Opis:: This article attempts at analysing the current and drafted legal regulations concerning court executive officers and execution as well as the civil procedure as regards the court executive officers’ legal status. Allowance is made for their hybrid position in the system: on the one hand, they perform public authorities’ functions; on the other hand, they conduct activities in a self-employed capacity, based on full business risk related e.g. to the high personnel and material costs.

Opis:: This article indicates the competence of court enforcement officer. At the outset, the text presents what character in the legal turnover is the court bailiff and indicates the characteristic features that distinguish him from the debt collector, who is only the executor of the will of the creditor and not the contractor of the State expressed in the wording of the court order. Next, he shows that the Polish legislator gave the opportunity to support the activities of court bailiffs by granting them a number of powers. These legal tools are used by bailiffs to achieve a specific purpose, specified in the enforcement title submitted of court enforcement officer office together with the application – the purpose of enforcement. However, it should be pointed out – as the final part of the article states, that the bailiff deals not only with the enforcement of cash benefits. Nevertheless, all measures taken by the enforcement authority must be based on applicable law and seek to ensure the expediency and correctness of the proceedings conducted, the purpose of which is to enforce court decisions.

Opis:: As a result of legislative changes, from January 1, 2010, cases in which probation teams of the judicial service executing decisions in criminal matters are referred to cases in which enforcement proceedings have been suspended pursuant to art. 15 § 2 of the Executive Penal Code. Despite the lapse of 10 years from the introduction of the obligation for probation officers to perform control activities in such cases, doubts are still raised as to the role and tasks of probation officers resting in the course of executive proceedings that have been suspended and have not been performed for some time. In the course of such suspended proceedings, does the professional probation officers still retain all the qualities associated with his status as an executive authority? The purpose of this study is to present the role of a probation officer as a authority of executive proceedings in a situation where, despite legality and enforceability, the judgment will not be enforced and will not be pending for reasons of a temporary nature and to present de lege ferenda conclusions regarding the regulation of the rights of probation officers in the discussed areas.
W wyniku zmian legislacyjnych od dnia 1 stycznia 2010 r. do zespołów kuratorskiej służby sądowej wykonujących orzeczenia w sprawach karnych kierowane są sprawy,w których postępowanie wykonawcze zostało zawieszone w trybie art. 15 § 2 kodeksu karnego wykonawczego. Mimo upływu 10 lat od wprowadzenia obowiązku wykonywania przezkuratorów czynności kontrolnych w tego rodzaju sprawach nadal zgłaszane są wątpliwości co do roli i zadań spoczywających na kuratorach sądowych w toku postępowania wykonawczego, które zostało zawieszone i przez jakiś czas nie jest wykonywane. Czy w toku takiego zawieszonego postępowania kurator zawodowy nadal zachowuje wszelkie przymioty związane z posiadanym przez niego statusem organu postępowanie wykonawczego? Celem niniejszego opracowania jest przedstawienie roli zawodowego kuratora sądowego jako organu postępowania wykonawczego w sytuacji, gdzie pomimo prawomocności i wykonalności, orzeczenie nie będzie wykonywane i nie będzie się toczyć z przyczyn o charakterze czasowym oraz przedstawienie wniosków de lege ferenda odnoszących się do unormowania uprawnień kuratorów sądowych w omawianych zakresie.
