Inspired both by the phenomenological thought of Karol Tarnowski and Józef Tischner and the personalist theology of Czeslaw Bartnik, the article fits into contextual soteriology which deliberately uses the method of correlation. The aim of this article is to present the Christian meaning of salvation in the context of one of the most moving existential experiences, that is the experience of anxiety (Angst). The indelible phenomenon of anxiety raises important soteriological questions: Who or what can bring the fullness of salvation to men and women? In what circumstances is the experience of salvation possible to the human being who is called an “anxious existence”? The first part of the article shows the essential difference between anxiety and fear (in contrast to fear, the matter of anxiety is real but indeterminate). The second part presents an ambivalent character of anxiety (anxiety can lead to despair or to salvation) and human attempts to overcome anxiety through falling into an inauthentic existence (a utopia of “salvation by fashion”). The third part characterizes an “eschatological conscience” (a conscience filled with anxiety of tragic finality) and its antithesis in the form of a “soteriological conscience” (a conscience which is open to the possibility of salvation coming from God). The last part of the article argues that the phenomenon of authentic interpersonal encounter is a necessary condition to experience the salvation coming from God in Christ.

Przedmiotem artykułu jest wadliwość sumienia. Część pierwsza prezentuje wybrane koncepcje sumienia oraz praktyczne skutki ich przyjęcia. W dalszej kolejności przedstawiona jest argumentacja na rzecz tezy, że zachodzi konieczny związek między przekraczaniem błędów sumienia a rozpoznaniem obiektywnej wartości dobra moralnego. Ostatnia część artykułu została poświęcona zakłamaniu, które oparte na błędnej koncepcji sumienia, stanowi jego najbardziej oporną na zmiany deformację.
The paper concerns the defectiveness of conscience. I start with description of conscience’s concepts and the practical results of its acceptance. Then I argue for the thesis that cognition of moral good’s objective value is necessary for the overcomings defectiveness of conscience. Finally I formulate the concept of mendacity as the form of conscience defect the most resistant to changes.

Decoupling has been diagnosed since the second half of the last century. It is conceived as a kind of separation, appearing in a variety of organisations, in situations in which established principles or rules, aimed at normalising interpersonal relationships or governing the rules of conduct, despite being officially established, are  not implemented. Another situation may also occur. It arises when individuals know and accept the guidelines, but for multiple – often subjective – reasons, they do not materialize as they are blocked by individual decisions. This results in serious consequences of a social, economic, legal or managerial nature. How they be prevented? Solutions based upon ethics seem to be a sound base to counteract the destructive consequences of decoupling. Human conscience is one of the fundamental ethical categories. Deep rooted in every person, it shapes behaviour, even though its impact can also be minimised. It turns out that a properly formed conscience gives better results in personal activity on both the individual and human levels. Also, conscience enables the correct interpretation of what is prohibited and what is expected, and thus becomes the perfect tool for countering decoupling. Finally, it can be assumed that as long as man has a well-constituted conscience and follows its guidance, the negative effects of a split between the recognized rules and their actual observance can be minimised.

Opis:
Discussion of the conscience clause at schools concerns the possibility to refuse the teacher’s actions incompatible with his conscience. This possibility, though questioned by many as unlawful, results from Polish legislation and international law. It is a consequence of freedom of conscience guaranteed by the Constitution of the Republic of Poland and a number of international and national legal acts. There are many situations in which reveals the conflict between the duty of performing a given program or command of educational authorities and their own convictions. They concern mainly the same vision of the school and its functions, school programs and the underlying concept of the human being and interpersonal relationships at the level of professional work of the teacher. In all these situations, the teacher should be a person of conscience, i.e. to follow his voice, which sometimes means opposition to the content of curricula and textbooks, orders of superiors or the prevailing customs.

The object of this paper is to provide an opinion on the regulation of conscience clause in relation to doctors, nurses and pharmacists under Italian law. The opinion was based on the legislative texts available on the websites of the Italian government and the Ministry of Health. Conscience clause is governed by Article 9 of Legge 22 maggio 1978, Norme per la tutela sociale della maternità e sull’interruzione volontaria della gravidanza (Legge 194/1978), under which a doctor or nurse may re‑ 194/1978), under which a doctor or nurse may refuse to provide and participate in carrying out abortions, should they submit a statement – subject to Article 5(3). Conscience clause is governed by Article 16 of Legge 19 febbraio 2004, n.40 standard in materia di procreazione medicalmente assistita (Law 40/2004), under which a doctor or nurse may refuse to participate in medical procedures and assisted conception treatments.

Contemporary organizations are one of the most important actors in social life. This is particularly true of business organizations whose activity often has extremely moral consequences. The aim of the paper is to present the problem of moral subjectivity and reflection on the possibility of recognizing an organization as a moral subject. The basis for the considerations were three reference points developed in subsequent parts of the article. The first is the category of moral responsibility. The second concerns the approach of moral subjectivity through the process of moral development. The third point is the category of conscience. Each of these points has been described as an attribute of a moral subject. On the basis of the examples, comments and discussions cited, the arguments for and against the attribution of the organization of moral subjectivity were confronted.

Opis:
One of the most important manifestations and signs of the new culture of life is unconditional defense of human life from conception to natural death which John Paul II spoke very often about.  Involvement and forms of activity in this field depend on the state of human consciences - from their righteousness. The author shows this fundamental issue in the light of the remains current and relevant today Encyclical Evangelium vitae. At the beginning it refers to the fact that the word conscience is today a commonly used as a moral category, but ambiguously understood. He draws attention that the root of this phenomenon is on the one hand, the practical abandonment of the objective truth known by reason, and, on the other hand, the departure from the faithful revelations of the truths revealed by God. Then he shows his commitment to defending human life as a testimony of right conscience. He stops by the legal protection of human life from conception, indicates to verbal manipulations blurring the truth about actions against human life, and stresses the importance of opposing conscience to unjust law. Finally, he draws the issue of shaping the right conscience in the defense of human life. He indicates to the proclamation of the Gospel of life, at the center of which is the person of Jesus Christ, emphasizes the intellectual aspect of formation of conscience, i.e. need for clear and convincing arguments about the value of human life and the proficiency of educating the young generation to live sexually in the service of love and life. It also draws attention to the many signs of the victory of the culture of life, but also to phenomena that point to the need for further actions to defend human life.

Spoglądając na panoramę współczesnego świata, można dojść do przekonania, że człowiek XXI wieku głęboko w swoim wnętrzu nosi poważny kryzys tożsamości. Wśród wielu przyczyn takiego stanu rzeczy, niewątpliwie jedną z nich jest to, że zapomniano o roli sumienia jako czynniku, który reguluje i wskazuje na rzeczywistość Prawdy, wobec której człowiek powinien kształtować swoje życie.Przywołanie refleksji nad którą pochylili się Ojcowie Soborowi zebrani na Vaticanum II wydaje się być cenny wkładem we współczesną debatę nad tożsamością człowieka, szczególnie jeśli chodzi o rolę sumienia i obowiązek wierności jego nakazom. Istotny wkład w kształtowanie soborowej koncepcji sumienia ma również ten, który w literaturze fachowej, nazywany jest Ojcem Soboru Watykańskiego II, a mianowicie John Henry Newman, invisibile peritus Soboru Watykańskiego II – określanego także mianem Soboru Newmana – wynoszony jest przez niektórych komentatorów do godności doktora sumienia. Niestety idee, zawarte w nauce kardynała i znajdujące swój dopełnienie w dokumencie soborowym Gaudium et spes, ciągle mają problem, by przebić się do świadomości człowieka XXI wieku.Niniejsze studium podejmuje kwestię obowiązku wierności sumieniu w perspektywie nauczania John’a Henry’ego Newman’a oraz Konstytucji Gaudium et spes. Jego celem jest ukazanie istotnej i tożsamej linii, jaką można zauważyć między myślą kardynała, a nauczaniem Soboru w odniesieniu do poruszanej kwestii. W dobie kryzysu tożsamości współczesnego człowieka przypomnienie fundamentalnej nauki o sumieniu, wydaje się być wartościowym głosem we współczesnej debacie moralnej i istotnym wskazaniem dla dzisiejszego człowieka.
Looking at the panorama of the modern world, one can come to the conclusion that the man of the twenty-first century carries deep in his interior a serious identity crisis. Among the many reasons for this state of affairs, undoubtedly one of them is that man has forgotten about the role of conscience as a factor that regulates and points to the reality of Truth, to which man should form his life.Recalling a reflection discussed among the Council Fathers gathered during Vaticanum II, it appears to be a valuable contribution to the contemporary debate over the identity of man, especially when it comes to the role of conscience and the duty of fidelity to its dictates. A significant contribution to the development of this conciliar concept of conscience is provided by a man, who specializes in literature, referred to as the Father of the Second Vatican Council, namely John Henry Newman. Newman, the invisibile peritus of the Second Vatican Council, which is also called Newman’s Council, is said by some commentators to have been raised to the dignity of Doctor of conscience. Unfortunately, the ideas contained in the teachings of the Cardinal, which found its fulfillment in the conciliar document Gaudium et spes, still have a problem breaking into the consciousness of the twenty-first century man.This study tackles the question of the duty of fidelity to conscience in view of the teaching of John Henry Newman and Gaudium et spes. Its aim is to show a significant and identical line, which can be seen between the thoughts of the Cardinal and the teachings of the Council with regard to the discussed issues. In the age of the identity crisis of modern man, recalling the fundamental teaching of conscience seems to be a valuable voice in contemporary moral debate and an important indication for today's man.

Question about the condition of social ethics, public morality and politics leads us to the notion of conscience and freedom of conscience. Traditionally, the term conscience has its origin in philosophy of morality and in religion. However, contemporary sociological research in Poland demonstrates that many social actors, predominately institutional Catholic representatives or politicians, within the public debate play a battle over morality. The article, in light of the empirical data and theoretical approach, undertakes the analyses on public morality and religion, bioethics, law, and politics to discuss the quest of ethical rigourism and political moralism. Nonetheless, in the context of the public debate over the freedom of conscience and its socio-political implications the author argues that religious and political debate over public morality is often an object of ideological manipulation.

In this paper we refer to the freedom of man and also his responsibility for the acts. In the introduction we define freedom and we point out how has freedom been understood in Greek philosophy and how it is understood in the modern philosophy. We refer to the freedom of the first people in paradise at the beginning of creation and the loss of freedom through the first sin. We analyze the relationship of liberty and law, liberty and truth and liberty of conscience and objection of conscience. The freedom of man is related to his responsibility and therefore in this paper we define the terms of responsibility and we clarify personal, family and political responsibility.

The purpose of this paper is to provide an opinion on the regulation of freedom of conscience in the constitutions of European Union countries (with the exception of Italian and Polish regulations). The author concludes that freedom of conscience is guaranteed in all European Union countries. In most of them, it is expressed explicitly in the Constitution, and in other countries, it is guaranteed under Article 9 of the Convention for the Protection of Human Rights and Fundamental Freedoms of 4 November 1950.

Sumienie nie pełni tylko roli osobistego autorytetu moralnego, ale jest również filarem godności i wolności człowieka w przestrzeni życia społecznego. Umożliwia ono bowiem wspólne poszukiwanie prawdy i rozwiązywanie dylematów moralnych przez członków ludzkiej społeczności. Po przedstawieniu różnych interpretacji sumienia, autor omawia związek sumienia z godnością człowieka. Godność sumienia stoi u podstaw jego wolności. Jednocześnie godność człowieka jest afirmowana w poszanowaniu wolności jego sumienia. Praktycznym wyrazem tej wolności jest prawo do sprzeciwu sumienia. Problem ten występuje najczęściej w kontekście pełnienia obowiązków przez pracowników służby zdrowia. Poszanowanie ich osobowych praw domaga się uszanowania również ich prawa do klauzuli sumienia, kiedy właściwe im postępowanie implikuje ich odpowiedzialność moralną rodzącą konflikt sumienia.
Conscience acts not only as a personal moral authority, but it is also a pillar of dignity and human freedom in the social life. It allows the joint search for the truth and resolve moral dilemmas by members of the human community. After presenting different interpretations of conscience, the author discusses the relationship of conscience with human dignity. The dignity of conscience is the basis of human freedom. At the same time human dignity is affirmed by the respect for freedom of conscience. The practical expression of this freedom is the right to conscientious objection. This problem occurs most often in the context of the duties of health professionals. Respect for their personal rights also demands respect for their right to conscientious objection when the proper procedure implies their moral responsibility which creates a conflict of conscience.
