    Subject and purpose of work: The study aims to identify the constraints in the functioning of PACS in Haryana, India. Materials and methods: The study was based on primary data collected from nine PACS managers through schedule. The purposive sampling technique was employed for the selection of PACS. The percentage was used for data analysis. The data were collected in the second quarter of 2022. Results: The study found that 100 % of PACS managers regarded lack of adequate funds, a low level of deposits, and increased day-to-day government intervention as constraints in the functioning of PACS. Subsequently, the respondents mentioned inability to mobilise resources (77.77%), lack of managerial skills (77.77%), lack of trained staff (55.55%), improper channel of recovery system (44.44%), untimely repayment and poor recovery percentage of the loan (44.44%), political interference (33.33%), difficulties due to low educational level of borrowers (22.22%), and uncooperative attitude of borrowers (11.11%). Conclusions: Main constraints in the functioning of PACS are lack of adequate funds, a low level of deposits, increased day-to-day government intervention, inability to mobilise resources, and lack of managerial skills.

    Opis:
    The purpose of the article is, first of all, to evaluate the rules concerning an agricultural activity run by social cooperatives and, secondly, to identify legal issues associated with setting up and running an activity by these entities, and to make an attempt to solve these problems. The first part of the article focuses on setting up a cooperative and on its members, especially people with disabilities, farmers and household members with the status of the unemployed. It presents some selected court decisions. Then, the paper discusses the issue of running an agricultural activity by social cooperatives. It raises the question of land contributions and tries to determine whether social cooperatives running an agricultural activity can be regarded as agricultural production cooperatives. This classification is important in terms of exercising the right of preemption in the event of sales of a land contribution or leased agricultural lands. Then, the paper focuses on the issue of de minimis aid and de minimis aid in agriculture. In conclusion, the author puts forward de lege ferenda proposals concerning preemption right in respect of a social cooperative. She also calls for the introduction of other legal instruments supporting the entity in question, e.g. greater opportunities to enlarge farms by the acquisition or lease of lands from the Agricultural Property Agency.

    Cooperatives in the world has played an important role in socio-economic development of each country. Also in Poland, the cooperatice movement has its own tradition and history. The main feature of the current activities of the cooperative is to focus primarily on local issues. Cooperative forms of management are to realize many functions and tasks, which are also in the free market are not substitutable by other operators or organizational structures. In addition, are important in the development of agriculture both national and local levels. Development of agricultural cooperatives is primarily conditioned by commitment, activity and entrepreneurial population. an important role is played by the local authorities, which, by the decisions can stimulate the development of such projects.

    The beginning of Credit Union of Agricultural Cooperatives is linked to Malopolska Region, where agricultural cooperative movement initialized by Stefan Stefczyk in 1899 was captured into concise legal frames called „The Bureau of Patronage over Companies of Savings and Loans at the State Department in Lwow”. That credit institution became seed of Credit Union of Agricultural Cooperatives in Lwow established in 1909. State Credit Union was an outpost of particularly self-governing, state character contributing towards the development of agricultural cooperatives. Soon after regaining independence by Poland after World War I, The Bureau of Patronage over Agricultural Companies in Lwow was reorganized into Credit Union of Agricultural Cooperatives in Warsaw with extended area of operation onto the entire territory of the Republic of Poland. During the Nazi occupation Credit Union of Agricultural Cooperatives still remained the financial centre for agricultural cooperatives. Unfortunately, after liberation from the German occupation Credit Union of Agricultural Cooperatives was forced to cease its activity.

    The article summarizes the practice of creation and functioning of small business forms in agriculture of Ukraine, assesses their role and capabilities at the present stage and in the future, identifies priority, desirable directions for further development of society and mechanisms for their provision. The necessity of implementing a consistent policy of entrepreneurial activity expansion in the rural area is substantiated, in the first place by family farming, which is capable to ensure the maximum employment rate of rural population. Due to the above-mentioned processes, agroholdings have narrowed down the ability of the rural population to conduct agricultural entrepreneurial activity. It has also been proved that in order to increase the efficiency of agricultural production, the profitability of rural households from the agricultural products production and sale, employment of rural population and the development of the agrarian market’s infrastructure, it is necessary to intensify the creation of agricultural servicing cooperatives, especially in sectors where the production of small business forms prevails. It was found that it is extremely important to introduce a permanent state of financial and other support for the development of agricultural servicing cooperatives and small forms of farming in the rural area, focusing on supporting the latter through cooperatives in which they participate.
    Artykuł podsumowuje praktykę tworzenia i funkcjonowania małych form przedsiębiorczości w rolnictwie Ukrainy, ocenia ich rolę i zdolności na obecnym etapie oraz w przyszłości, określa priorytetowe, pożądane kierunki dalszego rozwoju społeczeństwa, a także mechanizmy ich zapewnienia. Konieczność wdrożenia spójnej polityki rozwoju działalności gospodarczej na obszarach wiejskich jest udowodniona przede wszystkim przez rolnictwo rodzinne, które jest w stanie zapewnić maksymalną stopę zatrudnienia ludności wiejskiej. Ze względu na wyżej wymienione procesy agroholdingi zmniejszyły zdolność ludności wiejskiej do prowadzenia działalności rolniczej. Udowodniono również, że w celu zwiększenia skuteczności produkcji rolnej, rentowności wiejskich gospodarstw domowych wynikającej z produkcji i sprzedaży produktów rolnych, zatrudnienia ludności wiejskiej oraz rozwoju infrastruktury rynku rolnego, konieczne jest zintensyfikowanie tworzenia spółdzielni rolniczych, zwłaszcza w sektorach, w których przeważa produkcja małych form przedsiębiorczości. Stwierdzono, że niezwykle ważne jest, aby wprowadzić stały stan wsparcia finansowego i innego wsparcia na rzecz rozwoju spółdzielni rolniczych i małych form rolnictwa na obszarach wiejskich, koncentrując się na wspieraniu tych ostatnich poprzez spółdzielnie, w których uczestniczą.
