    While biobanks constitute an indispensable source of scientific data, they also generate many concerns related to the ethical, legal and social aspects of acquiring and storing of human biological material, particularly when it comes to the matters of privacy and confidentiality of data and commercialization of research results. It is important as social perception of biobanking may have a bigger impact on the donors than real scientific achievements, while negative images of biobanks may negatively influence the readiness to donate. This, in turn, may impede the functioning of biobanks. Thus, the aim of this paper is to describe the main social anxieties related to gathering and usage of human biological material. Beginning with the concept of geneticization, the paper will tackle the most important social concerns regarding biobanking: creation of a unique genohype, geneticization of diagnostics and identity, the risk of genetic discrimination and commercialization of genetics and gene patenting.

    Opis:
    Biobanks are one of the 10 Ideas Changing the World Right now – according to Time Magazine (2009). Samples and data deposition have become an increasing. trend in the world. Europe has invested a lot of money into infrastructures responsible for collection and storage of human biological samples. Poland, a country with a population of over 38.5 million people has just started investing funds into this powerful and indispensable tool for scientific research. Consortium of Polish Biobanks named as BBMRI.pl consisting of seven well-established biobanks developed a project for the Creation of the Polish Biobanking Network in order to organise our infrastructures according to world-recognized standards. The main tasks include: creation of Consortium of Polish Biobanks, development of IT solutions coherent with pan European needs, development of quality assurance tools, establishment of the Biobanking National Node, development of quality control programme and analysis of Ethical, Legal and Social Implications of research using human samples. Results of this project will increase Poland’s position in the international research arena of biomedicine, make our biorepositories open for international collaboration and in the future will contribute to the development of personalized medicine.

    Biobanks for research purposes legal regulation is currently under debate. An important issue discussed is protection of the personal data collected in the biobank, including genetic data and other health data. This subject is extremely important given the current development of information technologies that allow for mass aggregation and analysis of personal information. This article describes the constitutional requirements for the discussed regulation, in particular regarding the privacy and informational autonomy of the individuals. The author refers in particular to the application of the proportionality principle.

    Opis:
    The subject of the article is the analysis of the rights of donors donating their biological samples to biobanks in the 21st century. Issues regarding donor rights have been analyzed since the 1980s, however, changing times, creating Big Data databases as well as evolving legal awareness of donors meant that today the role of donors in the biobanking process should be perceived differently. Donors become active subjects of scientific research which is connected with the need to answer questions about the obligations to inform them about the results of scientific research conducted on their samples or incidental findings. Likewise, the combination of data registers and the creation of Big Data basis require the re-thinking of terms such as the protection of personal data of donors or the anonymisation of their data. These issues are imposed by negligence or complete lack of legal regulation of the biobanking, which makes the legal protection of the rights of donors dependent on the will of a particular biobank. All these phenomena result in the necessity of new approaches to the rights of donors and their inclusion in the future legal regulation.

    Nieustannie rozwijające się społeczeństwo europejskie aktywnie mierzy się z problemami etycznymi, dotykającymi każdej części życia. Tekst ma na celu zaprezentowanie problematyki zarządzania danymi medycznymi oraz zaproponowanie uzasadnienia dla tego obszaru działalności badawczo-rozwojowej z perspektywy Unii Europejskiej przy uwzględnieniu istniejących już wartości oraz podejścia filozoficznego. Na podstawie wybranych koncepcji prezentujących różne dziedziny filozofii oraz bioetyki artykuł prezentuje holistyczne i nowoczesne podejście do zagadnienia etyki w zarządzania danymi. Punktem wyjścia dla tego typu rozważań stała się teoria umowy społecznej T. Hobbesa, która omawia powinności człowieka wobec społeczeństwa oraz wolności przysługujących człowiekowi. Dyskurs analityczny został wsparty koncepcjami filozoficznymi L. Floridiego oraz A. Dawsona. Te dwa paradygmaty pomagają zakreślić nowoczesne problemy i terminologie, które starają się uchwycić zmieniające się aspekty technologiczne dzisiejszego świata.
    Endlessly changing European society actively faces ethical problems that transpire through every part of life. This article aims to present the problem of managing and utilizing medical data and proposes a concept for justifying these types of research and developmental activities from the perspective of the European Union. By selecting appropriate texts from different areas within philosophy and bioethics, the author aims to show a cohesive and innovative approach. He utilizes the concept of a social contract from the works of T. Hobbes in order to highlight the duties of humans toward their society and the liberties that are available to them. Moreover, the philosophical concepts of L. Floridi and A. Dawson help capture the modern problems and terminologies that try to explain the everchanging technological aspects of modern society.
