Opis:: This paper includes discussions about the issue of evaluating CROs. They are an expression of the theoretical exploration of factors and criteria which may have a significant impact on such an evaluation. It should be noted that evaluation of CROs is an important and complex problem, because today, in the real environment dominated by conflicts and crises, there is a real need to involve some of the resources of third party countries to resolve tensions in unstable areas. The need for a response from multinational forces (national, alliance) is dictated by the dynamics of the changes taking place in the security sphere, the multi-dimensionality of crises and conflicts, and their unpredictability (Iraq, Afghanistan). Today it is emphasised that such a commitment will form the basis of future international relations.

Opis:: The main objective of the paper is to state whether the evaluation criteria of managerial roles in judiciary administration suit the specificity of these roles. The first part of the paper presents the concept of systematic approach to organizational behavior and underlines the need of watching the criteria of assessment of managers’ performance with the tasks they perform. The second part of the article focuses on the results of the Authors’ researches, conducted among three groups of managers: directors, managers of divisions and managers of secretariats. In all three groups efficiency criteria were given priority – meeting the deadlines set and acting in compliance with formal procedures. Less frequently applied criteria were: evenness of delegating tasks to subordinates considering the competences of employees who are to compete the delegated tasks. The list of the evaluation criteria includes also the least frequently used ones, i.e. knowledge sharing and motivating employees with the tools tailored to their tasks and organizational environment.

Opis:: W artykule podjęto próbę oceny występujących w polskiej współczesnej prasie kobiecej angielskich dubletów leksykalnych przez pryzmat kryteriów oceny innowacji językowych (kryterium wystarczalności, ekonomiczności języka oraz estetyczne). Analiza wyodrębnionych anglicyzmów pozwoliła na konstatację, iż większość tychże dubletów to słownictwo zbędne w leksykalnym zasobie polszczyzny. Ekspansywna amerykanizacja kultury polskiej oraz języka polskiego przyczynia się jednak do coraz większej frekwencji owych dubletów w tekstach prasowych, choć, zważywszy na ich częstą niejasność znaczeniową oraz zakłócenia komunikacyjne, których są przyczyną, należy stwierdzić, że użycie tego typu elementów językowych powinno zostać w znacznym stopniu ograniczone.
Article attempts to assess lexical doublets occurring in Polish contemporary feminine press, through the prism of criteria of evaluation of linguistic innovations (criterion of sufficiency language, economy language and aesthetic). Analysis of these anglicisms allowed the statement that the majority of doublets is unnecessary vocabulary in Polish lexical resource. Expansive Americanization of Polish culture and Polish language, however, contribute to the increasing frequency of these doublets in press, though, given their frequent lack of clarity of meaning and communication disturbances, which are the cause, it is clear that the use of this type of language elements should be substantially limited.

Opis:: Celem artykułu jest ocena dialogu konkurencyjnego jako trybu postępowania, zasad stosowania kryteriów oceny ofert, w szczególności pozacenowych. Do badań empirycznych wykorzystano postę-powania prowadzone w procedurze krajowej w trybie dialogu konkurencyjnego w latach 2013–2014. Dialog konkurencyjny jest trybem udzielania zamówienia publicznego wykorzystywanym w przypadku zamówień o szczególnie złożonym charakterze z uwagi na jego aspekty techniczne unie-możliwiające dokonanie opisu przedmiotu zamówienia lub aspekty finansowo-prawne. Tryb ten charak-teryzuje się bardzo dużą elastycznością, przede wszystkim w stosunku do trybów przetargowych przy zachowaniu pełnej konkurencyjności postępowania. Zamawiający wszczynając postępowanie o udzie-lenie zamówienia publicznego dokonuje opisu swoich potrzeb i wymagań, ale zobowiązany jest do zastosowania w postępowaniu co najmniej jednego kryterium innego niż cena. Średni udział dialogu konkurencyjnego w strukturze zamówień publicznych w latach 2007–2013 wynosi 0,03%. Przepisy ustawy Prawo zamówień publicznych wskazują, iż kryterium oceny ofert jest cena albo cena i inne kryteria związane z przedmiotem zamówienia. Zastosowanie pozacenowych kryteriów oceny ofert niesie z sobą korzyści ekonomiczne i pozaekonomiczne dla obu stron postę-powania. Funkcjonowanie pozacenowych kryteriów oceny ofert jest określone ramami wynikają-cymi z rekomendacji ETS i Urzędu Zamówień Publicznych. Przedmiotem analizowanych postępowań były przede wszystkim specjalistyczne usługi in-formatyczne oraz roboty budowlane polegające na termomodernizacji budynków lub budowie obiektów rekreacyjno-sportowych z wykorzystaniem partnerstwa publiczno-prywatnego. Średnia liczba kryteriów oceny ofert wynosiła ponad 3, a zamawiający stosowali zarówno kryteria ekono-miczne, jak i jakościowe.
The aim of this article is to assess the competitive dialogue as a procedure in public procure-ment, the rules of applying the criteria in evaluation of the offers, especially out-of-price one. In the article there were analysed the proceedings held on national level in the competitive dialogue during 2013–2014. The competitive dialogue is applied in the case of particularly complex contracts in the rea-son of technically or economically problems that caused impossibility of describing the product or economic requirements. The competitive dialogue is very flexible, especially in comparison with tender and while maintaining full competitiveness for all candidates. The procedure of the compet-itive dialogue requires applying the out-of-price criteria. The Public Procurement Act in Poland constitutes that the criteria in evaluation of the offers in-clude: price or other criteria linked to the subject-matter of the contract which do not confer an unre-stricted freedom of choice on the contracting authority. The out-of-price criteria applied in the contract benefit in economic and non-economic areas for both side proceedings of the public procurement. The analysed contracts are focused on specialist computer services and public work included building thermo modernization and construction of sports facilities buildings with the public-private partnership. The contractors used an average of three criteria: both economic and qualitative.

Opis:: Celem artykułu jest zwrócenie uwagi na uwarunkowania prawne wyboru najkorzystniejszej oferty i problemy praktyczne występujące na kanwie stosowania poszczególnych przepisów ustawy z dnia 29 stycznia 2004 r. Prawo zamówień publicznych i innych ustaw. Zamawiający wybiera ofertę najkorzystniejszą na podstawie kryteriów oceny ofert określonych w specyfikacji istotnych warunków zamówienia. Najkorzystniejszą ofertą jest oferta, która przedstawia najkorzystniejszy bilans ceny i innych kryteriów odnoszących się do przedmiotu zamówienia publicznego albo oferta z najniższą ceną. W tym kontekście szczególnego znaczenia nabiera wskazanie przez zamawiającego kryteriów oceny ofert i sposobu operowania poszczególnymi kryteriami. Nowelizacja ustawy Prawo zamówień publicznych z dnia 29 sierpnia 2014 r. ukierunkowana została między innymi na rzecz wyboru ofert gwarantujących najlepszą relację jakości do ceny na podstawie pozacenowych kryteriów oceny ofert, w tym kryteriów środowiskowych, jakości, wartości technicznej. Tego rodzaju modyfikacje determinują również konieczność wzmocnienia kwalifikacji pracowników zamawiającego, w szczególności komisji przetargowej, w zakresie umiejętności właściwego sprecyzowania kryteriów pozacenowych. Praktyka stosowania nowych rozwiązań pozwoli wkrótce odpowiedzieć na pytanie, czy założenia ustawodawcy, które towarzyszyły nowelizacji przepisów ustawy Prawo zamówień publicznych, przyniosły oczekiwane rezultaty.
The objective of this article is to draw attention to legal conditions related to choosing the most advantageous tender and practical problems occurring on the basis of applying individual provisions of the Public Procurement Act of 29 January 2004 and other acts. Contracting authority chooses the most advantageous tender on the basis of criteria for evaluation of tenders determined in the specification of essential terms of the contract. The most advantageous tender is such a tender that presents the most advantageous balance of price and other criteria related to the subject-matter of the contract or a tender with the lowest price. In this context the indication of criteria for evaluation of tenders and the method of operating individual criteria by contracting authority grows in importance. Amendment of the Public Procurement Act of 29 August 2014 concentrated on, inter alia, the choice of tenders that guarantee the best relation of value for money on the basis of non-price criteria for evaluation of tenders, including environmental, quality and technical value criteria. Such alternations also determine the need to enhance qualifications of contracting authority’s employees, especially qualifications of tender committee, in respect of the ability to properly specify non-price criteria. The practice of applying new solutions shall soon answer the question, whether the assumptions of legislator that accompanied the amendment of provisions of the Public Procurement Act have produced expected results.

Subsequent part of the paper consists of specification of all the data and methods used and applied to obtain the final outcomes. Opis:: Celem naukowym artykułu jest określenie czynników decydujących o zróżnicowaniu cen ofertowych poszczególnych uczestników przetargów na roboty budowlane. W pracy wykorzystano: analizę statystyczną zmian kryteriów oceny ofert stosowanych w przetargach; przegląd wybranych wyników postępowań przetargowych w zakresie inwestycji oraz wywiady strukturyzowane z kierownikami przedsiębiorstw uczestniczących w przetargach. W wyniku przeprowadzonych badań określono poziom zróżnicowania cenowego ofert przetargowych oraz zidentyfikowano zestaw czynników, które determinują to zróżnicowanie. Ustalono też czynniki kształtujące oferty na najniższym poziomie cenowym. Przeprowadzone badania poszerzają teoretyczną wiedzę o czynnikach kształtujących efektywność procesu zamówień publicznych, a ich wyniki mogą być wykorzystane przy przygotowaniu postępowania przetargowego.
The aim of the article is to identify the factors influencing the possibility of varying the price level offered by the different participants in tenders for the construction works. The study was based on statistical analysis of changes in evaluation criteria of tenders; an overview of selected results of tender procedures in the field of investments; and structured interviews with managers of companies that participate in tenders. The results of the study determine the level of differentiation of price tenders and identify the factors that influence these differences. The study also presents the factors that allow to shape the offer at the lowest price level. The study broaden the understanding about the determinants of the effectiveness of the procurement process, and the results can be used in the preparation of the tender procedure.

Opis:: Artykuł dotyczy doboru kryteriów oceny ofert w polskim systemie zamówień publicznych. Instytucja doboru odpowiednich czynników realizacji umowy zamówieniowej pełni istotną funkcję w wydatkowaniu środków publicznych. W opracowaniu wskazano m.in. na obowiązek zamawiającego dotyczący formułowania adekwatnych i proporcjonalnych wymagań w stosunku do wykonawców w celu realizacji jednej z podstawowych swoistych zasad prawa gospodarczego publicznego – zasady prawidłowego gospodarowania mieniem publicznym. Szczególny nacisk w artykule położono na pozacenowe kryteria oceny ofert, a także ich funkcję w społecznej gospodarce rynkowej. Dokonano także analizy ekonomicznej kryteriów oceny ofert oraz scharakteryzowano dwuetapowy proces oceny (ocena techniczna i finansowa), który jest często wykorzystywany przy ocenie ofert najkorzystniejszych ekonomicznie. Zwrócono także uwagę na stosowanie rankingu, uwzględniającego zagregowane oceny wynikające z przypisanych wag w relacji do oferowanej ceny.
The paper concerns the selection criteria for the evaluation of offers in the Polish public procurement system. The institution of selecting the appropriate factors for the implementation of the procurement contract plays an important role in the spending of public funds. The study indicated, among others, on the contracting authority’s obligation to formulate adequate and proportional requirements from contractors in order to implement one of the basic specific principles of public economic law – the principle of proper management of public property. Particular emphasis in the paper was put on the non-price criteria for the evaluation of offers as well as their function in the social market economy. An economic analysis of the offer evaluation criteria was also carried out and a two-stage evaluation process (technical and financial assessment) was characterized, which is often used in the assessment of the most economically advantageous offers. Attention was also paid to the application of the ranking, taking into account the aggregate ratings resulting from the weightings assigned in relation to the offered price.

The twentieth century was characterised by a fundamental reinterpretation of the meaningfulness and information-bearing message of art, which had lost its dominance of basic informational values – conveying aesthetic ideals, education of society in the spirit of harmony and beauty, introducing moral qualities with the use of artistic means, ideological orientation, etc. In stark contrast to traditional art and to centuries-old artistic means of delivering certain information was street art, and the root cause of its emergence were the social problems of the post-war period in poor New York neighbourhoods. Growing in the reality of unemployment, general depression and poverty, children invented new forms of entertainment using whatever they could find around. And then, some years later, these new forms instantly reached almost all the countries of the world – both poor and rich. Yes, those post-war years brought skateboards, rap, graffiti and street art in the forms in which we know them today. Gradually, the meaningfulness of street art greatly deepened and expanded. In addition to self-expression and social protest, the list of topics also started to include an individual’s protest against total globalization. Political implications also appeared. For example, they are definitely characteristic for the graffiti and murals of the Revolution of Dignity in Ukraine. In the process of its development, legal street art was separated from illegal, purely amateur, spontaneous street art and artists who started “commercial street art” appeared, even though it would be more correct to call it urban art or simply modern art, since it is no longer created in street conditions, but is rather increasingly becoming the prerogative of art galleries and private customers. The attitude of other artists who do not consider their work for commerce is often somewhat ambiguous, as they promote art outside politics and commerce, i.e. “art for art’s sake”. A similar phenomenon concerned street art which originated in parallel with it. However, it was also determined by the needs of the creative development of young artists without available financing, became an art cluster, or rather a creative cluster which emerged due to the availability of a significant number of unused industrial enterprises where empty rooms were rented by artists for a token fee. The peculiarity of street art is its self-sufficiency, as its main narrative is intervention in urban space. In this case, the purpose of the narration of each artist is different: a particular message to leave a memory, a reaction to a political event, a form of protest, creative inspiration, etc. When street art evolves from spontaneous acts of art to an exhibit at a festival or gallery space, it can acquire a trans-media character, complemented by dances, performances or music.
Przez cały czas istnienia ludzkości formułowano odpowiednie kryteria dla środków informacyjnych i przedmiotu dzieł sztuki. Wiek XX charakteryzował się fundamentalną reinterpretacją sensowności i sposobu przekazu informacyjnego sztuki, która utraciła dominującą rolę w niektórych zakresach – przekazywania ideałów estetycznych, edukacji społeczeństwa w duchu harmonii i piękna - wprowadzając cechy moralne z wykorzystaniem środków artystycznych, pewne treści ideologiczne itp. Sztuka uliczna kontrastowała ze sztuką tradycyjną i wielowiekowymi środkami artystycznymi w sposobie dostarczania pewnych informacji, a główną przyczyną jej powstania były problemy społeczne okresu powojennego w biednych dzielnicach Nowego Yorku. W warunkach bezrobocia, ogólnej depresji i ubóstwa, młodzi ludzie wymyślili nowe rozrywki wykorzystując wszystko, co było w pobliżu. A potem, kilka lat później, ten trend objął niemal wszystkie kraje świata - zarówno biedne, jak i bogate. W ten sposób okres powojenny przyniósł deskorolki, rap, graffiti i street art w obecnej formie. Stopniowo znaczenie sztuki ulicznej pogłębiło się i poszerzyło: oprócz wyrażania siebie i protestów społecznych, wśród aktualnych celów pojawił się także indywidualny sprzeciw wobec postępującej globalizacji, pojawiły się implikacje polityczne, które, na przykład, zdecydowanie charakteryzują graffiti i malowidła ścienne Rewolucji Godności na Ukrainie. W trakcie swojego rozwoju legalna sztuka uliczna oddzieliła się od nielegalnej, czysto amatorskiej, spontanicznej. Pojawili się także artyści, którzy zaczęli uprawiać „komercyjną sztukę uliczną”, którą lepiej byłoby nazwać sztuką miejską lub po prostu nowoczesną sztuka, ponieważ nie jest już tworzona w warunkach ulicznych i znajduje się coraz bardziej pod prerogatywą galerii sztuki i prywatnych klientów. Postawa innych artystów, którzy nie uważają swojej pracy za komercję, jest często nieco niejednoznaczna, ponieważ promują oni sztukę poza polityką i handlem, uprawiając „sztukę dla sztuki”. Ciekawym zjawiskiem należącym do tego porządku w sztuce ulicznej są realizacje młodych artystów bez dostępu do zewnętrznego finansowania, które stały się swoistym „klastrem artystycznym”, czy raczej „klastrem kreatywnym”. Ich pojawienie się było możliwe ze względu na dostępność znacznej liczby niedziałających przedsiębiorstw przemysłowych, w których artyści wynajmowali puste pomieszczenia za symboliczną opłatą. Osobliwość sztuki ulicznej polega na tworzeniu narracji będącej interwencją w miejski obszar. W tym przypadku każdy artysta ma swój cel: przekazać wiadomość, upamiętnić siebie, zareagować na polityczne zdarzenie, wyrazić protest itd. W przypadku, gdy sztuka uliczna ze spontanicznej staje sztuką na festiwalu czy w przestrzeni galerii, może uzyskać transmedialny charakter i być dopełniona tańcami, performansami, muzyką.

Opis:: Interpretative Phenomenological Analysis (IPA) is a recently developed qualitative approach, not only in psychology but also in pedagogy. It turns out that not all IPA studies meet the indicated criteria of acceptability developed by Jonathan A. Smith (2011). The aim of this article is to present a set of criteria to evaluate IPA papers and to provide high-quality future research. The article is divided into three parts: first, I am going to focus on indicating limitations of pedagogical research in which IPA was used, later I shall go on to give examples of good practice. In the last section, I have correlated particular stages of research with the criteria of validity to show what makes IPA study excellent. I also formulate two main requisites for making high-quality IPA study.

Opis:: The paper considers major principles of methods based on quantitative measurements. The problem of construction investments is of paramount importance because they determine the potential of construction and the structure of expenses. The calculation of investments is an expensive tool of enterprise management used in planning the investments. It can be perceived as the harmonization and evaluation of the models for investment decision-making. Methods based on a single criterion can hardly be used in solving the problems associated with sophisticated technological or marketing systems. It is a multiple attribute decision method, taking into consideration major efficiency criteria, that enables the effective methods of solving complicated problems. When the quantitative criteria are precisely defined, the developed quantitative multiple criteria decision making (MCDM-1) method can be successfully applied. The present paper is devoted to the analysis of the algorithm and methods of application of the suggested technique.
