The sole purpose of air accident investigations should be the prevention of accidents and other incidents in the future, without apportioning blame or liability. A civil aviation safety system is based on feedback and lessons learned from accidents and incidents, while requiring the strict application of rules on confidentiality in order to ensure the availability of valuable sources of information in the future. Therefore, related data, especially sensitive safety information, should be protected in an appropriate manner. Information provided by an individual in the framework of a safety investigation should not be used against them, in full respect of constitutional principles, and national and international law. Each “involved person” who knows about an accident or serious incident should promptly notify the competent state authority for carrying out an investigation of the event. “Involved person” refers to one of the following: the owner; a member of the crew; the operator of the aircraft involved in an accident or serious incident; any person involved in the maintenance, design, manufacture of that aircraft or in the training of its crew; any person involved in air traffic control, providing flight information or providing airport services, which provided services for the aircraft concerned; staff of the national civil aviation authority; or staff of the European Aviation Safety Agency. In terms of the protection level of the organization (employer), employees who report an event or submit an application to the investigation cannot bear any prejudice from their employer because of information provided by the applicant. The protection does not cover (exclusions): infringement with wilful misconduct (direct intent, recklessness infringement); infringement committed by a clear and serious disregard of the obvious risks; and serious professional negligence, i.e., the failure to provide unquestionably duty of care required under the circumstances, causing possible or actual damage to persons or property leading the level of aviation safety being seriously compromised. All employees in the aviation sector, regardless of their function, have safety-related duties and are therefore critical to the security of the entire civil aviation system. The safety of this system requires that any event that has or may have an impact on security in aviation should be reported voluntarily and without delay, because it is necessary to conduct an appropriate investigation in order to increase the level of safety. “Just Culture” is the basic premise for the effective functioning of the reporting of events required for all aviation organizations in order to maintain and raise the safety level. As safety management is based on precise data, it is necessary to introduce appropriate procedures, which allow for obtaining information not only about the events that have already occurred, but also about any other events that could potentially cause hazardous conditions. All the procedures and rules of operation relating to the policy of Just Culture should be constructed so that they not only comply with the provisions of applicable law, but are also rational and understandable by all stakeholders, as well as provide certain comfort and confidentiality to persons reporting events that affect airline safety. Changes in the existing legal system should be established in cooperation with all concerned institutions: law enforcement, including the courts and public prosecution, aviation insurers, the Aircraft Accident Investigation Commission and other entities. Is it possible to reconcile the interests of the so-called culture of aviation safety, i.e., Just Culture, with the requirements of the above-mentioned institutions and traders involved in the implementation of air transport and the exploration of the effects of aerial surveys? The answers to this and similar questions will be widely presented in this article.

4M Overturned Pyramid (MOP) model is a new model, proposed by authors, to characterized MTS which is adopting epidemiological model that determines causes of accidents, including not only active failures but also latent failures and barriers. This model is still being developed. One of utilization of MOP model is characterizing accidents in MTS, i.e. collision in Indonesia and Japan that is written in this paper. The aim of this paper is to show the characteristics of ship collision accidents that occur both in Indonesian and Japanese maritime traffic systems. There were 22 collision cases in 2008–2012 (8 cases in Indonesia and 14 cases in Japan). The characteristics presented in this paper show failure events at every stage of the three accident development stages (the beginning of an accident, the accident itself, and the evacuation process).

Road transportation is playing an important role in almost all freight movements and contributes to the economy. It has the highest share in the modal division of transported goods. This situation is not about to change in the coming years. Therefore, it is necessary to change the current situation and modify rules and regulations, which could lead to a decrease in the number of accidents in either the EU or the USA. This paper identifies and compares different safety measures, rules and regulations governing the safety of truck transport in the EU and the USA. The number of accidents is a good safety indicator. Finally, suggestions for improvements in terms of truck drivers’ safety in the EU and the USA are proposed.

The purpose of this paper is to analyze cognitive distraction data to determine its impact of transit bus drivers' capability. Much of the theory and results applied in this paper are from the work of researchers working on similar projects. In order to understand cognitive distraction and how it can be mitigated, a Cognitive Distraction Model is outlined. The model was analyzed to evaluate the correlation between driver capability, and demographics and driving patterns. A model that provides an understanding about cognitive workload and driver capability could provide better psychological solutions to mitigate the number of accidents due to cognitive distraction and develop relevant driver training programs. Through additional research from the neurological and behavioral sciences, regulators could develop a better understanding of the causal factors and ways to control cognitive distraction.

This paper focuses on the issue of big data analytics for traffic accident prediction based on SparkMllib cores; however, Spark’s Machine Learning Pipelines provide a helpful and suitable API that helps to create and tune classification and prediction models to decision-making concerning traffic accidents. Data scientists have recently focused on classification and prediction techniques for traffic accidents; data analytics techniques for feature extraction have also continued to evolve. Analysis of a huge volume of received data requires considerable processing time. Practically, the implementation of such processes in real-time systems requires a high computation speed. Processing speed plays an important role in traffic accident recognition in real-time systems. It requires the use of modern technologies and fast algorithms that increase the acceleration in extracting the feature parameters from traffic accidents. Problems with overclocking during the digital processing of traffic accidents have yet to be completely resolved. Our proposed model is based on advanced processing by the Spark MlLib core. We call on the real-time data streaming API on spark to continuously gather real-time data from multiple external data sources in the form of data streams. Secondly, the data streams are treated as unbound tables. After this, we call the random forest algorithm continuously to extract the feature parameters from a traffic accident. The use of this proposed method makes it possible to increase the speed factor on processors. Experiment results showed that the proposed method successfully extracts the accident features and achieves a seamless classification performance compared to other conventional traffic accident recognition algorithms. Finally, we share all detected accidents with details onto online applications with other users.

This publication deals with the issue of joining traffic from a suburban road. This is just a seemingly simple maneuver in traffic, which should be made dynamically, but with particular caution. Engaging in traffic is a situation that initiates the driver's participation in road traffic and for this reason certain responsibilities are involved in the traffic involved. Nevertheless, directing a moving road with priority should remember that other drivers will not always give way to them in every situation.
Niniejsza publikacja dotyczy problematyki włączania się do ruchu z drogi podporządkowanej. Jest to tylko z pozoru nieskomplikowany manewr w ruchu drogowym, który powinien zostać wykonany dynamicznie, ale przy zachowaniu szczególnej ostrożności. Włączanie się do ruchu to sytuacja, która inicjuje udział kierującego w ruchu drogowym i z tego względu na włączają-cym się do ruchu ciążą określone obowiązki. Niemniej jednak kierujący poruszający się drogą z pierwszeństwem powinni pamiętać o tym, że inni kierujący nie zawsze i w każdej sytuacji im go ustąpią.

This paper aims to help enhance the process of risk identification and assessment in small enterprises by facilitating the incorporation of insights from accident, human error and risk perception models. This effort takes place through grouping and classification models of all these aspects according to certain criteria, to fit the proper set of models to each situation. To further facilitate the process, the main guidelines of each model are presented. The whole approach is not a new theoretical model but a simplified presentation to help safety engineers in selecting the proper model for the workplace to better assess its risks. An example of the application of this approach is also presented.

Recent crashes of ferries with large numbers of human victims have occurred because of navigator errors or because of their inability to make adequate decisions in an unexpectedly arisen emergency. Purpose: The objective of the study is to examine whether a wood processing company size affects the differentiation of workplace safety hazards as well as to investigate the influence of features characterizing an occupational accident casualty on their injury severity, considering the company size. Methodology: The study used non-aggregated data obtained from the Central Statistical Office, Poland. The data for analyzes were prepared through quality diagnosis, cleaning and transformation. Variables of no informative value were excluded from further investigation. Statistical tests were performed implicating the need for independent analyzes for two data subsets referring to: micro and small enterprises (employing up to 49 persons), and medium and large enterprises (employing 50 persons or more). For each of the two company groups, a logistic model was developed classifying the occupational accident casualty injury severity based on the casualty characteristics. In each case, the classification quality was assessed using a test data set. Findings: It was shown that the enterprise size had an impact on the severity of accidents at work and that the proposed method of classifying enterprises by size into two categories was justified. Explanatory variables in logistic models were interpreted according to their importance and intensity of influence on the explained variable. Practical implications: The obtained results can be used in the development of materials on occupational safety risks for entrepreneurs and OSH services. Social implications: Each type of economic activity carries various risks. Occupational accidents pose a serious social and economic problem. Research in the field of occupational safety allows a better understanding of the nature of such accidents and makes it possible to take effective preventive actions which, however, can depend on a company size. Originality/value: On the basis of the obtained results, it is possible to identify the factors influencing the severity of occupational accidents in wood processing companies according to their size. The research also showed that bivariate multiple logistic regression is an appropriate tool for analyzing occupational accident data.

This paper aims at reviewing the core Polish regulations on land use planning (LUP) around hazardous plants and presenting a researcher’s view on the proposal of a ministerial ordinance on safety distance determination from the plants creating a major accident hazard (Seveso establishments). Currently there are no legal regulations concerning the method of safety distance determination from Seveso establishments in Poland. The method of generic distances recommended in the Polish guidelines from 2007 is not mandatory. The author stands by her opinion expressed for the first time in 2015 that Polish legal regulations on safety distance determination from Seveso establishments formulated as a ministerial ordinance are indisputably needed. If the ordinance is issued, it will contribute to a more complete implementation of the Directive 2012/18/EU and will allow nationwide unification of the method of safety distance determination. The consequence based approach seems a reasonable option in Polish conditions. This researcher suggests an extension of the draft of the ordinance by introducing a reference tool for the mathematical modelling of accident consequences. It is also worth considering the introduction of legal norms for the description of areas designed in the spatial planning documents for the location of Seveso establishments.
W artykule przedstawiono przegląd podstawowych regulacji dotyczących za gospodarowania przestrzennego terenów wokół niebezpiecznych zakładów przemysłowych i opinie autorki o projekcie nowego rozporządzenia Ministra Środowiska w sprawie określania odległości bezpiecznej od zakładów stwarzających zagrożenie wystąpienia poważnej awarii przemysłowej (zakładów typu Seveso). W Polsce brak jest obecnie przepisów prawnych dotyczących metody oceny zagrożenia poważną awarią wokół zakładów typu Seveso. Metoda typowych odległości bezpiecznych, rekomendowana w opracowaniu z 2007 roku zatytułowanym Metodologia wyznaczania bezpiecznych lokalizacji zakładów mogących powodować poważne awarie, nie jest obowiązkowa do stosowania. Autorka podtrzymuje swoje zdanie wyrażone po raz pierwszy w 2015 roku, że polskie regulacje prawne dotyczące sposobu wyznaczania odległości bezpiecznej od zakładów stwarzających zagrożenie wystąpienia poważnej awarii w postaci ministerialnego rozporządzenia bezsprzecznie są potrzebne. Jeśli rozporządzenie zostanie wydane, przyczyni się do pełniejszego wdrożenia dyrektywy 2012/18/UE i ujednolicenia metody określania bezpiecznej odległości w całym kraju. Podejście, w którym wyznaczane są skutki potencjalnych poważnych awarii, wydaje się racjonalną opcją w polskich warunkach. Autorka sugeruje rozszerzenie projektu rozporządzenia Ministra Środowiska i określenie w nim referencyjnych narzędzi matematycznego modelowania skutków poważnych awarii. Warto jest również rozważyć wprowadzenie w postaci regulacji prawnych rozszerzonego opisu obszarów przeznaczonych pod lokalizację zakładów typu Seveso do wykorzystania w dokumentach planistycznych.

Safety, along with the issue of security, is the most substantial and critical issue to any society and nation of the mankind. The fact that human elements contribute dominantly, in particular, to the transportation – marine, air and road traffic – accidents requires not only the technical approaches, but also cultural configuration inherent to the accidents. This paper tries to incorporate Hofstede’s dimensions of national culture to identify possible interaction with accidents. It will be of help to figure out the need to consider the aspect of national culture to be efficient in dealing with policies for safer communities and nations.

This paper presents a flight safety analysis over the past a dozen or so years. The analysis was mostly conducted on the basis of statistical data recorded by units responsible for flight safety in the Armed Forces of the Republic of Poland. The first part of the paper presents a brief historic outline and basic flight safety-related definitions. It also describes basic elements of flight safety formulated by the International Civil Aviation Organisation, ICAO. It presents theories providing reasons for the occurrence of aviation incidents and1 the role of a human factor in flight safety and at the same time makes known so called James Reason's Model that explains why aviation accidents occur. In addition, it includes a few examples of the occurrence of serious accidents caused by the human factor. It also emphasises the importance of the system of aviation-related events reporting and investigation and the planning of preventive actions to be taken. The paper also stresses the need to change the way of thinking about aviation accident prevention, where the most important questions are not what or who, but why and how. The second part of the paper presents flight safety analysis in the Armed Forces for the previous year.

A retrospective study on accident analysis of the United States mines for 36 years was achieved using statistical analysis on the MSHA's accident databases between 1983 and 2018. A regression model of generalized estimation equation (GEE) was used for unbalanced panel data that provided 95,812 observations for 19,924 mine-ID-year in aggregate, coal, metal, and non-metal mines. The contributions of various parameters, including mine type, injured body part, days lost, age, and experience on the rate of accidents and injuries were investigated across the commodity types. The results showed coal miners in the East region are at a higher risk of accident. The results of regression analysis show that mine-tenured workers have a vital role in accident frequencies. Analysis of the injured body part on the injury rate indicates that the upper body injuries are the most significant among all mine types. Also, the fatality rate is significant in aggregate, and coal mines in comparison with metal and non-metal mines.

Identification of trends of the examined phenomenon plays a major role in taking decisions and allows conducting a deeper analysis of phenomena connected with the shaping of proper working conditions. One of the result indicators in the OSH system is the accident rate, whose existence is the result of a combination of various events. Seeking tangible economic benefits, decision makers in business entities who wish to improve activities protecting health and life of employees, pay great attention to using quantitative methods and drawing conclusions from them. This is conditioned by the fact that the analysis of the economic aspects of accidents is connected to a large extent with the cost of benefits the employer incurs for the benefit of accident victims. Therefore, the main goal of the article is to examine what impact on the cost of benefits due to accidents at work is exerted by such factors as: the number of related benefits, persons injured in accidents at work depending on the consequences and the number of days of inability to work caused by these accidents. Furthermore, this paper shows changes in costs of accident benefits of persons receiving those benefits due to inability to work caused by accident in business. In order to achieve this, it is proposed to present an econometric analysis based on the cross-section-time data with the dynamics of considered variables in voivodeships in Poland being examined. The study uses the annual data for the years 2010-2017. The data come from the CSO publications.

Problematyka przedstawiona w niniejszym opracowaniu ma charakter historyczny i stanowi wstęp do kolejnych opracowań szczegółowych. Jej celem jest przedstawienie zarysu kształtowania się systemu naprawienia szkody na osobie doznanej przede wszystkim w związku z wykonywaniem pracy lub uszkodzeniem ciała będącego następstwem zdarzenia drogowego w Nowej Zelandii. Nie są to oczywiście jedyne sytuacje uzasadniające wystąpienie przez poszkodowanego z roszczeniem o wypłatę świadczeń, ale z całą pewnością stanowiące kategorię centralną. W opracowaniu wskazano na kontekst historyczny, ponieważ nie pozostaje on bez znaczenie na kształt regulacji obecnej. Zasadniczo należy stwierdzić, że przyjęte w 1972 roku rozwiązania, chociaż na zmieniane na przestrzeni lat, zachowały swoją podstawę na której system (Accident Compensation System) opiera się do dnia dzisiejszego.
The issues presented in this study are of historical nature and constitute an introduction to the subsequent detailed research. Its purpose is to present an outline of the development of a compensation system for a person suffered primarily in connection with the performance of work or personal injury resulting from a road accident in New Zealand. These are, of course, not the only situations justifying a claimant’s claim for payment of benefits, but they are certainly a central category. The study indicates the historical context because it is not without significance for the shape of current regulations. Basically, it should be noted that the framework adopted in 1972, although changed over the years, has underlain the contemporary Accident Compensation System.
