Opis:: Aim. The subject of the article are types of rental dwelling in contemporary Poland. The aim of this paper is to present the forms of contemporary living in terms of age groups, way of study or work and financing possibilities of Poles compared to other countries in the world. Methods. The authors of the article present selected new forms of rental dwelling in Poland in context of changes after the collapse of communist system in 1989. The article discusses the present situation of Polish real estate market basing on European statistics. It indicates the problem of limited availability of housing and presents solutions implemented by the government and the private sector market. Results and Conclusion. Poland is one of the European countries with the highest rate of people living in overcrowded apartments or houses. The solutions introduced by the state in order to increase the availability of housing and allowing the alternative to buying a flat, encounter difficulties with spatial planning regulations. In the absence of sufficient support of the government private sector market see its chance for profit in constructing and renting apartments. Cognitive value. The article describes the phenomenon of a growing private rental, that could be a shift in dwelling characteristic of Poles and influence the housing market. It presents new forms of developments, showing the background of their creation.

Opis:: Obecnie świat zachodni wydaje się nasycony istniejącą ofertą wsparcia dla rozwoju przedsiębiorczości. Również w krajach Europy Wschodniej obserwujemy rosnącą liczbę inicjatyw na różnych szczeblach organizacyjnych, mających na celu towarzyszenie potencjalnym przyszłym przedsiębiorcom w ich wysiłkach. Jednak jest jedna, nigdy wcześniej nieoferowana na polskim rynku, nowość – pierwsza, stworzona w Gdańsku, przestrzeń co-living. Niniejszy artykuł ma na celu przedstawienie idei 4COs (co-living, co-working, co-habitation, co-development) zainicjowanej przez grupę młodych przedsiębiorców społecznych z Trójmiasta pod nazwą „Clipster” pod koniec 2015 roku. Dla lepszego zrozumienia nowatorskiego charakteru tego przedsięwzięcia na polskim rynku, autor analizuje podobne inicjatywy na świecie. Artykuł jest również próbą oceny wyzwań i wstępnych efektów tej inicjatywy, dzięki metodom jakościowym – wywiadom z pierwszymi uczestnikami oraz liderami projektu. Dodatkowo, autor sugeruje pewne ulepszenia i ewentualne przyszłe zmiany w tym przedsięwzięciu.
Nowadays, the Western world seems saturated with the myriad of enhancements for entrepreneurship development. Also, in Eastern European countries we observe a growing number of initiatives at different organizational levels, aiming at accompanying potential future entrepreneurs in their efforts. Meanwhile, there is one novelty, never before offered on the Polish market – the first co- -living space, launched in Gdańsk. Therefore, this article aims at presenting the idea of 4COs (co-living, co-working, co-habitation, co-development) initiated by a group of young social entrepreneurs from the Tricity as “Clipster” at the end of 2015. For better understanding of the novelty of this venture on the Polish market, the author analyzes similar initiatives worldwide. This paper is also an attempt to assess the challenges and results of this initiative thanks to the qualitative research methods – structured interviews with its first participants and with its leaders. Additionally, the author suggests some improvements and possible future developments of this initiative.

Opis:: The Penal Code presently in force provides for a “person living in actual co-habitation” and it stipulates in Article 115 § 11 the definition of “the person next of kin”. According to the invoked provision “the person next of kin shall be a spouse, ascendant, descendant, brother or sister, a relative in the same line or degree, a person being an adopted relation as well as his spouse, and also a person living in actual co-habitation.” Numerous differences and doubts arise in the doctrine and judicature when one attempts to decode the term “a person living in actual co-habitation” as it has not been strictly defined by the legislator. The results of its interpretation by way of linguistic, systematic and functional directives lead to the conclusion that the term contained in Article 115 § 11 of the Penal Code “a person living in actual co-habitation” indicates a person living with another person in such a factual relationship, where there are between them simultaneously spiritual, physical and economic bonds. It is possible to establish the existence of a relation of “living in actual co-habitation” also when the lack of one of such bonds is objectively justified. The difference of the sexes of persons living in such co-habitation is not a requisite condition to establish that they actually live in co-habitation within the meaning of Article 115 § 11 of the Penal Code.
