    Specyfika Komunii św. na sposób Wiatyku polega na tym, że wierny chrześcijanin przyjmuje Go w najbardziej decydującym, a zarazem delikatnym momencie swojego życia, tzn. w chwili przejścia z tego świata do wieczności, a przynajmniej w bliskiej perspektywie tego momentu. Udzielanie i przyjmowanie Komunii św. jako Wiatyku jest jednym z najstarszych zwyczajów Kościoła. Wiatyk powinien przyjąć wierny znajdujący się z jakiejkolwiek przyczyny w niebezpieczeństwie śmierci. O wypełnienie tego obowiązku powinni zadbać przede wszystkim duszpasterze, ale także sam wierny oraz jego rodzina lub najbliżsi. W przypadku zaistnienia różnych wątpliwości duszpastersko-prawnych zawsze należy rozstrzygać na korzyść wiernego, zgodnie z zasadą, że najwyższym prawem jest zbawienie dusz.
    The specificity of the Holy Communion in the way of Viaticum is receiving Him in the most decisive yet delicate moment of life, for example at the moment of passing from this world into eternity or at least in the short perspective of this moment. Giving and receiving Holy Communion as Viaticum is one of the oldest traditions of the Church. The faithful should receive Viaticum in any danger of death. Not only priests should take care of the fulfillment of this obligation, but also the faithful himself and his family and relatives. In the case of any pastoral and legal concerns the salvation of souls should be the most important so the problem should be always resolved in favour of the faithful.

    Opis:
    In the last century the Church enabled priests to grant collective absolution mainly due to warfare. After the Second Vatican Council previously issued norms were collected and adapted to current needs. In the Code of Canon Law promulgated in 1983 in canons 961-963 there are binding norms regarding general absolution. The legislator limits the application of collective absolution to two main circumstances, namely the danger of death and the case of serious necessity. In the event of the danger of death the Church law allows for absolution after a prudent assessment of the situation by a confessor. On the other hand, the determination of the case of seriousness is on the side of the diocesan Bishop, who is to base his assessment of the situation on the criteria agreed with the other members of the Episcopal conference. The general absolution standards are to be interpreted strictly.

    Questo articolo tratta del presunto avvenimento che diede origine al Salmo 116 e suggerisce che una malattia seria dell’orante ne rappresenti la griglia interpretativa più adeguata. Questa ipotesi è sviluppata in tre tappe. In primo luogo, viene affrontata sia l’analisi del problematico versetto 3 sia altre espressioni. Questa analisi chiarisce che non ci sono ostacoli contro la suddetta ipotesi. Conclusa questa tappa si passa a considerare l’intero Salmo 116 per collocarne gli elementi problematici in un contesto più ampio e illuminare quei dettagli tralasciati in favore delle interpretazioni che privilegiavano quella della malattia. Infine, il vocabolario e i motivi letterari del Salmo vengono comparati ad altri testi anticotestamentari che trattano della malattia, per corroborare la validità delle proposte qui presentate.
    This article deals with the event that gave rise to Psalm 116. The author proposes a serious illness of the prayer as its interpretative matrix. This assumption is developed in three stages. First, the problematic verse 3 is examined along with other expressions. This analysis leads to the conclusion that there are no decisive obstacles to such a hypothesis. Second, the whole of Psalm 116 is taken into account, in order to place problematic elements within the Psalm into a broader context; and so as to highlight previously overlooked details in favor of illness. Third, the vocabulary and the literary motifs of the Psalm are compared and contrasted with other texts dealing with illness, to justify the validity of the proposals.

    W celu możliwości realizowania prawa wiernych do sakramentów należy posiadać odpowiednią dyspozycję (por. kan. 843 § 1 KPK). Z tego powodu Prawodawca w szczególnych sytuacjach życia, jakim jest niebezpieczeństwo śmierci, zmienia normy, a niektóre wręcz zawiesza, aby wierni mogli przyjąć sakramenty, które w tym momencie najbardziej są im potrzebne do zbawienia. W ten sposób realizowane jest najwyższe prawo Kościoła salus animarum, które wyraża wolę Bożą i jako prawo Boże jest wyznacznikiem innych praw, które muszą być jemu podporządkowane. Dlatego analiza prawodawstwa dotyczącego poszczególnych sakramentów w niebezpieczeństwie śmierci pozwala zauważyć realizację tego prawa, a jednocześnie wykazać intencję Prawodawcy i sposób postępowania zgodny ze słusznością kanoniczną w sytuacjach wątpliwości oraz przypadkach nieuregulowanych przez prawo powszechne.
    In order to exercise the right of the faithful to the sacraments, one must have an appropriate disposition (cf. can. 843 § 1 CIC). For this reason, the Legislator, in special situations in life, such as the moments of danger of death, changes the norms, and even suspends some, so that the faithful can receive the sacraments that are most needed for their salvation at that moment. The analysis of the possibility of receiving individual sacraments in danger of death is not only an exegesis of the applicable law, but also an attempt to answer the emerging difficult and doubtful issues. In this way, the highest law of the Church is realized, the salus animarum, which expresses God’s will and, as God’s law, determines other laws that must be subordinate to it. Therefore, an analysis of the legislation on individual sacraments in danger of death allows us to notice the implementation of this right, and at the same time to show the intention of the Legislator and the manner of proceeding in accordance with canonical equity in situations of doubt and in cases not regulated by canon law. The primacy of the right to salvation and the duty of the Church to sanctify the People of God must be the source and the highest standard of conduct for faithful ministers in danger of death, but also for intellectual disabilities, etc.

    At the beginning of 2020 year in the world the virus outbreak began. An epidemic emergency has been introduced in Poland. The best method to stop epidemic is to reduce people-to-people contacts. Such actions create problems for the administration of the sacraments.     Wątpliwości związane z normą zawartą w kan. 868 § 2 Kodeksu Prawa Kanonicznego z 1983 r. pojawiają się od samego początku u wielu autorów literatury kanonistycznej. W tym kanonie znajdują odzwierciedlenie dwie fundamentalne kwestie, a mianowicie prawo do wolności religijnej, które jest jednym z podstawowych praw człowieka oraz konieczność chrztu do zbawienia. Dlatego nie jest łatwa interpretacja tego kanonu. Należy pogłębić zarówno kwestie teologiczne, jak i prawne w celu wyjaśnienia wszelkich wątpliwości związanych z obowiązującą normą kodeksową. Opracowanie to stanowi próbę podania interpretacji, która z jednej strony wyjaśnia większość wątpliwości wynikających z przenikania się w tej normie różnych kwestii teologicznych i prawnych, z drugiej pozostaje w zgodzie z nauczaniem Kościoła katolickiego oraz intencji ustawodawcy powszechnego.
    Doubts related to the norm contained in can. 868 § 2 of the 1983 Code of Canon Law appear from the very beginning with many authors of canonical literature. Two fundamental issues are reflected in this canon, namely the right to religious freedom, which is one of the basic human rights and on the other hand the necessity of baptism for salvation. Therefore, it is not easy to interpret this canon. Both theological and legal issues should be deepened in order to clarify any doubts related to the current canonical norm. This study is an attempt to give an interpretation, which on the one hand explains most of the doubts arising from the interpenetration of different theological and legal issues in this norm, and on the other hand, which is in accordance with the teaching of the Catholic Church and the intention of the universal legislator.
