    This study analysed the effects of cooperative member characteristics on income generation among smallholder farmers in Chibombo district of Central Zambia using logistic regression from a sample size of 398 co-operative members. The aim of the study was to analyze factors affecting income generation among small-holder famers with membership in agricultural cooperatives, and to identify factors that increase their income. Data were collected in May 2020 using a questionnaire. The empirical data indicated that income increased when there were increases in the cultivated area, primary education and cooperative membership period of 5–10 years but decreased with marriage, being widowed and a farming experience period of 5–10 years. The other factors had no significant effect. Thus, the study concludes that increasing cultivated area, duration of cooperative membership and attending at least primary education would better income generation among cooperative members.

    W celu kontroli bazy ciągnikowej utworzono program o nazwie "RSPmech", który został przetestowany w Rolniczej Spółdzielni Produkcyjnej Rostkowice. Dane gromadzone przy pomocy programu pozwoliły na prowadzenie bieżącej analizy m.in. stopnia zużycia paliwa czy też ilości przepracowanych motogodzin przez poszczególne ciągniki. Do bazy danych dostęp mają wszyscy pracownicy, ale za wprowadzanie nowych i korygowanie dotychczasowych informacji odpowiedzialna jest jedna osoba, która dokonuje ich z poziomu administratora, po zalogowaniu do programu.
    In order to provide monitoring for stock of tractors, the researchers developed an application named "RSPmech", tested in Rolnicza Spółdzielnia Produkcyjna Rostkowice [Rostkowice Agricultural Production Co-operative]. Data acquired using the application allowed to carry out current analysis including fuel consumption degree or number of machine-hours worked by individual tractors. All employees have access to the database, but only one person is responsible for entering new and correcting previously entered information. That person makes all entries from administrator's level, after having logged in the application.

    The article discusses the current state, legislative threats connected with the preparation of the Polish cooperative act and selected legislative proposals. The legal status of Polish cooperatives is unsatisfactory. The basic assumptions, structure and content of the regulations, which are of archaic and residual nature, are defective.A new cooperative law will not solve the problem if the existing legislation is merely amended. Another danger may stem from the defective definition of the essence and status of co-operatives in social market economy. The forthcoming cooperative law should be limited to general issues which apply tom co-operatives. Specific acts should govern individual co-operatives, e.g. credit cooperatives. The law should guarantee a broad statutory freedom. It is very important to have a precise yet a comprehensive definition of the purpose of the co-operative. The Finnish cooperative law provides a good example in this regard: “The purpose of a co-operative shall be to promote the economic and business activities of its members by means of the pursuit of economic activity where the members make use of the services provided by the co-operative or services that co-operative arranges for, directly, indirectly or otherwise.” Any future regulation should not limit the possibility of co-operatives becoming members of commercial companies.Differences between legal entities are becoming blurred, and this also applies o co-operatives. Therefore, co-operatives should take over some solutions from typical commercial companies, such as the marketability of shares.

    Opis:
    The aim of this paper is to attempt to answer the question whether EU funds are an effective instrument for the development of cooperatives in agriculture and rural areas. Therefore, it is necessary to analyze the provisions relating to both the legal regulations of EU funds and the establishment and operation of cooperatives. Firstly, the paper presents selected general issues concerning the cooperative movement in agriculture. Then, the discussion relates to agricultural producer groups, particularly the principles of using the EU funds and the characteristics of these entities. Subsequently, the research focuses on agricultural production cooperatives, dairy cooperatives and social cooperatives, especially in respect of the EU funds of which they could be beneficiaries. In conclusion, the author states that the European funds are unquestionably an effective tool for the development of cooperatives in agriculture and rural areas. First of all, it refers to cooperative agricultural producer groups and social cooperatives which run also agricultural activities. At the same time the EU funds serve as an additional factor in mobilizing groups of agricultural producers to extend the basic purpose of their activities. It refers mainly to processing. The author puts forward the demand for further financial support for groups of agricultural producers after 2013 and the adoption of a new Cooperative Law, and a separate law on agricultural cooperatives.

    Artykuł omawia aktualny stan, zagrożenia legislacyjne związane z przygotowaniem przyszłej polskiej ustawy spółdzielczej oraz wybrane propozycje legislacyjne. Stan prawny dotyczący polskich spółdzielni jest niezadowalający. Wadliwe są podstawowe założenia, struktura oraz treść przepisów, które cechują się archaicznością i szczątkowością. Uchwalenie nowej ustawy o spółdzielniach nie rozwiąże problemów, jeżeli nowa ustawa przyjmie w istocie postać nowelizacji obowiązujących przepisów. Kolejne niebezpieczeństwo może wynikać z wadliwego określenia istoty i miejsca spółdzielni w społecznej gospodarce rynkowej. Przyszła ustawa o spółdzielniach powinna być ograniczona do zagadnień ogólnych, które dotyczą każdej spółdzielni. Ustawy szczegółowe powinny regulować poszczególne spółdzielnie, np. spółdzielnie kredytowe. Ustawa powinna gwarantować szeroką swobodę statutową. Bardzo ważne jest precyzyjne, ale jednocześnie obszerne określenie celu spółdzielni. Dobrym przykładem może tu być definicja zaczerpnięta z fińskiej ustawy spółdzielczej w brzmieniu: celem spółdzielni jest wspieranie interesów gospodarczych lub zawodowych swoich członków przez prowadzenie przedsiębiorstwa, w ramach którego członkowie korzystają z usług dostarczanych przez spółdzielnię lub usług, które spółdzielnia organizuje, aranżuje bezpośrednio lub pośrednio lub inny sposób. Przyszła regulacja nie powinna ograniczać przystępowania spółdzielni do spółek handlowych w charakterze członka. Zachodzi proces zacierania się różnic między osobami prawnymi i dotyczy to także spółdzielnie. Dlatego powinny one przejmować w pewnym stopniu rozwiązania typowe dla spółek handlowych, np. zbywalność udziałów.
    The article discusses the current state, legislative threats related to the preparation of the future polish cooperative act and selected legislative proposals. The legal status of polish cooperatives is unsatisfactory. The basic assumptions, structure and content of regulations that are archaic and residual are defective. A new cooperative law will not solve the problem, if the new law actually accepts the amendment of the existing legislation. Another danger may be due to defective definition of the essence and place of the cooperative in the social market economy. The forthcoming cooperative act should be limited to general issues that apply to each cooperative. Specific laws should regulate individual cooperatives, eg. credit cooperatives. The law should guarantee broad statutory freedom. It is very important to have a precise, but at the same time, a comprehensive definition of the purpose of the cooperative. A good example may be the definition taken from the Finnish cooperative law, which reads: “The purpose of a co-operative shall be to promote the economic and business activities of its members by means of the pursuit of economic activity where the members make use of the services provided By co-operative or services that co-operative arranges through a subsidiary or otherwise”. Future regulation should not limit the access of cooperatives to trading companies as a member. There is a process of blurring differences between legal entities, and this also applies o cooperatives. Therefore, they should take over to some extent the solutions from typical commercial companies, such as the transferability of shares.
