There are often situations when the Chamber of bailiffs submit motions to the Voivodship Administrative Court (VAC) that challenging decisions of the Minister of Justice, concerning the appointment of new county court officers. The Council of the Chamber of Bailiffs believes that it has the status of a party in such proceedings, noting that the standing local government decision should be sought in the provisions regulated the scope of its activities, as well as in the court rules. Chamber of bailiff activities in the country have benefited from this privilege to a limited extent, challenging the individual cases of the creation of new posts a bailiff. The Council of the Chamber of Bailiffs in the arguments of their appeals against the decisions of the Minister of Justice setting up the new bailiffs, each time notes that the creation of a new position, although the effectiveness of enforcement remains unsatisfactory. Such action of the Council-not covered by law and contrary to the previous, until 20- year practice-impedes the access of lawyers to the profession, and also maintains the monopoly of the existing bailiff, which can work to the detriment of the public interest. On July 26th 2017 The Supreme Administrative Court of the Republic of Poland (SAC) issued a final decision in the case concerning the appointment of E. Z. by the Minister of Justice to the position of bailiff at the District Court in the city of G. The Commercial Chamber supervises the jurisdiction of regional administrative courts as far as customs, and most business regulation is concerned. The article examines and evaluates of the recognition of the Chamber of Bailiffs as parties in the appointment of a bailiff in the light of the 2 conflicting with each other judgments of the SAC and WAC in Warsaw with 2017r. In the cese brought before the SAC, the Council of the Chamber of Bailiffs in city of G. asked the Minister to request a retrial, claiming e. g. that has the status of a party in the proceedings. Concluded that the standing local government decision should be sought in the rules statuujących the scope of its activities, as well as in the rules. However, the Minister of Justice dismissed the appeal, stating that the request for a retrial cannot be acted upon, as it comes from non-party to the case. As explained, that no provision of substantive law does not grant local government authorities of the decision to the status of the parties in proceedings in respect of the appointment to the position of bailiff. Justice Minister Zbigniew Ziobro, after giving considerations of the applications of candidates, appointed in the same appeal of Lodz 19 bailiffs in the year 2016 and 3 this year. He did it after examining their past and competence. In accordance with the law asked also about the opinion of the House Chamber on the question of candidates and the need for new regional. The article contains numerous references to the jurisprudence of the Supreme Administrative Court and provincial (voivodeship) administrative courts. The author presented the administrative solutions to this issue and presented controversial and doubtful regulations. The presented de lege ferenda conclusions are aimed at introducing a precise and compatible procedure for approving shooting range regulations by the head of a commune, mayor or president of a city, in order to eliminate discretion in this respect.

The purpose of the study is to present the model of proceedings, in force since 2016 in Slovakia, regarding the administrative court procedure in administrative penalty cases, which can be taken over in whole or in part, or be one of the elements of a broader discourse on potential changes in Law on Proceedings before Administrative Courts, taking into account the specificity and essence of the Polish administrative judiciary. The study contains de lege ferenda postulates regarding changes in the judicial-administrative control of penalties in Poland. In the author’s opinion, the normalization of the judicial-administrative procedure for the control of administrative fines could be the first step towards the unification of the judicial procedure in this area and the resignation from its current multiplicity, by granting exclusive jurisdiction in these cases to administrative courts.

Postępowanie po wydaniu decyzji administracyjnej przez Prezesa Urzędu Ochrony Danych Osobowych jest specyficzne o tyle, że decyzja ta ma charakter ostateczny, a w konsekwencji nie sposób wnieść od niej odwołania do organu wyższej instancji, ponieważ w systemie ochrony danych osobowych takiego organu nie ma. W konsekwencji zaskarżenie decyzji Prezesa UODO następuje w drodze skargi do sądu administracyjnego, który rozpatruje sprawę według zasad określonych w przepisach ustawy o postępowaniu przed sądami administracyjnymi. To sytuacja swoista o tyle, że sprawy z zakresu ochrony danych osobowych wymagają zwykle adekwatnego postępowania dowodowego, oceny: czy administrator lub podmiot przetwarzający zastosowali odpowiednie środki techniczne i organizacyjne (wziąwszy pod uwagę ryzyko naruszeń praw lub wolności osób fizycznych), czy wprowadzili odpowiednią dokumentację, czy zastosowali prawidłowe przesłanki dopuszczalności przetwarzania danych osobowych, czy zrealizowali w sposób zgodny z prawem prawa osób, których dane dotyczą. Wszystko to sprawia, że postępowanie w przedmiocie skargi od decyzji Prezesa UODO prowadzone według procedur obowiązujących w postępowaniu przed sądami administracyjnymi wydaje się nader trudne i wręcz niespełniające uzasadnionych oczekiwań. W postępowaniu przed sądami administracyjnymi bardzo ograniczona jest bowiem możliwość przeprowadzenia dowodów. W tekście analizujemy poszczególne aspekty postępowania po wydaniu decyzji przez Prezesa Urzędu Ochrony Danych Osobowych, wskazując na jego charakterystyczne cechy, oceniając przyjęte rozwiązania i postulując zmiany.
The procedure following the issuing of an administrative decision by the President of the Personal Data Protection Office is final and, consequently, it is impossible to appeal against it to a higher instance authority. As a consequence, an appeal against the decision of the President of the Personal Data Protection Office. All this makes the proceedings concerning the complaint against the decision of the President of the Personal Data Protection Office, conducted in accordance with the procedures in force in the proceedings before administrative courts, seem very difficult and even failing to meet the legitimate expectations. In the proceedings before administrative courts, the possibility of taking evidence is very limited. In the text, we analyze individual aspects of the procedure after the decision is issued by the President of the Personal Data Protection Office, pointing to its characteristic features, assessing the solutions adopted and proposing changes.

The paper indicates the most important arguments raised by the participants in the dispute concerning the possibility of control by the administrative courts of decisions of the President of the Republic of Poland on the refusal to appoint a judge and an attempt to make a substantive evaluation of them. In my opinion, the refusal to appoint a judge, as well as refusal to accept the judge’s position under the amended Act on the Supreme Court (SC) should be strictly exceptional and in principle be justified at the constitutional level, which should be seen as the duty of the President to ensure compliance with the Constitution. Both of these resolutions should contain the motives of the President, which would make this act, with all its arbitrariness, more transparent. This is important not only from the point of view of the person concerned, but this also has an important social dimension. The public has the right to know, not only which candidates, who met the requirements for the appointment as a judge and were recommended by the National Council of the Judiciary of Poland (NCJ), were not appointed by the President, but also what reasons were at the heart of such a decision of the Head of State.

Celem referatu było ustalenie aktualnego charakteru postępowania dowodowego prowadzonego przez sąd administracyjny na podstawie art. 106 § 3 p.p.s.a. Dokonując wykładni tego przepisu należy mieć na uwadze swoiste rozszerzenie się pojęcia „kontrola”, którą posługuje się Konstytucja RP w art. 184. Spostrzeżenie to nawiązuje do wyposażenia sądów administracyjnych w kompetencje do orzekania o istocie sprawy administracyjnej, w ramach kontroli decyzji oraz postanowień administracyjnych, co nastąpiło w 2015 r. Zaznaczyć należy jednak, że jednocześnie nie dokonano jakiejkolwiek zmiany art. 106 § 3 p.p.s.a. W literaturze zdecydowana większość autorów nie łączy wyposażenia sądów administracyjnych w kompetencje do orzekania o istocie sprawy administracyjnej z jakąkolwiek modyfikacją wykładni art. 106 § 3 p.p.s.a. W artykule podjęto natomiast próbę wykazania, że kontrola, zawierająca również możliwość orzekania o istocie sprawy administracyjnej, zmodyfikowała charakter postępowania dowodowego prowadzonego przez sądy administracyjne na podstawie art. 106 § 3 p.p.s.a. Materiał badawczy wykorzystany w realizacji założonego celu stanowiły m.in. najnowsze pozycje literatury dotyczącej analizowanej problematyki (od 2016 r.) oraz najnowsze orzecznictwo sądów administracyjnych w tym zakresie. Zadbano o to, ażeby rozważania na temat wykładni art. 106 § 3 p.p.s.a. dokonywać w oparciu o stanowiska autorów zaprezentowane po 2015 r., w którym dokonano zmian legislacyjnych związanych z wyposażeniem sądów administracyjnych w kompetencje do orzekania o istocie sprawy administracyjnej.
The aim of the paper was to determine the current nature of the evidentiary proceedings conducted by the administrative court on the basis of Article 106 § 3 p.p.s.a. When interpreting this provision, we should bear in mind the peculiar expansion of the notion of "control", which is used by the Constitution of the Republic of Poland in Article 184. This observation refers to equipping the administrative courts with the competence to rule on the essence of an administrative case, as a part of the control of administrative decisions and orders, which took place in 2015. It should be noted, however, that at the same time there was no modification of Article 106 § 3 p.p.s.a.. In the literature, the vast majority of Authors do not connect equipping the administrative courts with the competence to rule on the essence of an administrative case with any modification of the interpretation of Article 106 § 3 p.p.s.a. Instead, the paper attempts to show that the control, which also includes the possibility to rule on the essence of the administrative case, has modified the nature of the evidence proceedings conducted by administrative courts on the basis of Article 106 § 3 p.p.s.a. The research material used in the implementation of the set objective was constituted, inter alia, by the latest literature on the analysed issue (as of 2016) and the latest case law of administrative courts in this respect. The considerations on the interpretation of Article 106 § 3 p.p.s.a. were attentively drawn on the basis of the authors' positions presented after 2015, in which the authors introduced the legislative changes related to equipping administrative courts with the competence to rule on the merits of an administrative case.

The commented judgement of the Regional Administrative Court in Warsaw of 2nd June 2015 (SA/Wa 1920/14) has had a significant impact on the change of the interpretation of the regulation on decisions issued by the President of the Supreme Audit Office. Namely it accelerated the court and administrative control of adjudicating related to a negative evaluation of a nominated auditor. Simultaneously, the Court decided – unjustly, according to the authors of the article – that a negative evaluation by the supervisor of a nominated auditor is an administrative decision of first instance. While a decision of the President of NIK, made on the basis of Article 76a (3) of the Act on NIK – is considered the final administrative decision. In their article, the authors present in detail the legal status and they analyse the stance of the Regional Administrative Court, justifying their reasoning in the area.

The article presents an analysis of legal regulations concerning supervisory insti-tutions as a key element in how local government functions. The effectiveness of supervision institutions is analyzed on the basis of legal regulations concerning bodies supervising the activities of local government. Exercising legal supervision contributes to restoring the state of affairs consistent with law, if it has been violat-ed, thus presenting statutory supervisory measures at the disposal of supervisory authorities. Ongoing supervision of voivodes and regional accounting chambers, as a matter of principle, is related to examining the legality of the legislative activity of the decision-making bodies of local government units, therefore the article discusses the process of supervisory proceedings related to the issuance of a supervisory deci-sion by the supervisory authority. In order to exercise supervision more effectively, in addition to appropriate legislative changes and the elimination of existing legal loopholes, in the author’s opinion, it is necessary to define the principles of coop-eration between supervisory authorities and other entities, including developing and agreeing on procedures for the mutual exchange of information. In addition, the actions taken by prosecutors, who, using their statutory powers, file numerous complaints to administrative courts against resolutions of local government units are also indicated. However, there is a complete lack of knowledge on the part of the supervisory authorities in this regard. The text recapitulates the results of the audit carried out by the Supreme Audit Office which concerned the supervision of voivodes over law-making by local government units in 2017–2019. The analysis of the subject of legal regulations relating to the exercise of supervision provides the basis for the author to formulate de lege ferenda postulates and to present the proposed directions of changes.

The commentary concerns the ruling of the Supreme Administrative Court on the Act of 28 June 2012 on the Repayment of Certain Dues to Enterprises Resulting from Implementing Awarded Public Contracts. The authors tend to conclude that the main thesis of the commented ruling of the Supreme Administrative Court, i.e. excluding the applicability of the Code of Administrative Procedure to actions taken by the Director General for National Roads and Motorways in connection with claims for payment due to subcontractors on the basis of the above mentioned Act raises important concerns about its correctness. It is debatable from the point of view of both the general structure of administrative law, and the purposes of the above mentioned Act which was to create a special procedure for repayment of dues to subcontractors. In the light of the circumstances of the adoption of the bill and its provisions, it is difficult to accept the view the adoption of which not only deprives subcontractors efficient and low-cost administrative mode to review the decision of the General Directorate for National Roads and Motorways (GDDKiA), but compels them to initiate additional civil proceedings before common courts, the subject of which will, in fact, be the examination of the correctness of operation of GDDKiA as a public authority.

Under the provisions of Act I of 2017 on the Code of Administrative Court Procedure, a brand new institution has been introduced in Hungary: as of 1 January 2018, in administrative court proceedings, the judge may, with the agreement of the parties, allow for a court mediation procedure in the cases in which the law does not preclude it. The primary method to approach the topic is the review of the relevant primary legal sources [actual law in the form of the constitution (Fundamental Law of Hungary), acts, governmental decrees, orders of the President of the National Office, court cases, etc.] and secondary legal sources (Hungarian and international scientific literature explaining the primary sources, the legal practice and also the specific circumstances determining the broader social environment) through which we may define relevant scientific problems, create our own definitions and prepare a catalogue of practical problems, specifically for Hungarian issues regarding the topic. Moreover, this article tries to build on the results of the interviews with judges, representatives of different defendants (administrative authorities) and others. Qualitative interviewing, including the interviewing of judges and other participants of such proceedings, is a relatively new method in the field of legal studies, at least in Hungary.

The article contains a historical and legal outline, taking into account the evolution of the jurisprudence of the Constitutional Tribunal and the Supreme Administrative Court. The admissibility of initiating the judicial-administrative procedure against the decisions of the Regulatory Commission of the Polish Autocephalous Orthodox Church is closely related to the judgments of these bodies. The author concluded that, in accordance with the provisions of the Act on the State’s Relationship to the Polish Autocephalous Orthodox Church, the ruling of the Regulatory Committee should be recognized as an administrative decision issued in a single-instance procedure. Such a decision is a final one, against which a party has the right to lodge a complaint to a voivodeship (i.e. provincial) administrative court.

Ukraine’s status as a candidate country for the European Union membership reinforces the need for comparative analysis between Ukrainian regulations and the laws of other EU Member States, as well as European regulations. One of the fields of comparative law is the development of mediation as a legal institution, also in cases when the state is involved – for disputes covered by administrative law. This has already been a subject of interest and promotion of both the EU and the Council of Europe, as European standards of democracy provide for the state’s cooperation with citizens/individuals. The aim of this article is – firstly – to compare the current development of mediation in administrative and court-administrative cases in Poland and in Ukraine, the similarities in successes and challenges, and – secondly – to determine to what extent both countries follow the latest CEPEJ guidelines. Although the state of research and literature on this subject is advanced in Poland and slightly less satisfactory in Ukraine, a comparative overview of this type of mediation regulations can be considered a novum. As for methodology, the paper is dominated by the logical-linguistic method, although some conclusions were drawn on the basis of both statistics and participant observation, i.e. the authors’ own mediation practice. So far – although both legal systems are quite compatible with the CEPEJ guidelines examined and provide for inter-branch solutions – in both countries in question, the development of administrative and court-administrative mediation is not a “success story.” A contrario: it can be classified as developing in the least resilient manner. To some extent, Poland and Ukraine show similarities and correlations in terms of successes and challenges, as well as social and mental barriers to mediation development.

The principle of prohibition of reformatio in peius is established in Article 134 § 2 of the Law on Proceedings Before Administrative Courts. According to this provision the administrative court is not allowed to issue a decision to the detriment of the complainant. A judgment adverse to the complainant can be exceptionally issued but only if the court fi nds a violation of the law resulting in the annulment of the challenged act or action. This principle is a procedural institution which ensures that the complainant’s situation will not deteriorate due to the decision of the administrative court. There are many interpretative doubts concerning the prohibition of reformatio in peius in the doctrine and the jurisdiction of the administrative courts. This is because administrative courts very rarely issue a decision on the merits. Decisions of administrative courts are basically of cassation nature. When the administrative court allows a complaint, the contested act is generally eliminated from the system of law and the case is returned for re-examination by the public administrative authority. It is therefore very diffi cult to determine the content of the prohibition of reformatio in peius in administrative court proceedings and in practice the prohibition of a change for the worse is not a real guarantee of the protection of the interests of the complainant. In the author’s opinion, the way of approaching the mechanism of application of the prohibition of reformatio in peius by the administrative courts needs to be changed. And yet, a signifi cant improvement in the eff ectiveness of the protection against the worsening of the complainant’s legal situation will only be possible through the introduction of a new legal regulation restricting the jurisdiction of public administrative authority, which will reconsider the case after the cassation judgment issued by the administrative court.

This article deals with the changes that were made and with possible expectations in the field of administrative justice which can be observed on the example of (not only) the Czech Republic. To this end, the contribution focuses, first, on the purpose of the administrative justice as such and on its history and development. Then it gives consideration to the current stat and form of the legal framework of the administrative justice in the Czech Republic. On this basis, the last part of the contribution deals with the changes which have been made in the administrative justice as well as with possible expectations that may be placed on the administrative justice, going hand in hand with its possible changes in the future.
