    The law of general average is one of the oldest institutions in maritime law, which is still applicable in contemporary shipping. Although the role and function of general average have naturally changed throughout centuries of its history (the main reasons therefor being the popularization of maritime insurance, which evolved much later than the general average) and general average has been and is subject to criticism pointing to its anachronistic nature and redundancy in today’s maritime economic realities. However practice shows that general average continues to resist these accusations and is commonly used in the practice of maritime commercial trade. This article deals with the issue of general average in light of Polish maritime law regulations, the essence and specificity of these legislative solutions concerning the safety of shipping in Poland, and also gives examples of events that occurred at sea that permit the announcement of an act of the general average. This article also presents considerations with regard to arguments in favour of maintaining the institution of general average as a legal instrument used in shipping, as well as critical voices emphasizing the need to eliminate general average as an institution of maritime law aimed at distributing losses, incurred to avoid a common peril, to the participants of a maritime adventure.

    Instytucja awarii wspólnej jest najstarszą instytucją prawa morskiego. Jej użyteczność we współczesnych stosunkach żeglugowych poddawana jest od dawna krytyce. Tym niemniej awaria wspólna pomimo tego, że nie jest przedmiotem żadnej umowy międzynarodowej zajmuje poczesne miejsce w wewnętrznych systemach prawnych państw morskich, a społeczność międzynarodowa wykazuje nią nadal duże zainteresowanie, zmieniając regularnie zasady jej rozliczania ustalone w drugiej połowie XIX w. w Yorku i Antwerpii. Podczas prac nad projektem nowego polskiego Kodeksu morskiego Komisja Kodyfikacyjna Prawa Morskiego dokonała pewnych zmian w uregulowaniach dotyczących awarii wspólnej, dostosowując przepisy polskiego prawa do nowych rozwiązań proponowanych przez uczestników morskiego obrotu międzynarodowego i organizacji pozarządowych, w tym Międzynarodowego Komitetu Morskiego.
    The concept of a general average is the oldest institution of maritime law. Its usefulness in modern shipping relations has long been criticized. Nevertheless, the general average, despite the fact that it is not the subject of any international agreement, occupies a prominent place in the internal legal systems of maritime states, and the international community continues to show great interest in it, regularly changing the principles of accounting established in the second half of the 19th century in York and Antwerp. During the work on the draft of the new Polish Maritime Code, the Maritime Law Codification Commission made some changes in the regulations concerning the general average, adapting the provisions of Polish law to new solutions proposed by participants of international maritime trade and non-governmental organizations, including Comité Maritime International
