    Opis:
    This paper attempts to describe selected elements regarding the situation on the agricultural property market and the assumptions of the policy in this respect in Poland. Particular attention was paid to legislative changes related to agricultural property trading. Statistical data from the Property Market Analysis and Monitoring System (AMRON), the Central Statistical Office, the Agency for Restructuring and Modernization of Agriculture (ARiMR) and the National Center for Agricultural Support, were used. The purpose of the study was to attempt to assess changes in land prices in Poland after systemic transformation. Attention was also paid to the issue of changes in the conditions for purchasing a property after the entry of the amended provisions of the Act on shaping the agricultural system came into force. An attempt was made to answer the question whether the introduced restrictions caused the prices of agricultural properties in Poland to change in spatial terms.
    W niniejszym artykule podjęto próbę opisu wybranych elementów dotyczących sytuacji na rynku nieruchomości rolnych i założeń prowadzonej polityki w tym zakresie w Polsce. Szczególną uwagę zwrócono na zmiany legislacyjne związane z obrotem nieruchomościami rolnymi. Wykorzystano dane statystyczne pochodzące z Systemu Analiz i Monitorowania Rynku Obrotu Nieruchomościami (AMRON), Głównego Urzędu Statystycznego, Agencji Restrukturyzacji i Modernizacji Rolnictwa (ARiMR) oraz Krajowego Ośrodka Wsparcia Rolnictwa. Celem opracowania była próba oceny zmian w cenach ziemi w Polsce po transformacji systemowej. Szczególną uwagę zwrócono na zagadnienie zmiany uwarunkowań zakupu nieruchomości po wejściu w życie znowelizowanych przepisów ustawy o kształtowaniu ustroju rolnego. Podjęto próbę odpowiedzi na pytanie, czy wprowadzone ograniczenia spowodowały, że ceny nieruchomości rolnych w Polsce uległy zmianie w ujęciu przestrzennym.

    Opis:
    The article presents the latest regulations related to spatial planning and its impact on the sale of agricultural real estate in the light of the Act on shaping the agricultural system. Relations between spatial planning and agricultural real estate indicate the tendency of essential planning authority of the municipality and thus to that they influence the sale of agricultural real estate, excluding the application of the law on shaping agricultural system. The article also presents a model of shaping the state policy in the field of preserving the agricultural character of real estate.

    The article presents selected legal instruments affecting the turnover of agricultural real estate in Poland. Changes since 2016 have introduced not only a new legal regime, but also numerous restrictions on the purchase of agricultural real estate. In some respects, they correspond to the resolution of the European Parliament, which encourages EU Member States to protect the agricultural nature of real estate. The current legal status, however, significantly affects the Treaty free movement of capital. In addition, it limits constitutionally protected property. The Polish regulations have been presented against the background of the regulations of selected European countries.

    The article presents current development trends related to European regulations concerning agricultural property trade. The legal instruments proposed by the European Parliament and the European Commission, which which are supposed to preserve the agricultural character of the property, has been presented. These regulations should help farmers to keep their jobs. They also recommend creating strict supervision over the turnover of agricultural real estate.

    Celem rozważań jest analiza głównych obszarów współczesnej regulacji prawnej obrotu nieruchomościami rolnymi, wpływającej zarówno na sytuację prawną właściciela nieruchomości rolnej, jak i na współczesny kształt rynku rolnego.  W konkluzji autorzy stwierdzają między innymi, że władcza ingerencja państwa zwłaszcza w sferze ingerencji publicznoprawnej narusza konstytucyjne granice ochrony własności poprzez istotne uszczuplenie prawa swobody działania właściciela. Występujące ograniczenia regulacyjne wyraźnie naruszają równowagę w regulacji własności rolniczej pojmowanej jako kompleks praw i obowiązków . Tworzący się normatywny prymat i dominacja administracyjnoprawnych instrumentów interwencji w rynek nieruchomości rolnych ogranicza występowanie instrumentów cywilnoprawnych na rzecz instrumentów administracyjnoprawnych.
    L’articolo si propone di sottoporre ad analisi le principali aree della regolazione giuridica in materia di trasferimento dei terreni agricoli, la quale ha un impatto sia sulla posizione giuridica del proprietario di un terreno agricolo sia sulla struttura del mercato agricolo stesso. Nella parte conclusiva, gli autori affermano, tra l’altro, che l’imperiosa ingerenza dello Stato, specie nella sfera del diritto pubblico, porta a violare i limiti costituzionali che concernono la tutela della proprietà in quanto essa mette rilevanti limiti al diritto, esercitato dal proprietario, di agire liberamente. Le restrizioni normative esistenti vanno ad alterare notevolmente l’equilibrio che caratterizza la regolazione della proprietà agricola, intesa come un insieme di diritti e doveri. Un primato normativo che sta per emergere nonché il predominio degli strumenti amministrativi di intervento nel mercato dei terreni agricoli vanno a ridurre la presenza di strumenti di diritto civile a favore di quelli di diritto amministrativo.
    The aim of this paper was to analyse the main areas of contemporary legal regulation of agricultural real estate market which affect both the legal situation of the agricultural real estate owner and the contemporary shape of agricultural market. The authors conclude, among other things, that state interference, especially in the public law sphere, violates the constitutional limits of property protection as it significantly depletes the right of owner's freedom of action. The existing regulatory restrictions violate clearly the balance in the regulation of agricultural property understood as a complex of rights and obligations. The emerging normative primacy and domination of legal instruments of intervention in the agricultural real estate market available in administrative law limit the occurrence of civil law instruments in favour of administrative law instruments.

    The article presents the story of the Kozyrski family who purchased and developed Jaroszówka nature reserve. Konstanty Kozyrski effected the transaction with Mikołaj Trochimowski in 1891. The estate’s development entailed setting up a fish farm, cattle trade and beekeeping. It was undoubtedly one of the best prospering estates in the outskirts of Bialystok during the Interwar Period. In 1940 the Kozyrski family was ranked landlords and deported to Siberia. They returned to Jaroszówka six years later.
    В статье рассказывается о судьбе белостокской семьи Козырских, которая приобрела и освоила урочище Ярошувка. Константин Козырский заключил сделку с Миколаем Трохимовским в 1891 г. Недвижимость развивалась за счет основания рыбного хозяйства, разведения коров, а также занятия пчеловодством. Несомненно, Ярошувка была одним из наиболее развитых поместий в пригородах Белостока межвоенного 20-летия. В 1940 г. Козырских назвали помещиками и сослали в Сибирь. Они вернулись в Ярошувку только спустя шесть лет.
