W artykule przybliżono zagadnienia związane z funkcjonowaniem planowania przestrzennego w odniesieniu do Niemiec, wskazując na podobieństwa i różnice w stosunku do rozwiązań polskich. Porównanie takie wynika z faktu wstąpienia Polski do Unii Europejskiej i potrzeby rozpoznania, na ile rozwiązania polskie są w tym zakresie podobne do rozwiązań europejskich. Ze względu na obszerność zagadnienia, w artykule przedstawiono zarys planowania przestrzennego na szczeblu krajowym, regionalnym i lokalnym. Choć system funkcjonowania planowania przestrzennego w obu krajach jest z pozoru podobny, to jednak napotkać można istotne różnice w zasadach organizacji i tworzenia planów w Polsce i w Niemczech.
The article is targeted at the readers from land surveying community and describes the physical planning rules and regulations in Germany with stress on similarities and differences to Poland. Such comparison results form the accession of Poland to European Union and the need to determine how much the Polish system is similar to the Euopean system. Because of the complexity of the subject, the article drafts the fundamentals of physical planning on the country, regional and local levels. Although the functioning of the system of physical planning in both countries appears to be similar, significant differences can be spotted in the rules of organization and creation of plans in Poland and Germany.

The right of ownership is the broadest and one of the most basic property rights, which allows the owner to use and dispose of possessions without the participation of third parties. Therefore, the process of modernising the land and building register (MLBR) is extremely important considering, for example, that the data contained in this register is the basis for the subsequent calculation of public-legal obligations associated with the owned property, such as taxes. According to the current legislation, the data collected in the land and building register (cadastre) on the type of land use in combination with the soil classification of agricultural and forest land, the use of the property, its purpose and other information, are the basis for determining the agricultural, forest and real estate taxes by the competent authority. In Poland, in most cases, we have to deal with a situation in which the data appearing in the register differs from the actual state. Municipal budgets suffer losses because of this, and owners of properties of similar area and value sometimes pay completely different taxes. In this paper, the authors show a practical example of MLBR and the problems existed with it.

The objectives important from the point of view of environmental protection can be implemented in different ways, using different management tools. Therefore, it should be noted that it fully seems reasonable to assume that some of the important goals in terms of environmental protection will be achieved through spatial management tools. The main objectives of this article are to determine how the spatial management system at local and regional level in Poland is carried out in relation to the environmental protection as well as to assess the current state of affairs in this area and to propose some changes. Particular attention was paid to the direct instrument of spatial management, which is the local development plan.

Municipal authorities should implement measures aimed at balanced development: in the ecological, economic and social range. An important role in this context is played by the procedure of the assessment of the environmental impact and the decision on the environmental conditions. The aim of this article is to identify the role that the decision on the environmental conditions issued by the municipal executive authorities plays in the regional and local development management. Surveying field measurements performed during the development and updating of land registry were based directly on measuring networks. Accuracy parameters of these networks are lower in comparison with modern measurement networks. The main reasons for the lower accuracy relate mainly to the lower precision of measurements, two orders of network and approximate techniques for determining the coordinates of the points of these networks. Currently, archival materials of the State Geodetic and Cartographic Resource are used during surveying of real estate (division, separation, modernization of land registry). The paper presents the results of experimental evaluation of the accuracy parameters of former networks. The purpose of the performed evaluation to was to analyze the possibilities of use archival materials of the State Geodetic and Cartographic Resource during surveying works related to real estate. The study was carried out on the basis of three test objects located in the Małopolskie voivodship. Points of the analyzed networks found on the ground were measured (approx. 34% of all points), and then their coordinates were determined. The representative research sample was constituted by sets of deviations Z - the length of the displacement vector of the point in the research sample in relation to its position considered as error free. The basic estimator of the accuracy of analyzed networks was the root mean square error RMSE. This estimator was determined on the basis of a vector Z* originating from the set, from which the outlying observations were removed. Values of calculated RMSE show, that for the analyz ed objects the required accuracy is met by no more than 16% of the points of the networks (RMSE ≤ 0.20 m). Therefore, it may be concluded, that for more than 80% of the border points the average position errors exceed the threshold size: 0.30 m relative to the 1st class geodetic network. Hence the conclusion that during surveying real estate, archival materials of the State Geodetic and Cartographic Resource should be used in a limited scope.

The legal basis for the modernization of the land and building registry is the Act of 17 May 1989 Geodetic and Cartographic Law, which determines how the procedure of update and modification of data, to the form which is in accordance with applicable regulations, is carried out. Maintaining of the proper degree of timeliness and reliability of the registry data is important because of the prospect of integration with the Databases of Topographic Objects (BDOT) and Geodetic Registry of Infrastructural Network (GESUT), in the project of construction of the Real Estate Integrated Information System (ZSIN). Furthermore, the land and building registry (EGiB) plays a significant role in the implementation of most of the processes of real estate management. The aim of the publication is to verify the compliance of the registry data regarding the area and the course of the borders of plots before and after modernization, with the real state in the field. The complex survey of plots before and after modernization was performed to assess the effects of modernization, taking into account the reliability of geodetic works and the timeliness of the registry data. The present study involved updating the course of borders and areas of the plots used solely for agricultural purposes. The object of research represented the complex of 31 plots used for agricultural purposes, located far from the village buildings. The study area is located in Małopolskie voivodship, in the district of Myślenice. In order to verify the course of borders of plots the rapid satellite measurement using the method RTK / RTN with the receiver CHC X900+ was applied. The selected measurement technique is economic and accurate, therefore often used by surveyors for this type of field tasks. The study showed the need for re-modernization of land and buildings registry in the selected area.

Land management constitutes an integral component of planned spatial management that binds it with the entity, which is responsible for land management, charging it with particular obligations, including those specified in the Surveying and Mapping Law of 17 May 1989. The Law entails such issues as the national land information system, land and building registry (property cadastre), state survey and mapping resources and the infrastructure inventory. According to the Law, data included in the land and building registry constitute a basis for business planning and spatial planning, as well as of public statistics, taxation and benefits, with proper marking of properties in the Land Registers. Data included in the Land and Building Registers and Infrastructure Registers, together with other data collected in the state survey and mapping resources, constitute a basis for the national land information system. The requirements of a good subjective and objective land division are met by the classification implemented by the Regulation of the Minister of Regional Development and Building of 29 March 2001 Concerning Land and Building Registry. The capability to use resources allocated by the European Union will be of fundamental importance for the development of Poland in 2007-2013. That capability will depend on the practical application of institutional instruments and solutions. Therefore, it is necessary to recommend to the Polish communes the databases, as well as land and property information, which are essential for land management, including the metadata databases on the existing and projected Spatial Databases and Geographic Information Systems (GIS) maintained by the initiative of the Chief National Surveyor.

The Land and Property Register (LPR) also called the Cadastre by the legislator should function in accordance with regulations in force, meet expectations of the public and provide universal access to Register data for its users. Beyond any doubt, credibility and usefulness of data in this public register are affected by the manner it is kept, which generally includes active and passive approach. If the LPR is kept in an active manner and constantly up to date, its data is very useful. The qualitative aspect of the land and buildings database’s records establishes the calculation accuracy of the owners’ land parcels evidenced in the Land and Mortgage Registers, which protect the ownership right to the property. In order to ensure that the plot of land is unequivocally and correctly measured, it is necessary to establish breakpoints of the parcels’ boundaries in the presence of the interested parties. Research conducted on the possibility of using the unmanned aerial vehicle (UAV) for measuring purposes indicates immense probability where this technology may be used for the selected details of group I (most accurately located) in modernization of land and buildings registers.
