The question of concubinage was very often mentioned in the sources of Polish synodal legislation in 12th–18th centuries. This extramarital union between a man and a woman was defined by the Latin term concubinatus. The more descriptive expressions used to explain this relation are as follows: peccandi libidinum, scelerata consuetudo or damnaticius status. The most extended terminology refers to the most relevant matter for the Catholic Church, namely to break with the sinful intercourse by the Christ’s faithful. The analysis of synodal decrees indicates that provided terminology expressed moral and legal qualification of living in concubinage. It was characterized by the pejorative meaning. Undoubtedly, it reflected the negative attitude of the Church towards these extramarital relations and people remaining in them. Provided terms applied mostly to clerics living in statu concubinatu. It shows how much attention the ecclesiastical authorities pay to clerical discipline. However, the fragments regarding the fight with concubinage of Christ’s faithful are less common. Particular legislators broadly used the terminology provided by the universal Canon law.

This study presents St. Augustine’s personal experiences related to marriage and family that eventually influenced his views on these topics. Augustine of Hippo is considered one of the greatest theologians of the ancient Christian world. Although he was unmarried, he was born into a Christian family and experienced what it was like to live with a woman in a quasi-married state before he converted to Catholicism. Augustine left behind a large body of writings dedicated to the topics of marriage and family. Even though these works do not constitute a coherent treaty on marriage and family, they do shed light on these issues. They also reflect the current and pressing problems that affected not only St. Augustine but also the people of his time. St. Augustine’s views on marriage and family have had an immense influence on the entire Latin Church’s position on these issues. In this regard, the primary source that contains a lot of biographical information is Augustine’s Confessions. This study is made up of two parts. Part I describes Augustine’s childhood experiences and family life. Part II describes youth and his experience living with a female concubine. This original study presents the sources of St. Augustine’s views on human sexuality and his relationship with his family.

Thesis Informal relationships are very popular in modern times. The number of people choosing marriage is slowly decreasing. The author of the article discerns the similarities and differences between cohabitation and marriage. The author puts forward the thesis that it is impossible to assess whether marriage is superior to cohabitation and vice versa. Concept The author presents the definitions and legal regulations of marriage and cohabitation. Additionally she lists the types of cohabitation and types of marriage. Results and conclusion In times of "liquid postmodernity" one should accept the coexistence of marriage and cohabitation, without assessing which of these forms is better, more beneficial, richer. Originality/Cognitive value In the subject literature cohabitation is presented as a short-term relationship, deprived of mutual obligations of partners, based only on sexual attachment and living together. It stands in opposition to marriage, which is as a permanent relationship based on mutual obligations of spouses and a strong emotional bond.

Set in the context of early 20 th century Malaya, W. Somerset Maugham’s (1874–1965) short story “The Force of Circumstance” (1926) concisely represents the conflicting attitudes to sex and family life among the British colonial employees. The narrative, which develops around the main hero Guy’s relationships with his English wife Doris and an unnamed Malay concubine, reflects a contrast between the attitudes to sex dominant in the official imperial ideology of that time and the practice in the colonies. The frameworks of narratology and Cognitive Poetics make it possible to read the complicated situation of the main hero as an extended metaphor of the British Empire, in which formal and informal family relations map onto the relations between Great Britain and the dependent states. Though the British imperial ideology used the concept of family to strengthen the relations between the metropole and the colonies, Maugham’s story represents the Empire as a not-so happy family – a result of circumstances rather than of mutual bond and consent.

The article discusses concubinage as a source of matrimonial impediment of public propriety (impedimentum publicae honestatis) in Canon Law. According to Canon 1093 of the Code of Canon Law from 1983 and Canon 810 Code of Canons of Oriental Churches from 1990, the impediment of public propriety arises from notorious or public concubinage. It nullifies marriage in the first degree of the direct line between the man and the blood relatives of the woman, and vice versa. Concubinage means a cohabitation between a man and a woman established on a more or less durable basis without a valid marriage. It’s unimportant whether the parties live in the same house or not. Concubinage is considered public when it is known in the community of the faithful, notorious when it is publicly known and carried out in such circumstances that it cannot be concealed or excused. Public propriety is an impediment of ecclesiastical law, hence can be dispensed by the local ordinary (Canon 1078 § 1 of the Code of Canon Law) and by the local hierarch (Canon 795 of the Code of Canons of Oriental Churches) in ordinary circumstances, and also by the persons mentioned in canons 1079–1080 of the Code of Canon Law and canons 796–797 of the Code of Canons of Oriental Churches in exceptional circumstan- ces. It should be noted that even if notorious or public concubinage ceases through the death of one of the parties or by mutual agreement, a dispensation is necessary.

Cel: Współczesne związki małżeńskie konstytuowane są w oparciu o dużo większą wolność w rozumieniu małżeństwa jako społecznego obowiązku, autonomię obojga partnerów oraz – w największej mierze – stanowią zalegalizowaną relację uwarunkowaną potrzebami uczuciowymi. Podobne założenia przyświecają kohabitacji, z wyłączeniem jej formalizacji w sensie prawnym. Metody: Autorka artykułu stara się przybliżyć podobieństwa i różnice pomiędzy kohabitacją a małżeństwem bez próby oceny, która z tych relacji jest bardziej wartościowa. Wyniki: W artykule przedstawiono i omówiono założenia teoretyczne, uregulowania prawne oraz modele kohabitacji i małżeństwa. Wykazano różnice oraz podobieństwa pomiędzy małżeństwem i kohabitacją. Wnioski: W przekonaniu autorki artykułu rozważania nad wyższością małżeństwa wobec kohabitacji nie są zasadne. Wartościowanie takie utrudnia zresztą wiele czynników. Jednym z nich jest brak dookreślenia, czym jest związek konsensualny, jakie są jego ramy czasowe, jak wygląda w nim kwestia rodzicielstwa, podziału obowiązków domowych etc.
Aim: Modern marriages are concluded based on much greater freedom in perceiving marriage as a social obligation, autonomy of both partners and – to the largest extent – they form a legalized relationship preconditioned by emotional needs. Similar characteristics are part of cohabitation, with the exception of its formalization in the legal sense. Methods: The author of the article strives to illustrate the similarities and differences between cohabitation and marriage without attempting to assess which of these relationships is more valuable. Results: The author of the article presents and discusses theoretical assumptions, legal regulations and models of cohabitation and marriage. Differences and similarities between marriage and cohabitation were shown. Conclusions: In the opinion of the author of the article, reflections on the superiority of marriage to cohabitation are not justified. Such an evaluation is stymied by many factors. One of them is the lack of precise definition of a consensual relationship, what its time frames are, what the issue of parenthood looks like in it, what is the division of home duties etc.

Accepted by some groups of people and condemned by others, informal relationships have been recognized but not defined by the Polish legislator. In the absence of legal definition it is a task of legal scholars and judges to establish what kind of relationships can be classified as falling under the heading of the equivocal expressions used by the legislator in legal acts. Traditionally, concubinage is deemed as a relationship of that kind. However, it is highly controversial how this type of informal union should be defined. In the first part of this paper the author presents opinions of the legal scholars and judges on the constitutive features of concubinage and proposed definitions of the term. In the second part he analyzes presented data and proposes a typological defini- tion of concubinage which on the grounds of Polish legal tradition can be described as a heterosexual, stable, (not necessarily) notorious relationship of two (or more) people who live together (or not). The cohabitants cannot be legally married and have to form a life communion (characterized by the existence of emotional, physical and economic sensu largo bonds). The union has to be seen by them as an autotelic value and cannot (even potentially) be against the law.

In Polish penal law the term “closest family member” has existed for decades. Since 1932, however, the circle of people encapsulated by that term has changed si- gnificantly. This article tracks those changes from the Polish Penal code of 1932 through to the revised Penal Code of 1969 and on up to 1997. In the Code of 1932, “closest family member” was defined as people connected to an individual by way of marriage, cognition or affinity. In the Code of 1969, this was expanded to incorporate adopted family members and their spouses, as well as a person with whom the individual lived in cohabitation. From the outset, this latter category generated issues relating to the status of adjudication of a cohabitating partner. Contemporarily, primary discussion revolves around homosexual couples. From the analysis of judicial decision and do- ctrine, it is clear that views in this respect remain divided. However, there is evidence that articulates greater appreciation that homosexual couples can be acknowledged as immediate family. Notwithstanding, doctrine and judicial decision is not unitary.

The Supreme Court’s resolution of 25 February 2016 states that the statutory term „person in cohabitation” permits the absence of gender difference, extending in practice new civil and criminal-procedural rights of homosexual couples. It also points to physical, spiritual and economic ties between partners, but if one of them is objectively justified, it does not change the nature of a relationship at all. This is the same field for numerous abuses. Resolution breaks as a consequence with the dominant and long-established case law and opinion of doctrine, degrading role and social mission of the family. As a result of the broad and inconsistent interpretation of notion as well incompatibility with argumentation of the Constitutional Tribunal the use of term for specific situations can cause a number of interpretational doubts and deepen legal chaos.
