Opis:
The author of the presented article focused his attention on the issue of the process of granting a dispensation from the impediment of consanguinity in two verdicts of the Roman Rota – c. Turnaturi of 25th January 2001 and c. De Angelis of 14th February 2003. He proved that the contrary verdicts in the same matter resulted from two different methods of argumentation used by the panel of judges. In the verdict of c. Turnaturi what was taken into consideration was the collected documentation but also other circumstances of the case while in the verdict of c. De Angelis the documents were the main focus of attention. The author believes that in the last sentence the method of decision-making was of positivist nature.

Background: Poor knowledge about Fragile X syndrome (FXS) may be a major barrier to early diagnosis that could improve quality of life and prognosis especially in the developing countries. Aim: The aim of this study was to evaluate simple and reproducible method for premutation detection in females of fragile X families for the first time in Egypt. Subjects and Methods: We have developed a rapid modified polymerase chain reaction (PCR)-based screening tool for expanded Fragile X mental retardation 1 (FMR1) alleles. This method utilizes betaine as additive to facilitate FMR 1 gene amplification. We screened fifty three males, thirty two first-degree females; twenty normal healthy controls in addition to six reference samples. Results: Simple PCR method showed 16 males with abnormal CGG repeats, where 10 of their mothers and four sisters had FMR 1 premutation. Consanguineous marriage was present in 66.6% percent of the studied families. Studying the correlation between genotype and clinical manifestations showed premature ovarian failure in 40% and learning disability in 50% of the studied female carriers. Conclusion: FXS has to be ruled out in families with consanguineous parents, before assuming that familial mental retardation is due to autosomal recessive gene defects. Early carrier detection may reduce the number of affected children. In conclusion, more studies are still needed of much larger sample size with known allele sizes in order to guarantee the accuracy of the method used.

One of the rules contained in the Code of Good Administrative Behavior adopted in 2001 by the European Parliament is the principle of impartiality and independence (Article 8). The presence of this rule, despite its non-binding nature, prompted the author to examine – using the method of comparative law analysis – whether the EU Member States have regulated this issue in their legal systems – and if so, to what extent and how. The basic institution serving the implementation of this principle is the disqualification of an employee of the authority from participation in the proceedings in situations where their impartiality seems to be at risk. Not all EU countries explicitly provide for such an institution. Among the legal systems that contain it, only some regulate the entirety of issues related to it: the grounds for disqualification, the procedure for disqualification and the consequences of it, as well as the appealability of orders taken in this matter and the consequences of violating the provisions on disqualification. Regulations of individual issues differ in the degree of detail. This applies primarily to the reasons for the disqualification of an employee of the authority. The most important reason for the disqualification of employees (except when they or their spouse are a party to the proceedings) is the consanguinity or affinity between them and the party. However, the ranges of such ties resulting in automatic disqualification of an employee, adopted in EU member states, differ significantly. The second area of significant difference is the consequences of the potentially biased employee’s participation in the proceedings. The solutions adopted in this regard in legislation and jurisprudence depend on how the main purpose of the provisions concerning the disqualification of an employee is perceived: as strengthening the public’s trust in the executive, or as a fair settlement of the matter.

Artykuł dotyczy znaczenia terminów "pokrewieństwo" i "powinowactwo" oraz innych terminów genealogicznych. Druga część artykułu poświęcona jest ukazaniu historycznej ewolucji zakresu pokrewieństwa i powinowactwa jako przeszkód małżeńskich w prawie kanonicznym Kościoła rzymskokatolickiego, od jego źródeł w prawie biblijnym i rzymskim, aż do roku 1917, kiedy to ukazał się pierwszy Kodeks Prawa Kanonicznego. Ponadto w artykule ukazano wpływ prawa kanonicznego na kształtowanie się przeszkód pokrewieństwa i powinowactwa w prawie rodzinnym obowiązującym w Polsce do początku XX wieku.
This article concerns the meaning of terms „consanguinity” and „affinity” and other genealogical terms. The second part of the article is dedicated to show a historical evolution of range the consanguinity and affinity as a impediments to marriage in Canon Law of Roman Catholic Church, from its source in the Law of the Bible and in the Roman Law, to 1917, when the first Code of Canon Law was published. Furthermore, in the article it is shown an influence of Canon Law on forming of impediments of consanguinity and affinity in FamilyLaw in force in Poland to the early 20th century.

Opis:
Polish family law, as a part of civil law, has been unified in 1945–46. The old law, coming from the period of Polish partitions, has been replaced by the decrees, based on drafts prepared by the Codification Committee before WW II. The decree Family Law from 1946 regulated the legal relations coming from consanguinity. One of the most important problems to be solved by the legislator was the status of children born out of wedlock. The article presents the drafts and the discussion about improving the legal status of this category of children. The decree finally improved their position, although it did not eliminate legal distinction of the two groups of children. The legal status of children born out of wedlock was a little worse than those coming from marriage, but the difference was not big. The decree gave an opportunity to provide the children with legitimacy in many cases. The differences in the legal status of children were finally eliminated in Poland in 1950, by enactment of the Family Code.
