    Opis:
    The object of considerations is legal issue of qualification of legal relations as cultivation contract in accordance with article 613–622 of Civil Code. Cultivation contract has productive character. Its subject is closely related to the manufacturing process in agriculture, where at the same time it is important starting position in the chain of supply of agricultural products, although sometimes it is regarded by mistake as sale or delivery contract. Judicial decisions, analyzed in the article confirm the existence of several model features, which occurence in particular legal relationship makes it a part of cultivation contract. While lack of characteristic features for code model of contracting causes that the agreement is not recognized as cultivation contract in the meaning of article 613–626 of Civil Code. Features of cultivation contract highlighted in the judicial practice can be divided into features so called connected with subjective aspects – parties to the contract and features connected with object of the contract. Party to the contract may be agricultural producer, who produces agricultural products in his own farm in productive process, and provides it to contracting person, and of course contracting person (most often entrepreneur). The subject of performance is “facere” – production and delivery of fixed amount of agricultural products, produced in own farm.

    Economic development is characterised by the fact that the share of agriculture tends to decrease both in terms of resources used and domestic product generated. This does not mean, however, that the role of agriculture in the economic development diminishes. It can be considered a paradox that the lower the share of agriculture in the national economy, the greater its role, as it provides raw materials for the production of goods, especially food, which meet the needs of the ever-growing community. The main aim of the presented study is to measure and evaluate changes in agricultural produce procurement in Poland in the years 2010-2016. The following research hypothesis is put forward in the study: Changes in the procurement volume had a much greater impact on the procurement value of selected agricultural produce in Poland in the period considered than changes in the level of transaction prices. In the paper, a comparative analysis of procurement of crop and animal products was conducted. The research process was based primarily on data derived from official statistics obtained from the Central Statistical Office and the Eurostat database regarding procurement of agricultural produce carried out by commercial entities and processing plants. This information is presented in qualitative and quantitative terms for total agriculture, as well as for individual voivodeships.
    Prawidłowością rozwoju gospodarczego jest to, że zmniejsza się udział rolnictwa zarówno w wykorzystanych zasobach, jak i w tworzonym produkcie narodowym. Nie oznacza to jednak, że zmniejsza się rola rolnictwa w rozwoju gospodarczym. Można uważać, za paradoks, że im mniejszy odsetek stanowi rolnictwo w gospodarce narodowej, tym większa jest jego rola, albowiem dostarcza ono surowców do wytwarzania dóbr, zwłaszcza żywnościowych, zaspokajających potrzeby coraz liczniejszej społeczności. Głównym celem niniejszego badania jest pomiar i ocena zmian skupu produktów rolnych w Polsce w latach 2010-2016.W niniejszym badaniu postawiono hipotezę badawczą: Zmiany w wolumenie skupu wywarły znacznie większy wpływ na wartość skupu wybranych produktów rolnych w Polsce w badanym okresie aniżeli zmiany w poziomie cen transakcyjnych. W artykule przeprowadzona została analiza porównawcza skupu towarów produkcji roślinnej oraz skupu towarów produkcji zwierzęcej Postępowanie badawcze oparto, przede wszystkim, na danych statystyki publicznej pozyskanych z Głównego Urzędu Statystycznego oraz bazy Eurostat z zakresu skupu produktów rolnych prowadzanego przez jednostki handlowe i przetwórcze. Informacje te prezentowane są w ujęciu ilościowym i wartościowym dla rolnictwa ogółem oraz dla województw.

    Celem artykułu jest ustalenie, czy w świetle przepisów prawa wspólnotowego obligatoryjnym elementem umowy dostawy produktów rolnych jest klauzula dotycząca rozwiązania lub wypowiedzenia kontraktu. Rozważania prowadzone są w oparciu o kanony wykładni prawa unijnego, z uwzględnieniem problemów różnych wersji językowych. Wykładnia gramatyczna przeprowadzona w różnych językach urzędowych Unii Europejskiej nie doprowadziła do jednoznacznych wniosków. Pozajęzykowe metody wykładni doprowadziły jednak do wniosków zaskakujących, bowiem odmiennych od literalnego brzmienia przepisu regulującego przedmiotową kwestię. W konkluzji Autorka stwierdza, że koniecznym elementem w umowach dostawy produktów rolnych winny być postanowienia dotyczące wypowiedzenia umowy, nie zaś jej rozwiązania. Klauzule te powinny być obligatoryjnie zawierane wyłącznie w przypadku umów terminowych, w których świadczenie producenta rolnego ma charakter ciągły lub okresowy.
    L’articolo si propone di determinare se, alla luce delle disposizioni del diritto dell’UE, la clausola di risoluzione del contratto o di recesso debba essere obbligatoriamente contenuta nel contratto di fornitura di prodotti agricoli. Le considerazioni sono state svolte sulla base dei canoni interpretativi del diritto dell’UE. L’interpretazione grammaticale, comprensiva di diverse lingue ufficiali dell’UE, non ha portato a conclusioni univoche. Mentre i metodi interpretativi non linguistici hanno condotto a risultati assai sorprendenti, distanti dal significato letterale delle disposizioni che disciplinano la materia in questione. Nella parte conclusiva l’Autrice ha affermato che del contratto in oggetto devono necessariamente far parte le disposizioni di recesso, mentre quelle di risoluzione vanno obbligatoriamente inserite nei contratti a termine, nei quali le prestazioni del produttore agricolo hanno un carattere continuativo o periodico.
    The purpose of the deliberations was to determine whether, under the provisions of European Union law, the clause on termination or cancellation of a contract is a mandatory element of the contract for the supply of agricultural produce. The considerations were carried out pursuant to the canons of interpretation of EU law. While a grammatical interpretation, taking into account the official languages of the European Union, did not lead to a conclusive answer, extra-linguistic methods of interpretation have resulted in surprising conclusions, differing from the literal wording of the provision regulating the issue in question. In has been thus concluded that a contract for the supply of agricultural produce should contain a provision allowing its cancellation rather than termination, but such a provision ought to be mandatory only in the case of fixed-term contracts, where the performance of the agricultural producer is continuous or periodical.

    In fighting global food cries, Agricultural product processing and storage plays an important role in food and feed preservation for the continual survival of man. Through the development of modern storage facilities, food crop preservation becomes easy and simple to follow. Rice and oil palm is a selected few agricultural product that will be taken into consideration in the course of this work. The study was conducted in Obubra Local Government Area of Cross River State, Nigeria, Storage experimentations were done at Faculty of Agriculture and Forestry Multipurpose screen house. The study was conducted with the aim to look into processing procedures and find possible solutions to the problems facing the farmers and agricultural machine operators in Agric business. Low level of mechanisation was observed to be high in areas visited during the period of this research.
