Opis:
Adaptations of classic children’s stories, especially fairytales and fables, are very popular among today’s publishers. Those adaptations, not necessarily done correctly, often confuse the audience, especially those who are not familiar with the originals, and therefore will not notice the changes destructive to the story. I will try to explain what exactly causes this “damage”, also affecting the youngest, most trusting listeners, namely children, on the example of Grimm brothers’ “Rapunzel”, and its adaptations into literary and animated versions.

Opis:
The Book of Proverbs presents four texts where the tree of life metaphor appears: 3:18; 11:30; 13:12; 15:4. They obviously allude to the heavenly tree, which – according to the description in Genesis – stood in the middle of the Garden of Eden. The motif is also present in tales and beliefs of ancient Near East cultures (Mesopotamia, Egypt, Canaan), which somehow affected its biblical use. The pre-sence of this metaphor in the Book of Proverbs indicates that regaining life that had been lost in the Garden of Eden was identified with gaining the divine gi= of wisdom. The tree of life, i.e. a gi= of a blessed life, means following the paths of wisdom in all its aspects: speech, desires, acts and relationships

Autor analizuje i interpretuje najważniejszy literacki tekst dendrologiczny polskiej literatury powojennej, czyli dramat Drzewo Wiesława Myśliwskiego. Rozpoznaje go jako typowy przykład symbiotyczno-toksycznego związku między Polską i literaturą, decydującego także o tym, jak funkcjonuje w polskiej literaturze świat roślin. Sytuacja zmienia się po roku 1989. Jej konsekwencją jest dzisiejsza, ekologiczna i polityczna ekspansja ekokrytyki, którą najskuteczniej reprezentują utwory Olgi Tokarczuk. Obok nich pojawiają się w tekście inne dendrologiczne tropy  reprezentowane w polskiej literaturze współczesnej między innymi przez teksty Andrzeja Stasiuka, Michała Witkowskiego, Wojciecha Wencla, Jana Leończuka i Andrzeja Sapkowskiego. Próba ich uporządkowania wydaje się zarówno potrzebna, jak i nieskuteczna.
The article critically considers Wiesław Myśliwski’s play "Drzewo" [The Tree], the most important text of Polish post-war dendrological literature. The play is viewed as a typical example of the symbiotic-cum-toxic relationship between Poland and its literature, a relationship that also influences the way the world of plants is represented in other Polish literary texts. The situation in this particular case changed after 1989. These days we observe a genuine expansion of ecocriticism and its political consequences, notably in the works of Olga Tokarczuk. Apart from her writings, dendrological tropes are represented in Polish contemporary literature in the texts of Andrzej Stasiuk, Michał Witkowski, Wojciech Wencel, Jan Leończuk, and Andrzej Sapkowski. The taxonomy of all their dendrological tropes seems as urgent to be conducted as it is, in fact, impossible to achieve.

Opis:
The study provides presentation of selected statistical concepts based on data depth by Tukey. The concepts as: the rang of depth, the half-space convex, contour, simplicial depth breakdown points, position numerical measures, the trimmed mean depth, regression depth and the set of generally positive points were exemplified in a two-dimensional space of the dataset. There are also given numerical algorithms in some cases to indicate already mentioned concepts and to study their affined transformation. W pracy omówiono definicję zanurzenia punktu w próbie oraz wywodzące się z lej koncepcji pewne inne pojęcie statystyczne. Przedstawiono między innymi wskaźniki określające stopień zanurzenia oraz zaproponowano metody numerycznego ich wyznaczania.

Morphology is the study of the form, shape and structure of an organism. The connection between the morphology and symbolism of trees is associated with the spirituals bonds existing between humans and trees. The common terms, such as „tree”, „trunk”, „branch”, „root”, „fruit”, „flower”, „leaf” have a specific meaning in botany. In addition these terms carry various symbolic meanings. This article attempts to analyse symbolic plant motifs which were based on the morphological structure of trees. The symbolic significance of trees is associated with their specific structure: the crown represents the mystical heaven, the trunk symbolizes the earthly world, the roots extend deep into the underworld. Possibly the best known cosmic tree (arbor mundi) is the Scandinavian Ash or Yggdrasil. It also represents the axis mundi – the centre of the world. Tree-like diagrams which graphically illustrate genealogies refer to the structure of trees as well (e.g. the tree of Jesse). Trees are the largest and longest living organisms on our planet. Among the tallest trees in the world are: Sequoia sempervirens „Hyperion” from California (measuring 115,5 m), and Eucalyptus regnans „Icarus Dream” from Tasmania (97 m high). The largest tree in terms of total volume is Sequoiadendron giganteum „General Sherman” in California (1500 cubic meters). The myth of the Ultimate Lotus Tree Sidrat al-Muntaha – that marks the end of the seventh heaven is a reference to a very large tree (probably Zizyphus lotus, however its specimen are not so large). The oldest known living specimen is the „Methuselah”, a bristle cone pine Pinus longaeva in California, which is estimated to be about 5000 years old. Taxus baccata from Henryków Lubański is the oldest tree (1250 years-old) on record in Poland. Due to their long life span, trees can be seen as “monuments”, which remind the world of important events in history, eg. the sycamore tree destroyed during the terrorist attack on the World Trade Centre on September 11, 2001, whose roots were used in preparation for the sculpture honoring St. Paul’s Church. Tree symbolism also relates to changes in the appearance of trees that result from their life cycle and phenology. Trees, which lose their leaves in winter and produce new ones in spring, symbolize rebirth after death. Therefore, the cosmic tree is also called the Tree of Life. In Japanese culture the seasonal changes in the appearance of trees indicated the passage of time. In many cultures around the world trees were held sacred because they were believed to be the homes of certain gods (e.g. Ficus sycomorus in ancient Egipt, oak trees in Slavic and German legends). It should be noted, however, that the trees themselves were not the objects of worship but the gods who were thought to dwell in these trees. Nowadays the respect people have for trees stems from other reasons.

The article focuses on the case of Gäfgen v. Germany, which con-cerns the restrictions imposed on police offi cers who work on cases involving terror and violence posing a risk to human life, and on the ones who have to make decisions protecting victims’ lives. The choice of measures serving the protection of the highest value, i.e. human life, is not easy. At the same time, police offi cers are assessed in terms of criminal law as regards the protection of the basic human rights enjoyed by perpetrators who pose a risk to other people’s lives. The case of Gäfgen v. Germany regards the choice of values, and the criminal liability of police offi cers, connected with thereof, as well as the problem of the admissibility of evidence obtained in breach of the law in criminal proceedings, and the limitations of the fruit of the poisonous tree doctrine.

Opis:
The problems of the so-called poisonous tree in the course of the preliminary legal proceedings appear and continue to appear basically in every individual instance of the evaluation of the body of evidence submitted to the public prosecutor’s department. The task of the public prosecutor’s department has to do inter alia with the keeping of law and order and the supervision of the prosecution of crime. This task is realised by the supervision of the consistency of the preliminary legal proceedings with the law, and the initialisation and the performance of operational-examination activities by law enforcement organs in the scope of activities which is stipulated in the acts of law which regulate the organisation and the object of activities of these organs. The supervision which was indicated should be realised in an in-depth, comprehensive and substantive manner. Within the framework of the evaluation of the activities engaged by other organs, inluding those that are authorised to execute and conduct operation-related activities, the public prosecutor is obliged to evaluate the correctness of the process of the accumulation of evidence and the making of decisions in terms of the scope and the means of utilising the said evidence. Such control may and should be conducted with reference to the constitutional principles, described particularly in Art. 2 – the principle of a democratic state of law, Art. 7 – the principle of legalism, Art. 45 Par. 1 – the principle of the right to a trial and the resulting principle of the right to due process. The regulations of the Constitution of the Republic of Poland have not been modified since 1997, therefore with the changed state of the regulations of the Code of Criminal Law (the addition of new regulations in Art. 168 a and b ) or the competence-related acts of law, it is still possible to interpret these regulation in terms of the constitutional norms which were indicated. The new content which was introduced to the code of criminal procedure is a source of serious constitution-related doubts, and the evaluation of the material which was submitted to be treated during criminal proceedings may lead to statements that the very fact of having acquired a piece of evidence with the violation of regulations or by means of a criminal offense and the simultaneous violation of the regulations of the Constitutions is sufficient to preclude the utilisation of a given piece of evidence in these legal proceedings and to preclude the establishment of the actual state of affairs on the basis of such a piece of evidence. It is impossible to accept a situation in which the functionaries of the state, i.e. of public authorities, can collect evidence-related material in violation of the law which is binding and it is in keeping with the law that, on the basis of this material, citizens may bear criminal responsibility.

No work of Cyril devoted to exclusively Adam’s sin was preserved. Though in entire of his exegetical and pastoral production repeatedly this theme which one of patterns of his theology constitutes appears. According to Cyryl, Satan caused with jealousy took the man to the sin hitting the emotional sphere in order after all to take the man for falsifying the intellect. Tempting which consists in showing pleasure, is a modus operandi of the Satan which having an influence on an affective sphere after all he causes that the logic of this sphere is winning the logic of the intellectual sphere and a superiority in action is taking over making the man – animal rationale – less rationale, and more animale. This concept is dismissing Cyril oneself for Philo’s research, according to which for the figure in telling about the first sin they are symbolizing Adam and Eve’s two hierarchized spheres of one man: appropriately the intellectual sphere and the affective sphere. In his deliberations about the sin of the first parents Cyril also refers to elements of the biblical description (Genesis 1-3), so as: the heavenly commandment, the tree of getting to know the good and evil and its fruit. Cyril is reflecting also about the phenomenon of the snake and the issue of the woman, which created in order to be a help for the man, showed herself to be – how Cyril is describing her – with „intermediary of the sin”. The Alexandrian is also giving some thought to the inborn knowledge of the first people and the concept acquaintances of the good and evil. As the being and relevant aspects of the sin of the first people Cyril – referring to the Pauline tradition – is listing the insubordination, disregarding, the betrayal of the Holy Spirit, the lack of the circumspection, the exaggerated love of the body or exaggerated cherishing pleasure. Cyril – what was indicated in the article – very much willingly is using the metaphor of Egypt (Exodus), seeing, the symbol of the sin in it particularly in the days of patriarchs, of particularly Adam’s sin.

The article aims at presenting children’s and youth books published in 2013, 2014 and 2015 by the publishing house called ‘Poławiacze Pereł’. The author analyses the content of three short stories: The Zebra by Ifi Ude, Bahar Means Spring by Agnieszka Aysen Kaim and Tales Under the Olive Tree by Aida Amer. The article author presents her considerations on multiculturalism as a subject of Polish education. The students’ comprehension of ‘otherness’ may enable them to respect and accept the differences in race, appearance, religion, behaviour, culture, clothing and preferences.

Zagadnienia omawiane w niniejszym artykule dotyczą statusu normatywnego czynności operacyjno-rozpoznawczych w kontekście ustawy o Policji oraz kodeksu postępowania karnego. Podjęto próbę wskazania warunków, które rzutują na legalny charakter inwigilacji, a co za tym idzie – na skuteczne wykorzystanie materiału operacyjnego w procesie karnym. W tym celu scharakteryzowano niejawną aktywność Policji, wyszczególniając dopuszczalne metody operacyjne oraz definiując czynności operacyjno-rozpoznawcze w świetle literatury przedmiotu. Aby w pełni zobrazować problematykę poruszoną w artykule, przeanalizowano relację prawną między dowodem nielegalnym, o którym mowa w art. 168a kpk, a dowodem z czynności operacyjno-rozpoznawczych, na przykładzie zarządzonej kontroli operacyjnej. Praktyczny wymiar tych rozważań omówiono z punktu widzenia postępowania dowodowego, z uwzględnieniem ról i obowiązków procesowych prokuratora oraz sądu.
The issues discussed in this article refer to the normative status of operational and investigative activities in the context of the Police Act and the Code of Criminal Procedure. Namely, an attempt was made to demonstrate the conditions that affect the legal nature of surveillance, and thus the effective use of operational material in a criminal trial. For this purpose, the covert activity of the Police has been characterized by listing acceptable operational methods and defining operational and reconnaissance activities in the light of the literature on the subject. Therefore, in order to fully illustrate the issues discussed, an analysis was conducted of the legal relationship between the illegal evidence referred to in Art. 168a of the Code of Criminal Procedure and the evidence from operational and reconnaissance activities, on the example of an ordered operational control. The practical dimension of these considerations is discussed from the point of view of evidence proceedings, taking into account the procedural roles and responsibilities of the prosecutor and the court.

Opis:
The object of the Constitutional Tribunal’s review is Article 168a of the Code indicating the reasons of inadmissibility of evidence. The draft Sejm’s position contains a conclusion that the above provision is consistent with the Constitution of the Republic of Poland. The applicant (the Commissioner for Citizens’ Rights) claims that the challenged provision expresses an absolute obligation to include any evidence in the Polish criminal trial, regardless of how it was collected, including evidence obtained in violation of the prohibitions on collecting evidence. In the justification of the Sejm’s draft position it was stated that the purpose of the amendment was to ensure that the offender would be held criminally responsible and that any innocent person would be released from this liability in any situation where material evidence could be subject to exclusion only due to a defect in the procedure for obtaining it.

Opis:
The article presents theoretical issues related to the interposition to Polish criminal procedure rules known as „prohibition of eating the fruit of the poisonous tree”. The study addressed the following issues: 1) the interpretation of the article 168a of the Code of Criminal Procedure in the version after 1 July 2015; 2) some of the issues related to the possible problems with applicaton of this rule, and 3) axiology and theoretical legitimacy of this regulation.
