Suicide is still one of the most stigmatized types of death, arousing controversy. There exists its special type: assisted suicide in which a one kills themselves with the help of another person. It is very interesting to compare the psychological consequences of these two forms of death for the suicide survivors – that is, the relatives of the ones who took their own lives. While there are many similarities between suicide and assisted suicide, certain "technical differences" between them can significantly affect the later functioning of the survivors. In the case of "ordinary" suicide, we distinguish factors that make it difficult to survive bereavement, while assisted suicide may sometimes also have a facilitating effect on this process. The literature review shows that suicide survivors experience a higher sense of guilt (exacerbated by sometimes felt relief), anger, abandonment and responsibility, and lower support and acceptance than the relatives of other deceased. Interestingly, they do not necessarily suffer from mental disorders more often, but they are more stigmatized and feel the need to hide the circumstances of their loved ones’ death. People left after the assisted suicide also sometimes experience emotions such as relief and a sense of abandonment, they tend to distance themselves from others and hide the truth about the death of their loved ones (in this case also because of the fear of legal consequences). The most significant differences, important for the later experience of bereavement, are the possibility of saying goodbye, as well as the belief that they provided their loved ones the "good death". These factors make it much easier to mourn, reduce the traumatic experience of grief. However, there are other factors potentially complicating bereavement – research shows that assisting in suicide correlates with certain mental disorders. This may be, for example, because of ethical doubts that this practice raises, conflict with the value system, potential remorse, alienation from the community after condemning such an act, fear of legal consequences and doubts if assisting in a suicide was a right decision.

This article undertakes to show the way that has led to the statutory decriminalization of euthanasia-related murder and assisted suicide in the Kingdom of the Netherlands. It presents the evolution of the views held by Dutch society on the euthanasia related practice, in the consequence of which death on demand has become legal after less than thirty years. Due attention is paid to the role of organs of public authority in these changes, with a particular emphasis put on the role of the Dutch Parliament – the States General. Because of scarcity of space and limited length of the article, the change in the attitudes toward euthanasia, which has taken place in the Netherlands, is presented in a synthetic way – from the first discussions on admissibility of a euthanasia-related murder carried out in the 1970s, through the practice of killing patients at their request, which was against the law at that time, but with years began more and more acceptable, up to the statutory decriminalization of euthanasia by the Dutch Parliament, made with the support of the majority of society.

In this article, I raise some questions about two human phenomena—suicide and euthanasia, in which people choose to die, and take steps to arrange their deaths. I am concerned with these phenomena at three levels: With the language that we use to describe and talk about them. With the ways in which the words we use impact on how we relate to those who wish for death or who act in ways that suggest that they do, even if they don’t. With some ethical issues that arise in relation to them. I begin with a discussion of the impoverished language and conceptual landscape of suicide and suicidal self harm, and suggest that this poverty of language is unhelpful, because it frequently leads to the mislabelling of deliberate self-harming and apparently self-harming acts. Through discussion of some problems with the current language, and of some real and hypothetical stories about suicide and acts that resemble suicide, but are distinct from it, I introduce some new ways of thinking about and labelling these most distressing of human phenomena. Later, I turn to the way in which the term ‘assisted suicide’ has begun to be used to label ‘arranged deaths’ that are more properly referred to as ‘euthanasia’. Nowadays, in many countries, including mine, more and more people not only want to have the opportunity to decide on the time of their dying, but want to arrange their deaths with the blessing of the legal system. The wishes of these people are important, because they concern the balance between life and death; between suffering and release; between care and its lack; between the public good and the private will, and between liberty and constraint. Most discussions of ‘assisted suicide’ and euthanasia focus on particular cases in which people wish to die, or on the way in which ‘arranged deaths’— whatever we call them—are viewed and treated legally in different countries. By contrast, I say a little about the reasons for the growing popularity of the term ‘assisted suicide’. En route I try to answer the question ‘When people choose to die, does it matter what we call it?’ I end with some comments about suicide, euthanasia and human dignity.

In the recent decade quite a few countries and regions legalised physician assisted death. While palliative care is already or becoming the standard end of life care in many countries, the increased availability of physician assisted death coupled with the secularisation of hospice in more settings require – where this has not happened yet – a clear response of palliative care specialists to patients’ requests for physician assisted death. The paper analyses the World Health Organisation’s current description of palliative care with a special focus on its prohibition of hastening death. Some palliative care professionals do not agree with the ban on hastening death, and these professionals’ non-conventional interpretation of palliative care actually seems to meet the wishes of some patients.

Przedmiotem artykułu jest omówienie regulacji eutanazji oraz medycznie wspomaganego samobójstwa w polskim prawie karnym. Postawiona zostaje teza, że stosowane obecnie regulacje: zabójstwa z litości (art. 150 K.k.) oraz pomocy w samobójstwie (art. 151 K.k.) nie uwzględniają kontekstu medycznego oraz sytuacji zdrowotnej ofiary, stąd prowadzone w literaturze rozważania dotyczące wysokości zagrożenia karnego oraz instytucji nadzwyczajnego złagodzenia kary są nieuzasadnione. Pominięte zostało rozważenie dopuszczalności wymienionych procedur medycznych, bowiem niezależnie od założeń aksjologicznych przyszła regulacja pozwoli na zwiększenie ochrony prawa do życia pacjentów oraz bezpieczeństwa prawnego personelu medycznego. Na zakończenie sformułowany zostaje zarys przyszłej regulacji.
The subject of the article is a review of the regulation concerning a euthanasia and medically assisted suicide in the Polish criminal law. The thesis is that the currently applicable regulations on: mercy killing (article 150 of the Criminal Code) and assisted suicide (article 151 of CC) do not include the medical context nor the health situation of the victim, hence the discussion in the literature on the subject of the penalty and the institution of extraordinary mitigation of punishment is unjustified. The discussion on the admissibility of the above-mentioned medical procedures is omitted because regardless of its axiological basis, the future regulation will increase the protection of patients’ right to life and the legal security of medical staff. Finally, an outline of the future regulation is presented.

Wprowadzenie: Fundamentalnym prawem człowieka jest prawo do życia. Eutanazja definiowana jako przyspieszenie śmierci w celu skrócenia cierpień chorego na jego życzenie, czyli śmierć zadana, sprzeciwiająca się śmierci naturalnej jest bardzo kontrowersyjnym tematem. Celem badań było poznanie opinii studentów na temat eutanazji. Materiał i metody: W badaniach zastosowano metodę sondażu diagnostycznego, jako technikę wykorzystano kwestionariusz ankiety własnej konstrukcji. Badania przeprowadzono wśród 100 studentów studiów niestacjonarnych II stopnia, kierunku Pielęgniarstwo, Wydziału Zdrowia i Nauk Medycznych Krakowskiej Akademii im. Andrzeja Frycza Modrzewskiego. Wyniki: Analiza materiału badanego wykazała, że większość ankietowanych sprzeciwia się prawnej legalizacji: eutanazji czynnej (60%), eutanazji biernej (56%), eutanazji dzieci (83%), samobójstwa wspomaganego (82%), eutanazji dokonywanej bez zgody i wiedzy chorego (95%). Stwierdzono istotną zależność między popieraniem legalizacji eutanazji czynnej a uznawanymi wartościami chi2(1) = 6,42; p = 0,011 oraz między popieraniem legalizacji samobójstwa wspomaganego a uznawanymi wartościami chi2(1) = 8,63; p = 0,003.Wnioski: 1) Większość badanych nie popiera legalizacji eutanazji oraz samobójstwa wspomaganego; 2) Uznawane wartości miały wpływ na opinie ankietowanych dotyczące legalizacji eutanazji i samobójstwa wspomaganego.
Introduction: The fundamental human right is the right to life. Euthanasia is defined as intentionally ending a life in order to end the suffering of the sick person at his request. This is a very controversial topic. The aim of the study was to examine attitudes of students towards euthanasia. Material and methods: In the study, a diagnostic survey method and a questionnaire of our own design were used. The study was conducted among 100 part-time students of the nursing second degree at Andrzej Frycz Modrzewski Krakow University. Results: Analysis of the research material showed that the majority of respondents opposed legalization: active euthanasia (60%), passive euthanasia (56%), euthanasia of children (83%), assisted suicide (82%), euthanasia carried out without the knowledge and agreement of the patient (95%). There was a significant correlation between promoting legalization of active euthanasia and recognized values (chi2 (1) = 6.42; p = 0.011) and promoting the legalization of assisted suicide and recognized values (chi2 (1) = 8.63; p = 0.003). Conclusions: 1) Most respondents do not support the legalization of euthanasia and assisted suicide; 2) Recognized values infl uence the opinions of respondents regarding the legalization of euthanasia and assisted suicide.

Death with dignity is very often equated with euthanasia and assisted suicide, which are regulated as prohibited acts in articles 150 and 151 of the Polish Penal Code Act of 6 June 1997. However, the media discussion between supporters and opponents of legalization of euthanasia, which is heating up especially when there are cases of terminally ill people who publicly demand the right to a dignified death without pain and suffering, which would entail the decriminalization of euthanasia and assisted sicide in national law. In the European Union, there are no uniform solutions in this respect and each of the member countries can adapt its internal legislation to its own legal regulations. The article points to the definitions and types of death as a legal and medical event, an analysis of existing legal regulations in Polish law related to euthanasia and its variants including assisted suicide. Additionally, it clarifies important legal doubts related to the existence of the right to a death with dignity as a normative category resulting from the Constitution and a cautious approach of the direction of changes in law in this area in the nearest future – proposing the adoption of a specific legal model due to the approach to the legalization of euthanasia within the European Union and changes in views on euthanasia in the opinion and public awareness in recent times.

INTRODUCTION: Euthanasia is generally defined as an act or negligence that causes death, and consequently, interruption of the suffering of an incurably ill person. MATERIAL AND METHODS: The analysis was based on the data of the European Institute of Bioethics. The main source of information was the Reports of the Belgian Federal Committee for Euthanasia Control and Evaluation Nos. 1–8. RESULTS: Just a year after legalizing this practice in Belgium, 235 people were subjected to ‘assisted death’. In 2017, the number of euthanasia procedures exceeded 2300. In the years 2002–2017 a total of 17,063 euthanasia procedures were performed. In recent years, the age structure of people undergoing euthanasia has changed. The number of people from the age of 80 and up is ncreasing, and it decreases at the age of 40–59. The main places of the death of patients remain the home and hospital. CONCLUSIONS: 1. Since the legalization of euthanasia in Belgium, the number of people submitting to this procedure has been steadily increasing. 2. In recent years, euthanasia in the patient’s home and in nursing homes is more often observed. 3. The most common reasons for euthanasia include neoplastic diseases.
WSTĘP: Eutanazja to pojęcie ogólnie definiowane jako czyn bądź zaniedbanie powodujące śmierć, a w konsekwencji przerwanie dotychczasowego cierpienia osoby nieuleczalnie chorej. MATERIAŁ I METODY: Analizę przeprowadzono na podstawie danych Europejskiego Instytutu Bioetyki. Główne źródło informacji stanowiły Raporty Belgijskiego Federalnego Komitetu ds. Kontroli i Oceny Eutanazji nr 1–8. WYNIKI: Już rok po zalegalizowaniu eutanazji w Belgii 235 osób zostało poddanych „wspomaganej śmierci”. W roku 2017 liczba eutanazji przekroczyła 2300. W latach 2002–2017 wykonano łącznie 17 063 eutanazje. Na przełomie ostatnich lat zmieniała się struktura wieku osób poddających się eutanazji. Zwiększa się liczba osób od 80 roku życia wzwyż, a zmniejsza w wieku 40–59 lat. Głównym miejscem śmierci pacjentów pozostaje dom i szpital. WNIOSKI: 1. Od momentu legalizacji eutanazji w Belgii liczba osób poddających się temu działaniu stale wzrasta. 2. W ostatnich latach częściej obserwuje się przeprowadzanie eutanazji w domu pacjenta oraz w domach opieki. 3. Spośród najczęstszych przyczyn eutanazji wymienia się choroby nowotworowe.

This is a review of Anthony Stavrianakis’ book Leaving. A Narrative of Assisted Suicide (University of California Press, 2019). Medically-assisted suicide still raises many issues and controversies of various types: ethical, legal, organizational and institutional. The situation varies greatly between countries, and depends on health care policies and socially recognised values. However, the overriding question is as follows: under what conditions should this form of death be allowed? Among the arguments that are well known, recognized and now tame, Stavrianakis’ research brings new light and perspective. The author goes deeper and searches for the real motives driving people to choose this manner of death. He sees the nuances and recounts the difficulties. In this article, I highlight aspects of Stavrianakis’ work that I find relevant and crucial for the issues considered.
