    Opis:
    The article is devoted to analysing the activities of the European Network of Ombudspersons for Children. The experience gained so far allows us to draw conclusions as to the activities of the institution coordinating the activities of ombudspersons for children in Europe and confirms that the exchange of good practices, support and coordination effectively strengthens the protection of children’s rights. This article aims to draw attention to selected problems related to the specificity of the activity of this European institution, which integrates not only the institutions of children’s rights ombudspersons but also other institutions established to protect the rights of the youngest in the situation of multifaceted threats of the modern world. The author tries to show that the European Network of Ombudspersons for Children undertakes intensified efforts to protect children’s rights and is effective in this respect.
    Artykuł poświęcony jest analizie działalności Europejskiej Sieci Rzeczników Praw Dziecka. Dotychczasowe doświadczenia powalają wyciągać wnioski, co do działalności instytucji koordynującej działania ombudsmanów do spraw dzieci w Europie i potwierdzają, że wymiana dobrych praktyk, wspieranie i koordynacja skutecznie wzmacniają ochronę praw dzieci. Celem niniejszego artykułu jest zwrócenie uwagi na wybrane problemy związane ze specyfiką działalności tej europejskiej instytucji, scalającej nie tylko instytucje rzeczników praw dziecka, ale także inne instytucje powołane do ochrony praw najmłodszych, w sytuacji wieloaspektowych zagrożeń współczesnego świata. Autor stara się wykazać, że Europejska Sieć Rzeczników Praw Dziecka podejmuje zintensyfikowane wysiłki na rzecz ochrony praw dzieci i jest w tym zakresie skuteczna.

    Artykuł o nadzwyczajnej skuteczności prawa norweskiego ma na celu wyjaśnienie czytelnikowi, dlaczego i jak szybko egzekwuje się prawa dziecka w Norwegii. Postawiona w temacie teza zostaje poddana przede wszystkim analizie prawnej. W tekście skomentowana jest również działalność Urzędu ds. Dzieci w Norwegii, który chroni dobra małoletnich w krótkim czasie. Dodatkowo uzasadniona jest działalność Rzecznika Praw Dziecka i jego wpływ na przyspieszenie spraw sądowych. Dla obywatela Polski może wydawać się to niezwykłym umocowaniem, ponieważ w Polsce tak się jeszcze nie dzieje. To w Norwegii na piedestale stoi dobro dziecka, jego zrównoważony rozwój i poczucie bezpieczeństwa w państwie i w domu, w którym zamieszkuje. Prawa dziecka są niezwykle skutecznie egzekwowane, dają na pierwszy rzut oka poczucie ogromnej ochrony. Może wydawać się, że ważniejszej od wychowania dziecka w rodzinie biologicznej. Dodatkowo zawarta jest informacja o Konwencji Stambulskiej i przygotowywanej Konwencji o Prawach Rodziny.
    Reading the article about the effectively law in Norway you should pay attention to law in your country. Especially in comparison with the norwegian law. One should ask themselves whether he / she would like to live. Whether in the country where the children`s rights are just respected or in the country where the children and their best interests are in the first plan. What is more important to his / her - worth of biological family or immediacy in enforcing children`s rights.

    Celem artykułu jest ukazanie okoliczności powołania Krajowego Urzędu ds. Ochrony i Przysposobienia Dzieci (Autoritatea Nationala Pentru Protectia Copilului Si Adoptie) oraz Zastępcy Rzecznika Praw Obywatelskich zajmującego się sprawami dzieci (Avocatul Copilului, czyli urzędu, który powstał w drodze ustawy ze stycznia 2018 r. i jest odpowiednikiem Ombudsmana dla Dzieci) oraz przywołanie ustaw określających kompetencje i zakres działalności obu tych instytucji. W tekście została przeprowadzona analiza aktów prawnych (dokumentów prawa międzynarodowego i przepisów prawa krajowego) oraz raportów przesyłanych przez Komitet ONZ ds. Praw Dziecka (CRC) stronie rumuńskiej, które przyczyniły się do powołania instytucji zajmujących się sprawami dzieci w Rumunii. Wnioski wynikające z przeglądu przepisów prawnych dotyczących ochrony dzieci w Rumunii dowodzą, że w ciągu ostatnich lat w tym kraju poczyniono ogromne postępy w kwestii opieki nad dziećmi i troski o poszanowanie ich praw. Rumunia zaczęła być postrzegana jako państwo liczące się z potrzebami najmłodszych obywateli, czego przejawem jest nie tylko powołanie instytucji Ombudsmana dla Dzieci czy też Krajowego Urzędu ds. Ochrony i Przysposobienia Dzieci, ale również wiele innych aktywności, których celem jest wspieranie dzieci. Wśród nich można wyróżnić międzynarodową konferencję „Udział dzieci w procesach decyzyjnych i kształtowaniu polityki na poziomie UE” zorganizowaną w Bukareszcie w maju 2019 r., podczas której przyjęto Bukareszteńską Deklarację Dzieci dotyczącą Partycypacji Dzieci w Podejmowaniu Decyzji na Szczeblu Krajowym oraz UE.
    The aim of the article is to present the circumstances of the establishment of the National Agency for Child Protection and Adoption (Autoritatea Nationala Pentru Protectia Copilului Si Adoptie) and the Deputy Ombudsman dealing with children's matters (Avocatul Copilului, an agency that was established by the Act of January 2018 and is the equivalent of the Ombudsman for Children) as well as to refer to the acts specifying the competences and scope of activity of both institutions. The article analyses legal acts (documents of international law and provisions of national law) and reports sent by the UN Committee on the Rights of the Child (CRC) to the Romanian side, which contributed to the establishment of institutions dealing with children's matters in Romania. The conclusions of the review of the child protection legislation in Romania show that the country has made great progress in the care of children and the respect for their rights in recent years. Romania began to be perceived as a country that takes into account the needs of the youngest citizens, which is manifested not only by the establishment of the institution of the Ombudsman for Children or the National Agency for Child Protection and Adoption, but also by many other activities aimed at supporting children. These include the international conference "Child Participation in Decision-Making and Policy Development at EU Level" organized in Bucharest in May 2019, during which the Bucharest a Declaration on Child Participation in Decision-Making at National and EU Levels was adopted.

    Opis:
    Celem niniejszego artykułu jest ukazanie instytucji Rzecznika Praw Dziecka (RPD), który, powołany ustawą z dnia 6 stycznia 2000 r. o Rzeczniku Praw Dziecka, stoi na straży ochrony praw dziecka. Rozważania zostały podzielone na sześć podpunktów. W pierwszej kolejności zostanie omówiona geneza instytucji ochrony praw dziecka. Kolejny podpunkt będzie traktował o podstawach prawnych organizacji i funkcjonowania Rzecznika Praw Dziecka, a także o jego pozycji ustrojowej. Kolejne rozważania przybliżą czytelnikowi kompetencje Rzecznika Praw Dziecka. W tym rozdziale autorka pochyli się nad zakresem zadań RPD, trybem i różnymi formami jego działania gwarantującymi przestrzeganie praw dziecka w Polsce. Następne rozważania dotyczyć będą współpracy Rzecznika Praw Dziecka z organami władzy, organizacjami pozarządowymi oraz innymi podmiotami. W dalszej kolejności omówiona zostanie ochrona praw dziecka w działalności RPD, tj. prawo do życia i ochrony zdrowia, prawo do wychowania w rodzinie, prawo do godziwych warunków socjalnych, prawo do nauki oraz prawo do ochrony przed przemocą, okrucieństwem, wyzyskiem, demoralizacją, zaniedbaniem oraz innym złym traktowaniem, na podstawie wybranych przykładów. Autorka przeanalizuje także, w kolejnym podpunkcie, uwagi Rzecznika Praw Dziecka o stanie przestrzegania praw dziecka w latach 2000–2010. Na zakończanie rozważań zostanie dokonane podsumowanie działalności na rzecz ochrony dzieci na przestrzeni 10 lat działalności Rzecznika oraz wyrażona ocena jego działań i skuteczności.
    This paper presents the institution of the Ombudsman for Children (Rzecznik Praw Dziecka (RPD), who, installed through the Act of Parliament, dated 6th February 2000, is on duty to safeguard the rights of the child. The study comprises seven chapters. Introductory we recapitulate the development of the institution of the protection of the rights of the child. The following chapter discusses the legal foundations of the organization and the exercise of the office as well as its legal status. Subsequently we define the Ombudsman‘s competences and reponsibilities. The author defines the range of his duties, the modalities of his activities that warrant the observance oft he right of the child in Poland. Consecutively we eludicate the cooperation between the RPD and organs of the public administration, nonstate organizations and other entities. Next we eximplify the observance oft he rights of the child within the following domains: the right for life and physical health, the right for being brought up in the family, the right for a decent social environment, the right for education and protection from the use of violence, cruelty, exploitation, demoralization, neglect and other forms of abuse on the evidence of actual cases from 2009/10. Consecutively, the auther analyzes the RPD’s comments on the effective observation of rights oft he child in the decade from 2000–2010. The final chapter summarizes the RPD’s activities on behalf of the children’s protection during the decade of the office, assesses his activities and efficiency.

    This article comprises a synthetic general review, presentation analysis and assessment of interpretation and efficiency of main legal sources of protection of children’s rights in international, European and Polish home law. As well as other problems of social and individual safety of children and youth, against of all forms of violence and abuse, social orphanage and other pathologies, aimed at building of a general common feelings of their safety in everyday life and activities. Authors present the two complementary spheres of organized institutional protection, prevention and intervention of children’s rights, based on the most important sources of law and asses their implementation and functioning in practice in Poland. The first sphere of the Polish model and system of protection of children’s rights, based on both legal and material guarantees and instruments, are public – state and territorial self-governing administration authorities, dedicated organs, institutions such as Ombudsman of children’s rights, regional and local centers of social care, safety and protection of family life and all forms of intervention in case of all forms of crises, violence and abuse of children and youth. The second complementary spheres of very dynamic manifold activities and social initiatives of various NGO’s and informal groups and individual persons, aiming at effective protection of children’s rights. These nongovernmental activities, both initiate, stimulate and control different forms of real prevention, protection, intervention and defense of children and their rights and counteracting all forms of social orphanage, violence and abuse in social relations with children and adolescents in different domains of our life, as well private and public. Their main aim is increasing of the feeling of safety of children and youth in Poland on the grounds of proper implementation and interpretation of respective legal regulations
