The authors of the article present the idea of the maintenance of aircrafts’ battle damages. The aim of the paper is to discuss the issue of the field maintenance of aircrafts. The process of evaluating damages and recommendations regarding verification of airframe structure elements and its equipment damaged by an enemy’s impact has been addressed. The paper demonstrates the changes in dealing with the issue of battle damages of aircrafts, which have occurred over the period of several decades. The new challenges faced by personnel servicing the modern aviation constructions in a contemporary battlefield have been subjected to the evaluation. Concepts regarding the new maintenance methods of an airframe construction of military aircrafts have been outlined.

The verdict of the Supreme Court of 11 October 2013 (fi le I CSK 697/12) and the decision of the Constitutional Tribunal of 25 June 2015 (fi le SK 32/14) are discussed and their signifi cance for the understanding of punitive damages analysed. The main problem discussed in this paper is the question whether there is room under Polish law for punitive damages modelled a common law system and whether the adoption of this solution could possibly infl uence the basic premises constituting the liability for damages already adopted. The main focus has been put on the argumentation of the Supreme Court presented in its verdict regarding the possibility of enforcing by Polish courts a judgment in which a foreign court awarded punitive damages, and the arguments of the Constitutional Tribunal regarding the constitutionality of a legal provision establishing a possibility of fl at-rate damages, being awarded and increased in the event of the determination of guilt by the breaching party. Certain detailed provisions that are contradictory from the point of view of the fundamental assumptions underlying the liability for damages in Polish law and the laws of most European legal systems (and the German system in particular) are also examined. Further, a synthetic analysis of the positive and negative aspects of punitive damages identifi ed by other researchers is presented. This is followed by a mention of other institutions available under Polish law which may constitute an alternative to punitive damages, at least when it comes to the provision of an adequate preventive and punitive measure in the event of gross or culpable damage.

Information asymmetry between claimants seeking damages for competition law violations and the alleged infringing undertaking(s) is a key problem in the development of private antitrust enforcement because it often prevents successful actions for damages. The Damages Directive is a step forward in the facilitation of access to evidence relevant for private action claims. Its focus lies on, inter alia, 3rd party access to files in proceedings conducted by national competition authorities (NCAs). The harmonization was triggered by the inconsistencies in European case-law and yet the uniform rules on access to documents held in NCAs’ files proposed in the Damages Directive seem to follow a very stringent approach in order to protect public competition law enforcement. The article summarizes the most relevant case-law and new provisions of the Damages Directive and presents practical issues with respect to its implementation from the Polish perspective.

Article 7 of the Act of 6 July 2001 on the preservation of the national character of the country’s strategic natural resources alone does not determine the rules for determining and paying compensation. The provisions of Article 7 of the Act cannot constitute a binding basis for an investigation in the way of civil damages for loss of property stocks listed in Article 1 of the Act. Despite the use of Article 7 of the Act the term “claim” in current law, to any entitlements to the beneficiaries named in Article 7 of the Act, civil law concept of limitation is not in general use.

Damages of car engine pistons are one of the most expensive failures regarding final consequences and possibilities of engine repair. There have been many research works carried out so far regarding the materials, manufacturing techniques, geometrical shapes and reliability of engine pistons. Notwithstanding all these studies, there is a huge number of piston damage cases. This work is concerned with causes of piston damages and possibilities of early detections. Damaged piston of petrol and diesel engines in passenger and light duty cars have been analyzed. A compendium of case studies of damaged piston causes has been presented. The analysis of different types of damage mechanisms such as thermal and mechanical fatigue, seizure due to insufficient clearances, poor lubrication, overheating and damages due to abnormal combustion have been presented in this work. Faults of electronic control system, engine management malfunction, ignition-timing faults were recognized as the most frequent initial causes of piston damages. Possibilities of early diagnostics of particular causes of damages have been elaborated and presented in the context of total costs of repairs.

Nuclear power plants supply nearly one sixth of the world electric energy production. Though nuclear power is a very efficient source of energy, it produces dangerous radioactive waste composed of nuclides characterized, among others, by a long decay time and containing also significant quantities of fissible and even fissile materials. Therefore, spent nuclear fuel must be carefully stored for at least hundreds of years, all this time needing permanent supervision. Simultaneously this cumbersome waste contains also important amounts of energy that should not be simply buried forever. Thus, in spite of the fact that ultimate disposal of spent nuclear fuel in adequate geological formations is recognized as safe for the energy hungry world that tries at the same time to avoid CO2 emissions, this is a hardly acceptable solution. Fortunately, there is an effective approach, namely – spent fuel recycling, particularly with the help of nuclear fusion. Simultaneously, one has to admit that this concept has not attained yet technological maturity, thus lengthy and costly investigations still are necessary before nuclear fusion achieves development level adequate to industrial application. Since every nuclear device must be generally safe, therefore this article raises a safety issue of fusion-fission hybrid design. In order to ensure the required reliability of evaluations the development of heterogeneous model of the device was assumed as the starting point for further respective research. The performed calculations have indicated that maintenance of subcriticality even in the case of system collapse is achievable.

Global trade and intercontinental tourism are on the rise in today’s world. This, in turn, leads to more cross-border law suits. Inevitably, jurisdictions will be confronted with legal concepts that are unknown in the host forum. This contribution investigates whether, and to what extent, punitive damages judgments originating in the United States can be enforced against the assets of a defendant in a number of selected Member States of the EU. More specifically, the article explores the possibilities of enforcing American punitive damages judgments in five EU countries, namely Germany, Italy, Spain, France and England. This comparative analysis reveals that the case law in these selected countries is relatively divergent as to the stance adopted towards foreign punitive damages, resulting in different degrees of acceptance of this legal remedy.

The aim of the paper is to present an alternative interpretation of the article 449 of the Polish Civil Code. In contrast to the most common, literal interpretation thereof, the paper offers a purposive interpretation taking into account ratio legis of the provision at stake. This tool enables to cast away some interpretative doubts which are constantly raised in the literarure. For inastance, it leads to the conclusion that the acknowledgement of debt which (according to the article 449 of the Polish Civil Code) renders the claims for damages assignable shall be limited to the acknowledgement in the strict meaning of the term, that is to the acknowledgement understood as a contract between creditor and debtor, and shall determine a sum of the acknowledged claim. The paper concludes that the article 449 of the Polish Civil Code, thanks to its purposive interpretation, may effectively protect assignors from assigning their claims for damages for the price which is far lower than the value of damages to which the assignor was entitled. This conclusion put in the context of ongoing works on the new law regulating the compensation agencies makes the article 9 of this law (which exludes the possibility of assignement of claims for damages) redundant.

The article examines the claim for damages as regulated in Art. 79 section 1 point 3 letter b) of the Copyright Act and contains an assessment thereof presented against the background of European law. The claim for damages in the case of infringement of copyright is currently provided for in two variants: as compensation falling under general principles of liability for damages and, alternatively, as compensation taking the form of a lump sum. As far as the lump-sum compensation is concerned, it is not necessary for the claimant to prove actual damage. The amount of compensation in this form is set as a double amount (in the absence of culpability on the part of the infringer) or a triple amount (when the infringing conduct is culpable) of an “appropriate royalty”. Such a severe liability violates the civil law standards pertaining to the redress of damages, in particular it interferes with the compensative function of liability for damages. It simultaneously distorts the balance between the claim for a lump-sum compensation and other claims available to right holders in the case of infringement of copyright and, in wider perspective, the balance within the entire system of intellectual property law. It appears dubious whether the legal regulation of the claim for a lump-sum compensation contained in Art. 79 section 1 point 3 letter b) of the Copyright Act is in compliance with the Directive 2004/48/EC on the enforcement of intellectual property rights. Arguments in support of this view have been put forward in the article. Doubts which been expressed in that regard will most likely be clarified by the Court of Justice in its future response to the request for a preliminary ruling, which was made by the Supreme Court.

The submitted bill sets out the conditions for liability of the Treasury for the loss caused to functionaries and their “eligible family members” and the procedure for granting them indemnity benefits. The bill causes substantive doubts, as it deprives the aggrieved party of compensation for harm to property, in particular, for personal items lost, destroyed or damaged when on duty. Article 9 paragraph 1 of the bill appears to violate the Constitution of the Republic of Poland, as it excludes from those covered by insurance – without adequate justification – spouses in the separation. The bill also requires clarification by indicating whether or not granting (on the basis of the bill) a one‑time indemnity benefit affects the scope of compensation awarded under the general rules following the same event. In addition, Article 34 paragraph 3 of the bill is inconsistent with the Constitution of the Republic of Poland, since it denies the recourse to the law in some cases for compensation.

Presented here models deal with un-repairable systems. The essential concepts of discrete states and continuous time semi-Markov process theory deliver. Mathematical apparatus for models constructions and analysis. Multi-state reliability functions and corresponding expectations, second moments and standard deviations are calculated for the presented systems.

The article looks primarily at the material comprised in the volume edited by A. Piszcz, Implementation of the EU Damages Directive in Central and Eastern European Countries published in 2017 and based on that compares aspects of the disclosure of evidence issue in Bulgaria, Croatia, Czech Republic, Estonia, Hungary, Latvia, Lithuania, Poland, Romania, Slovakia and Slovenia. The purpose of this article is to look into how the process for the disclosure of evidence has evolved in eleven countries of the European Union in light of Directive 2014/104/EU. The article looks at six key issues with regard to disclosure of evidence in light of Directive 2014/104/EU: general procedural issues; procedure for the submission of evidence; criteria for the disclosure of evidence; restrictions on the disclosure of evidence; disclosure of evidence by parties other than the defendant; and consequences of the failure to comply with a request to submit evidence. The article relies on primary data from eleven EU countries from Central and Eastern Europe.

The aim of the study was to determine the effect of mechanical harvest on the seed quality of yellow lupin. Two effects were studied: the cultivar of yellow lupin (the indeterminate cultivar - Mister and the determinate cultivar - Perkoz) and harvest methods: hand-picked plants with manual shelling of seeds as a control and mechanical shelling with a plot harvester. In comparison with manual shelling of seeds, the mechanical harvest reduced the seed germination and increased the number of abnormal seeds both cultivars. Determinate cultivar was more sensitive, because the loss of its quality was higher (germination of 10%) than indeterminate cultivar (6%). Perkoz had also higher electrical conductivity, with the mean value of 34.3 μS × cm-1 × g-1 . Manual shelled seeds were characterized by a significantly lower leakage of exudates (24.9 μS × cm-1 × g-1), and hence, it exhibited greater vigour than mechanical harvested seeds. Most relations of Pearson correlation coefficient between vigour tests and germination were strong or practically functional.

In the course of the evolution of state liability for damages caused in the exercise of public authority the phenomenon of constitutionalisation can be observed, dating from Polish Constitution of March 1921, which guaranteed the citizens a compensation for damages caused by the wrongful act of state authority. Not until the Polish act of state liability for damages caused by public officials entered into force in 1956, was this constitutional guarantee explicitly expressed in a legal act. The legislator partially took into consideration then the solutions propounded by Witold Czachórski, especially in the draft of a decree, which was published in 1946 in the pages of the academic journal “Państwo i Prawo” as a part of his contribution concentrating on the unification of regulations concerning state liability for damages. One of the most important postulates of Witold Czachórski, which is reflected also in contemporary constitutional and statutory legislation, was implementing a method of regulation based on the civil law system, in which a citizen is an equal party to a legal relation and has a claim against the state being a citizen’s equal before a dispute settlement body.
