In this article I want to show the relationship between the phenomenon of the gender reproduction and Polish philology formal education (state, conditions through a network of ministerial documents) at the high school stage. A significant part of the article refers to the mechanisms of reproduction in general knowledge, which is the basis for the belief that the interpretation of literary texts and the subject teacher's attitude affects the reproduction of gender norms. At the outset, I am presenting the tests' results of the year 2011, relating to the institutional determinants of educational processes, to then move to propose a model of reading taking into account such categories, as: gender, sexuality, otherness etc. I assume that this interpretation should be a multidimensional reading, open to the flow of meaning, against the symbolic violence and context.

The aim of the study presented in this article was to verify the presence of the assumptions of anti-discrimination education in the lyrics of songs featured on the album “Hip-Hop racism stop! #1”, a project launched as part of a Polish campaign called “Music Against Racism”. The study involved using the content analysis method in an interpretative paradigm according to the contextual theory of meaning. The main conclusion is that the use of songs as a form of educational support can be a valuable element in the anti-discrimination education, but it is crucial to call for “negotiating with young people the content of existing culture”, which may provoke discussion with students about the ways in which words are used to form a specific image of the world. Another important conclusion is the “paradox of violence” referring to a tendency to appeal for the rejection of violence, while at the same time using violence-provoking words.

Opis:
The paper deals with homosexuality and the ways it is viewed in society. It focuses on some aspects that accompany homosexual people’s social functioning, such as stereotypes, discrimination, and homophobia. In Poland, as well as in other countries, there exists the problem of discrimination against homosexuals, which results in serious difficulties gay people have to overcome in their everyday life. Since it is mainly from the lack of knowledge that discrimination or homophobia often stem, education might be the key solution. The educational idea this paper puts forward is based on anti-discrimination efforts that promote education through films. The cinematic works chosen for this purpose, Milk, Brokeback Mountain and A Single Man, can help to understand the social aspects of discrimination and homophobia, as well as the psychological consequences suffered by those discriminated against. Still, a screening of films is not sufficient for the accomplishment of this goal; it should be complemented with an after-film discussion that would increase a person’s awareness of differences and various points of view, encouraging them to refresh their own beliefs. Such actions may create an opportunity for the participants and thus result in the change of their attitude.

Recently, both in Bulgaria and abroad, it is increasingly common to find accommodation, restaurants and entertainment facilities that advertise and offer a wide range of services. However, these are not intended for general consumers but only those who have reached maturity (excluding minors and the under-aged). According to press publications hotels and restaurants that pre-select their guests based on their age are mainly concentrated on the Bulgarian Black Sea coast and in the mountains or they specialize in spa and balneo procedures. It turns out that consumers find it easier to stay with a pet, albeit at an extra cost, than go on vacation with their teenage children. Such practices adopted by representatives of the tourism industry raise some questions of a moral, ethical and legal nature. The current article traces the development of a specific administrative and judicial proceeding initiated to establish the presence of discrimination against consumers in a tourist facility – a restaurant. An overview of the claims and arguments of the claimant is made as well as an analysis of the reasons and considerations given by the competent administrative and judicial authorities. The author’s opinion on the issue is expressed.

Countering social exclusion is becoming a import_ant social issue. Those kinds of activities are developed in the field of anti-discrimination education, (where one of the most meaningful aspects is preventing hate speech). Such activities are undertaken in campaigns and projects, for example: “Bez nienawiści,” “Hejtstop,” “Mowa miłości,” which are promoted on the social network Facebook. They are examples of good practices that should be disseminated and continued, also in the context of formal education.

Council of Europe has a long history of combating discrimination, although this subject has been dealt with in different institutional setting. The principles of equality and non-discrimination feature prominently and repeatedly in the Council of Europe documents. Promoting human rights and non-discrimination have been focal issues for the Council of Europe ever since its founding, paving the way for numerous policy measures, campaigns, conferences, trainings and debates. This paper presents current trends in Council of Europe’s non-discrimination policy, as well as the historic review of the process of its development. It focuses, both on the presentation of instruments and practical effects. The Council of Europe has played a key role in the development of a common anti-discrimination agenda. European Convention on Human Rights and Fundamental Freedoms and the Protocol no. 12, as well as the other instruments dealt with in this presentation, were a major step in the fight against discrimination in Europe. At the level of general orientation of the Council of Europe policy against discrimination the legislation prohibiting discrimination brings forth effective results. Nevertheless, combating discrimination and un-equality requires more than prohibition. Therefore, the Council of Europe must not see progress to date as the endgame, but rather a first step towards a society in which everyone can participate equally.

The well-known cases of religiously motivated refusal to serve customers deserve a thorough analysis as they pose a serious challenge to liberal-democratic values, the rule of law, and freedom in economic affairs. Are they examples of legitimate expression of religious conscience or just acts of discrimination which are forbidden by law? If the latter, how swift should be a reaction of the state by applying sanctions provided by anti-discrimination laws? How the state through its laws should shape the relationship between religion and commerce? To answer these questions the Enlightenment concept of doux commerce will be debated since this idea entails an assumption that markets promote interactions among strangers and thus can facilitate peaceful cooperation in a pluralistic society. In particular, large part of this article will be dedicated to the recent analyses of this concept advanced by Nathan B. Oman. He underlined the moral significance of markets which train people to interact on the basis of personal detachment and art of putting unsolvable issues aside.

Before 2013, the term ‘gender’ as used to define male and female social roles had appeared relatively rarely in the public sphere. However, it had not been completely unknown. Whenever this term did occur in utterances of public figures, it was mostly in reference to equality policies (gender policy) and the idea of gender mainstreaming in EU projects. It was commonly associated with feminism and has in this form entered the social consciousness, including the minds of major public figures, especially those with highest state positions. The situation changed radically in 2013. The term ‘gender’ started to be connected with ‘gender ideology’, a term coined by people associated with the Catholic Church. This article presents the ways in which the issues related to the broadly meant gender are presented on the right and left sides of the political scene. This analysis is based on selected interviews and other utterances of famous politicians as well as the articles in popular weekly magazines published in 2011–2015. This paper covers both kinds of utterances – those in line with the rules of political correctness and the examples of hate speech. All examples are provided to highlight the mechanisms of discrimination hidden in the language of politics.

The main aim of the article is to describe the state and challenges of anti-discrimination education in Poland and to analyse how it influences the rights of national and ethnic minorities and foreign pupils. The question, whether we deal with the backlash against anti-discrimination education in Poland has been preoccupying the experts and practitioners for some time. The application of specific antidiscrimination provisions in the education sector plays the key role in this regard. The irrefutable reality is of a retreat of the state in these areas that threatens its social role and has the result of inequalities, xenophobia, and intolerance. The central question then becomes – how might the backlash against anti-discrimination education affect the situation of national and ethnic minorities and foreigners and social attitudes towards these groups.

Institutional discrimination against women in Poland is a social problem that persists despite constitutional guarantees of gender equality and legislation providing for compensatory measures. The article analyzes the possibility of using M. Marody’s concept of the “brave victim” as a means of designing compensatory actions in legislation and enforcement that will help eliminate institutional discrimination. Institutional discrimination is defined in legal doctrine as discrimination that occurs at the level of a given institution, organization, or even society as a whole.The article also analyzes cultural and social factors that condition or contribute to the deepening of legal and social inequality for women. The article identifies areas of institutional discrimination in Poland, including: the labor market, parental rights, social rights, access to political functions, and increasing women’s participation in public life.The analysis of national legal regulations and regulations implemented from EU law indicates the heterogeneity of protection against discrimination. The article proposes conditions and principles for the application of special legal solutions that establish anti-discrimination standards applicable in the current social conditions in Poland.The concept of the “brave victim” is a social fact that the legislator should take into account when designing policy law to avoid social tensions and develop effective legal solutions to counter discrimination.

W treści artykułu skoncentrowano uwagę na regulacjach prawa międzynarodowego, stanowiących narzędzie walki z przejawami dyskryminacji rasowej i określeniu ich oddziaływania na polskie unormowania. Scharakteryzowano pierwsze zapisy antydyskryminacyjne, opisano najbardziej znaczące w omawianym zakresie normy międzynarodowoprawne, przedstawiono także definicję legalną pojęcia „dyskryminacja rasowa” oraz podniesiono kwestię wpływu wybranych działań legislacyjnych i faktycznych w sferze międzynarodowoprawnej na unormowanie tej materii w polskim ustawodawstwie. Ponadto, na podstawie analizy raportów organów monitorujących stan ochrony prawnej oraz dokonujących oceny efektywności istniejących w przedmiotowym zakresie regulacji krajowych, podjęto próbę sformułowania postulatów de lege ferenda w zakresie ochrony przed dyskryminacją ze względu na rasę w Polsce.
The objective of this paper is to describe international legal regulations designed to combat symptoms of racial discrimination and to show its influence on Polish legal standards. The author depicts the background of the problem, identifies legal definition of the term racial discrimination and describes law as it stands. Significant regulations taken into account refer to general rules and limitations of international law in the field of racial discrimination and its effect on Polish legal system. Moreover, the author tries to formulate demands of law de lege ferenda on the base of the newest reports on Poland published by international monitoring and controlling commissions.

Nowadays law is considered to be an effective instrument of shaping social reality. In this context special attention must be paid to gender equality law and jurisprudence which setting protection against unequal treatment because of someone’s gender intend to make a balance between individual’s identity and social expectations related to his or her role. These social preconceptions based on gender stereotypes must be contested insofar as they serve as an instrument to rationalize inequality between women and men. The aim of the article to explore the gender stereotypes in the anti-discriminatory judgments of the Court of Justice of the European Union. The article claims that the CJEU’s case law is unambiguous with respect to this. On the one hand the Court contributes to eradication of stereotypes based on gender in some cases, on the other – it reinforces them in the other. The article starts with explanation of the role of the gender equality principle in the EU legal system. It also makes some general remarks on stereotypes, biases and discrimination. The second part is devoted to the CJEU case law in which the Court, explicitly or implicitly, avoids applying the gender stereotypes lens to equality issue. The third part of the article analyses those of the CJEU judgments which, unfortunately, can be considered as perpetuating gender stereotypes and as such discrimination based on them.

Różnorodność zasobów ludzkich organizacji nie jest kategorią nową, choć współcześnie kwestia zarządzania uwzględniającego paradygmat różnorodności zasobów ludzkich nabiera większego znaczenia przynajmniej z trzech powodów. Pierwszy – to procesy internacjonalizacji czy wręcz integracji międzynarodowej przyczy¬niającej się do zwiększonej mobilności ludzi. W szerszym kontekście to procesy globalizacji prowadzące do współpracy ludzi nie tylko z różnych krajów, ale wręcz różnych kontynentów, co powoduje m.in. wzrost liczby wymiarów różnorodności (Habgood, 2012). Drugi – to profesjonalizacja funkcji personalnej, w szczególno¬ści w modelu zarządzania zasobami ludzkimi, wymagająca dla swej skuteczności odpowiedniego uwzględniania w zasadach, celach, metodach czy procedurach coraz szerszego zakresu cech człowieka, a także zespołu pracowników czy wręcz osób współdziałających (dostawcy, klienci). Trzeci powód wzrostu znaczenia zarządzania różnorodnością pracowników to rozwój nowoczesnych form współ¬działania czy kooperacji w procesach produkcji i świadczenia usług (np. elastyczne formy zatrudnienia, wirtualność, sieciowość struktur). Celem artykułu jest analiza rozwoju koncepcji zarządzania różnorodnością zasobów ludzkich w organizacji jako jednego z obszarów zarządzania. Przedstawiono czynniki, które brane są pod uwagę przy decyzji wprowadzenia paradygmatu różnorodności do ZZL, oraz opisano trzy modele zarządzania różnorodnością zasobów ludzkich. Podstawą opracowania jest krytyczna analiza literatury przedmiotu oraz opisy praktyk zarzą¬dzania różnorodnością w organizacji. Przedstawione rozważania mogą stanowić ramę metodyczną dla opracowania strategii i programów ZZL w organizacjach przyjmujących różnorodność jako jedną z wartości organizacyjnych.
Human resource diversity in the organization is not a new notion. However, current questions of management that take into account the paradigm of human resource diversity are presently growing in importance for at least three reasons. The first involves processes of internationalization or even international integration leading to increased mobility. In a broader context, this is a matter of advancing globalization fostering the cooperation of people who not only live in different countries, but even on different continents, thus adding new dimensions to diversity (Habgood, 2012). The second reason is the professionalization of the personnel function, particularly within the HRM model. This requires the taking into account of a growing number of characteristics encompassing individuals, worker teams, and partners (suppliers, customers) in its rules, objectives, and procedures in order to be effective. The third reason has to do with the development of modern forms of interaction and cooperation in production and service delivery processes—e.g., flexible work arrangements, virtuality, and network structures. The objective of this article is a presentation of an analysis of human resource diversity management in the organization as one of the aspects of organizational diversity management. It presents factors that are taken into account in decision relating to the introduction of the diversity paradigm in HRM and identifies three models of human diversity management. The article is based on a critical review of pertinent literature and on the descriptions of organizational diversity management practices. The presented solution may serve as a framework for methods for developing HRM strategies and programs in organizations that assume diversity to be an organizational value.
