    Artykuł podejmuje zagadnienia w ostatnim czasie bardzo żywo dyskutowane i ważne dla środowiska ludzi zajmujących się ochroną szeroko pojmowanego dziedzictwa. Po porządkującym przypomnieniu podstawowych pojęć oraz współczesnej teorii konserwacji-restauracji omawia kwestie wartościowania jako podstawy i warunku prawidłowego planowania prac. Autorka przedstawia doświadczenia z kartą zabytku jako narzędziem umożliwiającym porządkowanie procesu wartościowania, a zarazem prezentowanie jego wyników w formie syntezy czytelnej nie tylko dla specjalistów. Drugą część artykułu stanowią rozważania nad zagadnieniem przydatności dla pielęgnacji zabytkowych parków i ich konserwacji Siedmiu zasad konserwatorskich – „drogowskazów” wypracowanych na potrzeby konserwacji-restauracji dzieł sztuki.
    This article focuses on issues that are widely discussed in recent times and important for the specialists who deal with the preservation of broadly understood heritage. After providing an ordering reminder of basic terms and contemporary theory of conservation and restoration, the article discusses the issues of evaluation as the basis and condition for correct planning of works. The author presents experimental studies with the ‘monument record sheet’ as a tool allowing the ordering of the valuation process and showing its results in a form of synthesis that is intelligible not only for specialists. The second part of the article includes considerations regarding the issue of usefulness of the Seven Principles of Conservation – guidelines elaborated for the purpose of conservation and restoration of fine arts – while maintaining and restoring historic parks.

    Opis:
    The paper discusses ethical guidelines in relation to the conservation of historical monuments made of stone. The presented rules consider the building stone specificity and its susceptibility to various corrosion factors and the character of deteriorated areas in that kind of historic monuments. The basic conservation rule sounding Primum non nocere is deconvoluted to more particular principles like: (i) to preserve authentic historical matter as a carrier of artistic, scientific and historical value of the object, (ii) to provide minimal scale of intervention, (iii) to provide the reversibility of the methods and particularly materials used from conservation or reconstruction works, (iv) to provide distinguishability of reconstructions parts and (v) to provide the integrity of the work of art. The adaptability of these particular rules to the of conservation of stone artistic artefacts is also presented.

    The article deals with an interesting debate following a project that started with the question raised by the press: “Why not overpaint or reconstruct the missing parts of a famous wall painting?” and concluded with a panel discussion that conveyed a better understanding of restoration theories on the part of both the press and the parish. Moreover, part of the project featured an exhibition to communicate the basis of our restoration theories and understanding, whilst requesting a dialogue with the priest and the parish; so, they might communicate their intentions and opportunely discuss theological interpretations with regard to the missing part in the wall-painting, which was important for us in reaching an understanding of the principles behind their ideas.

    Przedmiotem niniejszego opracowania jest analiza współczesnej roli deontologii konserwatorskiej wraz z odniesieniem do znaczenia moralnych zasad ochrony dziedzictwa sztuk wizualnych na linii czasu. Celem badań jest aktualizacja roli etyki konserwatorskiej zarówno w każdym indywidualnym przypadku, jak i w głębszym rozumieniu znaczenia etyki sensu largo. Rozważania o etyce w ochronie zapisu obecności człowieka oparte są na nadziei na trwanie dziedzictwa sztuk wizualnych „jak długo będzie istniał świat”. Od zarania cywilizacji homo sapiens kierował się instynktem zachowania spuścizny przodków. Przykład przetrwania sztuki w jaskini Chauveta sprzed ponad czterdziestu tysięcy lat ukazuje, że od początku w centrum zagadnień cywilizacyjnych jest relacja obiektu i człowieka, który zajmuje się ochroną dziedzictwa wytworzonej przez siebie kultury. Współczesne spojrzenie na dziedzictwo sztuk wizualnych opiera się na zrozumieniu oświeceniowego kontekstu powstania deontologii konserwatorskiej i aktualizacji jej znaczenia. Analiza kluczowych teorii przedstawia różne podejścia konserwatorskie, w tym traktowanie zabytków ruchomych i nieruchomych i innych dóbr kultury, m.in. sztuki współczesnej. Zrozumienie zasad postępowania i rozszerzonych filarów teorii konserwatorskich toruje drogę do wzmocnienia badań naukowcom, konserwatorom, ekspertom i studentom. Deontologia leży u podstaw ich pracy. Wpływa także na praktykę w szerokim zakresie dziedzictwa, dóbr kultury, sztuki autograficznej w tradycyjnych dyscyplinach, jak i sztuki allograficznej. Artykuł ten ma rozszerzyć zakres teorii związanej z ochroną sztuk wizualnych, ich praktyczną konserwacją, restauracją, ekspozycją i adaptacją we współczesnym, partycypacyjnym społeczeństwie, a także zaangażować odbiorców. Kto chce kształtować przyszłość dziedzictwa, powinien tworzyć ją dzisiaj, opierając się na zasadach etyki.
    This study analyses the contemporary role of conservation ethics with regard to the importance of applying moral principles to preserve the heritage of the visual arts over time. The aim of the study is to update the role of conservation ethics both in individual cases and in the meaning of ethics in broad terms. Taking ethical considerations into account when safeguarding records of human presence is based on the hope that the legacy of the visual arts will last for ‘as long as the world exists’. Since the dawn of civilization, man has been driven by the instinct to preserve the legacy of his ancestors. The example of the survival of art from more than forty thousand years ago in the Chauvet Cave shows that from the beginning, the relationship between objects and man – who is concerned with preserving the legacy of the culture he has created – has been a central issue for civilization. Looking at the heritage of the visual arts from today’s standpoint is based on understanding the emergence of conservation ethics in the context of the Enlightenment, and updating its meaning. An analysis of the key theories reveals there are various approaches to conservation, including the treatment of movable and immovable artefacts and other cultural assets, including contemporary art. Understanding the rules of conduct and the broadened approach to conservation theories paves the way for scholars, conservators, experts and students to enhance their research. Deontology, i.e. ethics, lies at the heart of their work. It also influences the practices across a wide range of heritage, cultural property, autographic art in traditional disciplines, as well as allographic art. This article is intended to expand the scope of the theory related to the preservation of the visual arts, their practical conservation, restoration, display and adaptation in today’s participatory society, as well as to involve viewers. Those who want to shape the future of their heritage should create it today based on ethics.

    By the judgement of 8 May 2018 (II OSK 1926/17), the Supreme Administrative Court dismissed the cassation appeal of the Lublin Provincial Heritage Conservation Officer against the judgement of the Voivodeship Administrative Court in Lublin of 6 April 2017 (II SA/Lu 1119/16), in which the Court found ineffective inclusion of a real estate monument record card (the area of the former Jewish cemetery in Biłgoraj at Maria Konopnicka Street) in the provincial record of historical monuments. The Supreme Administrative Court stressed that although the judgement under appeal was incorrectly reasoned, it was in accordance with the law since there were grounds for declaring the contested act ineffective. The aforementioned judgement deserves attention due to the fact that it expresses the position that it is impossible to apply the general principles of the Code of Administrative Procedure in the proceedings conducted by the provincial heritage conservation officer concerning the inclusion of the record card of a historical monument in the provincial record of monuments. The purpose of the gloss is to refer to this view.
    Wyrokiem z dnia 8 maja 2018 r. (II OSK 1926/17) Naczelny Sąd Administracyjny oddalił skargę kasacyjną Lubelskiego Wojewódzkiego Konserwatora Zabytków od wyroku Wojewódzkiego Sądu Administracyjnego w Lublinie z dnia 6 kwietnia 2017 r. (II SA/Lu 1119/16) stwierdzającego bezskuteczność czynności polegającej na włączeniu do wojewódzkiej ewidencji zabytków nieruchomości położonej w Biłgoraju przy ul. Marii Konopnickiej jako obszaru byłego cmentarza żydowskiego. NSA podkreślił, że choć zaskarżony wyrok został wadliwie uzasadniony, to odpowiada prawu, gdyż istniały podstawy do stwierdzenia bezskuteczności zaskarżonej czynności. Wyrok NSA zasługuje na uwagę, ponieważ wyraża stanowisko o braku możliwości stosowania przepisów ogólnych Kodeksu postępowania administracyjnego w postępowaniu prowadzonym przez wojewódzkiego konserwatora zabytków w przedmiocie włączenia karty ewidencyjnej zabytku do wojewódzkiej ewidencji zabytków. Celem glosy jest rewizja tego poglądu.
