The anthropological orientation of the word law in Adam Mickiewicz’s writingsThis article discusses the anthropological orientation of the word law in Adam Mickiewicz’s writings. The author claims that this word is essential for the interpretation of the poet’s historiosophical thought, in the context of legal culture of the Grand Duchy of Lithuania. The citizens of Lithuanian territories recognized the 16th century Statutes as a distinctive feature of the state’s cultural identity, because they were still effective in the judicature under the Russian Partition, and in social awareness they remained a semblance of the independence from the foreign rule. The Romantic understanding of law, state and morality resulted in perceiving these values as “the spirit of the world” of which the image of virtue was born. In the dimension of legal discourse, law as an idea takes a real shape in its definition, in poetic tropes, and in scholarly discussions, but most of all in the actions of literary characters. The metaphorical and symbolic meanings of law manifest themselves in the topos of the court of law, judging what is right and what is wrong; good and bad faith; in family, social and political relations. The analysis of the texts has shown that the poet, by depicting the way of perceiving and understanding the organisation of political life in analogy to family life, enclosed his own personal vision of law and order in the structures of language. Антропологическая ориентация слова право в творчестве Адама МицкевичаСтатья посвящена антропологической ориентации слова право в текстах Адама Мицкевича. Автор утверждает, что слово является ключом к интерпрета ции главной историософической мысли поэта в контексте юридической культуры Великого княжества Литовского. Культурообразующим знаком государства для жителей литовских земель были статуты XVI века, которые были обязательны еще на территории аннексированной Россией, а в общественном сознании oни были символом зависимости от чужой власти. Понимание права, государства и моральности в Романтизме отражают ценности, олицетворяющие «дух мира», который рождает представление о добродетели. В юридическом дискурсе право как идея добра принимает реальную форму в определении, в поэтических тропах и в ученых выводах, а прежде всего в действиях литературных героев. Метафорическое и символическое значение права выражается в теме суда, устанавливающего правых и виноватых, выносящего решение о добрых и злых намерениях в семейных, общественных и политических отношениях. Анализ текстов показывает, что поэт, проводя аналогию между политической и семейной жизнью, в структурах языка реализует собственное представление о законности.

The iconography of the Book of Genesis has been elaborated on in extensive studies in which connections with the biblical text and commentaries, mainly patristic, have been demonstrated. In the state of research gathered on this subject by U. Mazurczak in ‘Das Sechstagewerk in der Ikonographie des Mittelalters. Forschungsstand und Forschungsperspektiven’ (Acta Mediaevalia 8:1995) the author pointed out crucial research problems which were worth further studying in the iconography of ‘Genesis’. Moreover, in a book published in 2012 Human corporeality in medieval Italian painting (Vol. 1. Lublin 2012) the issues of the created body and its significance in the realm of medieval anthropology were presented. In the present study selected texts of Jewish apocrypha and philosophical commentators, which inspired Christian representations of illustrations for the Book of Genesis: the creation of man and his sojourn in the paradise as well as his departure after the original sin, have been pointed out. Jewish tradition in the images of angels in the illustrations of Cotton’s Bible, repeated on mosaics in the narthex of St. Mark’s Church in Venice has been also indicated. Those figures bear resemblance to the texts by Philo of Alexandria who explained the significance of angels appearing next to God in the subsequent days in his commentary On the creation of the world. The number of angels from the first to the seventh refers to each day being created. Elements of Jewish tradition can be also traced in the famous Bible of Czerwińsk (1148-1155), destroyed during World War II, where God the Creator was depicted together with three angels. God the Father anoints the first angel with the same gesture as he touches Adam’s forehead, which is shown in the following medallion. In this way Philo interpreted the creation of mind as stamping it with the wisdom of God the Creator who imprinted his stigma in man’s mind. The apocrypha called the Book of Jubilees was of significant importance—the list of angels’ (residents’ of heaven) powers was enumerated there. They rule over cosmic powers and over man on the earth. In the Book the dialogical form between God and the angels is developed and the gesture of touch is also explained here as it was presented in a codex once stored in Polish collection. The touch is a sign of the deep connection between man and Yahweh who reveals himself in a special way on the day of Sabbath—The Day of God’s Glory. With the sign of touching Adam’s forehead God gave his blessing to man on the seventh day, namely the day of consecration. In a codex stored in the National Library in Vienna and called the Vienna Genesis the scene of the parents going beyond the gates of paradise after the original sin was developed, in turn. A classic motif of an angel standing next to the gates of paradise was enriched with the second female figure, a personification which is deprived of signs of sanctity but is standing close to Adam and Eve. The miniaturist enriched the image of the paradise gates with a motif of blazing but not burning out rims of circles. The female personification, exposed by means of the smartness of clothes and proportionally exceeding all the figures of the scene including the angel, was identified with the personification of Wisdom. The author points out the personification of Divine Law here. In Liber Graduum, a compilation of Gnostic and Hebrew texts, its author concentrated on a description of the sin and the grace of God received by the parents. Before having committed the sin they experienced only God’s love in the paradise, however, after the sin they experienced Divine Mercy, together with Divine Law. The figure in Vienna Genesis standing beyond the gate next to the parents is the figure of the Law given by the merciful God to them.

It concerns the observation of the significance of names in the Jewish culture and faith. The author describes what is the significance of christening (giving names) by the Jewish people and portrays existing rules in this regard partly derived from the Jewish religion, and partly from the Jewish tradition.

serious confrontation with the subject: “Person” in the Code of Matrimonial Law (CIC and CCEO), is an—invariably relevant—challenge that the study of canon law and jurisprudence have to face. The argument for the validity of this conclusion is provided by the famous John Paul II’s thesis, proclaimed in the Familiaris Consortio exhortation (1981) and the famous 1997 Address to the Roman Rota, which can be summarized in the following words: the foundation and structural principle of interpersonal (ethical and legal!) relationships in marriage is matrimonial love. This axiom—still insufficiently present in the thoughts of canonists and church judges—reflects the deepest truth, of which “prophetically” the author of the monumental works Love and Responsibility and The Acting Person gave testimony; the truth that not elsewhere, but in the conciliar spiritually person-centric vision of matrimonial community (communio/consortium), a hermeneutic key should be sought for an adequate and complete understanding of the structure of marriage, harmoniously integrating its two personal and institutional dimensions.Karol Wojtyła’s/John Paul II’s brilliant thought deserved to be confronted with the premises that prove the hypothesis that the mere declarative identification in the expressed judgments/concepts with the idea of a personalistic aggiornamento (“programmed” especially in numbers 47–52 of the Council’s Constitution Gaudium et Spes) does not yet guarantee the adequacy and completeness of the canonistic approaches to the “truth of matrimony.” This is both in the sphere of theological exposure in accordance with the Magisterium (in the light of the “Image of God”) and at the praxis level: the interpretation and application of the normative records in the nodal canons of CIC and CCEO. The first part of the study is dedicated to illustrating such a state of affairs – in various proposals of doctrine and jurisprudence: from a concept that is completely misguided and destined to fail in advance; through a concept that, because of its extremely conservative approach to the need for vetera et nova harmonisation, has not stood the test of time, to concepts, indeed, universally acknowledged in the study of canon law, whose authors (or their adherents), after all, should be suggested to implement certain necessary corrections: bigger or smaller. In the second part, the research contemplation focuses on the conclusions of the realization of the conciliar postulate of “harmonization” in presenting a person-centric vision of matrimony. These synthetic remarks constitute an attempt to show the basis for an adequate interpretation of the formula adopted by the two codes announced in the title: “a partnership of the whole of life”.

The landmark decisions of the Supreme Court change the ethos of adjudicating. The substantive due process doctrine allowed the Court to become an actual lawgiver. This doctrine widely extended the understanding of the due process clause of the 5th and 14th Amendments. Increased power of statutory construction corresponded with the doctrine of loose constructionism (living constitution). Decisions like Griswold v. Connecticut and Roe v. Wade created new constitutional rights, emanating from the radical liberal anthropology. Adjudication became a field of an ideological battle in the culture war over anthropology determining the law’s content . In the classical and Christian understanding, being free is considered as having one’s identity discovered as an ontological constant, thus allowing an individual to develop himself according to the nature’s essence . The liberal anthropological revolution defines freedom as a power of self-creation, serving individual’s preferences. The liberal elites, employing ideas of social engineering, attempt to enforce rules based on coexistence and relationship of equal rights. Individual rights emanate from the autonomous, personal choice of life values, the key of the constitutional interpretation. The wider this right of self-definition , the wider the scope of the state’s intervention. In Griswold v. Connecticut the right to privacy signified deep cultural change rooted in such an anthropology. This “emancipation project” is thus built on an axiology destroying relations, becoming a kind of a religion of secular salvation. The state serves here as a demiurge and is sacralized. This causes an increasing abyss between the elites and the rest of the citizens, with a corresponding social disintegration of it’s public life. For instance Obergefell v. Hodges enforces a new anthropological definition of marriage, beginning to delegitimize creeds and actions of religious communities. This reflects a global phenomenon of connecting individual liberal rights with politics of identity and the post-modern culture of right understood as autonomous will without reasoning about its ontological, universal basis. The Supreme Court decisions are not separated from wider culture, but based on the new anthropological understanding of man as a consumer, with his individual will becoming the very basis of rights.
Niektóre kluczowe orzeczenia Sądu Najwyższego Stanów Zjednoczonych zmieniają model amerykańskiego etosu orzeczniczego. Doktryna substantive due process dała Sądowi władzę de facto stanowienia prawa. Poszerzyła też znacząco rozumienie pojęcia due process, zawartego w poprawkach V i XIV Karty Praw. Zwiększona władza interpretacyjna Sądu korespondowała z doktryną tzw. living constitution. Orzeczenia takie, jak Griswold v. Connecticut i Roe v. Wade czy Obergefell v. Hodges tworzą nowe konstytucyjne prawa w duchu antropologii radykalnie liberalnej, ale też pole bitwy ideowej w wojnie o kulturę, dotyczącej antropologii determinującej prawo. Prawo jednostki wynika z autonomicznego wyboru wartości jako klucza interpretacji konstytucyjnej. Im szersze prawo indywidualnego autodefiniowania swego życia, tym szerszy zasięg państwa. W orzeczeniu Griswold v. Connecticut prawo do prywatności sygnalizowało głęboką zmianę kulturową opartą na takiej liberalnej antropologii. Jej „emancypacyjny” projekt, w oparciu o aksjologię niszczącą relacje, stanowi rodzaj „religii” świeckiego zbawienia, którego demiurgiem jest sakralizowane państwo, z rosnącym dysonansem między elitami a resztą obywateli i dezintegracją społeczeństwa, w tym życia publicznego. Orzeczenie Obergefell v. Hodges narzuciło nową antropologicznie definicję małżeństwa, delegitymizując publiczne poglądy i działania instytucji religijnych. Decyzja jest objawem zjawiska globalnego, w którym liberalne prawa jednostki wiążą się z polityką tożsamości i postmodernistyczną kulturą praw jako autonomicznego chcenia, z ignorowaniem pytania o ich ontologiczne, uniwersalistyczne umocowanie. Orzeczenia Sądu Najwyższego nie są zatem zawieszone w próżni prawnej. Opierają się na antropologii traktującej człowieka jako konsumenta, gdzie wola jednostki ma stać się jednocześnie żądaniem prawa.

Opis:
Among the numerous interesting and remarkable topics of applied law related to the period between the two World Wars, this study focuses on a very special aspect of judicial practice of that time. It attempts to trace archaic standards, legal folk traditions, as reflected by court decisions or brought up by the parties during the litigation process. Based on this approach, studies and case-studies published in a Hungarian ethnographical journal, Ethnographia, were re-evaluated in order to exploit a rich historical source and extract interesting legal historical information that had not been directly expressed before.
