In this paper, the author raised the question of whether the separation of powers is a use-less concept. It points out to insufficient reflection of its theoretical and philosophical origins. The paper also distinguishes its components, which it then analyses in more detail. Great attention is dedicated to the tension between the system of checks and bal-ances and the institutional independence. It also examines the purpose of the separation of powers, warning that we can no longer seek it exclusively in the prevention of tyranny but rather in the optimization of government. At the end of the paper is emphasized the need to examine the question of how to solve tension between these components.

The purpose of the article is to analyse the subject of the problems involved in protecting human rights in Thailand and the role of the courts according to the Thai Constitution. The author discusses four selected issues of human rights protection in Thailand: the citizens’ insufficient awareness of human rights, the ineffectiveness of law enforcement,the possible conflicts linked to traditional beliefs and the problems of applying double standards. The article also presents the structure and the function of the Constitutional Court, the Court of Justice and the Administrative Court of Thailand. Throughout the paper the author seeks to prove that the Constitution of the Kingdom of Thailand honours and protects human rights.

In 2010 Hungary entered a new chapter in its history, described on the domestic stage as ‘the struggle for freedom’, the ‘age of national independence’ (from any foreign diktat) and the ‘unorthodox economy’, which led also to its ‘opening to the East’ (including China and Russia). The unquestioned leader of the state, Prime Minister Viktor Orbán, even confi rmed that this is ‘an illiberal system’, moving ever further and further away from the liberal democracy established in 1990. Using mainly Hungarian language sources (as only small part of the crucial material is available in English), this study tries to describe the essence of the new system, the way it works, and what it looks like. The importance of this Hungarian case study lies in the fact that it constitutes yet another challenge on the path of European integration, along with so many other obstacles that have recently been occurring. Is the new Hungarian system a model for the others in the region and for the whole EU? No one knows the answer, but it is high time we examined what the Hungarian system looks like from the inside, after its departure from the rule of law, liberal democracy, and the system of checks and balances.

Separation of powers is one of the most basic principles democratic states are based on. Still, there is No. common standpoint what exactly separation of powers means. The present essay examines the ideas of Rousseau, Marxist scholars and some modern theorists concerning separation of powers and checks and balances mechanisms that exist in the legal system. The author analyses as well how the different powers balance each other in practice.
Podział władzy jest jedną z podstawowych zasad, na których oparte są państwa demokratyczne. Nie odnajdziemy jednak wspólnego stanowiska co do rozumienia i zakresu podziału władzy. Niniejszy esej analizuje idee Rousseau, marksistowskich uczonych i niektórych współczesnych teoretyków dotyczące podziału władzy oraz mechanizmów kontroli i równowagi, które istnieją w systemie prawnym. Autor analizuje również, w jaki sposób poszczególne władze równoważą się w praktyce.

The main purpose of this article is to bring the reader into an atmosphere of intensity created by the political disputes about the need of immigration reform in the United States. It is unquestionable that problems of the immigrants, who for decades were crossing illegally American borders, contribute to internal political turbulences in this country. This article proceeds on the assumption, that the immigration related problems created a social „melting pot” which became one of the most serious challenges for the American policymakers. The confrontation of the President with Congress was inevitable. On the one hand, Obama’s administration started to regulate the status of illegal immigrants by executive orders; on the other hand, the Congress was determined to bloc these actions as illegal attempts of the President violating the prerogatives of the legislative body. The conflict resulted in the stalemates which seriously undermined the effectiveness of the American system of checks and balances. The lack of legal certainty, a necessary component of the reliability of the democratic governments, triggered the dispute over the values of the interpretational flexibility of the Constitution of the United States.

The article is devoted to the study of the mechanisms of influence of the institute of constitutional justice on the processes of balancing power in a democratic state and formulating conclusions on the basic principles of reforming the domestic constitutional model of relevant legal relations. The author states that the special status of constitutional justice bodies within the continental model, in particular the status of the Constitutional Court of Ukraine between branches of government, is due to the important mission of constitutional justice bodies to find a fine line between positive, natural law and political influence of different branches of government. The corresponding task allows to make certain analogies with the status of some other subjects of power. The key difference between the Constitutional Court of Ukraine, as a subject of relations between the branches of government, is much greater, and even in fact - the maximum distance from each of these branches. Such a model becomes especially relevant when the legislature, executive and president are representatives of the same political force, when the body of constitutional jurisdiction actually remains the only entity capable of resisting the possible intentions of the respective forces to “control” the judiciary. At the same time, the special status of the bodies of constitutional justice, along with the institutional provision of their maximum distance from any single branch of government, is also guaranteed by the requirements of professionalism of their staffand a certain degree of independence from electoral sentiment.

Opis:
The article presents the checks and balances in the budget procedure in Poland. In the first place, the article explains the term checks and balances. Next the article discusses the constitutional regulation of the budget procedure and the public authorities that participate in this procedure. These considerations allow to distinguish “budget checks and balances” and describe them from the point of view of the relationship between the public authorities participating in the budget procedure. The article also presents the legal nature of the state budget and the legal norms contained therein, the differences between the state budget and the Budget Act and the issue of the draft budget versus the principle of discontinuation of works of the parliament.
Artykuł dotyczy problematyki checks and balances w procedurze budżetowej w Polsce. W pierwszej kolejności w artykule zostaje wyjaśniony termin checks and balances. Następnie artykuł omawia konstytucyjną regulację procedury budżetowej oraz występujące w tej procedurze organy władzy publicznej. Rozważania te pozwalają na wyróżnienie „budżetowych checks and balances” oraz ich omówienie z punktu widzenia relacji pomiędzy organami władzy publicznej biorącymi udział w procedurze budżetowej, ze szczególnym uwzględnieniem opracowania, uchwalenia i kontroli wykonania budżetu. Poruszone są również wątki charakteru prawnego budżetu państwa i zawartych w nim norm prawnych, różnic pomiędzy budżetem państwa i ustawą budżetową, a także zagadnienie projektu ustawy budżetowej a dyskontynuacji prac parlamentu.

The principle of checks and balances counts among the most fundamental constitutional values, as it is connected with the recognition and guaranteeing of human rights – in other words is the very essence of the Constitution, an act that limits the majority rule to allow for the rights and freedoms of the individual. Also of key importance is the connection of this precept with the essence of the democratic system, understood as one where the majority rule is constrained by human rights. The principle of checks and balances could function in full only in correspondence with culture of respect for human rights. The status of the sovereign needs legitimacy, which derives from the sovereign’s subordination to the Constitution. Being sovereign means being unsubordinated to anybody. It is thus fair to conclude that the attribute of sovereignty actually belongs to the values that have been shaped by culture and linked to the timeless moral rules and principles corresponding to humanity’s eternal dilemmas – the values that create the constitutional culture, i.e. a community’s set of values. The sovereign does not exercise the supreme authority over values, and the values are embodied in the Constitution, which is inseparably linked with the people and their sovereignty. The Constitution of the Republic of Poland reflects the precepts of liberal democracy, or such kind of democracy where the sources of human rights do not stem from the will of the majority. The model of governance adopted in the Constitution could be described as consensual democracy. Constitutional practice has taken a course where the system of consensual democracy – as laid down in the Constitution of Poland, with the power of the majority being constrained by rights of the minority – is turning into a system of a majority democracy, based not on a dialogue between the majority and the opposition, but on the power of a parliamentary majority who disregards the systemic role of the opposition.
