The subject of the opinion is providing answer to a question whether, in a view of the indicated Constitutional Tribunal’s judgement, a housing cooperative has the right to deprive a pending person – who paid housing contribution in the shape of saved cash from a housing passbook on account of a flat – of membership of the cooperative. It flows from the Constitutional Tribunal’s judgement that only such natural persons who are entitled to cooperative tenant law for the apartment, cooperative ownership law for the apartment, separate ownership or the promise of separate ownership can be members of the housing cooperative. Admission to the housing cooperative of a person, who does not possess one of the rights indicated in the judgement is not admissible.

Opis:
Pedagogical journalism and literature of the interwar period emphasised importance of the cooperation between family and school with respect to cooperative education of school-age children and youth. Cooperative education started usually in family through the formation of reason, will and emotions. Family home constituted a basic level of education and could repeatedly stimulate cooperative interests. Common work of the family at family farm or in craft or cottage industry business became the first school of cooperation and joint-action onwhich cooperative activity was based. Family home played a supporting part in the development of student cooperative. The acceptance of parents and their recognition, and sometimes their involvement in the work of student cooperation, were a form of encouragement for students and teachers for further activity of the cooperative. At the same time, student cooperative – in particular in rural areas –was a medium stimulating the parents of these students and the environment to cooperatistic actions. The social life of school was guided by the principle of convergence, i.e. its interpenetration and complementation by the family home and environment life. The idea of cooperation in the interwar educational system being accomplished in practice by means of student cooperatives had the possibilities of playing a very big part. This was determined by its broad application in educational activity of the Polish school as well as its understanding and acceptance by the family and environment. Important part was played by the tutor of student cooperative. His / her duty was to tighten the cooperation between student cooperative and family homewhich, on the one hand, ensured the understanding of teacher's actions and, on the other hand, provided material and moral assistance for the cooperative. At the same time, teacher – through student cooperative – could influence socially and educationally the family and environment, showing the benefits yielding from mutual cooperative work based on joint-action. c

W artykule zawarto podstawowe informacje na temat organizacji spółdzielczych, które funkcjonowały w okresie dwudziestolecia międzywojennego oraz znalazły swoje miejsce po transformacji gospodarczej lat 90. Istniejące w latach 20. podmioty spółdzielcze przenikały każdy sektor życia gospodarczego w przeciwieństwie do tych, które zaczęły się rozwijać tuż po odzyskaniu przez polskich przedsiębiorców możliwości tworzenia niezależnych organizacji gospodarczych, w tym również tych opartych o przepisy prawa spółdzielczego. Podstawowym celem artykułu jest więc wykazanie, że spółdzielczość może mieć istotny wpływ na rozwój gospodarczy nie tylko lokalnych wspólnot, ale również całych regionów, prowadząc do poprawy sytuacji materialnej mieszkańców – dzięki sięganiu do rozwiązań przedwojennych, mimo ograniczonego wsparcia rozwoju tego sektora na początku transformacji gospodarczej oraz osłabienia organizacyjnego sektora spółdzielczego po upadku wojewódzkich związków rewizyjnych działających do początku 1990 r.
The paper includes basic information about cooperatives that operated in the inter-war period and were re-established in 1990s. The cooperatives existing in the 1920s penetrated each economic sector, on the contrary to those which started to act immediately after regaining the legal opportunities to form independent economic entities, including the ones functioning on the ground of cooperative act. Thus, the underlying aim of the article is to verify the thesis that cooperative movement can highly infl uenced on not only local communities but entire regions, leading to the improvement in fi nancial situation of their inhabitants. It results from the use of the pre-war solutions, despite limited support given to the sector in the beginning of economic transformation and organisational weakening of cooperative sector after the fall of the regional cooperative associations which operated from the beginning of 1990s.

Aim: Cooperative purchasing is considered a promising area for lowering the cost in the health care sector, although recent initiatives show mixed results. The purpose of this study is to find a thorough explanation for the performance of cooperative purchasing in healthcare by investigating the role of trust, commitment, organizational factors (i.e. group formality, and IT system effectiveness) and interpersonal skills (i.e. teamwork skills, and communication). Design/research method: A conceptual model for the performance of cooperative purchasing was developed. This model was empirically validated using a survey of 88 Dutch hospital purchasing professionals. Conclusions/findings: Analysis shows a significant impact of trust and commitment in cooperative purchasing groups on performance. Group formality and teamwork skills appear to be essential for achieving trust and cooperative purchasing performance. We also found a positive impact of IT system effectiveness on commitment, not on trust. Positive feelings about the group and positive expectation about the continuity of the group can be stimulated through effective IT systems. Since proper IT support is often neglected in many healthcare organizations, management efforts to improve IT systems could truly facilitate the tactical purchasing process of cooperative purchasing in hospitals. Originality/value of the article: Many cooperative purchasing initiatives suffer from conflicts over the allocation of savings, time, and costs. Despite the growing importance of cooperative purchasing, few empirical studies have explored the effects on hospital performance. Our study extends previous research by investigating the relationships between trust, commitment, and the performance of cooperative purchasing (1) and the impact of organizational factors and interpersonal skills on trust and commitment in purchasing groups within a healthcare context (2).

Przedmiotem opracowania jest charakterystyka spółdzielczej umowy o pracę, która stanowi podstawową formę zatrudnienia członków w spółdzielniach pracy i tylko tam zasadniczo jest wykorzystywana. Ustawodawca wymaga, aby poza przypadkami określonymi w przepisach PS, spółdzielca przez cały okres członkostwa był zatrudniony na podstawie spółdzielczej umowy o pracę, co ma istotny wpływ na sposób zawarcia tej umowy oraz jej treść. Zgodnie z art. 182 PS z chwilą objęcia danej osoby członkostwem w spółdzielni pracy zarówno po stronie spółdzielni, jak i jej członka powstaje obowiązek pozostawania ze sobą w spółdzielczym stosunku pracy. Co ważne, w razie nienawiązania stosunku pracy z winy spółdzielni, członek może dochodzić przez cały czas trwania członkostwa zawarcia spółdzielczej umowy o pracę, a niezależnie od tego może on, w ciągu roku od dnia powstania członkostwa, dochodzić odszkodowania według przepisów prawa cywilnego. Roszczenia te podlegają kognicji sądu pracy.
The subject of the foregoing study is the characteristics of the cooperative employment contract, which is the basic form of employment of worker cooperatives members, and, in principle, is used only there. The legislator requires that, in addition to the cases laid down in the provisions of the Cooperative Law, the cooperative member is employed for the entire duration of the membership on the basis of a cooperative employment contract, which has a significant impact on the way in which the contract is concluded and its content. Pursuant to Article 182 of Cooperative Law, as soon as a person joins a worker cooperative, both the cooperative and its member are obliged to enter into and remain in a cooperative employment relationship with each other. Importantly, if the employment relationship is not established through the fault of the cooperative, the member may claim, for the entire duration of the membership, the conclusion of a cooperative employment contract, and apart from that, he may, within one year from the date of becoming a member, claim compensation under the provisions of civil law. These claims are subject to the cognition of the labour court.

Spółdzielnie socjalne są istotnym narzędziem ograniczania wykluczenia społecznego na lokalnym rynku. W ostatnim czasie dzięki zmianom w przepisach prawa ustawodawca wprowadził możliwość tworzenia przez nie konsorcjum spółdzielczego łącznie z innymi organizacjami wspierającymi osoby wykluczone. Dzięki temu rozwiązaniu mogą one podnosić swoją konkurencyjność oraz budować stabilne miejsca pracy starając się chociażby o środki publiczne z większą szansą na ich pozyskanie. Tego typu rozwiązanie posiada również pewne ograniczenia. Niewątpliwie jednym z nich są wątpliwości co do odpowiedzialności za niewykonanie umowy oraz dodatkowe obowiązki administracyjne nałożone na spółdzielnie. W artykule czytelnik znajdzie ich wpływ na rozwój konsorcjum spółdzielczego oraz możliwości jego wykorzystania w przyszłości.
Social cooperatives are important element which reduce social exclusion in the local market. In the last few months legislator introduced radical changes in social cooperative act. It imposed the possibility to create cooperative consortium between social cooperatives and organizations which support then in built stable working places for barred persons. This solution helps to improve its economic potential and solve problems witch government procurement agreement. A cooperative consortium can also impose limitations. One of them is additional acts of administration and financial responsibility impose on cooperative consortium members. In the article reader can also find information about future development of social cooperatives in Poland.

Traditional cooperative banks are considered as locally and socially embedded, lending to local clients from locally collected deposits and financing the local economy.. To offset their disadvantage due to their insufficient size, they exploit the information advantage deriving from their geographical proximity to their clients and the advantages of their peculiar corporate governance deriving from the member-ownership. This paper examines the relevant theories on cooperative finance, while examining the underlying geographical and corporate governance aspects in a less advanced transition economy environment. Governments’ preference towards commercial banking and at the same time their negligence towards the cooperatives in general led to a loose financial regulation of the sector. The limits of cooperatives’ corporate governance and demutualization intensify when loosing social/local embeddedness. Cooperative banks, located in the periphery with insufficient socio-economic conditions to develop closer relationships with borrowers accelerate capital flight from their regions. Commercial cooperatives entering new markets show higher lending activity but have more non-performing loans due to the lost information advantage.

The main aim of the article is an analysis of historical cooperative principles and their significance in cooperative banking sector. In Poland, there are 565 cooperative banks and about 101,300 members are associates of cooperative banks. The cooperative principles are partly doing in this banks and a number of member of cooperative banks is decreasing. 
Głównym celem artykułu jest analiza historycznych zasad spółdzielczych i ich znaczenia w sektorze bankowości spółdzielczej. W Polsce działa 565 banków spółdzielczych, w których zrzeszonych jest prawie 1013 tys. członków. Wartości spółdzielcze są realizowane tylko częściowo, a liczba członków banków spółdzielczych spada.

The paper examines the impact of trust in an agricultural marketing cooperative. The aim is to explore how the trust among members and between members and management affect the commitment of members towards the cooperative (group cohesion) and their satisfaction with the cooperative. Trust is examined from two dimensions: cognitive and affective. Our results have clearly proved that trust has a positive impact on group cohesion and satisfaction. According to the experiences, however, the impact of examined dimensions of trust is differentiated: the statistical models regarded the impact of affective dimensions on group cohesion and members’ satisfaction more important than the impact of cognitive dimension.
Przedstawiono wpływ zaufania do spółdzielni rolniczych ich członków. Przeanalizowano, w jaki sposób zaufanie pomiędzy członkami spółdzielni oraz pomiędzy członkami i kierownictwem wpływa na zaangażowanie członków w rozwój spółdzielni (spójność grupowa) i ich zadowolenie ze współpracy. Zaufanie było badane z perspektywy dwóch wymiarów: poznawczej i emocjonalnej. Wyniki dowiodły, że zaufanie ma pozytywny wpływ na spójność i satysfakcję grupy. Z doświadczenia wynika jednak, że wpływ badanych wymiarów zaufania był zróżnicowany – modele statystyczne uwzględniały wpływ wymiarów emocjonalnych na spójność grupową i satysfakcję członków silniej niż wpływ wymiaru kognitywnego.

The paper introduces the positional cooperative and non-cooperative game of a greater number of met ships for the description of the process considered as well as for the synthesis of optimal control strategies of the own ship in collision situation. The approximated mathematical model of differential game in the form of triple linear programming problem is used for the synthesis of safe ship trajectory as a multistage process decision. The considerations have been illustrated an example of program computer simulation to determine the safe ship trajectories in situation of passing a many of the ships encountered.

A cooperative bank as an institution of the cooperative sector operates in both economic and social dimension. A limited participation of the cooperative dimension of such institutions is due to legal regulations, however, only the bank can decide about taking into account the actual identity of the co-operative. The purpose of the study became a co-operative identity analysis of Polish cooperative banks and to examine the perception of cooperative identity in cooperative banks based on a survey of headquarters staff of the selected bank. Based on a survey of employees there was found a good knowledge about the characteristics and limitation of activities resulting from the cooperative legal form.

Artykuł jest poświęcony jednej z działających w Wadowicach po II wojnie światowej instytucji: Wadowickiej Usługowej Spółdzielni Pracy (wcześniej działającej jako Wielobranżowa Spółdzielnia Pracy Wadowice). Tekst jest kolejnym z cyklu historii spółdzielni omawianych przez Andrzeja Kotowieckiego w numerach 23 (2021 rok) i 24 (2022 rok) rocznika naukowego "Wadoviana". Rozwój powojennej spółdzielczości był przede wszystkim efektem socjalistycznej gospodarki zakładającej likwidację drobnej wytwórczości kupieckiej i rzemieślniczej. Szansą na przetrwanie był ruch spółdzielczy, na ziemi wadowickiej działający już w okresie galicyjskim. W latach 50. cztery mniejsze spółdzielnie połączono w Powiatową Spółdzielnię Usług Rzemieślniczych, której nazwę zamieniono na Powiatową Spółdzielnię Usług Wielobranżowych, produkującej między innymi obuwie i konfekcję. Instytucja prężnie rozwijała się w latach 60. i 70. rozbudowując infrastrukturę, zakłady i magazyny, i opierając kadry na absolwentach szkół z praktyczną nauką zawodu. Kryzys przyszedł w latach 80. a przede wszystkim po uchwaleniu przez Sejm ustawy o zmianach w organizacji i działalności spółdzielczości. Według stanu na 2022 rok na majątek spółdzielni składają się tylko cztery zakłady usługowe (pod koniec lat 70-tych było ich blisko 80). Z charakteru wielobranżowej organizacji współczesna Spółdzielnia opiera się przede wszystkim na trzech branżach: metalowej, motoryzacyjnej oraz remontowo-budowlanej.
The article is devoted to one of the institutions operating in Wadowice after World War II: Wadowice Service Cooperative (formerly operating as Wielobranżowa Spółdzielnia Pracy Wadowice). The text is another in a series of histories of cooperatives discussed by Andrzej Kotowiecki in issues 23 (2021) and 24 (2022) of the scientific yearbook "Wadoviana". The development of post-war cooperatives was primarily the result of the socialist economy, which assumed the liquidation of small merchant and craft production. A chance for survival was the cooperative movement, operating in the Wadowice region already in the Galician period. In the 50s. four smaller cooperatives were merged into the District Craft Services Cooperative, whose name was changed to the District Multi-branch Services Cooperative, producing, among others, footwear and clothing. The institution developed dynamically in the 60s and 70s, expanding infrastructure, plants and warehouses, and basing its staff on graduates of schools with practical vocational training. The crisis came in the 80s, and above all after the Sejm passed the Act on changes in the organization and activities of cooperatives. As of 2022, the assets of the cooperative consist of only four service plants (at the end of the 70s there were nearly 80 of them). As a multi-branch organization, the modern Cooperative is based primarily on three industries: metal, automotive and renovation and construction.

The article discusses the current state, legislative threats connected with the preparation of the Polish cooperative act and selected legislative proposals. The legal status of Polish cooperatives is unsatisfactory. The basic assumptions, structure and content of the regulations, which are of archaic and residual nature, are defective.A new cooperative law will not solve the problem if the existing legislation is merely amended. Another danger may stem from the defective definition of the essence and status of co-operatives in social market economy. The forthcoming cooperative law should be limited to general issues which apply tom co-operatives. Specific acts should govern individual co-operatives, e.g. credit cooperatives. The law should guarantee a broad statutory freedom. It is very important to have a precise yet a comprehensive definition of the purpose of the co-operative. The Finnish cooperative law provides a good example in this regard: “The purpose of a co-operative shall be to promote the economic and business activities of its members by means of the pursuit of economic activity where the members make use of the services provided by the co-operative or services that co-operative arranges for, directly, indirectly or otherwise.” Any future regulation should not limit the possibility of co-operatives becoming members of commercial companies.Differences between legal entities are becoming blurred, and this also applies o co-operatives. Therefore, co-operatives should take over some solutions from typical commercial companies, such as the marketability of shares.

The aim of this paper is to analyse the vulnerability of Polish cooperative banks to changes in macroeconomic environments within the poviats where those banks operate. We find that the profitability, cost income and growth of cooperative banks are strongly related to local conditions. Banks headquartered in poviats with lower unemployment are able to report healthier earnings and leaner cost structures, and face better growth prospects. Deteriorations and revivals in poviats are reflected in bank performance and growth, demonstrating the sensitivity of these banks to local developments not necessarily mirrored in national economic indicators. In addition, despite homogeneity within the cooperative banking sector, we demonstrate differences in the relation of performance and economic situation between subgroups of small, medium-sized and large banks.

The general problems of the Hungarian education system surface in the higher education sphere as well. Instructors frequently note the knowledge, skill, and competence-related deficien-cies of newly enrolled students. Additional difficulties are posed by the lack of motivation or the low level of interest toward learning. Furthermore, the prevalence of traditional educational meth-ods, the lectures designed for a large student audience and similarly structured seminars tend to exacerbate the problem. Students do not prepare for classes or strive to increase their knowledge via independent work and active in-class participation. Consequently new methods are needed for increasing the efficiency of the educational process, along with the enhancement of internal moti-vation and the promotion of subject-related interest.

A housing cooperative that owns a real estate or a construction object and a perpetual usufructuary of land is a taxpayer regarding the real estate tax, except that it is paid according to different rates. In case of land and buildings related to business operations, the tax is calculated at higher rates. In the author’s opinion, the statutory phrase “buildings related to conducting business activities” should be understood as a fact of an actual use of a residential building for such activities.

W pracy podjęta została tematyka funkcjonowania spółdzielczych podmiotów finansowych mających na świecie i w Polsce długoletnią historię. Spółdzielcze kasy oszczędnościowo-kredytowe są instytucjami świadczącymi usługi podobne do bankowych, tworząc razem z nimi system finansowy. Idea działalności SKOK-ów jest odmienna i wywodzi się z zasad wzajemnej pomocy i solidaryzmu. Odmienne są również przepisy prawa regulujące funkcjonowanie tych podmiotów. Z przeprowadzonych badań opinii członków wybranych oddziałów Kasy Stefczyka w woj. warmińskomazurskim wynika, że jest to instytucja rozpoznawalna, ciesząca się zaufaniem i w pewnym zakresie konkurencyjna wobec banków.
The paper deals with the question of cooperative credit unions, financial institutions which have a long history in the world and in Poland. Cooperative savings and credit unions provide services similar to the ones offered by banks, together with which they constitute the financial system. Unlike banks, however, cooperative credit unions originate from different concepts, including mutuality and solidarity. Likewise, the legal regulations which govern CUs are different. The present survey conducted among members of Stefczyk Credit Union branches in the Province of Warmia and Mazury has shown that the Credit Union is an familiar institution , seen as trustworthy and competitive with banks.

The purpose of this research is to examine the role of cooperative financial institutions in modern financial system and determine their place in national financial intermediation. Peculiarities of functioning cooperative financial institutions in world practice are studied and their basic similarities are identified. Need for formation and development of cooperative financial institutions of 2nd and 3d levels, particularly the cooperative banks in national practice is substantiated. On the basis of studying the international experience of countries with different levels of economic development, conditions of formation and activities of cooperative bank institutions in the domestic practice have been determined.
Celem tej pracy jest analiza roli spółdzielczych instytucji finansowych funkcjonujących we współczesnym systemie finansowym oraz określenie ich miejsca w krajowej interwencji finansowej. Specyfika funkcjonowania spółdzielczych instytucji finansowych podlega badaniom światowej praktyki a podobieństwa między nimi są identyfikowane. Uzasadniona jest więc potrzeba rozwoju spółdzielczych instytucji finansowych na drugim i trzecim poziomie, zwłaszcza w odniesieniu do banków spółdzielczych w praktyce krajowej. Na podstawie przeprowadzonych badań określone zostało międzynarodowe doświadczenie krajów o różnych poziomach rozwoju, różnych warunkach tworzenia oraz działania instytucji banków spółdzielczych w praktyce krajowej.

This article is an attempt to establish the level of Internet use in a business activity by managers of social cooperatives operating in Lower Silesia. Social cooperatives as a form of social enterprise must maintain a profitable business activity. Only this way they can provide jobs for people facing social exclusion, which is their primary objective. To make this possible it is necessary to take market orientation approach so also compete with other for-profit entrepreneurs. The article discusses the results of authors’ research about on-line business activity of social cooperatives in Lower Silesia and compares them to the results of an analysis carried out for the small and medium enterprises sector. This sector was chosen as a control group because of similarities between it and the social enterprises sector. The conducted analyzes show a lower level of social cooperatives on-line business activity especially among the newly created entities.

The keynote of this article is the thesis of the need for development of new competencies, a new approach to business, particularly new attitudes in the face of the contemporary, socioeconomic and cultural reality. This reality, implied by the globalization process, requires the use of appropriate cognitive approach in search of answers to the question of what rules- teleological or causality – and, therefore, what structures determine globalization. Subordination structure, reducing the freedom and initiative of a person, or interaction structure, creating the conditions conducive to creativity and innovation. Considerations lead to the conclusion that the structure which should be distinguished is that, where people in power will always strive to petrify the relationship of subordination, and thus the diversity and multiplicity of forms of human behavior will be treated as a threat. There is also the second type of the structures of globalization, which is dominated by openness to the reality of actually existing diversity of its forms and manifestations. These structures, which remain in a synergistic system to each other, release both the energy of the progress of civilization and the specific risks of globalization. This is demonstrated by the impact of technological progress and development of technoscience shaping contemporary reality of socio-economic and cultural globalization

In conditions of diverging from the model of the permanent employment we can find in the Spanish economy a successfully operating cooperative corporation Mondragón. - even in the period of economic recession. One of the main goals the corporation aspires to achieve, besides the maximization of the profit, is rising the level of the job security and creating new places of employment. The article discusses the most important characteristics of the model of employment in Mondragon Cooperation. In the article a hypothesis was constructed that solutions in the employment accepted in the Basque cooperative corporation support the rise of level of the job security even in the period of an economic crisis. In the result of conducted research the assumption was confirmed.

Post-crisis bank regulations recognised the need for a creation of a formalized resolution framework which would allow for an efficient resolution of troubled banks, with no or limited use of public funds. However, the resolution schemes are based on complex procedures, which aim at balancing the interests of different stakeholders. The purpose of this paper is to identify and assess the key elements of the resolution framework under the Single Resolution Mechanism (SRM) and the Bank Recovery and Resolution Directive (BRRD), concentrating on the bail-in tool. In particular, the paper attempts to demonstrate that there are some serious economic and social problems, when the resolution procedures are applied to local and regional banks, such as the cooperative sector, illustrating it with the bank resolution experience in Italy.
