The article presents the thought of Father Dumitru Staniloae ( t 1993), one of the most outstanding Romanian theologians of the 20th century, based on his book Poztia d-lui Lucian Blaga fata de Crestinism si Ortodoxie (The Attitude of Mr. Lucian Blaga toward Christianity and Orthodoxy) Sibiu, 1942. The author begins by expounding the general character of the universal religious phenomenon. Beyond the multiplicity of the forms and the ways in which religion is manifested there are certain common points. Fr. Staniloae distinguishes five such specific elements typical for religion: 1. a strong and steadfast faith in the truth of the things it professes; 2. the personal character of the ultimate reality; 3. there is a certain differentiation a believer makes between these ultimate realities with a clear and less clear personal character and nature - even though sometimes the divine reality is perceived in an extremely intimate relationship with nature, each religion preserves an awareness that the divine reality is something else than nature itself; 4. the belief in the self-revelation of the divine reality - it is a universal conviction with the believers of all religions that the Divinity revealed and reveals Itself and the data about It are not a figment of the human mind or imagination, a self-revelation of the human spirit; 5. a certain expectance, confidence and hope with which man ties himself up to the Divinity in as far as his destiny is concerned. The universal human consciousness expects and believes in man’s salvation from under the destructive power of nature or of certain evil forces. Expectation is a deep instinct of the human nature; faith is the mysterious power given to man at the same time with any religion. There is also a functional interpenetration of these elements. Faith without a personal God and without revelation cannot exist, nor without the presence of a purpose, as that of the salvation of existence. Their persistence reveals the existence of a personal relationship between God and man in the interest of his salvation, as well as man’s firm belief in the possibility of a personal salvation and in a special communion with God and, as a result, that there is also an interest on the part of God to save man. Faith and revelation are conveyed from generation to generation, but at the same time faith is largely produced by revelation, each man experiencing in a mysterious way the pressure of the ultimate reality upon his conscience. All kinds of theories have been conceived which see religion as originating from the divinization of the forces of nature, society, or a political leader etc. In reality however religious experience distinguishes the divine from all these phenomena, even though it may have the experience of the divine presence and of its power in connection with them. Religious experience is an awareness of the mysterious presence of the Divinity and as such any religious man knows the difference. In the case of the religious phenomenon we come across a minimal realization and participation of the ultimate reality pertaining essentially to the faith in the Divinity, to its revelation and to the hope in a personal salvation as a common minimal background of all religions, and as such of the Christian Faith. Fr Staniloae draws our attention to the fact that what counts in the relation among religions is not this minimal background but the contribution of each religion. In his attempt to draw a line between Christianity and the other religions, he asserts that everything the non-Christian religions possess in addition, as a surplus, is either a jungle of myths, or a resuscitation in different manners of the same minimal background which make up the universal religious conviction. Myth is a human invention bom of his endeavour to capture in image the basic fact of the Divinity and of Its revelation; hence a poetic and personalized expression of what is known through the general revelation, or a personalization of a power in nature or of a personal attribute. Christianity differs radically from these religions, because by the surplus it asserts, it testifies to an essential increase in the divine revelation. We have in Christianity the full revelation of the Divinity, as well as the manifestation of Its personal character as God has come as a man among men. Christianity is an entirely different religion in so far as the awareness of the nearness of the divine reality is concerned, as the only religion dominated by the awareness of an increase - to the last possible extent - in the divine revelation, without imposing a new element to the general definition of religion. Moreover, Christianity is not a religion of myths. This is due to the fact that God’s presence in the world, as a perceptible and active reality, renders futile all myths: when the divine reality is so close to us and so commanding, there is no longer any place for myths. At the same time there is no attitude which embraces all parts of the Universe with so much love and appreciation as does Christianity, because all are the work of the hands God and the object of His fatherly care.

Examples of scandals related to exposing the unethical practices of companies which are classified as CSR leaders include cases where their declarations on undertaking social responsibility, as well as spending a lot of money on spectacular social campaigns and then rigorously reporting it in the appropriate documents, are accompanied by acts of abusing workers’ and environmental rights, misleading customers, i.e., abusing consumer rights, and finally “tax optimisation”, which generates measurable losses to the local communities. These cases raise the question about the reason for corporate social responsibility not being immune to abuse or opportunities to treat it as merely an image-related issue. The problem is presented using Max Weber’s widely known typology. It contrasts the ethics of conviction (ruled by the principle of intentionally keeping to the rules which have been adopted as being right) with the ethics of responsibility for the consequences of actions, including those that were undertaken in good faith but which have unintentional consequences. The usefulness of Weber’s typology when considering CSR problems becomes evident when we notice that the dominant interpretation of the corporate social responsibility concept, with its characteristic emphasis on voluntariness and positivity of actions within CSR, brings this concept closer to the ethics of conviction model. Voluntary actions in the field of CSR should go beyond carrying out regular goals of economic activities, i.e., the maximisation of profits, by providing good quality, desirable goods and services. However, what should be considered a prosocial activity –and thus, social responsibility –remains unclear in some companies. In accordance with the thesis of the paper, this ambiguity is one of the important factors that create discrepancies between declarations and real corporate activities. As we can see, the focus on voluntarily doing good which has been adopted in the current interpretation of CSR pre-empts the pursuit to avoid bad practices, both in theory and in the implementation of CSR programmes. Moreover, the CSR-dominant interpretation leads to a particular terminological confusion and replaces the companies’ responsibility towards concrete stakeholders, which is appropriate for the economic activity, with an abstractly understood responsibility towards an abstractly understood society. In this sense, the conceptual analysis of the relationship between CSR and ethics reveals that one of the important sources of problems with CSR is joining this concept with an unsuitable model of ethics. This is not because of the alleged defects of the ethics of conviction, appreciated by Weber, among other thinkers, but because it is a model that, in fact, is not suitable for business ethics. If the ethics of conviction is private, then it cannot be used to regulate social relations. In conclusion, it may be stated that, paradoxically, a dominant way of thinking about the social responsibility of corporations leads more to separation than to bringing together ethics and business. CSR, in its current form, cannot be an efficient means of implementing ethical objectives in business because it defines the issue of social responsibility as a sphere of private beliefs and arbitrary interpretations. Therefore, it undermines the relevance of the proper and socially significant notion of responsibility for economic activities and their consequences. Of course, the CSR concept can and should be modified; the question remains as to whether eliminating the elements that bring it closer to the ethics of conviction does not actually translate into giving it up entirely.

Poland belongs to the circle of European states in which it is permitted that the participants of penal procedure can come to agreement. The codification of 6th June, 1997, introduced two reforms of consensual complementary dispute resolution: conviction without a trial in art. 335 of penal code and conviction in line with the limited trial in art. 387 of penal code is defined by a common term of entering a no contest plea. In principle, the goal of the institution under discussion is to accelerate and make more effective the penal trial. If in technical literature this institution was generally accepted, in practice, despite the fact that it has been functioning for 14 years, it still arouses doubts. It follows mainly from the fact that there is no unanimous regulation of the rules. One should pay special attention to the fact that the aggrieved party has not been taken into consideration in art. 335 of the code of criminal procedure. One should then postulate to change this regulation because in practice it leads to abuses.

Opis:
This paper touches upon an important issue in practical application of law, i.e. aggregate sentence under the laws changed during the great reform of criminal law and criminal procedure. An often highlighted aspect of the said issue is the normative nature of the construct of the aggregate sentence, whose correct theoretical understanding, in the author’s opinion, helps in solving some of the problems with interpretation encountered by scholars. A particularly important issue raised within that area is the negative premise contemplated in Article 85 § 4 of the Polish Criminal Code, and especially the said provision of law, making the wording of the norm requiring the imposition of an aggregate sentence more adequate. Clear highlighting of statutory decoding of the legal definition of the term “conviction” used in Article 114a CC and the importance of the implication of this drafting technique, allows the author to make a clear statement as to the possibility of combining the sentences passed in countries that are not the EU members.

Głównym celem naukowym niniejszego opracowania jest przedstawienie i analiza zmodyfikowanychprzez nowelę z 14 października 2021 r. przesłanek orzeczenia pozbawienia prawpublicznych zawartych aktualnie w art. 40 § 2 k.k. Rozważania wstępne koncentrują się naprzedstawieniu istoty i znaczenia wymienionego środka karnego w systemie środków karnychokreślonych w Kodeksie karnym. Zaprezentowano stan prawny w tym zakresie obowiązującyprzez nowelą i wskazane przez projektodawców przyczyny dokonanej modyfikacji ustawowej.W związku ze zmianą prawa w obrębie przesłanek orzeczenia pozbawienia praw publicznychpodjęto próbę skonfrontowania i wzajemnej relacji aktualnych przesłanek. Rozważania w tymobszarze pozwoliły na sformułowanie wielu wniosków krytycznych w odniesieniu do wprowadzonychzmian legislacyjnych i stanowiły asumpt do wysunięcia postulatu de lege ferenda.
The main scientific aim of the article is to present and analyse the amendment of 14 October2021 to the prerequisites of disfranchisement laid down in Article 40 § 2 CC. The initialconsiderations focus on the essence and significance of the aforementioned penal measure inthe system of penal measures determined in Criminal Code. The article presents the legal statebefore the amendment and the reasons for the amendment presented by the authors of the bill.As concerns the change of law within the scope of prerequisites of disfranchisement, the articletries to confront the mutual relationships of the present prerequisites. The considerations madeit possible to formulate a series of critical conclusions concerning the legislative changesintroduced and constituted and impulse to put forward a proposal de lege ferenda.

Punishment with imprisonment and the security measureof detention on remand, are among the most severe sanctions and convictions provided by the albanian criminal legislation. The unjust serving of such measures or punishments implies serious psychological and economic consequences for both the convicted person and his/her family members. Similar to the infringement of any right and freedom, the unjust infringement of the right to liberty, induces the obligation to return the person in the previous state and to provide compensation for related consequences. Besides the right to effective remedy, the international human rights acts provide, specifically, for the right to compensation of the person in cases of an unlawful arrest or detention, as well as in the case of serving an unjust punishment as a result of the miscarriage of justice. In both hereof mentioned cases, these acts acknowledge the right to compensation for unjust imprisonment, while leaving it to the member states to establish a special mechanism under the domestic legislation which would enable actual fulfillment of such right for the citizens of the said country. This paper is an attempt to present an overview of the Albanian legislation regarding the mechanism established toward the effective implementation of the right to compensation, in the case of decisions of the respective state institutions causing the unlawful or unjust imprisonment, from the point of view of respective international obligations.

W artykule przedstawiono istniejące w polskiej procedurze karnej formy konsensualizmu procesowego. Opisane zostały przesłanki wystąpienia z wnioskami o skazanie bez rozprawy (art. 335 § 1 i 2 Kodeksu postępowania karnego), warunki dobrowolnego poddania się odpowiedzialności karnej oraz instytucji przewidzianej w art. 338a Kodeksu postępowania karnego. Przedstawiona została również ewolucja uprawnień osoby pokrzywdzonej przestępstwem w kontekście rozwiązań konsensualnych oraz realizacja celów postępowania karnego w odniesieniu do wspomnianych trybów. Uwzględniając zmiany wprowadzone przez ostatnie nowelizacje podkreślono rolę porozumień, wskazując ich liczne zalety, zastosowanie w praktyce oraz konsekwencje, jakie wywołują w kolejnych etapach procesu. Zwrócono także uwagę na postępowanie mediacyjne, jak również na przejawy porozumień procesowych w innych aktach prawnych, do których należy zaliczyć między innymi umorzenie restytucyjne.
The article presents the existing forms of the consensus agreement in the Polish criminal procedure. The paper covers the description of premises of the motion to be convicted without a trial (art. 335 § 1 and 2 of the Code of Criminal Procedure), conditions of voluntary submission to criminal liability and the institution provided for in art. 338a of the Code of Criminal Procedure. The evolution of the rights of the aggrieved within the consensus agreements and the execution of the aims of the criminal procedure with respect to abovementioned types have been also presented. Considering the changes introduced by recent amendments, the role of the consensus agreements has been emphasized, including their multiple advantages, their practice and the consequences which arise in further stages of the proceedings. One shall also pay attention to the mediation procedure, as well as the indications of consensus agreements, including among others the compensatory (restitution) discontinuation, in other legal acts.
