The authors discuss the Parliament’s tasks in relation to the accession process, which can be divided into several basic areas. The first is the creation of the constitutional framework to provide a national legal basis for the membership in the European Union. The Sejm also decided on the method of ratification of the Accession Treaty in the form of a referendum, having previously adopted the necessary provisions for its execution. The power of parliamentary scrutiny over the accession process was actively exercised. The Sejm conducted political supervision of the accession negotiation process, analysed the state budget and its implementation with a special focus on expenditures on integration aims, and monitored the use of pre-accession funds. Another area of the Sejm’s activity was the preparation of the legal framework for functioning after accession to the EU. The Sejm also participated in the process of European integration through its activities in the field of parliamentary diplomacy.

The purpose of this paper is to examine and analyse the appropriate modalities for the process of the Europeanisation of the countries from the Balkans, interalia, for the need to avoid the Balkanisation of Europe, bearing in mind all the aspects. The effects of these processes can be disseminated into two directions, EU-Balkans and vice versa, so the main point is to explore the common spots and to use them in the EU’s accession path of the Balkan countries. Due to the character of the paper, the most frequently used methods will be the descriptive method, the content analysis method and the comparative method.

In this article, the meaning and nature of ratification is discussed. It is shown that in early practice and doctrine, ratification was a confirmation that what had been signed had been duly and properly signed – an acknowledgment by a principal of the act of his agent. No doubt, this theory was not a strict acceptance of the doctrine of private law agency, even at a time when private law analogies were more freely accepted than they are today. For ratification of an act of an agent concluded within the limits of his authority is not strictly necessary in private law. But the difference is purely formal. In both cases – treaties and contracts made by agents – the signed document created obligations. In international law the document was not perfectly binding until a ratification was issued. It is, at any rate, clear that the private law analogy was valid in the seventeenth, and the greater part of the eighteenth, centuries to this extent: the duty to ratify – i.e. to acknowledge publicly the binding force of a signed treaty – was held not to apply when the agent had exceeded his instructions. This was the only generally recognized ground for refusing a ratification. The French and American Revolutions changed all this. They attempted to banish from public law the notion of absolute power. Indeed, for a short interval, as has been shown, the treaty– making power was vested in a national assembly – in France, the National Convention, in the United States, in Congress. But this was found impracticable, and in the United States the Senate reserved only the power to sanction and participate in the final act of ratification. When this deliberative element was introduced into the process of ratification, it became apparent that ratification could no longer be regarded as obligatory. An account of ratification in theory and in practice is incomplete without a study of the formal clauses in treaties with regard to the date of their coming into force. It is clear that, in many cases, ratification is dispensed with, either for reasons of expedition, or because ratification does not require any deliberation according to the constitutional practice of the States concerned. On the other hand, the development of the multipartite treaty caused signature or accession to supplant ratification, in the increasingly common case of States becoming parties to a treaty to which they are not original signatories. The very large number of constitutional texts prescribing a specific procedure for the conclusion of treaties, the changed character of ratification, and the existence in formal documents, and in treaties themselves, of clear stipulations as to satisfaction of constitutional requirements, it is impossible to ignore the relevance of such provisions in international law.

Albania is a member of WTO from September 2000 and is currently in a deep and substantial transformation of the trade policy. Albanian trade regime is very liberal, open and transparent fully compliant with WTO law. Accession to EU is the strategic goal of all Governments after ’90s and alignment with EU acquis is at the core of any process. EU integration is an engine for the development in all candidate or potential candidate countries. This process requires the alignment of national policies and harmonization of the legislation. Trade policy is among the most developed policies in European Union and Albania. This is mainly due to the membership in World Trade Organization (WTO) and Free Trade Agreements (FTA) with the most important trading partners. The accession of Albania to EU will significantly affect the Albanian trade policy. This paper analyses the state of play of Albanian trade policy and presents the main developments in the EU Common Commercial Policy after the Lisbon Treaty (2009). Based on this analysis the paper highlights the implications for Albanian trade policy.

The essence of the analyzed problem is expressed in the need to decide which procedure for ratification as provided in the Constitution, applies to this Treaty because of its legal nature and the underlying content, especially in connection with the concept of transfer of powers to the European Union. In accordance with the provisions of the Constitution, an appropriate procedure for ratification by the Republic of Poland of the Treaty of Accession of the Republic of Croatia is its ratification by the President of the Republic with prior consent granted by statute (under the Article 89 paragraph 1 of the Constitution).

This article examines how the United Kingdom (UK) trade unions organise Polish migrant workers in the aftermath of post EU enlargement migration, and what forms of inclusion strategies they implement. The benefits and limitations of various inclusionary approaches are scrutinised through the analysis of semi-structured interviews conducted with officers of three different large trade unions. These unions have at times, applied similar and at other times very different strategies, which depend on the unions' structures and decision-making. These approaches vary from equal treatment and the 'level playing field' approach to special treatment. While the first combined approach has resulted in some positive experiences in locating and recruiting Polish members, further inclusion through activism, however, calls for a special treatment approach.
