This article, through the prism of immigration policy models proposed by Stephen Castles (1995), Steven Weldon (2005) and Liah Greenfeld (1998), discusses those aspects of Norwegian immigration policy that refer directly to children. Areas such as employment, education, housing and health care influence the situation of an immigrant family, which in turn affects the wellbeing of a child. However, it is the education system and the work of Child Welfare Services that most directly influence a child’s position. Analysis presented in this article is based on the White Paper to the Norwegian Parliament, and data that were obtained in expert interviews and ethnographic observation in Akershus and Buskerud area in Norway, conducted between 2012 and 2014. The article raises the question whether the tools of immigration policy used by social workers and teachers lead to integration understood as an outcome of a pluralist or individualistic-civic model of immigration policy or are rather aimed at assimilation into Norwegian society, attempting to impose the effect of assimilation or the collectivistic-civic policy model.

The time after 1945 is one of the most important moments in the process of developing children’s rights, because for the first time in the history of Polish legislation the established law had equalized the legal position of all children, abolishing all differences between those who were born in and outside of marriage. The analysis carried out in the text shows that the law established at that time was not only progressive in relation to the past, but it also kept up to date, about which, after the liberal breakthrough of 1989, we do not want to remember. The developed principles of exercising parental authority, with parents’ rights and duties equated, caused the concept of the child welfare to play a leading role in the interpretation of family law. The child welfare has therefore become the basic value that requires priority treatment. It is also important that after 1945 the process of eliminating children’s corporal punishment from the pre-school and school environment, and now also from the family circle, was initiated.

Celem artykułu było wykazanie, że zaspokojenie potrzeb dziecka jest istotnym elementem wpływającym na kształtowanie jego dobra i zapewnienie bezpiecznego rozwoju. W tym celu autorka odwołuje się do wyników badań własnych dotyczących analizy pola semantycznego pojęcia dobra dziecka. Ich rezultatem było ujawnienie zasobów wiedzy przypisanych do poszczególnych ról zawodowych i zbadanie zinternalizowanych w nich znaczeń (zarówno konotacyjnych – zwykle oczywistych, jak i denotacyjnych – często nieoczywistych, a nawet nieuświadamianych). Badania prowadzono z udziałem przedstawicieli wybranych zawodów działających na rzecz dzieci i pracujących z nimi – sędziów rodzinnych, kuratorów, pracowników socjalnych, asystentów oraz przedstawicieli NGO. Jednocześnie autorka stawia tezę, że niezaspokojenie potrzeb materialnych związanych z ubóstwem, o których mowa w artykule, nie jest zjawiskiem, które prowadzi do umieszczania dzieci poza rodziną. W opinii autorki zaniedbywanie różnorodnych potrzeb dzieci jest skutkiem nawarstwienia wielu sprzężonych ze sobą problemów występujących w rodzinie, takich jak uzależnienie, przemoc czy niezaradność w sprawach opiekuńczych. Jednocześnie autorka zauważa, że chociaż regulacje prawne dotyczące wsparcia materialnego rodzin są pożądane, to nie rozwiążą problemów związanych z zaniedbywaniem potrzeb psychicznych i emocjonalnych małoletnich dzieci.
The aim of the article is to demonstrate that meeting the needs of children is an important element that influences their welfare and ensures secure development. This is why the author refers to the results of her own studies focusing on the semantic field analysis of the concept of child welfare. In them, she revealed the pools of knowledge attributed to individual professional roles and explored the meanings internalised in them (both connotational – usually obvious, and denotational – often not obvious or even unconscious). The studies were carried out with the participation of the representatives of selected professions working for the benefit of children and with them, such as family judges, court-appointed guardians, social workers, assistants and NGO representatives. At the same time, the author argues in the article that unsatisfied material needs due to poverty do not lead to the placement of children outside their families. In the author’s opinion, neglecting a variety of children’s needs is a consequence of the compilation of many interrelated problems arising within the family, including addiction, violence or helplessness in terms of care. The author also notes that although legal regulations granting financial support to families are desirable, they will not solve the problems caused by the negligence of psychological and emotional needs of minor children.

The subject of this paper as an analysis of the permissibility of using a picture of a small child and a publication of such a picture, which may only be allowed if the child welfare has been protected. An attempt is made to answer the question whether a consent granted by a representative of a state authority to publish a picture of a child, an infant, or a newborn baby in particular, may amount to an act contrary to child welfare. The deliberations of the paper include issues such as using a picture of a human being from foetal life, or parents placing a picture of their small child on a social network page.
Przedmiotem artykułu jest analiza zagadnienia dopuszczalności posługiwania się wizerunkiem małego dziecka oraz dopuszczalności publikowania tego wizerunku w taki sposób, by działania te nie godziły w zasadę dobra dziecka. Autorka podejmuje próbę udzielenia odpowiedzi na pytanie, czy wyrażenie przez przedstawiciela ustawowego zgody na publikację wizerunku małego dziecka, w szczególności noworodka i niemowlęcia, może być postrzegane jako działanie sprzeczne z dobrem dziecka. Rozważania obejmują problematykę wykorzystania wizerunku człowieka z czasu jego życia płodowego oraz wykorzystania wizerunku małego dziecka przez rodziców przez umieszczanie go na portalach społecznościowych.

This paper examines social stigma in relation to child welfare involvement. Drawing on interviews with twenty former youth in care, the paper highlights the participants’ experiences with stigma and their adaptive responses. Notably, participants described pervasive stigma that accompanied their status as youth in care. To contend with the stigma they experienced, participants developed a range of responses, including concealment, challenging the stereotypes, physical retaliation, and seeking solidarity. The study aligns with previous research identifying concealment as a relevant strategy for mitigating the effects of stigma among foster care recipients. However, the results also extend the literature in this area by identifying additional adaptive responses. Moreover, the participants revealed that the stigma they experienced was pervasive, yielding long-term effects.

W artykule przedstawiona zostanie istota i uwarunkowania realizacji dobra dziecka, a także podjęta zostanie próba odpowiedzi na pytanie czy piecza zastępcza gwarantuje realizację praw i dobra dziecka.
The article concerns the foster care of a child in the context of the implementation of the rights and welfare of the child. Upbringing in a family is one of the basic rights of a child, while placing a child outside the family in foster care can only be of a subsidiary nature. The article will present the essence and conditions for the implementation of the child's welfare, and an attempt will be made to answer the question whether foster care guarantees the realization of the rights and welfare of the child.

W artykule poruszono zagadnienia dobra dziecka, dysfunkcji rodziny i pieczy zastępczej w polskim systemie prawnym. Opisano znaczenie rodziny, jej funkcji i roli w życiu każdego dziecka. Przybliżono problem dysfunkcji rodziny oraz niewłaściwych postaw i zachowań rodzicielskich. Przedstawiono także instytucję pieczy zastępczej jako formę pomocy rodzinie stosowaną w przypadku braku należytej pieczy rodzicielskiej oraz naruszenia zasady dobra dziecka.

The thesis characterizes the importance of the family, its functions and the role in the life of each child. The problem of family dysfunctions, improper attitudes and parental behaviours is disclosed. Moreover, the foster care institution is presented as a form of family support applied in the absence of due parental care and violation of the child welfare principle.

W pracy opisano znaczenie rodziny, jej funkcji oraz roli w życiu każdego dziecka. Przybliżono problem dysfunkcji rodziny, niewłaściwych postaw i zachowań rodzicielskich. Ponadto przedstawiono instytucję pieczy zastępczej jako formę pomocy rodzinie stosowaną w przypadku braku należytej pieczy rodzicielskiej oraz naruszenia zasady dobra dziecka.

Opis:
This Article is about the nature of contacts between the so-called “peripheral” parents and children. It discusses the issue of dependence of access rights on parental authority, over the subsequent amendments of the family law in Poland. The paper describes the basic forms of exercising contacts between parents and children. It also presents forms of regulating them in legal proceedings. The guiding principles which should guide the court in issuing decisions which determine the scope and method of contact of parents with children are pointed out in the article. It also shows the institution of “alternate care” introduced to the Family and Guardianship Code under the Act of 25 June 2015 amending the Act - Code of Family and Guardianship Code and the Law - Code of Civil Procedure, which entered into force on 29 August 2015.
