Opis:
Contemporarily, historic monuments and sites are highly diverse and vast in number. This means that each asset and property has different value and, hence, different principles and forms of historic preservation need to be applied. Diversification of historic monuments and sites should be a part of the monument protection system and based on the widely accepted and followed methodology. No single methodology allowing for assessing the value of all historic monuments and sites has been developed yet. For this reason, diversification of historic monuments and sites is not applied in the international doctrinal documents. The most comprehensive method of assesing heritage value has been implemented into UNESCO’s World Heritage system. It consists on comparing assets within a certain reference group, yet it does not involve value gradation. Within the monument protection system, historic monuments and sites can be divided into two major groups, i.e. classes (in terms of the value of an asset or property) and categories (in terms of the specific features of an asset or property). In the Polish system of historic monuments and sites, application of categorisation (typology-based groups) is justified. However, for practical reasons (a risk of protection being depreciated and weakened), classes can be applied in limited scope (valuing groups).

Opis:
Value assessment of historic monuments and sites and their classification are affected by conservation works and the impact they exert on elements of historical significance. Whether a historic monument or site can be still considered evidence of a past epoch depends on the scope of conservation works carried out in this asset. Works conducted in appropriate manner provide new information about the past. Additionally, a historic monument or site is attributed new values - not only aesthetic and functional but also the historical ones. This allows for changing their classification. Therefore, the role that the results of conservation works play in classification of historic monuments and sites has been particularly emphasised. The author of this article ponders upon whether layers of the previously carried out conservation works as well as their effects can be the reason for redoing value assessment and re-classifying a historic monument or site. These deliberations provided a basis for drawing conclusions and producing recommendations pertaining to the influence that conservation works and layers created as their result exert on the actions taken by historic preservation offices supervising these works. For this reason, the present classification should include the following: – increasing the importance of historic monuments and sites which have not been transformed at all or have been slightly modified This concerns historic monuments and sites which are typical of their epoch, e.g. tenement houses, palaces, industrial plants, etc. – valuable layers and elements created in the course of conservation works, which should be preserved and, prior to issuing permits by historic preservation office and launching conservation works, assessed in terms of their values. These elements should be preserved in order to place these assets under a different class, usually of a higher rank. Preserving elements created in the course of formerly conducted conservation works and resulting in forming multiple layers is compliant with the currently applied conservation theory, which no longer accepts purist methods as a way of preserving monuments and sites. Due to this, it is possible to preserve the evidence of conservation works and take care of historic monuments and sites in order to preserve them for future generations.

In Czechia, provisions of law pertaining to historic preservation were established in 1958, during Stalinism. The regulations were provided in Czechoslovakian Act on Cultural Monuments. It was superseded by the Act on State Care for Historic Monuments and Sites being currently in force, which was adopted in the former political system in 1987. Due to dynamic economic, political, and ownership-related transformations taking place at that time, it was necessary to amend it. Consequently, for several years, the legislators have been working on a new act referred to as “The Act on Protection of Resources of Historic Monuments and Sites.” This article pertains to legislative solutions and classification of historic monuments and sites in the light of the Act being developed. In this document, historic monuments and sites are not grouped into specific categories. Instead, they are all considered material elements of cultural heritage. On the other hand, assets of historical significance are classified into cultural monuments, monument ensembles, and national culture monuments and sites of the most outstanding significance. Additionally, two temporary forms of historic preservation have been developed: areas and reserves of historical significance. Archaeological monuments and properties considered as having outstanding historical values under certain international agreements are treated separately. This classification allows for assigning tasks to appropriate administrative bodies and, at the same time, encouraging institutions responsible for historic preservation of monuments and sites on the national level to become advisory bodies of regional administration institutions. What is worth mentioning in the field of historic preservation in Czechia are government’s attempts at making historic monuments and sites more available to citizens by introducing certain legal regulations, i.e. providing the government with pre-emptive right to purchase a property of historical significance from a private owner. This approach results in increasing government’s profits from tourism and culture-related products.

W związku z dwudziestoleciem obowiązywania Ustawy z dnia 23 lipca 2003 roku o ochronie zabytków i opiece nad zabytkami autor stawia zasadnicze pytania dotyczące przedmiotu ochrony prawnej, to jest rozumienia prawnej definicji zabytku, granicy oddzielającej zabytki od innych obiektów dawnych oraz kryteriów przesądzających o tym, który obiekt winien trafić do rejestru zabytków, a który – jedynie do wojewódzkiej lub gminnej ewidencji zabytków. W poszukiwaniu odpowiedzi w pierwszej kolejności prześledzono przepisy ustawy i przeanalizowano poszczególne kategorie zabytków w kontekście zakresu przyznanej ochrony prawnej oraz kryteria, na których podstawie dany obiekt ma być kwalifikowany do określonej kategorii. Następnie omówiono prowadzony w ostatnich latach dyskurs przedstawicieli środowiska konserwatorskiego, który dotyczył zagadnień związanych z wartościowaniem zabytków, w tym prac nad ujednolicaniem kryteriów waloryzacji. Przedstawiono także zróżnicowane stanowiska w kwestii kryteriów wpisania zabytku do rejestru, prezentowane w decyzjach organów ochrony zabytków oraz w orzecznictwie sądów administracyjnych. Rezultatem prowadzonej analizy są krytyczne wnioski dotyczące braku jednolitych i powszechnie zrozumiałych standardów oceny zasobu zabytkowego i sposobu interpretacji prawnego pojęcia zabytku oraz niejasnych kryteriów mających przesądzać o tym, który obiekt winien trafić do rejestru zabytków. Artykuł wieńczą refleksje na temat działań, które w ocenie autora winny zostać podjęte, by uporządkować proces wartościowania zabytków.
In conjunction with the twentieth anniversary of the Act of 23 July 2003 on the protection and care of historical monuments, the author raises some fundamental questions concerning the subject of legal protection, that is, the understanding of the legal definition of a monument, the borderline separating monuments from other historical objects, and the criteria determining which objects should be included in the central register of monuments, and which should only be included in voivodship or municipal records of monuments. In order to find an answer, first the provisions of the Act were examined, and the various categories of monuments analysed with regard to the scope of legal protection provided and the criteria for qualifying them to a particular category. Then the discourse that has been taking place in recent years among representatives of the conservation community is discussed; this concerns issues related to the valuation of monuments, including work on standardizing the criteria for their valorization. Also presented are the differing views on the issue of the criteria for entering a monument in the register, as expressed in the decisions of monument protection authorities and in the rulings of administrative courts. The result of the analysis is a critique of the lack of consistent and generally understood standards for the evaluation of historic monuments and how the legal concept of a monument should be interpreted, as well as vague criteria to determine which objects should be included in the register of monuments. The article concludes with reflections on actions which, in the author’s opinion, should be taken to organize the process of valuation of monuments.
