    From the very beginning, the Church took upon herself the care of those to be married. Therefore, She placed upon Her spiritual pastors the obligation to prepare the faithful for the Sacrament of Matrimony. Aware of the fact that marriage is such an important occurrence in the lives of the engaged couple, and in the lives of the entire community of the faithful, the Church felt obligated to provide pastoral aid for young people in preparation for marriage. It is no wonder that the Codex Iuris Canonici of 1917 obligates spiritual guides to carefully and sensibly teach the faithful about the sacrament of matrimony and its hindrances. This topic also found its reflection in the resolutions of the First Synod of the Diocese of Tarnow. The resolutions put to rest the lawful disposition of the topic of a premarital exam which confirms that one is free to marry, and to announce the banns in order to remove any obstacles to marriage. Presented in such a way - using precautionary measures - the pastor diligently uproots these obstacles, allowing him to assist in the completion of the marriage in a weighty and agreeable manner.

    There are several categories of marriages that are outlawed from marriage banns. They are: secret marriages (under codex law); marriages concluded under a dispensation from the obstacle of the diversity of religion (under particular law [on the example of Poland]); mixed marriages concluded after a dispensation from the canonical form (by virtue of this dispensation [on the example of Poland]); marriages concluded in danger of death (under codex law); marriages concluded in an emergency (by epic); and marriages of ruling families (by virtue of the immemorial custom). To them should be added marriages, which have received a dispensation from the banns.
    Istnieje kilka kategorii małżeństw, które są wyjęte spod prawa o zapowiedziach. Są to: małżeństwa tajne (na mocy prawa kodeksowego); małżeństwa zawierane za dyspensą od przeszkody różności religii (na mocy prawa partykularnego [na przykładzie Polski]); małżeństwa mieszane zawierane za dyspensą od formy kanonicznej (na mocy tejże dyspensy [na przykładzie Polski]); małżeństwa zawierane w niebezpieczeństwie śmierci (na mocy prawa kodeksowego); małżeństwa zawierane w nagłych wypadkach (na mocy epikii); oraz małżeństwa rodzin panujących (na mocy niepamiętnego zwyczaju). Do nich należy dodać małżeństwa, które uzyskały dyspensę od zapowiedzi.

    Opis:
    The publication of marriage banns was in the Church from the beginning of its activity. In the middle century IV Lateran Council commanded to publish da ta base of parties before contract marriage. Now Code of C anon Low prescribes: „Before a marriage takes place, it must be established that nothing stands in the way of its valid and lawful celebration”. „The Episcopal Conference is to lay down norms c o n c e rn in g . the publication of marriage b a n n s . ”. The Polish Episcopal conference in the year 1989 promulgated norms about preparation for entering marriage. Those norms order to publication of marriage banns in Poland. In the y ear 1995 polish Parliament passed a bill Personal Da ta Base Protection Statute. This document prohibits inter alia divulgation of news personal da ta bases. What can do a priests in those situation?The Concordat between Holy See and Republic of Poland decides that Catholic Church exercises jurisdiction according to canon low. Furthermore Personal Data Base Protection Statute permits data bases processing of people who are faithful of the Church.

    According to can. 1067 of the Code of Canon Law „The Episcopal Conference should issue norms relating the examination of spouses, the marriage banns and other opportune means to accomplish the investigations necessary before marriage, so that the parish priest, following them diligently, may assist in the marriage”. Taking into account the legal norms regarding preparation for marriage and the protection of personal data amended by the Polish Bishops’ Conference, this article systematizes the topic of premarital announcements in the current legal order of the Catholic Church in Poland.

    The origins of the marital announcements issue concerning persons of dierent church aliation, go back to the eighteenth century. Since then, this issue has been regulated by the particularistic law, which was largely conditioned by the civil law. So far, there has been formulated only one do- cument of general nature which focuses on this subject – Pio-Benedictine Code. Codication of John Paul II does not mention the discussed issue. In Poland the discussed issue appears in the Polish Episcopal Conference Instructions on preparing for marriage in the Catholic Church and in the Polish Episcopal Conference Instructions on the pastoral care for marriages of dierent church aliation. However, they do not give clear guidelines, but some tips which certain standards of conduct can be inferred from. Perhaps the new Polish Episcopal Conference Instruction on marriage in the Catholic Church, which is being presently prepared, will regulate this issue in detail.
