The 20th century was an age of extremes. In this article I concentrate on two disasters, the Holocaust and Hiroshima, in order to develop a philosophical reading of moral extremes under circumstances of war. My aim is to differentiate between these two events by exposing a normative framework. The significance of the Holocaust points to the phaenomenon of a rupture of species, which stands for a moral transgression never thought of. In analytical terms, this confronts us with the clashing of two normative orders: Firstly, the universal moral respect of every human being; secondly, the radical particularism of Nazism. To denounce the moral otherness of the latter is to highlight the war aims of Nazism: imperial aggression to dominate Europe, and annihilation of the Jews as a world-historical mission. In view of both aims, war against Nazism was just. The moral disaster of Hiroshima, however, stands in marked contrast to this characterization. The political leaders of the US did not intend to annihilate the Japanese people; they thought they would end war by making use of a nuclear weapon. It is, therefore, a misleading metaphor to speak of a “nuclear holocaust”, or to allude to a genocidal action in this case. This does not mean at all that dropping the bomb was justified. Quite contrary to the US official stance, it is important to consider this event in moral terms by relying on precise historical circumstances and well-founded critical analysis. There is strong evidence that it was a moral failure to opt for the bomb. This comes close to the diagnosis of a war crime within a just war framework. Nevertheless, this diagnosis must be kept distinct from the type of crime involved in the Holocaust.

Согласно Рамочному решению Совета Европейского союза «О борьбе с определенными формами и проявлениями расизма и ксенофобии посредством уголовного законодательства» каждому государству – члену Европейского союза необходимо было принять меры для обеспечения наказания за публичную восхваление, публичное отрицание или публичную грубую банализацию геноцида, преступлений против человечества и военных преступлений. Выполняя данные требования, в статью 74.1 Уголовного закона Латвийской Республики были внесены соответствующие изменения. Цель данной статьи – инициировать обсуждение возможных проблем, связанных с применением статьи 74.1 «Отрицание геноцида, преступлений против человечества, преступлений против мира и военных преступлений» Уголовного закона. Автор предлагает свое видение проблематики применения нормативного регулирования по данному вопросу.
According to the Section 1 of the Council of European Union Framework Decision 2008/913/JHA on combating certain forms and expressions of racism and xenophobia by means of criminal law, each Member State shall take the measures necessary to ensure that the following intentional conduct is punishable: publicly condoning, denying or grossly trivialising crimes of genocide, crimes against humanity and war crimes. Section 74.1 ―Acquittal of Genocide, Crime against Humanity‖ of the Criminal Law provides for liability in the public glorification of genocide, crime against humanity, crime against peace or war crime or glorification, denial, acquittal or gross trivialisation of committed genocide, crime against humanity, crime against peace or war crime, including genocide, crime against humanity, crime against peace or war crime committed by the U.S.S.R. or Nazi Germany against the Republic of Latvia and its inhabitants. The article aims to initiate a debate on potential problems related to the application of the Section 74.1 ―Acquittal of Genocide, Crime against Humanity‖ of the Criminal Law. The author offers his vision of the regulatory framework application problems.

In March 2012 the ICC delivered its first and long-awaited judgment in Prosecutor v Lubanga. Trial Chamber I found Thomas Lubanga guilty as co-perpetrator of the war crimes of conscripting and enlisting children into the armed forces. The guilty verdict was followed by a reparations decision on 7 August 2012. This article examines the extent to which the ICC has successfully fulfilled its mandate to formulate reparations principles. The position of reparations within international law generally is discussed. This is followed by an explanation of how the ICC reparation regime functions. The bifurcated reparations mandate of the ICC is also explained. The focus of the article is on a critical assessment of the Lubanga reparations decision. The Court’s treatment of the harm requirement and the requirement of causation is examined. It is argued that the Court’s failure to clarify the requirements of “harm” and “causation” meant that it did not fulfil its mandate to formulate reparations principles.

Sieci społeczne online mają istotne znaczenie w funkcjonowaniu współczesnego społeczeństwa. Zastosowanie zaawansowanych metod analitycznych w ich badaniu może być wykorzystane do wsparcia zarządzania bezpieczeństwem narodowym w co najmniej dwóch aspektach. Po pierwsze umożliwia identyfikację wojny informacyjnej prowadzonej z wykorzystaniem mediów społecznościowych. Po drugie zaś udostępnia metody rozpoznania struktury i sposobów działania zorganizowanych grup przestępczych, takich jak na przykład organizacje terrorystyczne. Te dwa obszary zastosowań zostały omówione w odniesieniu do aktualnego stanu badań naukowych, ograniczeń w ich prowadzeniu oraz potencjalnego zastosowania tych badań w zakresie bezpieczeństwa narodowego.
Online social networks are essential dimension of modern society. Applying advanced analytical methods in social networks can be used to support of national security in at least two aspects. Firstly it allows identification information war, which is conducted with the use of social media. Secondly it provides methods for the recognition of the structure and methods of operation in organized criminal groups, such as terrorist organizations. These two areas of application are discussed in relation to the current state of art in scientific research, limitations, and potential applications in the national security.

The cultural context, where two neighboring Slavic nations are in a state of war and the Russian imperialistic approach has never gone away for good, must be taken seriously into consideration. The international legal analysis of the Russo-Ukrainian war is not enough to truly understand the essence – rationale – of this armed conflict and then to find a solution to how to solve it and punish the perpetrator – the Russian Federation. The arguments gathered here by the author come from her own experience during trips to Russia and Ukraine, as well as military courses facilitation where students are taught that in modern warfighting it becomes more and more valid to change the (Western) lens and begin thinking as the perpetrator does. Only then we are objectively able to see and understand if the atrocities committed by Russian troops in Ukraine bear the hallmarks of a war crime or an act of genocide.

The paper addresses the role which national attitudes play in terrorist threat perception and in the choice of specific counterterrorism strategies. Study 1 shows that participants higher on nationalism tend to perceive the threat of terrorism as more serious than participants lower on nationalism. Moreover, we found that nationalism mediated the relationship between the perceived terrorist threat and the support for tough domestic policies, even at the expense of considerable limitation of civil liberties. Study 2 confirms the link between the perceived terrorism threat and the support for suspension of civil liberties. Nevertheless, when terrorism was seen in terms of crime rather than in terms of war, the mediating role of nationalism disappeared. The results contribute to a better understanding of the process whereby the perception of one’s own national group and the perception of one’s own nation-state translate into specific reactions triggered by external threats.

Prior to its ruling in Janowiec and Others v. Russia, the Grand Chamber of the European Court of Human Rights had recognised a “humanitarian exception” to the general rule by which the procedural obligations imposed by articles 2 and 3 of the European Convention only arise if the substantive violation of the Convention occurs after the entry into force of the Convention for the respondent State. In Janowiec, the Court was invited to apply this “humanitarian exception” to one of the great unpunished atrocities perpetrated on European soil in the past century. The Court declined to do so, mechanistically imposing its own temporal limitation on the “humanitarian exception” by which the substantive violation of the right to life and the prohibition of ill treatment must take place after the adoption of the Convention on 4 November 1950. The essay concludes that this limitation is questionable, that the reasoning behind it is dubious, and that the result is a regrettable confirmation of a situation of impunity.

During Perestroika, Russian authorities admitted publicly that, during Stalinism, a single order led to the extrajudicial execution of 26,000 Polish nationals (in what became known as the “Katyń forest massacre”). In 1990 Russia commenced criminal investigations, but they were discontinued and results were classified as secret in 2004. Following years of silence under communism, families of the victims demanded information from the Russian authorities, without results. The ECHR entered into force in Russia in 1998. This article analyzes the case Janowiec and Others v. Russia, brought before the Strasbourg Court by the relatives of the victims of the Katyń massacre. The applicants maintained that Russia violated the ECHR by discontinuing the investigation and failing to account for the fate of prisoners. In their opinion, Article 2 (right to life), and Article 3 (prohibition of torture and inhuman treatment) had been violated. This article compares the reasoning of the Court in the Chamber (2012) and Grand Chamber (2013) rulings. The latter produced a reformatio in peius with respect to the applicants’ interests. Grand Chamber ruled it had no competence either over the atrocity or over the subsequent improper treatment by Russian authorities. With this verdict, it deprived the applicants of the only claim upon which the Chamber had earlier ruled in their favour.

This text concerns main moral issues connected with the armed conflict currently underway in Syria. On the basis of an analysis of texts published in the opinion-forming American journal The New York Review of Books, the author tries to show the complexity of the conflict in terms of the problems faced by world opinion.The author concludes that we, ordinary citizens, and the leaders of the world powers, in undertaking actions (participation in military actions, taking sides, humanitarian aid) had to resolve certain dilemmas and that in doing so they took into account their subjective interests. The author thus confirms his original thesis that the contemporary world is no longer guided by international solidarity or the UN principle of a “responsibility to protect.”

The article presents the hero silhouette of blessed Alice Kotowska – the nun of the Congregation of the Sisters of the Resurrection, the superior of the community in Wejherowo and the secondary school principal. Because of her involvement in religious, social and patriotic activities, at the end of October in 1939, she was arrested by the Nazis and soon shot in the forests of Piaśnica. She was one of the tens of thousands of victims of the Pomeranian Crime. Account for her saintly life and the suffered death at the hand of the occupant, she was exalted to the glory of alters in 1999 among 108 Polish martyrs of World War II.

In 2014 Yasmina Khadra published the novel Qu’attendent les singes. It depicts a negative image of Algeria in the first decade of the 21st century – a country ruled by corrupted elites capable of all crimes. In the same year the writer announced his decision to participate in the presidential election in Algeria. The aim of this article is to analyze Khadra’s latest crime novel and to ask question about the links between the political campaign and the promotion of the book.
W 2014 roku Yasmina Khadra (pseudonim literacki Mohammeda Moulessehoula) wydał powieść kryminalną Qu’attendent les singes. Przedstawia w niej negatywną wizję Algierii w pierwszej dekadzie XXI wieku – kraju rządzonego przez skorumpowane elity zdolne do najgorszych zbrodni. W tym samym roku pisarz ogłosił decyzję o starcie w wyborach prezydenckich w Algierii. Celem artykułu jest analiza ostatniej powieści Khadry oraz krytyka strategii marketingowej opartej na połączeniu dwóch kampanii promocyjnych: politycznej i literackiej.
