Opis:: Neonatal mortality rates by gestational age and birth weight category are important indicators of maternal and child health and care quality. However, due to recent laws on administrative simplification and privacy, these specific rates have not been calculated in Italy since 1999. The main aim of this work is to assess the possibility of retrieving information on neonatal mortality by the linkage between records related to live births and records related to infant deaths within the first month of life, with reference to 2003 and 2004 birth cohorts. From a strict methodological point of view, some critical aspects of the most used record linkage approach are highlighted: specific problems may arise from the choice of records to be linked if there are consistency constraints between pairs (in this context, one death record can be linked to at most one birth record). In the light of considerations on the quality of the starting data, the retrieval of information on neonatal mortality by gestational age and birth weight is restricted to Northern Italy. Specific neonatal mortality rates are provided with reference to 2003 and discussed with particular emphasis on quality issues in the data collection processes.

Opis:: Poland’s system of higher education has expanded rapidly in the last quarter century. Not all graduates of the massified educational system have succeeded in the labor market. Part of the public debate regarding the labor market performance of graduates focuses on the performance of graduates who attended private institutions and part-time programs. As yet, there has been no detailed research into the career paths of recent university graduates in Poland, let alone a comprehensive investigation of the differences between the performance of graduates of various types of studies. In this paper, we present the newly created Polish Graduate Tracking System. We use data from the system to evaluate the labor market performance of recent graduates and to demonstrate the differences between graduates of public and private education. Overall, the privately educated graduates fare better on the labor market, but a more in-depth analysis shows that this could be attributed to their strategy of early entry into the labor market.

Opis:: Estimating the size and places of residence of the population of Ukraine has been this country’s problem for the past decade, and is related to the lack of census data for the 2010 round, large-scale processes of external and internal labour migration, and Russia's armed aggression against Ukraine that started in 2014. This already disadvantageous situation has been significantly exacerbated by Russia’s full-scale war against Ukraine which began on 24th February 2022. Conducting statistical surveys, especially surveys regarding the population, turned out to impossible under war circumstances. Therefore, the task of developing effective approaches to estimating the population size using data from existing sources, in particular the data of mobile operators regarding the number, location and mobility of subscribers, has become even more pressing. The article highlights the results of a study on the use of data from mobile operators, data from administrative registers, and the results of a special population sample survey on the use of mobile communication for the purpose of estimating the population. It also provides the results of experimental calculations of the population size in Ukraine as a whole and in particular regions. The study moreover showed that the size of Ukraine’s population in November 2019, unlike the official estimate of 41,940.7 thousand people, was probably about 37,289.4 thousand people. The developed approaches can be used to estimate the number and location of the population of Ukraine during the intercensal period or significant population movements due to environmental disasters or military conflicts.

Opis:: The article aims to present data resources for the needs of research in geography of industry in Poland. These sources can be independently obtained primary sources or secondary sources. Primary data have a unique value. They are collected for a specific purpose to solve a specific problem. They usually allow for a detailed description of the theme under investigation. As they are obtained directly from the surveyed entities during statistical research, they show timeliness and originality. In the research in geography of industry, primary data sources are used relatively rarely. It is mainly due to the time-consuming and costly nature of this type of research and the increasing difficulties in obtaining consent for research from respondents. Therefore, secondary data, which are the results of previous research, primarily by Statistics Poland, are especially popular. Statistics Poland, deals with issues useful from the point of view of the research in geography of industry, both in the form of surveys of the official statistics and as part of experimental studies. The article describes research carried out by Statistics Poland, which provides essential information about the industry and its location. Administrative data sources which may be helpful in this regard have also been mentioned. Public statistics has access to many of them. The area of interest of official statistics regarding data on industrial activities also refers to the data on the labour areas, which were created using the European version of the TTWA algorithm. The argument presented in this article proves that public statistics investigates a broad spectrum of phenomena related to industrial activities, and the results of these studies are and may be widely used by researchers in geography of industry.

Opis:: The pace of changes taking place in the contemporary world creates demand for current data at the lowest possible level of territorial aggregation, enabling the assessment of the impact of these changes on local labour markets. Data resources gathered in registers and administrative systems directly or indirectly related to employment seem to provide an opportunity to satisfy these new expectations. However, to be able to use administrative resources for statistical purposes, it is necessary to make allowances for the fact that the administrators of registers and administrative systems collect data to satisfy their own needs and that official statistics reuses them. The aim of the article is to show the analytical opportunities which administrative data sources provide and to demonstrate that they can complement or even replace traditional methods of collecting data on employed persons. The experimental adaptation of data from these sources for statistical purposes proves that, for example, data on employed persons, calculated on the basis of the resources of the Social Insurance Institution (ZUS) and the Agricultural Social Insurance Fund (KRUS), correspond almost fully in terms of definitions with data collected by official statistics. The readiness to come to terms with slight methodological differences related to the count of employed persons in agriculture or persons employed for the purpose of vocational training or agents will make it possible to provide users with this important labour market statistics faster, more frequently, and in aggregations different than those recently offered by official statistics, while limiting or even eliminating many reporting obligations imposed on the national economy entities. This article describes official statistics' current methods of researching employed persons and compares them with the experimental method of calculating the number of these persons on the basis of administrative data sources. Due to the fact that data calculated by means of the experimental method are characterised by a multitude of new information, we decided to present here only selected examples of their analyses and contribution to expanding the knowledge about employed persons in the Polish economy. We would also like to emphasise that data used for this purpose refer to all employed persons (in all entities, including the smallest ones with the maximum of nine employed persons). Other advantages of the administrative data sources are the monthly availability of data and the possibility of aggregating them down to gmina (the lowest local administrative unit) level.
Tempo zmian we współczesnym świecie rodzi zapotrzebowanie na bieżące dane na możliwie najniższym poziomie agregacji terytorialnej, które pozwalałyby na diagnozowanie wpływu zachodzących zmian na lokalne rynki pracy. Szansę na sprostanie tym potrzebom dają zasoby danych gromadzone w rejestrach i systemach administracyjnych, dotyczące bezpośrednio lub pośrednio wykonywania pracy. Wykorzystanie zasobów administracyjnych do celów statystycznych wymaga uwzględnienia tego, że gestorzy rejestrów i systemów administracyjnych zbierają dane na swoje potrzeby, a statystyka publiczna wykorzystuje je wtórnie. Celem artykułu jest wskazanie możliwości analitycznych, jakie dają administracyjne źródła danych, oraz wykazanie, że mogą one uzupełnić, a nawet zastąpić tradycyjne metody zbierania informacji o pracujących. Przeprowadzone prace eksperymentalne polegające na zaadaptowaniu danych z tych źródeł dla celów statystycznych dowodzą, że np. dane o pracujących wyliczone na podstawie zasobów Zakładu Ubezpieczeń Społecznych i Kasy Rolniczego Ubezpieczenia Społecznego niemal w całości pokrywają się definicyjnie z danymi zbieranymi przez statystykę publiczną. Zaakceptowanie drobnych różnic metodologicznych dotyczących liczenia pracujących w rolnictwie czy pracowników zatrudnionych w celu przygotowania zawodowego oraz agentów pozwoli na dostarczanie ważnych danych statystycznych z obszaru rynku pracy szybciej, częściej i w innych agregacjach niż prezentowane dotychczas przez statystykę publiczną, przy jednoczesnym ograniczeniu czy wręcz zlikwidowaniu wielu obowiązków sprawozdawczych ciążących na podmiotach gospodarki narodowej. W artykule opisano dotychczasowe metody badania osób pracujących stosowane w statystyce publicznej i porównano je z eksperymentalną metodą wykorzystującą administracyjne źródła danych. W związku z tym, że dane uzyskane metodą eksperymentalną dostarczają wielu nowych informacji, w niniejszym opracowaniu zdecydowano się na przedstawienie jedynie przykładowych analiz tych danych, które poszerzają wiedzę o pracujących w polskiej gospodarce. Warto również podkreślić, że wykorzystane tu dane administracyjne odnoszą się do wszystkich pracujących (we wszystkich podmiotach, także tych najmniejszych, o liczbie pracujących do dziewięciu osób włącznie). Atutem danych administracyjnych jest ponadto ich comiesięczna dostępność oraz możliwość agregowania do poziomu gminy.

Opis:: One of the basic goals of Bologna Process is to promote students mobility. Transforming five-year studies in two-cycle structure gave students the opportunity of horizontal mobility – chance to change the institution of higher education or faculty after completing first cycle. This paper presents results of the research on the students’ educational paths and on their horizontal mobility after becoming bachelor in 2010 at University of Warsaw. It is the first research on this issue based on data collected by University’s administration and stored in two related systems that collect the data: web-based central admission system (IRK) and University Study-Oriented System (USOS).
Jednym z założeń Procesu Bolońskiego jest promowanie mobilności studentów. Wprowadzenie systemu studiów dwustopniowych stworzyło możliwość mobilności pionowej studentów – zmiany uczelni lub kierunku studiów po zakończeniu studiów I stopnia. W tekście przedstawione są wyniki badania mającego na celu przeanalizowanie wyborów osób, które w 2010 roku uzyskały tytuł licencjata na Uniwersytecie Warszawskim, oraz określenie, w jakim stopniu zachodzi zjawisko mobilności pomiędzy kierunkami studiów w momencie przejścia między studiami I i II stopnia. Jest to pierwsze tego typu badanie prowadzone z wykorzystaniem danych administracyjnych, gromadzonych w ramach dwóch stowarzyszonych systemów: Internetowej Rejestracji Kandydatów (IRK) oraz Uniwersyteckiego Systemu Obsługi Studiów (USOS).

Opis:: Until now there have been two types of analysis used in monitoring graduates’ situation on labour market. The fi rst type of analysis used surveys among graduates and / or employers. The second was based on public statistics. These analyses usually were not combined and did not provide the possibility to identify the links between education path and the success in the labour market. This paper presents a project that is carried out by the Quality Evaluation Unit of the University of Warsaw. The main goal of the project is to create a methodology of evaluation research that is capable of describing relation between success in studying and labour market success. In the project we will use multiple sources of information, which are administrative data collected continuously by various institutions independently from any researchers activities. The register of Social Insurance Institution (ZUS) contains a wealth of information on the professional activity of Poles while institutions of higher education have collected data on the history of students’ educational careers in their electronic registers. Data gathered by University of Warsaw on the educational path of students have been used in the project so far. Combining information from these two sources creates great opportunities for systematic evaluation of learning processes and outcomes in institutions of higher education. The project implemented by Quality Evaluation Unit of UW aims at something seemingly impossible – a systematic study enabling in-depth analysis that is not expensive.
Dotychczas w naszym kraju wnioski o sytuacji absolwentów na rynku pracy wyciągane były na podstawie dwóch rodzajów analiz. Jedne wykorzystywały badania opinii absolwentów i/lub pracodawców. Drugie natomiast opierały się na statystykach publicznych. Te analizy zwykle nie były łączone i nie dawały możliwości określenia związków pomiędzy ścieżką edukacyjną a sukcesem na rynku pracy. W niniejszym tekście przedstawiamy projekt badawczy realizowany przez Pracownię Ewaluacji Jakości Kształcenia Uniwersytetu Warszawskiego (PEJK UW), którego głównym celem jest wypracowanie metodologii badań ewaluacyjnych pozwalających na opisanie tego związku i zbadanie jego siły. W prezentowanym projekcie będą z sobą połączone informacje z wielu źródeł. Są to dane administracyjne gromadzone przez rozmaite instytucje w sposób ciągły, niezależnie od działań badaczy. Rejestr Zakładu Ubezpieczeń Społecznych zawiera bogaty zasób informacji na temat aktywności zawodowej Polaków. Natomiast dane o historii edukacyjnej studentów od kilku lat są powszechnie gromadzone przez wyższe uczelnie w kraju w ich elektronicznych rejestrach. W projekcie wykorzystywane są też informacje o ścieżce edukacyjnej studentów dostępne w rejestrach Uniwersytetu Warszawskiego. Połączenie danych z tych rejestrów stwarza wielkie możliwości do prowadzenia systematycznych badań służących ewaluacji efektów kształcenia na wyższych uczelniach. Projekt realizowany przez PEJK UW umożliwia zatem pogodzenie różnych, pozornie sprzecznych ze sobą postulatów: systematyczność badań, możliwość prowadzenia pogłębionych analiz oraz minimalizację kosztów badań.

Opis:: After over twenty years of its existence, on 25th May 2018 the Bureau of the Inspector General for the Protection of Personal Data (GIODO) was transformed into the Personal Data Protection Office (UODO), which took over the staff, assets, obligations and liabilities of the Bureau. The reform significantly extended the tasks and competences of the UODO President. While GIODO was only the national body for personal data protection, the UODO President is tasked not only with personal data protection, but also serves as a supervisory body. The independence of the institution was also strengthened. At present, the mandate of the UODO President is regulated in as many as three legal acts (RODO, uodo and uodzzp). The article is dedicated to several key issues, in the light of the reforms and changes introduced with the new regulations, related mainly to the administrative and complaints proceedings.

Opis:: The aim of the paper is to present the experience of the Republic of Serbia in conducting the 2022 Census of Population, Households and Dwellings, focusing on the employment, legal framework and financing of the census as well as on its successful implementation. It discusses strategic decisions on data collection and the integration of information technology - including geospatial data, data collection techniques, machine learning, record linkage and monitoring system - to overcome the challenges posed by the census. The paper addresses the census undercoverage, explores the use of administrative data for item imputation, and examines the development of a statistical population register. The study demonstrates the benefits of adopting a digital-census approach: significant improvement of accuracy, cost reduction and acquired expeditiousness. The Statistical Office of the Republic of Serbia conducted a digital census combined with traditional methods, excluding self-enumeration, along with the use of administrative data for item imputation, and recommends this approach as the most effective way to obtain precise and comprehensive information about a population, including its demographic characteristics, geographic distribution and overall size.
Celem artykułu jest przedstawienie doświadczeń Republiki Serbii w zakresie organizacji Powszechnego Spisu Ludności, Gospodarstw Domowych i Mieszkań 2022, ze szczególnym uwzględnieniem zagadnień dotyczących zatrudnienia personelu, ram prawnych i finansowania tego badania oraz warunków jego udanej realizacji. Praca skupia się na strategicznych decyzjach w sprawie zbierania danych oraz zastosowania technik informatycznych, takich jak: wykorzystanie danych przestrzennych, cyfrowe metody uzyskiwania danych, uczenie maszynowe, łączenie rekordów czy system monitorujący, mających na celu sprostanie wyzwaniom związanym ze spisem. Autorzy poruszają także kwestie niedostatecznego pokrycia spisu oraz wykorzystania rejestrów administracyjnych do imputacji danych. Ponadto poświęcają uwagę opracowaniu i udoskonalaniu statystycznej ewidencji ludności, dokładności danych, obniżeniu kosztów i zwiększeniu efektywności badania. Główny Urząd Statystyczny Republiki Serbii przeprowadził spis powszechny w sposób cyfrowy, łącząc ten mechanizm z metodami tradycyjnymi (z wyłączeniem samospisu) i posiłkując się rejestrami administracyjnymi w celu imputacji danych. Metoda ta jest w artykule rekomendowana jako najefektywniejszy sposób uzyskania precyzyjnych i wyczerpujących informacji na temat populacji, w tym jej charakterystyki demograficznej, rozmieszczenia przestrzennego i liczebności.

Opis:: The police process huge amounts of personal data without which they would not be able to carry out their basic tasks. The data processed by the police have a very different nature and scope. Data processing in such large quantities and in such a wide range is associated with great responsibility for its safety. Maintaining a high level of security becomes a challenge when, at the same time, it is necessary to take care of the rights of data subjects. The article contains an overview of administrative decisions issued by the Inspector General for Personal Data Protection (currently: the President of the Personal Data Protection Offi ce) relating to police activities. The issues of the implementation of the rights of data subjects are discussed in three areas, i.e.: sharing information from police resources, deleting data from the National Police Information System, and verifi cation of identity documents.

Opis:: Zmiany w zakresie problematyki ochrony danych osobowych związane z wejściem w życie przepisów RODO oraz ustawy o ochronie danych osobowych spowodowały nałożenie na Prezesa UODO szeregu różnorodnych zadań. Wiele z nich organ ten wykonuje korzystając z podstawowej prawnej formy działania administracji, jaką jest decyzja administracyjna, która w tym przypadku podejmowana jest w jednoinstancyjnym postępowaniu. Na tym tle podjęto kolejno analizę: statusu i zakresu zadań, w tym uprawnień nadzorczych Prezesa UODO oraz ram proceduralnych, w których są one podejmowane – w tym z wykorzystaniem formy decyzji administracyjnej. Za zasadne uznano też zbadanie, czy w konkretnych przypadkach forma decyzji administracyjnej stanowi adekwatny środek realizacji zadań powierzonych przez przepisy RODO Prezesowi UODO. W konkluzji autorki uznały za konieczne rekomendowanie, aby ustawodawca ściśle określił formę prawną, w jakiej powinny być wykonywane zadania Prezesa UODO. Nadto wskazały one, że ustawodawca zdaje się nie dostrzegać, że charakter powierzonych Prezesowi UODO zadań wskazuje, iż forma decyzji administracyjnej nie zawsze wydaje się być nie tylko najlepszą, ale wręcz odpowiednią. Szczególnie, gdy chodzi o działania tego organu związane z koniecznością wydania ostrzeżenia czy udzielenia upomnienia – forma decyzji administracyjnej nie wydaje się być zasadną.
Changes in the field of personal data protection related to the entry into force of the provisions of the GDPR and the Act on the protection of personal data resulted in the imposition of a number of different tasks on the President of the Personal Data Protection Office. Many of them are implemented by this authority using the fundamental legal form of administrative action – i.e. an administrative decision, which in this case is adopted in one-instance proceedings. On this basis, the following analysis was carried out: the status and scope of tasks, including the supervisory powers of the President of the Personal Data Protection Office, and the procedural framework in which they are undertaken – including the form of an administrative decision. It was also considered worth to examine whether, in specific cases, the form of an administrative decision constitutes an adequate means of implementing the tasks entrusted by the provisions of the GDPR to the President of the Personal Data Protection Office. In the conclusion, the authors considered it justified to recommend that the legislator should precisely define the legal form in which the tasks of the President of the Personal Data Protection Office should be performed. Moreover, they indicated that the legislator does not seem to notice that the nature of the tasks entrusted to the President of UODO indicates that the form of an administrative decision does not always seem to be not only the best, but even appropriate. Especially when it comes to the actions of this authority related to the need to issue a warning or issue a reminder – the form of an administrative decision does not seem to be justified.

Opis:: Postępowanie po wydaniu decyzji administracyjnej przez Prezesa Urzędu Ochrony Danych Osobowych jest specyficzne o tyle, że decyzja ta ma charakter ostateczny, a w konsekwencji nie sposób wnieść od niej odwołania do organu wyższej instancji, ponieważ w systemie ochrony danych osobowych takiego organu nie ma. W konsekwencji zaskarżenie decyzji Prezesa UODO następuje w drodze skargi do sądu administracyjnego, który rozpatruje sprawę według zasad określonych w przepisach ustawy o postępowaniu przed sądami administracyjnymi. To sytuacja swoista o tyle, że sprawy z zakresu ochrony danych osobowych wymagają zwykle adekwatnego postępowania dowodowego, oceny: czy administrator lub podmiot przetwarzający zastosowali odpowiednie środki techniczne i organizacyjne (wziąwszy pod uwagę ryzyko naruszeń praw lub wolności osób fizycznych), czy wprowadzili odpowiednią dokumentację, czy zastosowali prawidłowe przesłanki dopuszczalności przetwarzania danych osobowych, czy zrealizowali w sposób zgodny z prawem prawa osób, których dane dotyczą. Wszystko to sprawia, że postępowanie w przedmiocie skargi od decyzji Prezesa UODO prowadzone według procedur obowiązujących w postępowaniu przed sądami administracyjnymi wydaje się nader trudne i wręcz niespełniające uzasadnionych oczekiwań. W postępowaniu przed sądami administracyjnymi bardzo ograniczona jest bowiem możliwość przeprowadzenia dowodów. W tekście analizujemy poszczególne aspekty postępowania po wydaniu decyzji przez Prezesa Urzędu Ochrony Danych Osobowych, wskazując na jego charakterystyczne cechy, oceniając przyjęte rozwiązania i postulując zmiany.
The procedure following the issuing of an administrative decision by the President of the Personal Data Protection Office is final and, consequently, it is impossible to appeal against it to a higher instance authority. As a consequence, an appeal against the decision of the President of the Personal Data Protection Office. All this makes the proceedings concerning the complaint against the decision of the President of the Personal Data Protection Office, conducted in accordance with the procedures in force in the proceedings before administrative courts, seem very difficult and even failing to meet the legitimate expectations. In the proceedings before administrative courts, the possibility of taking evidence is very limited. In the text, we analyze individual aspects of the procedure after the decision is issued by the President of the Personal Data Protection Office, pointing to its characteristic features, assessing the solutions adopted and proposing changes.

Application of data integration of different, including administrative, sources enables the use of information in terms of full coverage and rich in substance. The joint observation of variables observed in separate data collections generate a synergy effect increasing amount of knowledge derived from socio-economic research.

This article aims to draw attention to the duties of personal data protection in general administrative proceedings in the context of the General Data Protection Regulation, which came into force on 25 May 2018. It depicts the subjective, the objective, as well as the territorial scope of the application of GDPR, subsequently referring it to certain procedural steps taken in the course of administrative proceedings. Moreover, deliberations concerning the processing of personal data which takes place within the scope of administrative proceedings, as well as the role of the parties in such proceedings have been presented.

Czy statystyka oficjalna, której zadaniem jest zapewnienie rzetelnego systemu informacji, jest w stanie sprostać tym oczekiwaniom? W rozdziale podjęto próbę odpowiedzi na powyższe pytania poprzez omówienie zmian organizacyjnych badań statystycznych, metod przeprowadzania oraz transformacji spisów ludności, a zwłaszcza zagrożeń i perspektyw na przyszłość związanych z wykorzystaniem pozastatystycznych źródeł danych (m.in. rejestrów administracyjnych czy big data), jako alternatywnych metod przeprowadzania spisu ludności.
The census is the basic source of information on the condition and structure of the population and its territorial distribution. This study is an essential part of the national and international official statistics system, primarily because it provides population estimates. The census is one of the oldest statistical surveys, but ... is it still needed today? Is official statistics, whose task is to provide a reliable information system, be able to meet these expectations? The chapter attempts to answer the above questions by discussing organizational changes in statistical surveys, methods of conducting and transformation of censuses, and especially threats and future prospects related to the use of non-statistical data sources (eg administrative registers or big data) as alternative methods carrying out a census.

Opis:: The right to the protection of personal data, which is part of the right to privacy, is a fundamental human right. Thus, its guarantees were included in the high-level regulations of the European Union as well as the legal norms of the EU Member States. The first Polish law regulating the protection of personal data was adopted in 1997 as the implementation of EU Directive 95/46. The law imposed a number of obligations on public and private entities which process personal data in order to protect the rights of data subjects and, in particular, to guarantee them the ability to control the correctness of processing of their personal data. Therefore, the law obliged data controllers to process data only on the basis of the premises indicated in the legislation, to adequately secure data, and to comply with the disclosure obligation concerning data subjects, including their right to correct false or outdated data or to request removal of data processed in violation of the law. However, as complaints directed by citizens to the supervisory body-the Inspector General for Personal Data Protection-showed, personal data controllers, especially those operating in the private sector, did not comply with the law, acting in a manner that violated their customers’ rights. In the hitherto existing unfair business practices of entrepreneurs, the violations of the data protection provisions that were the most burdensome for customers were related to preventing them from exercising their rights, including the right to control the processing of data, as well as the failure to provide the controller’s business address, which made it impossible for subjects whose data were used in violation of the law or for the inspecting authorities to contact the company, a lack of data security and a failure to follow the procedures required by law, the failure to secure documents containing personal data or their abandonment, a lack of updating customer data, the use of unverified data sets and sending marketing offers to deceased people or incorrect target recipients, and excessive amounts of data requested by controllers. The violations of the rights of data subjects recorded in Poland and other EU Member States-among other arguments-provided inspiration for the preparation of a new legal act in the form of the EU General Data Protection Regulation (GDPR) (which entered into force on 25 May 2018). The extension of the rights of people whose data are processed was combined in the GDPR with the introduction of new legal instruments disciplining data controllers. Instruments in the form of administrative fines and the strongly emphasised possibility to demand compensation for a violation of the right to data protection were directed in particular against economic entities violating the law.

Opis:: Artykuł został poświęcony nowemu organowi nadzorczemu w Polsce – jakim jest Prezes Urzędu Ochrony Danych Osobowych. Prezes UODO jest sukcesorem poprzedniego organu ochrony danych osobowych jakim był Generalny Inspektor Ochrony Danych Osobowych. W artykule omówiono ogólne warunki związane z powoływaniem organu nadzoru w sprawach dotyczących ochrony danych osobowych wynikające z przepisów RODO. W publikacji przedstawiono zakres właściwości, wymogi formalne do objęcia stanowiska Prezesa UODO, które wynikają z ustawy z dnia 10 maja 2018 r. o ochronie danych osobowych. W drugiej części przedstawiono zadania, kompetencje i uprawnienia Prezesa UODO, biorąc pod uwagę w szczególności kompetencje związane z nakładaniem kar za nieprzestrzeganie przepisów, dotyczących ochrony danych osobowych. Artykuł powstał w oparciu o analizę aktów prawnych oraz dostępnej literatury przedmiotu.
The article was devoted to the new supervisory authority in Poland – the President of the Personal Data Protection Office. The President of the PDPO is the successor of the previous personal data protection authority, which was the Inspector General for Personal Data Protection. In the article, the general requirements connected to the appointment of a supervisory authority for personal data protection resulting from the provisions of the GDPR, were discussed. The formal requirements and conditions that are required to assume the post of the President of the PDPO resulting from the Act of 10 May 2018 on the Protection of Personal Data were also described. In the second part of the article, the tasks, competences, and powers of the President of the PDPO were presented, with special regard to competences connected to imposing administrative fines for the infringement of personal data protection provisions. The article is based on the analysis of legal acts and available literature on the subject.

Opis:: In the article publications have been analyzed and summarized on this topic: studied the experience of implementing building information models and geographic information models for administrative and economic management of transport infrastructure facilities on the example of the regional airport activity. After the stage of collecting geospatial data from various sources and sensors, the data is imported into CAD-systems or GIS-systems. Different software products are used to work with both of these models. The processes of data organization in the process of creating building information models and geographic information models differ to some extent. The issues of integration of such models are not yet fully addressed and need to be addressed. In the process of integration of spatial data, solutions to the integration of semantics, topology, formats and standards of geospatial data are needed. An important task is to develop and study the experience of creating software modules that allow you to integrate BIM-models into geographic information systems. Based on the research, it is established that the current area of research is the development of technologies that allow the generation of information from BIM and GIS to create a more interconnected infrastructure. The integration of BIM and GIS information to create a spatial data infrastructure (SDI) is a perspective direction.

Opis:: Niniejszy artykuł porusza kwestię pogodzenia w ramach porządku prawnego dwóch niezwykle ważnych wartości, jakimi są jawność życia publicznego oraz ochrona prywatności. Omawiane zagadnienie jest analizowane z uwzględnieniem zarówno ustawodawstwa krajowego, jak i rozwiązań obowiązujących na poziomie europejskim. Warstwa teoretycznoprawna pracy jest poświęcona wytłumaczeniu kluczowych pojęć. W oparciu o orzecznictwo polskich sądów administracyjnych zostały kolejno wskazane przykłady sytuacji, w których udostępnienie danych osobowych w trybie dostępu do informacji publicznej było dopuszczalne. Rozważania prowadzą do finalnego stwierdzenia, że szczególnej ochronie podlegają informacje dotyczące podmiotów indywidualnych w zakresie, w jakim dotyczą ich prywatności lub tajemnicy przedsiębiorcy, jednak ograniczenie to nie obejmuje szeroko rozumianych podmiotów pełniących funkcje publiczne.
This article addresses the issue of reconciliation of two paramount but opposing values which are transparency of public life and the protection of privacy under one legal system. The discussed problem is analyzed taking into account both national and European legislation. The theoretical part of the work is dedicated to the explanation of fundamental legal terms. Subsequently, basing on the jurisprudence of Polish administrative courts, authors give examples of situations in which disclosure of personal data is in compliance with the regulations on the access to public information. The considerations lead to the final statement that information on individual entities is subject to special protection to the extent that it relates to their privacy or secret of the entrepreneur. The restriction, however, does not apply to the so-called entities holding public positions.

Opis:: At the beginning of the 20th century, there was an active debate about random selection of units versus purposive selection of groups of units for survey samples. Neyman's (1934) paper tilted the balance strongly towards varieties of probability sampling combined with design-based inference, and most national statistical offices have adopted this method for their major surveys. However, nonprobability sampling has remained in widespread use in many areas of application, and over time there have been challenges to the Neyman paradigm. In recent years, the balance has tilted towards greater use of nonprobability sampling for several reasons, including: the growing imperfections and costs in applying probability sample designs; the emergence of the internet and other sources for obtaining survey data from very large samples at low cost and at high speed; and the current ability to apply advanced methods for calibrating nonprobability samples to conform to external population controls. This paper presents an overview of the history of the use of probability and nonprobability sampling from the birth of survey sampling at the time of A. N. Kiaer (1895) to the present day.

Opis:: Przedmiot badań: Niniejsze opracowanie poświęcone zostało analizie obowiązku prawnego współpracy podmiotów zobowiązanych do stosowania tzw. ogólnego rozporządzenia o ochronie danych osobowych (znanego szerzej jako RODO) z organem nadzorczym, którym w Polsce jest Prezes Urzędu Ochrony Danych Osobowych, oraz konsekwencjom jego naruszenia. Przedmiotem swoich dociekań autorka artykułu uczyniła normy prawa ochrony danych osobowych oraz praktykę ich stosowania. Cel badawczy: Podstawowym celem niniejszego artykułu jest ustalenie i ocena czy rozwiązania prawne przyjęte w art. 31 RODO są właściwe i wystarczające z punktu widzenia zapewnienia sprawnej realizacji zadań powierzonych organom nadzorczym odpowiedzialnym za monitorowanie stosowania przepisów o ochronie danych osobowych. 1 Metoda badawcza: Podstawową, zastosowaną w przypadku niniejszego opracowania metodą badawczą jest analiza materiału normatywnego i poglądów piśmiennictwa. Ponadto, w oparciu o rozstrzygnięcia Prezesa Urzędu Ochrony Danych Osobowych analizie poddano stosowanie prawa ochrony danych osobowych we wskazanym powyżej zakresie. Wyniki: Obowiązek współpracy z organem nadzorczym, wyrażony wprost po raz pierwszy na gruncie przepisów tzw. ogólnego rozporządzenia o ochronie danych, jest ważnym instrumentem zapewniającym niezakłóconą realizację kompetencji przyznanych organowi nadzorczemu. W tym kontekście jest on jednym z elementów składających się na fundament europejskiej reformy prawa ochrony danych osobowych, jakim jest wzmocnienie pozycji organu nadzorczego w relacji z administratorami, podmiotami przetwarzającymi – oraz gdy ma to zastosowanie – ich przedstawicielami. Wprowadzenie możliwości zastosowania sankcji finansowej jako konsekwencji naruszenia art. 31 RODO zapewnia możliwość urzeczywistnienia tego celu i pozwala na realne dyscyplinowanie podmiotów zobowiązanych do stosowania przepisów ogólnego rozporządzenia – zarówno w wymiarze indywidualno-, jak i ogólnoprewencyjnym, tj. zarówno w stosunku do samego podmiotu ukaranego, jak i do przyszłych adresatów żądań kierowanych przez organ. Jak pokazuje ponad 3-letnia praktyka stosowania przepisów ogólnego rozporządzenia, przyjęcie przez prawodawcę europejskiego takiego rozwiązania okazało się konieczne. Możliwość nałożenia administracyjnej kary pieniężnej, w przypadku naruszenia obowiązku współpracy z organem nadzorczym, może się okazać jednym z niewielu, a czasem wręcz jedynym narzędziem, po który organ będzie mógł sięgnąć, dążąc do niezakłóconej i terminowej realizacji powierzonych mu zadań, w tym przede wszystkim monitorowania i egzekwowania stosowania ogólnego rozporządzenia. Tym samym norma ta w sposób pośredni wpływa również na realizację praw osób, których dane dotyczą. Z drugiej strony, zastosowana na gruncie art. 31 RODO konstrukcja prawna, z którą wiąże się konieczność odwołania do innych przepisów ogólnego rozporządzenia określających kompetencje organu, chroni te podmioty przed jej ewentualnym nadużywaniem i ma istotny wymiar gwarancyjny.
Background: The study deals with the analysis of the legal obligation of cooperation by subjects required to employ the norms of the GDPR with the supervisory authority, in case of Poland, the President of the Personal Data Protection Office, and the consequences of lack of such cooperation. The Author investigates the norms of the personal data protection law and their use in practice. Research purpose: The primary goal of this study is to establish whether the solutions adopted in Article 31 of the GDPR are enough when considering the mandate of supervisory authorities. Methods: The primary method used in this study has been the analysis of the normative material and scholarly review. Additionally, the decisions of the President of the Personal Data Protection Office have served as the basis for analysis of employment of GDPR relevant norms in this regard. Conclusions: The duty of the controller to cooperate with the supervisory authority, first stated in the GDPR, is an important instrument to ensure the execution of power granted to a supervisory authority. In that context it serves as one of the keystones of European personal data protection reform, as strengthening of the supervisory authority in relation to controllers, processors and – if applicable – their representatives. The introduction of administrative fines as a result of violating Article 31 ensures that this goal is met and allows for real disciplining of subjects required to employ the norms of the GDPR, both individually and generally. As demonstrated over the last three years of its use, the adoption of such solution by the European lawmakers has been necessary. The possibility of imposing administrative fines for lack of cooperation with the supervisory authority might be one of the few, and sometimes the only, tools that such authorities can employ to ensure the accomplishment of its mandate, especially in regard to monitoring and enforcing GDPR execution. Therefore, this norm indirectly affects the exercise of data subjects’ rights. On the other hand, the legal construct of Article 31 requires the implication of other GDPR norms by the authority, which serves to protect them from abuse by the institution.
