In the position of the Sejm a statement was proposed that the appealed provision of the Act on the Border Guard, in the area in which it stipulates that an officer entitled to a functional allowance is not entitled to time off from service in exchange for service overtime exceeding service standards, is compliant with the indicated provision of the European Social Charter drawn up in Turin on 18th October 18 1961. The Applicant emphasized that the legislator did not comply with the provisions of the ESC, for he deprived Border Guard officers serving in independent or managerial positions of the right to free time or remuneration for the time of service performed in overtime. In the justification of the position, it was stated that Article 4 of the ESC does not determine the extent of additional remuneration that employees are entitled to for overtime work. Therefore the national legislator has been left with far-reaching freedom to define the rules of remuneration of employees.

In the opinion it was stated that although examining identity documents is associated with a temporary restriction of freedom of a Deputy by an authorized body, it does not constitute a violation of the privilege of parliamentary inviolability. Undertaking Deputy’s activities related to the exercise of the mandate in a border zone, does not require an appropriate consent. The privilege of inviolability does not absolve the Deputy from the obligation to respect the law. As a rule, a Border Guard officer cannot detain the Deputy during performing activities falling within the scope of the parliamentary mandate in the border zone. Deputies may be detained only in the event of joint fulfillment of requirements provided in the Article 105 para. 5 of the Constitution.

Terrorism and ecoterrorism are one of the contemporary public safety threats in Po-land. The emerging radical ideologies that assume violence and terror find their sup-porters, which enforce state activity. Both the Police and the Border Guard, guarding the broadly understood security and public order, are obliged to counteract and combat terrorism. This article presents considerations regarding counteracting and combating terrorism and ecoterrorism in Poland by the Police and the Border Guard. Thanks to their activities, it is possible to identify terrorist threats and counteract them, as well as to prosecute the perpetrators of acts of terrorism.

Celem niniejszego artykułu jest przedstawienie – w ogólnym zarysie – podstaw prawnych i organizacyjnych działalności Straży Granicznej w dwudziestoleciu międzywojennym. Okres ten można podzielić na dwa etapy. Pierwszy: lata 1918-1928, drugi 1928-1939. Granicę pomiędzy nimi wyznacza rozporządzenie Prezydenta RP z 22 marca 1928 r., na mocy którego na miejsce Straży Celnej powołano do życia – zorganizowaną na wzór wojskowy – Straż Graniczną. Fakt odzyskania w listopadzie 1918 r. niepodległości stanowi dla narodu polskiego wydarzenie o przełomowym i historycznym znaczeniu. Po niemal 123 latach Polska w wyznaczonych na konferencji w Wersalu granicach znalazła się ponownie na mapie Europy. Ale już wkrótce byt niepodległego państwa polskiego, został zagrożony (konflikt polsko-ukraiński 1918-1919, wojna polsko-bolszewicka 1920-1921), toteż obrona jego granic stała się najważniejszym zadaniem władz II RP. W związku z tym należało w krótkim czasie – na podstawie nowych już przepisów prawnych – zbudować sprawną, skuteczną strukturę (bardzo ważną rolę w tym zakresie odegrało przygotowanie, wyszkolenie kadr oraz wyposażenie ich w nowoczesny sprzęt) straży granicznej. Najtrudniejszy egzamin przyszło zdać żołnierzom i oficerom, którzy strzegli polskich granic we wrześniu 1939 r. Tragicznym  pokłosiem sowieckiej agresji (17 września 1939 r.) była zbrodnia katyńska dokonana przez NKWD wiosną 1940 r. W masowych mogiłach Katynia miejsce wiecznego spoczynku znaleźli także oficerowie Korpusu Ochrony Pogranicza, wśród nich pochodzący z Przemyśla Romuald Dziedziuk (2. pułk piechoty).
The purpose of this article is to outline the legal and organisational foundations of the activity of the Border Guard during the two decades that intervenen between the wars. This time can be divided into two periods: 1918-1928 and 1928-1939. the transition between them was marked by the President's order of 22 March 1928, whereby the Border Guard was called into existence to supersede the former Customs Guard. Its structure was modelled upon that of the military. the recovery of independence in 1918 was a milestone in the Polish history. After nearly 123 years, Poland found its place on the map of Europe within the limits determined by the treaty of Versailles. Soon the independent existence of the Polish State became threatened (the Polish-Ukrainian conflict in 1918-1919, the Polish-Bolshevik War of 1920-1921), so for the Polish state authorities a defence of the country's borders was top priority. Hence, within new legislation, it became necessary to build an efficient structure of border guard (preparation and training of personnel as well as provision of modern equipment were vital). the hardest test awaited soldiers and officers who defended the Polish borders in the September of 1939. the tragic aftermath of the Soviet invasion (17 September 1939) was the Katyń Massacre, conducted by NKWD in the spring of 1940. the mass graves at Katyń also accommodated the bodies of Border Protection Corps officers, including the body of Romulad Dziedziuk of Przemyśl (2nd Infantry Regiment).

Realność Rzeczypospolitej jako bytu skończonego oznacza, że posiada ona prawo do granicy oraz do „Straży Granicznej” jako instytucji mającej za naczelne zadanie strzeżenie bezpieczeństwa państwa. Kim powinien być strażnik? Sokrates naucza, iż „dobry i pracowity strażnik państwa” powinien być „wychowany i wykształcony”. Czym jest ta formacja w jej istocie? Metafizyczność i katolickość charakteryzują najprecyzyjniej istotę struktury prawno-moralnej Straży Granicznej; pierwszy wymiar można dostrzec w jej oryginalnej „podmiotowości”, drugi zaś wymiar uzewnętrznia się najbardziej w pojęciu „osoby”, zaczerpnięty z katolickiej myśli teologicznej. Właśnie osoba strażnika, obywatele państwa Rzeczypospolitej oraz państw sąsiednich narodów Polski, ludzie przekraczający granicę i obsługiwani przez straż graniczną są najwspanialszymi „podmiotami” tej formacji i zarazem przedmiotami jej naczelnej troski we wszystkich działaniach. Granica rozumiana jest zatem generalnie jako zewnętrzny znak wewnętrznego i zewnętrznego bezpieczeństwa obywateli i ich państwa. Jaka jest finalność Straży Granicznej w Rzeczypospolitej? Z pewnością ma ona za najwyższy cel stać w służbie dobra wspólnego Polaków i Polski oraz dobra każdego obsługiwanego i napotkanego na przejściach granicznych człowieka. Stosowanie kary możliwe jest de iure jako następstwo złamania prawa. Z powyższego wynika konieczność troski o godne szlachetności osoby ludzkiej przejścia graniczne jako wizytówki narodu polskiego i państwa.
The reality of ended Polish Republic means that it has the right to the border and “Border Guard” as an institution with a task of safeguarding the security of the country. Who should be a border guard officer? Socrates says that a good and diligent guard of the state should be well-mannered and educated. What is this formation in its essence? Its metaphysical nature and Catholicism characterize the essence of the moral and legal structure of the Border Guard; the first dimension can be seen in its unique “subjectivity”, while the other dimension manifests in the concept of a “person”, taken from the Catholic theological thought. the greatest “subjects” of this formation and objects of its concern are the border guard officers, citizens of the Republic of Poland and neighbouring nations, people crossing the border serviced by the Border Guard. the border is generally understood as an external sign of internal and external safety of citizens and their state. What is the final image of the Border Guard in the Republic of Poland? Surely it has to serve and support Poles and their country, but also every person crossing the Polish border. the use of penalties is possible, according to law, as a consequence of breaking the law. It means that the need to respect for human dignity should be the pride of Polish nation and the country.

Głównym celem niniejszego artykułu jest prezentacja historii i rozwoju Nadbużańskiego Oddziału Straży Granicznej od początku istnienia do 2011 r.
In the Polish system of internal security, tasks of the state border protection are carried out by Border Guard. Established in 1991, independent and subordinated to Ministry of Internal Affairs formation plays significant role in national and European dimension, as body responsible for safety of external border of United Europe. Very important element of formation is Nadbużański Border Guard Regional Unit. This body is responsible for protection external EU border partly with Ukraine and Belarus. the main goal of  this study is presentation history and process of development of Nadbużański Border Regional Guard Unit since its beginning to 2011.

Uncontrolled migration is one of the threats to the state, and as illegal immigration, it is a leading threat to international security. From the point of view of state security, illegal immigration is classified as “requiring caution.” In the case of Poland, illegal immigration is to a considerable extent handled by organised crime of transnational reach, effectively taking the form of criminal enterprises. In the present day, differentiating between migration and exile is intricate, because the reasons behind migration are unclear and depend on numerous factors, also related to migration policies in target countries. However, for criminal enterprises, which stop at nothing to maximise their business profits, both refugees seeking refuge and migrants seeking to improve their socio-economic situation are a source of substantial financial gain. Criminal organisations generate profit by committing various crimes. In establishing the thematic scope of this work, I assumed that its subject would be the process of the formation of border services in interwar Poland. This means a deliberate and complete disregard for the essentially distinct administrative role played by the border guard. The presentation of the Border Guard from an administrative perspective changes the situation so profoundly that a thorough discussion of its implications would certainly double the volume of the publication. A superficial treatment of the administrative issue would lead to misunderstandings. Furthermore, a superficial omission of the administrative issue was deemed necessary because the formations were mainly military in nature. Before going into details and elaborations, I would like to present my main research objective, which is the following question: what was the evolution of the legal status of Polish border formations in the inter-war period? In view of this objective, it is necessary to present the work from a historical perspective. The chronology of the facts is important for the subject matter, as it serves to systematise the considerations. The structure of the work and the research method were adjusted to the above-mentioned assumptions of the publication, which shows the reasons for the creation and the process of transformation of the border formations in relation to various types of institutional solutions, up to the moment of the creation of the Border Protection Corps and the Border Guard Corps, operating under these names until 1939. The potential conclusions resulting from this chapter concern: the presentation of the institutional construction of the border formations in the years 1918–1939 and the demonstration that in the interwar period they were the main organs of the Second Polish Republic, which guaranteed the inviolability of state territory and the security of the citizens on the subordinate territory.

Wnioski płynące z analizowanych badań pozwalają stwierdzić, iż poprawa ,,Założeń wieloletniej koncepcji funkcjonowania Straży Granicznej na lata 2009-2015» znacząco wpłynie na proces umacniania bezpieczeństwa transgranicznego Polski.
The aim of this paper is to define the cross-border security and to attempt the delineation of a new direction for its development, as well as to show the important issues relating to the functioning of the state border protection and make suggestions for their solution. The research material is literature related to the wider security, as well as the Border Guard statistics. The test method is the analysis of text and statistics. The results of the research focused on the presentation of the discrepancies and differences between the theoretical assumptions and the actual state of the Polish cross-border security. The conclusions of the included studies allow us to conclude that the long-term improvement ,,Assumptions Border Guard operation concept for 2009-2015” significantly affect the process of strengthening Polish cross-border security.

Cross-border cooperation constitutes one of the most important projects within the European ‘architecture’, and entails an entire system consisting of international public law, European integration, subsidiarity and partnership parameters, decentralisation and regionalisation, as well as international and domestic security parameters. It is one of the priorities of the European neighbourhood and strategic partnership policy. Cross-border cooperation focuses on member states and states utilising the European Neighbourhood and Partnership Instrument. It applies to both land and sea borders. With regard to cooperation aimed at ensuring Polish border security, two levels can be defined: 1. cooperation with the neighbouring states and domestic institutions with regard to the system of managing state border security, focused primarily on actions relating to preventing and counteracting cross-border crime; 2. cooperation benefiting third countries (countries which are not neighbours) which is advisory in nature and entails sharing experience and best practices. In this paper, I analyse various methods and forms of cross-border cooperation on the international and domestic level.

Author analyses in the article the problem of functioning of the external borders of the Republic of Poland in the Schengen area. The text frames the analysis in the context of the political science. The author discusses the changes in state system of protection of the state border of the Republic of Poland resulting from the integration of the Republic of Poland with the European Union, in particular with the Schengen area. The basic objective of the article is the analysis of the scope and type of organisational and administrative-logistic undertakings in the field of border protection after Poland’s participation in the Schengen Area. The analysis is started with characterisation of changes in the system of management of the state border and the ways of functioning of border services in connection with the accession to the EU were characterised. EU requirements for strengthening border infrastructure and the system of cooperation between institutions responsible for border security were also analysed. As a result, the accession of the Republic of Poland to the Schengen area entailed a complete change in the strategy of managing the state borders. Autor analizuje w artykule problem funkcjonowania granic zewnętrznych Rzeczypospolitej Polskiej w strefie Schengen. Tekst sytuuje się w obszarze nauk o polityce. Autor omawia zmiany systemu ochrony granicy państwowej Rzeczypospolitej Polskiej, wynikające z integracji Rzeczypospolitej Polskiej z Unią Europejską, w szczególności ze strefą Schengen. Celem podstawowym artykułu jest analiza zakresu i rodzaju przedsięwzięć organizacyjnych i administracyjno-logistycznych w zakresie ochrony granicy po przystąpieniu Polski do strefy Schengen. W pierwszej kolejności scharakteryzowano zmiany systemu zarządzania granicą państwową oraz sposobów funkcjonowania służb granicznych w związku z akcesją do UE. Analizie zostały również poddane unijne wymogi zarówno w zakresie wzmocnienia infrastruktury granicznej, jak i systemu współpracy instytucji odpowiedzialnych za bezpieczeństwo granic. W efekcie przystąpienie Rzeczypospolitej Polskiej do strefy Schengen wiązało się z całkowitą zmianą strategii zarządzania granicami państwa.
