On the basis of the current legislation in relation to the issues of the second chapter of the Constitution (Human rights), the Constitutional Court of Georgia considers only the issue of the constitutionality of the content of normative acts and considers the appeals as inadmissible where the violation of rights is derived not from the content of the norm but its misuse in practice. This approach extends as well to those cases when the violation of a person’s rights is caused by incorrect interpretation of the norm by the court and improper use in the process of legal correlation. The Georgian Legislation does not grant to the Constitutional Court the authority to consider the indicated issue. The indicated issue is a legal problem to the extent that the initial point of the democratic states is to defend the human rights and correspondingly, the primary goal of the constitutional control should be the restoration of the human rights violated by the state structures (authorities). However, the recent precedential law gives us a possibility to make the conclusion that the General Courts in a number of cases define the law contrary to the Constitution, and the Constitutional law is powerless to restore the right of the person whose right was violated by the action of the judge of the court. The aim of this article is to analyze advantages and disadvantages of real-life constitutional appeals and prove importance of granting to the Constitutional Court of Georgia the authority of considering the “realistic” constitutional appeals.

The constitutional complaint under review questioned the constitutionality of a provision of the Act on Detective Services which stipulates that a person who in the course of providing detective services performs activities statutorily reserved for state bodies and institutions is liable to a fine. In the opinion of the author, the questioned provision does not violate the principle of definiteness of criminal law provisions. The use of a GPS locator by a detective may be treated as secret acquisition and recording of data contained in computer data carriers. The challenged provision was assessed as conforming to the Constitution.

Constitutional principles and norms are the basis of the environmental policy of the Belarusian state at the present stage of its existence. They determine the limits, intensity, methods of its implementation, the degree of participation in the implementation of environmental policy of both the state bodies and civil society institutions. The scientific methods of cognition used in the research include analysis, synthesis, abstraction and comparative method. The study concluded that environmental protection in the Republic of Belarus is a set of measures, a system of state, international and public measures for the rational use, protection and restoration of natural resources, protection of the environment from pollution and destruction in order to create the most favourable conditions for the existence of human society, to meet the material and cultural needs of both living and future generations based on the constitutional principles and norms. Environmental protection can be considered as an independent constitutional principle underlying the modern policy of the Belarusian state.

In view of the constitutional crisis that has been going on since 2015, the issue of locating the Supreme Court and the Constitutional Court within the system of State organs seems to be particularly important. One of the questions that should be answered is to what extent the ideas adopted in the 1990s appear to be helpful for the proper positioning of the Supreme Court and the Constitutional Tribunal within the system. The issue of the origins of the aforementioned ideas should also be examined. Answering these questions enables the identification of essential problems related to the way in which the legislator shaped the relationship between the Constitutional Tribunal and the Supreme Court. The topic of this paper is to present the general assumptions the legislator relied on when setting the position of the Constitutional Tribunal, and the question of whether these assumptions remain fully valid – especially with regard to the possibility of reviewing the interpretation of the Supreme Court.

The subject of this article is the institution of the constitutional complaint, which is analysed in connection with European integration. It should be noted that Poland’s membership of the European Union has had a great influence, not only on the system of national law, but also on the jurisprudence of the Polish Constitutional Tribunal; therefore considerations are carried out here mainly in relation to the Constitutional Tribunal.            In examining the issue of the constitutional complaint, the following assumptions may be stated. First, the constitutional-complaint procedure, is in fact, the examination of the compliance of legal norms with the Constitution, any deviation being related to the entities initiating proceedings before the Constitutional Tribunal, Article 191(1)(6), of the Constitution[1], and to the material scope of the complaint, as determined in Article 79 of the Constitution. Second, there is no doubt that the constitutional complaint can become an important legal instrument shaping the jurisprudence of the Polish Constitutional Tribunal, which has to face constitutional issues related to European integration[2]. Following the example of the practice of other Member States, e.g. Germany, the Tribunal may use the institution of the constitutional complaint as a means of controlling the compliance of the secondary law of the European Union with the Constitution of the Republic of Poland.   [1] The Constitution of the Republic of Poland, Journal of 2 April 1997, Journal of Law 1997, No. 78, item 483, as amended. This article aims to analyze abuse of a country’s constitution as a unique means by which fundamental changes can be introduced to the country’s political system. The term “abusive constitutionalism” is used to discuss the shift of the political system toward decreased democracy by means of changes to the constitution, as in the case of Hungary. In contemporary Poland, abuse of the constitution has entailed the creation of a parallel system via ordinary legislation passed rapidly by a simple parliamentary majority. The thesis of this paper is that “abusive constitutionalism” and an “abused constitutionalism” stem from a crisis in liberal democratic constitutionalism as a motivating force and moral signpost in the public sphere. In the place of democratic constitutionalism, there has been a return to emotion-laden conceptualizations of the political community. Primordial bonds, unquestioned traditional values, and founding myths are perceived as more meaningful than the law and the constitution. This sort of return to the past has its historical validation, but it is also a reaction to the growing complexities of the contemporary world and its risks. Another important empirical context for abusive constitutionalism is the negative constitutional consensus of a passive electorate. One indicator of a negative constitutional consensus is the population’s lack of interest in the democratic functioning of the public sphere.

The recent legal changes pertaining to the institution of the Constitutional Tribunal arouse many controversies. This paper presents a sociological and legal study conducted to collect and examine the opinions regarding the above held by Polish lawyers who because of their profession and experience are in a position to confront directly the legal practice with the changing legal system that is directly responsible for the level of protection of individual rights and the exercise of individual fundamental rights. From the point of view of rationality and functionality of the operations of the Constitutional Tribunal an opinion formulated by jurists who due to their background have greater legal awareness seemed invaluable. After all it will be their opinion which will decide about the future of the judiciary in Poland. The results of the current transformations being implemented in constitutional judiciary as well as at the level of common courts have consequences for all the citizens. The aim of the questions asked in the survey was to fi nd how lawyers in Poland saw the situation with the Constitutional Tribunal today as well as what the though it its regime and functioning could be like in the future. Questions also concerned the current and actual legal status of the Tribunal and the lawyers’ reactions to the changes being implemented or about to me made, and if possible the possible ways of ending the current Constitutional Tribunal crisis.

The use of references to foreign law and jurisprudence by the constitutional courts around the world currently gains more and more attention from scholars. The admis-sibility and usefulness of conducting such a horizontal dialogue between various juris-dictions raises controversies in other countries, but not in Poland, where no significant academic discussion on the legal basis and justification for using comparative arguments in constitutional jurisprudence has been conducted. The reasons for this lack of contro-versy seem to lie in the roots of the 1997 Constitution, and the way in which the Polish legal system is constructed. The Polish Constitutional Tribunal is quite prone to using comparative references in its reasoning. However, it rarely clearly indicated their role or significance for the resolution of the case before it. The analysis of the case-law of the Tribunal indicates that references to foreign law concern constitutional provisions, legislation, and the judgments of other constitutional courts. The purpose of the refer-ences stresses the universality of particular constitutional norms and deciphering their meaning, as well as gathering data significant for the assessment of the proportionality of a national law, as well as at drawing inspiration from the decisions taken by foreign courts. However, the persuasive use of a comparative argument demands that the meth-odological problems which can be noticed in the case-law should be addressed. They in-volve in particular: the need to justify the choice of comparative material that is analysed, the fragmented nature of the analysis, and the lack of a clear indication what role these kind of arguments have in constitutional argumentation.

This article examines the process of the judicial Europeanization of the Polish Constitution. In Poland the judicial method of Europeanizing the Constitution is currently the primary way of adjusting constitutional norms to requirements resulting from EU law. The phenomenon of re-interpretation of constitutional provisions in light of the new and changing realities is a characteristic feature of contemporary constitutionalism. It has been a long time since most national constitutions have undergone significant textual changes. In Poland, the scope of judicial Europeanization of the Constitution is connected, to a great extent, with the inflexible procedure required for constitutional amendments. In this situation, these so-called “silent changes” of constitutional norms are the easiest and fastest way of reacting to requirements stemming from Poland’s EU membership. In the Polish case not only have the norms regarding the political system of the state changed, but also constitutional standards relating to the protection of fundamental rights and freedoms have undergone the process of the Europeanization. To some extent, these changes relate to procedural norms as well.

This paper debates abusive constitutionalism and constitutionalism abused as ways to introduce a fundamental change of political system. Abusive constitutionalism consists in a change of a democratic regime in a less democratic one with the help of democratic means, i.e. democratically legitimized change of the existing constitution, or proclamation of a new constitution, as it recently happened in Hungary. An example of abused constitutionalism presents contemporary Poland. There the fundamental change of democratic regime happens notwithstanding the still binding constitution, as in an oblivion of it, by the means of ordinary laws proclaimed in a rush process by the ruling parliamentary majority. The whole process is steered in an informal way by the chairman of the ruling party. The important context of abusive constitutionalism, and of constitutionalism abused, as I am going to argue, presentst he crisis of liberal constitutionalism, the loss of its motivational force as a moral sign-post in the public sphere. Instead, one observes a retreat to some primordial and emotionally laden conceptualizations of a politically organized community (a Gemeinschaft) where emotions, primary bonds, foundational myths are more important than law and liberal constitution. Such a retreat results from the past but also presents a reaction to the growing complexity of the contemporary world, and involved risks.

Russia’s continuing aggression against Ukraine is exceptional both in terms of its scale and its global implications. A peaceful and prosperous future for Ukraine, neighbouring states and indeed the entire continent, depends upon two interrelated factors. The first is Ukraine’s ability to win, with Western support, the war initiated against it by the Russian Federation under Putin. This would bring about a new global opening, ending the Moscow-Beijing anti-Western axis in world politics. The second factor is Ukraine’s ability to take advantage of the constitutional moment that will present itself as attention shifts from the military effort toward the process of state reconstruction. Presenting the situation of Ukraine in regional, historical, and global context, we draw attention to specific challenges and choices that state elites will face post-war. We explain the internal and external implications of these choices to show why Ukraine should seize its upcoming constitutional moment. Drawing on both political theory and real world examples of constitutional revolutions, we explain the factors involved in the effective exploitation of the constitutional moment. We suggest that, channelled to constructive purposes, the demands and aspirations of Ukrainian citizens may help propel the political and economic reforms needed to secure social trust and a stable future. We conclude that multi-level political and civic engagement in a new constitutional process will be indispensable for reconstructing the institutional foundations for peace, democratic governance and the rule of law in post-conflict Ukraine.

The article focuses on Russian constitutional ideology with overview of its historical preconditions and analysis of recent significant cases of the Russian Constitutional Court. There is a discussion of gay activist Alekseyev’s case and “foreign agents’ law” case in constitutional practice as most significant examples of positivistic way of legal reasoning. The paper argues that legal positivism through its form – legal formalism is the main ideology in the modern constitutional practice in Russia. This ideology is based on the assumption that constitutional justice can find social truth. German positivistic and Soviet Marxist views have strongly determined the modern Russian constitutional discourse.
