprobującym komentarzu, w oparciu o tezy zawarte w wyroku, omówiono przyczyny uzasadniające odwołanie inspektora ochrony danych związane z wykonywaniem przez niego zadań oraz inne przyczyny odwołania inspektora. Ponadto zwrócono uwagę na wątpliwości odnoszące się do odwołania inspektora ochrony danych z powodu reorganizacji przedsiębiorstwa. Kwestia odwołania inspektora ochrony danych ma duże znaczenie praktyczne, a przedstawione w komentarzu rozważania i wnioski mogą okazać się pomocne wielu administratorom.

The paper concentrates on the protection of personal data in the European Union. The paper presents a comprehensive reform of the data protection frame‑ work, proposed by the European Commission in January 2012, including a policy Communication setting out the Commission’s objectives and two legislative pro‑ posals: a regulation setting out a general EU framework for data protection and a directive on protecting personal data processed for the purposes of prevention, detection, investigation or prosecution of criminal offences and related judicial activities. Both proposals concern the question of ensuring effective protection of fundamental rights. The analysis of the proposed legislation shows nevertheless that in this shape they do not lead to consistency and uniformity of the entire system of personal data protection in the EU. Significant differences in both proposals concern including different subject matter and material scope, effective protection of fundamental rights and the establishment of the hierarchy of the existing legal acts in this area.

Przedmiotem artykułu jest prezentacja, analiza i ocena przepisów ustawowych oraz wykonawczych odnoszących się do powoływania, rejestracji oraz zadań administratora bezpieczeństwa informacji jako pod-miotu zobowiązanego do sprawdzania zgodności przetwarzania danych osobowych z przepisami, nadzorowania opracowania i aktualizowania dokumentacji opisującej sposób przetwarzania takich danych oraz środki techniczne i organizacyjne zapewniające ochronę przetwarzanych danych osobowych odpowiednią do zagrożeń oraz kategorii danych objętych ochroną, zapewniania zapoznania osób upoważnionych do przetwarzania danych osobowych z przepisami o ich ochronie oraz prowadzenia rejestru zbiorów danych przetwarzanych przez administratora. Przeprowadzona analiza przepisów ustawy o ochronie danych osobowych oraz rozporządzeń wykonawczych odnoszących się do administratora bezpieczeństwa informacji stanowi podstawę licznych wniosków de lege ferenda, a wśród nich m.in.: wprowadzenia obowiązku powoływania administratora bezpieczeństwa informacji przez administratora danych, wskazania w ustawie skutków prawnych: powołania administratora bezpieczeństwa informacji niespełniającego wymogów ustawowych oraz niezgłoszenia powołanego administratora bezpieczeństwa informacji do rejestracji przez Generalnego Inspektora Ochrony Danych Osobowych, jak również uregulowania w ustawie procedury przekazywania administratorowi bezpieczeństwa in-formacji wiadomości o prowadzonych zbiorach danych osobowych oraz ich aktualizacji, a także ewentualnym zaniechaniu przetwarzania danych w prowadzonym dotychczas zbiorze
The article presents, analyses and evaluates the statutory regulations and secondary legislation on the appointment, registration and tasks of an administrator of information security as an entity obliged to check the compliance of personal data processing with the regulations, to supervise the development of and update documents describing the way of data processing and technical and organizational means ensuring the protection of personal data adequately to threats and the category of data protected, to inform persons authorized to process personal data about the provisions on their protection and to keep a register of databases processed by the administrator. The analysis of the provisions of the Act on the protection of personal data and secondary legislation on the administrator of information security constitutes basis for numerous conclusions de lege ferenda, including, inter alia, the introduction of an obligation to appoint an administrator of information security by a data administrator and pointing out legal consequences of the act in case of: an appointment of an administrator of information security who does not meet the statutory requirements and a failure to register an administrator of information security by the General Inspector of Personal Data Protection, as well as the regulation of the procedure of providing an administrator of information security with information on personal data collection and their updating as well as potential discontinuance of processing data in the existing collection.

Przedmiotem opracowania jest analiza postanowienia Wyższego Sądu Krajowego w Hamm z dnia 23 września 2022 r. (26 W 6/22) i poprzedzającego go w I instancji postanowienia Sądu Krajowego w Siegen z dnia 26 listopada 2021 r. (2 O 236/21), dotyczących dopuszczalnego zakresu podmiotowego i przedmiotowego kościelnych aktów prawnych z zakresu ochrony danych osobowych. Analizie poddano stanowisko sądów państwowych odnoszące się do dopuszczalności stosowania kościelnych regulaminów ochrony danych osobowych w podmiotach medycznych prowadzonych przez kościół, a także w odniesieniu do poboru podatku kościelnego. Wykazano, że judykatura aprobuje szeroki zakres podmiotowy i przedmiotowy regulaminów kościelnych, co ma bezpośredni wpływ nie tylko na ukształtowanie konkretnych praw przysługujących osobom, których dane są przetwarzane, ale także na właściwość organów nadzorczych. Porównywalny do RODO poziom ochrony danych osobowych przewidziany w kościelnych aktach prawnych realizujących uprawnienie kościoła lub innego związku wyznaniowego, określone w art. 91 ust. 1 RODO, skutkuje akceptacją dla szerokiego zakresu podmiotowego i przedmiotowego tych aktów oddziałujących także na prawa osób niebędących członkami danego kościoła lub innego związku wyznaniowego. Aprobata dla takiego rozwiązania wynika nie tylko z istniejących unormowań prawa konstytucyjnego i samego art. 91 RODO, ale także z istotnego podobieństwa kluczowych unormowań kościelnych regulaminów ochrony danych do rozwiązań RODO.
This paper presents an analysis of the order of the Higher Regional Court of Hamm, dated 23 September 2022 (26 W 6/22), and the preceding order in the first instance issued by the Siegen District Court, dated 26 November 2021 (2 O 236/21), relating to the permissible subjective and objective scope of data protection legal acts enacted by churches. The author analysed the view of state courts regarding the admissibility of the application of church data protection regulations in church-run medical facilities, as well as in relation to the collection of church taxes. He has demonstrated that jurisprudence supports a broad subjective and objective scope of church regulations, which has a direct impact not only on the formation of specific rights of data subjects but also on the competence of supervisory authorities. The level of protection of personal data, comparable to that of the General Data Protection Regulation (GDPR), provided for in-church legal acts implementing the power of a church or another religious association, as set out in Article 91(1) GDPR, leads to the acceptance of a broad subjective and objective scope of these acts, which also affects the rights of non-members of the church or other religious organization concerned. The support for such a solution stems not only from the existing norms of constitutional law and Article 91 GDPR itself but also from the essential similarity of the key norms of the church data protection regulations to the solutions provided in the GDPR.

The opinion presents Sejm’s draft position in the proceedings before the Constitutional Tribunal concerning the motion by the Prosecutor general for examination of the provisions authorizing the representatives of the Supreme Audit Office to process sensitive personal data. In the Sejm view, the questioned provisions, insofar as they enable inspectors from the Supreme Audit Office to process data revealing the racial or ethnic origin, political views, religious or philosophical beliefs, denominational, party or trade union affiliation, as well as genetic code data and those concerning one’s habits or sex life, violate the constitutional principle of proportionality in the context of right to privacy and the individual‘s information autonomy.

In 2016, while testifying before a UK parliamentary committee, William Binney, former technical director of the US National Security Agency, stated that by implementing bulk surveillance programmes, “your government and my government has permitted what terrorists have wanted all along but could never achieve. That is to cause us to restrict our freedoms while also tripping up our efforts to stop them”.Despite the passage of years, controversy about the proportionality of the use of surveillance programmes involving indiscriminate and bulk data collection continues unabated. There are numerous arguments that such measures should not be used in democratic states. Despite the recurring reports of abuse and questionable usefulness of such solutions, there is also no shortage of arguments put forward by proponents of the use of untargeted measures proving the need (or even necessity) for their use for public security purposes.The issue presented here is also the subject of ongoing interest on the part of legislators and the judiciary. The article aims to provide an overview of the evolution of the ECtHR’s position on the use of electronic surveillance, in particular its untargeted forms. However, the article is intended not only to recapitulate the reasoning as set out in recent case law – including the 2021 judgments of the Grand Chamber in Big Brother Watch et al. v. United Kingdom and Centrum för rättvisa v Sweden – but also to prompt further discussion on the relevance of the Court’s position as set out in relation to the most important legal issues relating to mass surveillance. It is the author’s intention that in this way it will be possible to answer the question of whether the current standard set by the ECtHR can be considered sufficient to protect against the risk associated with the spread of modern surveillance measures and their increasing use by public authorities.
