Opis:
The phenomenon of multiterm mayors has become widespread in Poland, especially after introducing the direct election of the executive in municipalities in 2002. The direct election has given the mayors the dominant position in local politics. The way to limit it has seemed to be the limitation of number of terms in office of the municipal executive bodies to two. In the presented paper the arguments of opponents and supporters of this solution were analyzed. The analysis was made from the perspective of two levels: institutional- legal and socio-political. The aim of the analysis is to show the positives and negatives of the implemented change and the projected effects. The legal basis, its compliance with the constitution and the implications for the active and passive suffrage were analyzed. Also the results for local political systems and for local communities were examined, and it was confronted with the issue of political culture.
Zjawisko wielokadencyjnych wójtów, burmistrzów i prezydentów miast stało się w Polsce powszechne, w szczególności po wprowadzeniu bezpośrednich wyborów organu wykonawczego w gminie w 2002 r. Bezpośredni wybór dał wójtom, burmistrzom i prezydentom miast dominującą pozycję w lokalnej polityce. Sposobem na jej ograniczenie ma być wprowadzenie limitu dwóch kadencji. W artykule poddano refleksji to rozwiązanie, analizując argumenty zarówno jego przeciwników jak i zwolenników. Analizę przeprowadzono z perspektywy dwóch płaszczyzn: prawno-instytucjonalnej oraz polityczno-społecznej. Celem rozważań jest ukazanie pozytywnych i negatywnych stron wprowadzonej zmiany oraz prognozowanych efektów. Przeprowadzona została analiza podstaw prawnych, zgodności z konstytucją i skutków tego rozwiązania dla czynnego i biernego prawa wyborczego. Przeanalizowano również jego skutki dla lokalnych systemów politycznych oraz dla lokalnych społeczności, a także skonfrontowano to z zagadnieniem kultury politycznej.

El patriarcado en distintos momentos históricos ha impedido a las mujeres el acceso a la educación, pero muchas han encontrado la forma de burlar los mandatos del poder para acceder al conocimiento. Las reivindicaciones de las mujeres han sido obviadas muchas veces, así como su obra y aportaciones desde la ciencia, la filosofía y el pensamiento feminista. Recuperar los nombres de las que abrieron camino con sus tratados, de las que accedieron a las universida-des buscando recovecos legales y lograron ser referentes para otras muchas, reflexionar sobre la influencia que unas tuvieron en otras que hablaban su misma lengua, es tan fundamental como contextualizar los discursos reaccionarios de los que defienden los privilegios del varón frente a los derechos de ciudadanía. Es, por tanto, fundamental incorporar la perspectiva de género en el análisis histórico.
Throughout history, patriarchy has prevented women from accessing education. However, many of them have found ways to circumvent the dictates of male power to gain access to knowledge. Women's demands are often invisible, as well as their work and contributions from science, philosophy and feminist thought. It is imperative to recover the names of those who broke new ground with their treaties, of those who managed to be admitted to universi-ties through the search for legal nooks and crannies, and became a touchstone for many ot-hers, as well as to reflect on the influence that some of them had on others who spoke the same language. It is also crucial to contextualize the reactionary discourses of those who de-fend the privileges of men against citizenship rights. It is therefore essential to incorporate a gender perspective into the historical analysis.

The aim of the survey was to find out what attitudes young people aged twelve to seventeen maintain towards adult civic qualities and virtues as compared with their demands for changes in civic behaviour. The objective of the study was to find out whether, based on their perception of adult behaviour, the critical youth wish for changes in civic behaviour and which aspects of citizen life they should be linked to. The survey tool used was a questionnaire investigating attitudes and behaviour in various situations of citizens’ everyday life. There were 33 Likert-type question items in the questionnaire (e.g. They are proud of their country.). The questionnaire showed a high level of reliability. The survey sample consisted of 533 adolescent respondents (aged 12–17). There were four factors generated through factor analysis from the collected results: 1. Respect for traditional social norms and roles; 2. Tolerance and respect for other people’s rights; 3. Patriotism and trust in public institutions; 4. Application of constitutional civic rights. The adolescent respondents were asked to mark the statements which should be changed. The outcome confirmed the hypothesis of high criticality in the respondents, which we consider a significant social challenge: adolescents demand a major change in civic behaviour described by the total of 14 items (42.7%) in all four factors. The highest number of proposed changes falls into the factor of “Respect for traditional social norms and roles”, while the fewest proposed changes concern the factor of “Patriotism and trust in public institutions”. According to the respondents, traditional social norms and roles and tolerance and respect for other people´s rights should be strengthened as well. The attitude towards active civic virtues implies a need for better and more sophisticated civic virtues education, both within the family and in schools. The results obtained from this survey will be used in generating civic education programmes for primary and secondary schools.

As the adoption of the Hungarian simplified naturalisation scheme raised much tension both in the neighbouring countries of Hungary and in the main host countries of EU citizens, this paper summarises the nature of such reactions and the most frequent fears that EU states expressed. The main aim of the study is to show what effects a country’s modification of its citizenship rules may have on the situations of other EU member-states and European Union citizens. The article also raises one practical aspect of the situation that evolved as a result of the answer by Slovakia to the Hungarian modifications – namely the ex lege withdrawal of Slovakian citizenship if a person acquires a new one from another country. It introduces in detail the free-movement aspects of ethnic Hungarians losing their Slovakian citizenship, while not leaving their homeland in Slovakia, arguing that people in such a situation may rightfully and immediately be eligible for permanent residence rights, which would provide them with a higher level of protection.

This contribution examines the legal powers that Dutch authorities have to restrict the right to free movement of mobile but ‘unwanted’ EU citizens, including measures that seek to expel and ban EU citizens from re-entering the Netherlands. The article defines ‘unwanted’ EU citizens as mobile EU citizens in respect of whom national authorities seek to take measures to restrict their right of residence, either on the grounds of their being an unreasonable burden on the Dutch social assistance system or in respect of public policy and public security. We analyse the relevant EU legal rules, their interpretation by the Court of Justice of the EU and their national implementation and application in order to show the legal constraints faced by national authorities when seeking to restrict EU mobility. This legal study is supplemented by a discussion of existing data on the number of EU citizens expelled or removed from the Netherlands. Our analysis suggests that, due to the legal protection enjoyed by mobile EU citizens against measures restricting their residence rights, the Dutch authorities encourage voluntary departure as a pragmatic solution to the presence of ‘unwanted’ EU citizens.

The modern world is opening up to a series of innovations, differences and broadly understood diversity. The pace of changes becomes a peculiar substructure of creating patchwork nations. The variety of races, colors, religions and cultures. All of the above contain a point which, like an electron, resembles an omnipresent “variant”. This constant value is a human being. We are accompanied by a sense of belonging to a specific place, culture and values. On this basis, we expect something (e.g. having rights and freedoms). Citizenship seems to be a binder that puts us in a clearly narrowed community with certain values and often allows us to distinguish our own “self”. Created by history, absorbing presence, citizenship is an important element of our affiliation to the country, to culture and to the values hidden behind them. In the world of diversity, it seems to be a desirable and important element. The purpose of this article is to discuss the contemporary role assigned to citizenship, as well as to show the citizenship as a factor shaping the position of the individual and justifying the distinction made in specific areas of human functioning in the state.

In the contemporary world social participation of children is seen as an idea that should be implemented at various social levels. The idea itself is understood multi-dimensionally – as various social activities, including the participation in decision-making processregarding children’s matters. In the discourse on participation, which has been developing dynamically since the adoption of the Convention on the Rights of the Child, various theories are used as a background against which children’s participationis considered and justified. The ethnic landscape in the Baltic States is dominated by one large ethnic minority: Russians. Lithuania is an exception as here the first biggest ethnic minority are Poles, followed by Russians. The Baltic States have also significant Slavic minorities, such as Belarusians and Ukrainians. There are many barriers for people from different ethnic groups to overcome because the Baltic societies are segregated according to ethnicity across a number of dimensions: language, work and geography. During the Soviet period there were separate language schools, a system that reinforced ethnic separation. Labor market was also split along ethnic lines and a large proportion of ethnic minorities lived spatially segregated from the majority group and was concentrated mostly in urban centers. The impact of communist heritage and the construction of the post-communist state order had a negative impact on the integration process of the Russian minorities in those countries. The ethnic Russians had been heavily marginalized as many of them had no citizenship at all. As a result, they had limited access to labor-market and less social protection. However, the accession of the Baltic States to the European Union (EU) has succeeded in significantly changing policies with respect for and protection of minorities in the three Baltic countries. In the last years the ethnic Russians have in fact been partially accommodated through the consistency of the citizenship laws with the European Union norms, which precisely require the protection of minorities and respect for them. The aim of the study described herein is to investigate the historic roots of ethnic segregation between the native Baltic population and the Russian minority and show how the entry of the Baltic States into the EU has facilitated the process of promoting minority rights, especially from the perspective of granting citizenship right to Russian (and Polish) ethnic persons living in those countries.

This paper’s aim is to approach the issue of European citizenship by showing the dynamics of the related policies. While recognising the importance of the legal assessment of the Union citizenship as defined by the Treaties, much attention is paid to the socio-cultural meaning of the European citizenship, which stimulates the emergence of a supranational loyalty and a sense of belonging to the European Union. After an analysis of the historical development of the concept of European citizenship, it is empirically demonstrated that the success of the European citizenship policy depends critically on the capacity of the Union to meet the mainly pragmatic expectations of the citizens. Accordingly, the lack of a harmonised welfare system at the European level, which causes restrictions of the free movement of the Union citizens within the member states, proves to be the major disincentive of the European identification.

This paper sets out a new reconstruction of indigenous rights as a field of sociological research. Questioning the dominant pluralist paradigm in such inquiry, it claims that indigenous rights are primarily the results, not of socially embedded customs, but of interactions between international law and national law. It then proceeds to explain that, to capture such rights, a focus on social integration and national citizenship is required. It uses this framework to explain indigenous rights as elements of a global legal order that facilitates the construction of citizenship, especially in societies in which citizenship has been subject to deep strain.

This article focuses on an analysis of the redefinitions of the visions of intimate citizenship in the arenas created by the recent women’s protests in Poland. The 2016 and 2018 attempts by the Sejm, the lower house of the Polish Parliament, to introduce amendments to the existing law regulating access to abortion in Poland stirred dramatic social mobilisations and widespread social protests labelled with the umbrella term “Black Protests”. We see these mobilisations not only as a protest, but also as attempt to (re)define dominant notions of citizenship, and in particular, as a quest for a new model of intimate citizenship, i.e. a public reconceptualisation of the rights regarding the private/intimate sphere. Our article offers an in-depth analysis of these reconceptualisations. It unfolds in the following way. Firstly, we discuss the phenomena of the Black Protests and Polish Women’s Strikes and present the context of their emergence as well as their agenda. Secondly, we briefly discuss the issue of intimate citizenship. We then present the methodology as well as discuss the empirical material used for our analysis. In the final part, we reconstruct the visions of (intimate) citizenship emerging from the collected material.
Próby zmiany prawa regulującego dostęp do aborcji w Polsce, podjęte przez polski Sejm w 2016 i 2018, zainicjowały intensywną społeczną mobilizację i szerokie protesty społeczne, określane wspólną nazwą „Czarnych Protestów”. Tę mobilizację traktujemy jako próbę (prze)definiowania obowiązujących pojęć obywatelstwa, a w szczególności jako wyraz poszukiwania nowego modelu obywatelstwa intymnego, czyli publicznego przedefiniowania praw dotyczących prywatnej, intymnej sfery. Celem autorek artykułu jest analiza wspomnianych (re)artykulacji intymnego obywatelstwa. W pierwszej części tekstu autorki opisują, czym były Czarne Protesty oraz Ogólnopolski Strajk Kobiet, a także przybliżają kontekst ich powstania oraz postulaty. W drugiej części zdefiniowana zostaje kategoria obywatelstwa, a w szczególności obywatelstwa intymnego. Następnie przedstawiona zostaje metodologia badań. W ostatniej, analitycznej części artykułu autorki rekonstruują wizje obywatelstwa intymnego wyłaniające się z analizowanego materiału empirycznego.

Economic and political changes in Europe, particularly in the last decade have led to an increase in the cultural diversity of its citizens. Latvia, which received a troubling legacy from the former Soviet Union – a diverse ethnic mix, also found itself EU. In 1989, after nearly fifty years of Soviet domination it regained its independence and stood on the way of reform and transition from a totalitarian to an independent style of governance. Among the many problems that appeared in front of this small country in 2004, there were also those that are lively debated in contemporary Europe. Some of them are laws for immigrants and minority rights. Analysis of past and present situation in Latvia seem to be particularly important to the events which have recently been seen in Ukraine which is an another country of the past Soviet Union – and after 1990 also the Russian – sphere of influence. Article deals with the integration process, with Latvian law regulating issues of citizenship, minority rights and the status of the state language as conforming to international standards. It also deals with the education of national minorities in Latvia. Bilingual education proposed to the minorities has goal to integrate the Latvian society as a whole, to build a multicultural state based on unity. Bilingual education also enables the acquisition of language skills allowing the free movement on the labor market. This ensures both the protection of ethnic and religious identity by providing the understanding of the language and culture of the country of residence. Problems of this young state are still waiting for a solution by the future government in Latvia. This small Baltic country, for ten years, is integrating multinational community of its own country into the tissue of Western Europe to which it was a stranger till the year 2004.

The article analyses the importance of the existence and functioning of European Union (EU) citizenship institutions for materialization of federal concepts of European integration. In the first place, the evolution of this institution and legal foundations of its functioning have been analysed. The second part of the article is aimed at answering the question to what extent EU citizenship may be regarded as a federal institution. Then the issue of the importance of this institution for building political identity of Europeans should be considered.
