W tekście omówiono różne formy korzystania z tradycji w kulturze lokalnej: od reliktów po „implanty” kulturowe. Esej stanowi rekonesans w tej dziedzinie, przedstawia swoisty katalog praktyk kulturowych, głównie dotyczących implantów. Ważne jest również pytanie o odbiorców tak przygotowanej oferty. Komu służyć mają „implanty” kulturowe? Interesująca jest tu także rola stowarzyszeń i fundacji, czy też ogólnie rzecz ujmując „NGO’sów” w kształtowaniu wspomnianych zjawisk. Główne tezy są tu dwie, po pierwsze – implanty tworzone są tam, gdzie kulturze lokalnej doskwiera jakiś poważny brak. W miejsce usuniętych, wyrugowanych, zapomnianych obiektów i tradycji powstają nowe; korzysta się z tkanki historycznej w tym procesie lub też implanty są tworzone z tkanki kulturowo obcej. Zjawisko obserwowane jest także w kulturze konsumpcji. Druga teza mówi, że tym, co umożliwia sprawne tworzenie implantów, są organizacje pozarządowe, które pełnią funkcję swoistego „niwelatora” barier wykonawczych, z jakimi borykają się inne instytucje. Przykłady z różnych regionów Polski i rejestrów kultury służą jako poparcie tych tez.
The article discusses various forms of using tradition in local culture: from relics to cultural “implants.” This essay is a reconnaissance in this field, and presents a kind of catalog of cultural practices, mainly concerning implants. The question of the recipients of thus prepared offerings is also important. Who the cultural “implants” are supposed to serve? The role of associations and foundations (in general – “NGO’s”) in shaping the aforementioned phenomena is also of interest. There are two main theses. Firstly, implants are created where the local culture suffers from some serious deficiency – in place of removed, uprooted, forgotten objects and traditions, new ones are created; historical tissue is used in this process or implants are created from culturally foreign tissue. The phenomenon is also observed in the culture of consumption. The second thesis says that what enables the smooth creation of implants are NGOs, which act as a kind of “leveler” of the performance barriers faced by other institutions. Examples from different regions of Poland and cultural levels serve to support these theses.

The authors of this article undertake a general discussion of the legal protection of Japan’s cultural heritage. They begin their reflection with the issue of comparative legal studies, treating it as a determinant of the direction and scope of legal analysis of the cultural property protection in Japan. However, their main focus are three issues. These are: the history of legal protection of the cultural heritage against the background of the formation of modern Japanese law, the subject of protection and its categories according to the Japanese Act of 30 May 1950 on the Protection of Cultural Property, and the empirically significant aspect of conservation theory concerning the issue of the authenticity of a historic substance in relation to Japan. The authors end their analysis of the legal history of the protection of Japan’s cultural heritage with a discussion of the 1950 Law, which (amended) still remains in force. The curious practice of monuments conservation in Japan related to the understanding of the authenticity of a historic substance by the Japanese is addressed by the authors in the last part of the article.

The necessity to protect contemporary cultural properties was implemented by the provisions of the Polish Law of Spatial Planning and Development of 2 March 2003. Lack of detailed provisions regarding that issue causes the necessity to introduce uniform principles of identification and protection of valuable landmarks. Our analysis of the cultural property definition and the examples of present planning solutions indicates the problems associated with the selection and protection of the objects that may constitute contemporary cultural properties.

Kluczowym problemem omawianym w artykule jest ochrona pozostałości przedurbanizacyjnego krajobrazu kulturowego na terenach miast. Autor zwraca uwagę na wartość struktur i elementów dawnych podmiejskich wsi w przestrzeni współczesnych miast. Stawia tezę, że kluczowe komponenty dawnego rozplanowania nie są ani należycie identyfikowane, ani waloryzowane – skutkiem czego ich ochrona jako obiektów dziedzictwa jest wybiórcza i powierzchowna. Postuluje konieczność skorygowania dotychczasowej teorii i praktyki postępowania zarówno w badaniach krajobrazu historycznego, jak też w praktyce ochrony zabytków i planowania przestrzennego. Tezy artykułu zostały zilustrowane przykładami z terenu Wrocławia.
The key problem discussed in this paper is the protection of the relic of pre-urbanized culturallandscape in urban areas. The author draws attention to the value of structures and elements of suburban villages in contemporary urban spaces. He argues that the key components of the former layout are neither well-identified nor valued – for this reason their protection is selective and superficial. The author believes that it is necessary to correct both the methodology of historical landscape research and the practice of cultural landscape, in particular the practice of spatial planning protection. The theses are illustrated by examples from the area of Wrocław.

Leżajsk town as an exemplification of religious tourism and protection of cultural heritageThis paper discusses the relationship between religious tourism and the protection of cultural heritage. The multicultural as well as multi-religious town of Leżajsk, which is part of the “ Hasidic Trail ”, exemplifies these studies. The first part of the paper describes the notion of religious tourism and the most essential issues of cultural ( religious ) legacy management in contemporary tourism. The major aspects of Hasidic Judaism are described ; the believers of which come to Leżajsk in great numbers today. Furthermore, the cultural legacy of Leżajsk and religious tourism development in the city are also described. The paper also introduces the most important enterprises held by the Foundation for the Preservation of Jewish Heritage in Poland, which operates the Hasidic site in Leżajsk, and assesses whether these initiatives fulfill the assumptions of the balanced development idea in tourism.

In the article, the author presents the concept of public interest in spatial planning and development from the perspective of selected specific regulations. The subject of the analysis are certain requirements of environmental protection, including water management and protection of agricultural and forest land; requirements of protection of cultural heritage and monuments, as well as contemporary cultural assets, and the need to ensure an adequate quantity and quality of water for the purpose of supplying the population. The author is of the opinion that the statutory definition of public interest does not capture its essence. Therefore, the reconstruction of this concept should be made from the perspective of the designations of public interest which can be decoded by means of laws from the sphere of substantive administrative law.

Among the whole set of legal norms, norms that are legal principles are of particular importance. The attribute that gives a legal norm the status of a principle of law is its importance for the legal system. An important division of legal principles introduces a distinction between the principles formulated directly in the legal text (explicit principles), the principles interpreted from the legal text, although not explicitly expressed in the legal text (implicit principles), and the principles of law not expressed in legislative acts but constituting an element of legal culture (second-degree implicit principles). The law on the protection of cultural heritage is now considered to be a comprehensive branch of law, and one of the basic criteria for separating a branch of law is the possession of own principles of law, a criterion which is satisfied in relation to the catalogue of principles presented in the article, with the guiding principle being the principle of cultural heritage protection interpreted under Articles 5 and 6 of the Constitution of the Republic of Poland. Among other principles of the law on the protection of cultural heritage the following can be distinguished in particular (with the reservation that the catalogue presented in the article has an open character): the principle of access to monuments, the principle of social utility of monuments, the principle of access to information, the principle of control over the state of preservation of monuments, the principle of integrity of the monument, the principle of sustainable development, the principle of cultural heritage management, the principle of change in the usable value of the cultural heritage over time, the principle of financing by the monument holder, the principle of financing from public resources, principles of property protection, the principle of proportionality, the state control over the trading in monuments and the principle of the control of exporting historic objects abroad.
Pośród całego zespołu norm prawnych szczególne znaczenie mają normy będące zasadami prawa. Cechą nadającą normie prawnej status zasady prawa jest jej doniosłość dla systemu prawa. Ważny podział zasad prawa wprowadza rozróżnienie na: zasady wprost sformułowane w tekście prawnym (zasady explicite), zasady wyinterpretowywane z tekstu prawnego, choć wprost niewyrażone w tekście prawnym (zasady implicite), zasady prawa niewyrażone w aktach prawodawczych, a stanowiące składnik kultury prawnej (zasady implicite drugiego stopnia). Prawo ochrony dziedzictwa kultury jest dziś uznawane za tzw. kompleksową gałąź prawa, a jednym z podstawowych kryteriów wydzielania gałęzi prawa jest posiadanie własnych zasad prawa, które to kryterium jest spełnione wobec katalogu zasad przedstawionych w artykule, z zasadą naczelną, jaką jest wyinterpretowana z art. 5 i 6 Konstytucji RP zasada ochrony dziedzictwa kultury. Wśród innych zasad prawa ochrony dziedzictwa kultury wyróżnić można w szczególności następujące (zastrzegając, że katalog zaprezentowany w artykule ma charakter otwarty): zasada dostępu do zabytków, zasada społecznej użyteczności zabytków, zasada dostępu do informacji, zasada kontroli stanu zachowania zabytków, zasada integralności zabytku, zasada zrównoważonego rozwoju, zasada zarządzania dziedzictwem kultury, zasada zmiany wartości użytkowej dziedzictwa kultury w czasie, zasada finansowania przez posiadacza zabytku, zasada finansowania ze środków publicznych, zasady ochrony własności, zasada proporcjonalności, zasada kontroli państwa nad obrotem zabytkami oraz zasada kontroli wywozu zabytków za granicę.

Tourist infrastructure design involves interference in natural environment. When undertaking tasks connected with development of this economy branch, it is necessary to consider the whole network of connections between natural environment, cultural landscape and envisaged undertaking. In this paper authors discuss issues of tourist investments design for the open landscape, based on chosen examples, and present solutions of design matters.

The article aims to present the problem of the ineffectiveness of international legal instruments for the protection of cultural heritage. It presents examples of where such laws were violated and suggests that international criminal law can contribute to a better condition of cultural property. Przedmiotem niniejszych rozważań jest zagadnienie społecznej ochrony dziedzictwa kulturowego jako obszaru potencjalnego oddziaływania turystyki. Cel artykułu koncentruje się wokół ukazania edukacyjnego potencjału praktyk poznania turystycznego i ich roli w budowaniu więzi z dziedzictwem kulturowym. Autor w oparciu o literaturę przedmiotu oraz obserwacje uczestniczące rozpatruje intelektualny i emocjonalny kontekst tej specyficznej relacji pomiędzy poznaniem a ochroną. Główny wątek dociekań dotyczy specyfiki zachowań turystów w spotkaniu z dziedzictwem kulturowym i edukacyjnych implikacji tegoż spotkania, które w rezultacie umożliwiają refleksyjną postawę względem reliktów przeszłości, pozwalając na kształtowanie zachowań sprzyjających ochronie wytworów dawnej kultury. Zważywszy na masowość podróży turystycznych w świecie zachodnim, poznanie turystyczne pomimo wielu niedoskonałości i ograniczoności wydaje się odgrywać żywotną rolę w procesie społecznej ochrony reliktów przeszłości. Szczególne znaczenie ma tutaj emocjonalna strona poznania, co potwierdza tezę, że to emocje otwierają drogę do rozumienia i stymulacji postaw ludzi w procesie społecznej reprodukcji dziedzictwa.
The subject of this article is the issue of the social protection of cultural heritage as a sphere of the potential influence of tourism. The objective is to show the educational potential of tourist cognition practices and their role in creating bonds with cultural heritage. The author analyses the intellectual and emotional aspects of this specific relationship between cognition and protection based on the literature on this subject and his own observations. The main subject of consideration is the specific behaviour of tourists coming into contact with cultural heritage and the educational outcomes of that contact, which enable adopting a reflective attitude towards the relics of the past and thus enable shaping behaviours favourable to the protection of cultural property. Taking into account the prevalence of tourism in the West, tourist cognition, despite its many imperfections and limits, seems to play an active part in the process of the social protection of relics of the past. The emotional aspect of cognition occupies a prominent role in this respect, which supports the thesis that emotions open the way to understanding and stimulating people’s attitudes in the process of social regeneration of heritage.
