Opis:
This paper analyses the concept of critical infrastructure (CI) in the context of electoral process organization. I will determine whether the seats of circuit electoral commissions (CECs) meet the relevant criteria. How can such facilities be effectively protected? What does international, European, and national law prescribe in this regard? I will examine doctrine and the provisions of the current legal system, including the documents of the National Electoral Commission (NEC). I adopt the statutory1 assumption whereby critical infrastructure should be understood as systems and their functionally interdependent facilities, including buildings, equipment, installations and services that are essential to the security of the state and its citizens, serving to ensure the proper functioning of public administration bodies, institutions and entrepreneurs. Critical infrastructure is comprised of systems which, for example, ensure the continuity of public administration.

Zbrojna napaść Rosji na Ukrainę spotkała się ze zdecydowaną reakcją Zachodu. Jednak w przypadku kilku państw była ona spóźniona, co mogło świadczyć o istnieniu w nich rosyjskich wpływów. Celem badań była analiza możliwości oddziaływania przez Rosję na procesy decyzyjne w państwach zachodnich oraz wpływu takich oddziaływań na bezpieczeństwo Zachodu. Wyniki pokazały, że Rosja dysponuje wieloma narzędziami wpływu politycznego, do których można zaliczyć dyplomację, komunikację polityczną, rosyjską diasporę, Rosyjską Cerkiew Prawosławną oraz sympatyzujące z Rosją organizacje i ugrupowania społeczne i polityczne. Zostało również ukazane, że w celu wywierania wpływu Rosja wykorzystuje cały aparat państwowy, co stanowi zagrożenie dla szeroko rozumianego bezpieczeństwa państw Europy Zachodniej. Wnioski płynące z badań wskazują też na to, że Zachód może stać się ofiarą własnej tolerancji i poprawności politycznej, zwłaszcza w przypadkach kryzysów celowo wywoływanych przez Rosję.
The armed attack on Ukraine met with a strong reaction from the West. However, in the case of several countries it was late, which could indicate the existence of Russian influence there. The aim of the investigation was to analyse the possibility of Russia influencing decision-making processes in western countries and the impact of this influence on the security of the West. The results showed that Russia has many tools of political influence, including diplomacy, political communication, the Russian diaspora, the Russian Orthodox Church, and social and political organisations and groups sympathetic to Russia. It has also been shown that, to exert influence, Russia uses the entire state apparatus, which poses a threat to the broadly understood security of western European countries. The conclusions of the research also indicate that the West may become a victim of its own tolerance and political correctness. Especially in cases of crises deliberately caused by Russia.

Wojna to zawsze czas trudnych decyzji. To test realności „chęci pokoju”, ale również weryfikacja „szykowania się na wojnę”. Ogień wojny weryfikuje więc preparację i reaktywność wobec wojny. Okazuje się jednak, że przy tradycyjnie dużym znaczeniu decyzji establishmentu polityczno-wojskowego i ich wpływie na przebieg wojny obronnej i losy przetrwania społeczeństwa, równie ważne znaczenie ma sekwencja, a przede wszystkim ciągłość sygnałów napływających od strony społecznej. Kompozycja metodologiczna niniejszego artykułu zakłada aktualizacyjną refleksję nad „triadą wojny” i jej systemowymi relacjami, jakie uwidaczniają się w obliczu wyzwań wojennych państwowości i wyzwań wojennych, wyzwań bezpieczeństwa codzienności społecznej. O ile raczej reaktywnie niż prewencyjnie można reagować na salwy agresora, o tyle docenianie ewentualności ryzyka wojny, pozwala wzmocnić wiele fundamentów państwowości zawczasu. Występują również określone szanse, pośród już zmaterializowanych zagrożeń. Stąd tytułowa kategoria „wyzwania”. Refleksje i konstatacje niniejszego artykułu, dokonane na podstawie założonego celu: poznawczego i utylitarnego – mogą posłużyć jako propozycja rzucenia nowego światła na funkcjonowanie państwa i wykształcenie utrudniającej agresorowi inwazję - odporności.
War is always a time of difficult decisions. This is a test of the reality of the “will for peace”, but also a verification of “preparing for war”. The fire of war therefore verifies preparation and reactivity towards war. It turns out, however, that given the traditionally great importance of the decisions of the political and military establishment and their impact on the course of the defensive war and the fate of society’s survival, the sequence and, above all, the continuity of signals coming from the social side are equally important. The methodological composition of this article assumes an updated reflection on the “triad of war” and its systemic relations that become visible in the face of war challenges of statehood and war challenges, security challenges of everyday social life. While it is possible to react reactively rather than preventively to the aggressor’s volleys, appreciating the possibility of war allows us to strengthen many of the foundations of statehood in advance. There are also certain opportunities among the already materialized threats. Hence the title “challenges” category. The reflections and conclusions of this article, made on the basis of the assumed cognitive and utilitarian purpose, can serve as a proposal to shed new light on the functioning of the state and the development of immunity, which makes the invasion more difficult for the aggressor.

Naturalną cechą instytucji państwa jest to, iż wyposażone w atrybuty władzy zwierzchniej otacza opieką dobra chronione w ramach swej zewnętrznej i wewnętrznej aktywności na różnych płaszczyznach, w tym m.in. gospodarczej, militarnej, społecznej, kulturowej i porządkowej. Dotyczy to zarówno jego suwerenności i interesów na arenie międzynarodowej, jak i wszelkich spraw na arenie wewnętrznej. Aktywność demokratycznego państwa prawnego obejmuje zagadnienia bezpieczeństwa narodowego, czyli wolności od wszelkich wyzwań i zagrożeń godzących w interesy państwa jako instytucji politycznej, społecznej, terytorialnej i przymusowej oraz interesy ogółu narodu, grup społecznych i poszczególnych jednostek. Znaczna część tych interesów dotyczy areny wewnętrznej państwa, która obejmuje m.in. zapewnienie bezpieczeństwa i porządku wewnętrznego, wymuszanie przestrzegania panującego porządku prawnego, zapewniania minimum egzystencji obywatelom, ochrony ich życia i zdrowia oraz środowiska naturalnego. Tradycyjnie bezpieczeństwo wewnętrzne pojmowane jest jako ogół działań na rzecz przeciwdziałania zagrożeniom wewnątrz państwa, i tylko w trzech domenach, tj. bezpieczeństwa ustrojowego, publicznego (lub porządku publicznego) i powszechnego. Autor stoi na stanowisku, iż współcześnie pojęcie bezpieczeństwa wewnętrznego należy postrzegać szerzej. Wynika to z faktu, iż demokratyczne państwo prawne ochrania nie tylko panującą władzę, lecz przede wszystkim całą grupę państwową, jak i różne grupy społeczne i poszczególnych obywateli. Owa troska o bezpieczeństwo to nie tylko ochrona panującego porządku prawnego i grupy władczej. To także działanie na rzecz tworzenia warunków bezpiecznego bytu i rozwoju całego społeczeństwa (narodu) i jego poszczególnych części. To ocalanie ich życia i zdrowia, zapewnianie niezbędnych warunków godnego funkcjonowania i wsparcie na różnych etapach i w różnych dziedzinach ich aktywności. Na koniec wreszcie warto mieć na względzie, iż w bezpieczeństwie wewnętrznym chodzi nie tylko o zabezpieczenie przed czynnikami wewnętrznymi. To również ochrona cennych dóbr na arenie wewnętrznej przed zagrożeniami zewnętrznymi, których sprawcami mogą być podmioty zewnętrzne, państwowe i pozapaństwowe. Pod uwagę musi być też brana ochrona przed skutkami wydarzeń zewnętrznych, pośrednio oddziałujących na niemal wszystkie aspekty wewnętrznego funkcjonowania państwa. Niniejszy artykuł jest przeglądem różnych stanowisk i poglądów na temat bezpieczeństwa wewnętrznego RP oraz próbą autorskiego ujęcia przedmiotowej problematyki.
It is a natural feature of state institutions that equipped with the attributes of supreme authority, it takes care of protected goods as part of its external and internal activity on various levels, including economic, military, social, cultural, and ordinal. This applies to both his sovereignty and interests in the international arena, as well as all matters in the internal arena. The activity of a democratic state ruled by law covers the issues of national security, i.e., freedom from all challenges and threats that harm the interests of the state as a political, social, territorial, and compulsory institution, as well as the interests of the nation, social groups and individual individuals. A significant part of these interests concerns the internal arena of the state, which includes, inter alia, ensuring security and internal order, enforcing compliance with the prevailing legal order, ensuring a minimum subsistence level for citizens, protection of their life and health and the environment. Traditionally, internal security is understood as all activities aimed at counteracting threats within the state, and only in three domains, i.e., systemic security, public (or public order) and universal security. The author is of the opinion that the concept of internal security today should be perceived more broadly. This is due to the fact that a democratic state ruled by law protects not only the ruling authority, but above all the entire state group, as well as various social groups and individual citizens. This concern for security is not only the protection of the prevailing legal order and the ruling group. It is also an effort to create conditions for the safe existence and development of the entire society (nation) and its individual parts. It is saving their life and health, providing the necessary conditions for their decent functioning and support at various stages and in various areas of their activity. Finally, it is worth bearing in mind that internal security is not only about protection against internal factors. It is also the protection of valuable goods in the internal arena against external threats, the perpetrators of which may be external, state, and non-state entities. Protection against the effects of external events, indirectly affecting almost all aspects of the internal functioning of the state, must also be considered. This article is a review of various positions and views on the internal security of the Republic of Poland and an attempt at the author's approach to the subject matter.

Celem artykułu jest omówienie najważniejszych problemów w relacjach na szczeblu centralnym między pionem archiwalnym MSW a Naczelną Dyrekcją Archiwów Państwowych w latach 1976–1990, przede wszystkim przekazywania materiałów archiwalnych oraz regulacji kwestii spornych. Transfery dokumentacji zostały zaprezentowane na tle analogicznych procesów w archiwach spoza sfery MSW, takich jak Archiwum Komitetu Centralnego Polskiej Zjednoczonej Partii Robotniczej, Centralne Archiwum Wojskowe, archiwa Głównej Komisji Badania Zbrodni Hitlerowskich w Polsce – Instytutu Pamięci Narodowej oraz Archiwum Wojsk Ochrony Pogranicza. Istotną częścią artykułu jest szczegółowe opisanie procedowania ustawy z 14 lipca 1983 r. o narodowym zasobie archiwalnym i archiwach wraz z dyskusją na ten temat, która odbyła się wewnątrz resortu spraw wewnętrznych. Podjęto próbę przeanalizowania kontaktów płk. Kazimierza Piotrowskiego, dyrektora Biura „C” MSW, z prof. Marianem Wojciechowskim, naczelnym dyrektorem archiwów państwowych, zwłaszcza ukrytego wymiaru tych relacji, oraz działań Służby Bezpieczeństwa na polu archiwalnym w momencie transformacji lat 1989–1990. Przy omawianiu tego ostatniego zagadnienia postawiono i poddano pod rozwagę hipotezę o maskowaniu nieregulaminowego brakowania dokumentacji wewnątrz resortu poprzez transfery archiwalne poza resort spraw wewnętrznych.
The aim of this article is to discuss the most important problems in relations at the central level between the archival division of the Ministry of the Interior and the Supreme Directorate of the State Archives between 1976 and 1990, primarily the transfer of archival materials and the regulation of controversial issues. The transfers of documentation are presented against the background of analogous processes taking place in archives outside the Ministry of the Interior, such as: the Archives of the Central Committee of the Polish United Workers’ Party; the Central Military Archives; the archives of the Central Commission for the Investigation of Nazi Crimes in Poland – the Institute of National Remembrance; and the Archives of the Border Guard. An important section of the article provides a detailed description of the procedure of the law of 14 July 1983 on national archival resources and archives, together with discussions on this topic that took place inside the Ministry of the Interior. An attempt was made to analyse the contacts of Colonel Kazimierz Piotrowski, director of the Bureau “C” of the Ministry of the Interior, with Professor Marian Wojciechowski, chief director of the state archives, especially the hidden dimension of these relations, and to analyse the activities of the Security Service in the archival field at the time of the 1989–1990 transition. In discussing the latter issue, the hypothesis of concealing the unregulated removal of documentation within the Ministry by means of archival transfers outside the Ministry of the Interior was raised and submitted for consideration.

Religion can become an instrument of manipulation and destabilization in society, everything depends on people who have access to the levers of power, the position of Church hierarchs and the level of religious literacy of the population. The article is devoted to the study of the concept of the correlation of national identity and Christian universalism, as well as the model of Church–State relations in the modern social teaching of the Russian Orthodox Church, in the context of the analysis of some aspects of the religiosity of the Belarusian student youth, namely quantitative indicators of trust in the Church, attendance of divine services, and confessional affiliation.
Религия может стать инструментом манипуляции и дестабилизации в обществе, все зависит от людей, имеющих доступ к рычагам власти, позиции церковных иерархов и уровня религиозной грамотности населения. Статья посвящена исследованию концепции соотношения национальной идентичности и христианского универсализма, а также модели церковно-государственных отношений в современном социальном учении Русской Православной Церкви, в контексте анализа некоторых аспектов религиозности белорусской студенческой молодежи, а именно количественных показателей доверия к церкви, посещение богослужений и конфессиональной принадлежности.

In the digital society, states’ information security has become one of the key elements of ensuring the competitiveness and sustainable development of the state, guaranteeing its integrity and security in general. An important component of state security is the internal security of the state, which must ensure the personal and public safety of its citizens. Modern Ukraine is building a new system of criminal justice, which requires a new information system for risk assessment and support for optimal decision-making. Today, applied research and the development of information and analytical software for the internal security of the state have acquired a special meaning. In the paper, there is built a set of models for providing operational information for decision-making in criminal justice. This is a cluster model for creating criminal profiles of convicts, and a scoring model for identifying individual characteristics of criminals that have the greatest impact on their propensity to reoffend. The obtained models can provide reliable support for decision-making in the field of criminal justice and become part of the information support system for the internal security of Ukraine in general.

Zapewnienie poziomu bezpieczeństwa wewnętrznego państwa wymaga systemowych rozwiązań prawnych ukierunkowanych na ochronę tej wartości. Odnosi się również do ochrony innych dóbr, które mogą być zagrożone bądź w wyniku zdarzeń będących efektem zagrożeń wynikających z praw przyrody lub rozwoju cywilizacyjnego stać się przedmiotem naruszeń. Na gruncie legislacyjnym zabezpieczenie realizacji tego celu równoznaczne jest więc z obowiązkiem państwa stanowienia i stosowania prawa w obszarze organizacji systemu bezpieczeństwa wewnętrznego państwa, a w jego ramach zintegrowanego systemu ratowniczego zobowiązanego do ochrony tychże wartości i dóbr. Podejmowane rozważania mają w związku z tym na podstawie przepisów prawa wykazać podstawowe z punktu widzenia trójstopniowego podziału terytorialnego państwa założenia organizacji i funkcjonowania krajowego systemu ratowniczo-gaśniczego jako jednego z elementów owej organizacji bezpieczeństwa wewnętrznego państwa i systemu ratowniczego. W powyższym zakresie pomocna staje się także ocena statusu organów publicznych wyposażonych w kompetencje i zadania, odpowiedzialnych za krajowy system ratowniczo-gaśniczy na poszczególnych poziomach, jak również jednostek systemu za działania ratownicze, skierowane na wspomnianą ochronę.
Ensuring the level of internal security of the state requires systemic legal solutions aimed at the protection of this value. It also refers to other goods that may be endangered or, as a result of events resulting from threats being a consequence of the laws of nature or civilization development, become the subject of violations. On the legislative basis, securing the implementation of this goal is therefore tantamount to the state's obligation to legislate and apply the law in the area of the organization of the state's internal security system, and within it, an integrated rescue system obliged to protect these values and goods. Therefore, the considerations taken are to demonstrate the basic assumptions of the organization and functioning of the national rescue and firefighting system as one of the elements of the organization of the state's internal security and the rescue system, based on the provisions of the law. In this respect, it is also helpful to assess the status of public authorities with competences and tasks, responsible for the national rescue and firefighting system at individual levels, as well as system units for rescue operations aimed at the said protection.

Opis:
The purpose of the article is to present the diplomatic activity of representatives of the Polish Navy, aimed at creating solid political and military foundations for the foundation, which was the maritime security of the state. Poland found itself in a new reality, becoming a coastal state. It had a maritime border and the company of states that were not satisfied with such a state, namely: the Weimar Republic and Bolshevik Russia. In addition to these countries, new countries have emerged in the Baltic Sea basin, such as Poland, Lithuania, Latvia, Estonia, and Finland. One cannot ignore the eternal Baltic States, i.e., Denmark and Sweden. Poland decided that its foreign policy in the Baltic Sea basin should be based on good neighborly relations with countries that, like it, have regained their independence, as well as with Denmark and Sweden. Today, from the perspective of several decades, it can be said that this task was difficult to implement. This was influenced by many factors, which will be presented in the article. Unfortunately, one of them, independent of the Polish side, were the provisions of the Treaty of Versailles, which were not able to prevent the revival of German power and the revolutionary Soviet Union. The Versailles order achieved neither legitimacy nor a balance of power. A key role in the foreign policy of coastal states is played by the navy, which is its most important component. The Navy is the only branch of the armed forces of a country that, through the sovereignty of the decks and their immunity, has a much greater diplomatic „potential” than the land forces or the air force. Therefore, representatives of the navy are participants in universally understood diplomacy and function as naval attachés. It is they who are responsible for maintaining „maritime” relations between the states with which international relations are maintained. It is they who prepare the visits of warships in a given country and take care of their proper setting. It was, it is, and it will be. Poland began to fit into this mechanism practically from the establishment of the Polish Navy and continues to this day. The presented article focuses on the diplomatic missions of PMI officers in the interwar period.

Artykuł ma charakter naukowo-badawczy, a jego przedmiotem jest analiza uchwał i postanowień Izby Karnej Sądu Najwyższego w zakresie prawa karnego materialnego wydanych w 2022 r., w wyniku rozpatrzenia tzw. pytań prawnych. Przedmiotem rozważań są takie zagadnienia jak: przestępstwo niezawiadomienia o przestępstwie (art. 240 § 1 k.k.); zawieszenie biegu przedawnienia karalności w związku z epidemią COVID-19; słuchacz lub student Wydziału Porządku Publicznego w Szczytnie Akademii Spraw Wewnętrznych jako osoba niepełniąca służby w organach bezpieczeństwa państwa oraz zatrzymanie prawa jazdy osobie wchodzącej w skład jednostki wojskowej wykonującej zadania poza granicami państwa, popełniającej za granicą czyn polegający na prowadzeniu pojazdu mechanicznego w stanie nietrzeźwości (art. 135 ust. 1 p.r.d.). Podstawowym celem naukowym była ocena zasadności dokonanych przez ten organ interpretacji przepisów regulujących zagadnienia prawne poddane Sądowi Najwyższemu do rozstrzygnięcia. Główną tezą badawczą było wykazanie, że tzw. instytucja pytań prawnych kierowanych do Sądu Najwyższego spełnia ważną rolę w zapewnieniu jednolitości orzecznictwa sądów powszechnych i wojskowych, gdyż argumentacja stanowiska tego organu jest pogłębiona. Wyniki badania mają oryginalny charakter, ponieważ rozwijają twórczo interpretację zawartą w analizowanych rozstrzygnięciach. Badania mają przede wszystkim zasięg krajowy. Artykuł ma istotne znaczenie dla nauki – zawiera pogłębioną analizę dogmatyczną oraz duży ładunek myśli teoretycznej, a także jest przydatny dla praktyki, wzbogacając argumentację Sądu Najwyższego lub przytaczając okoliczności uzasadniające poglądy odmienne.
The article is of scientific research nature and it aims to analyse resolutions and rulings of the Supreme Court Criminal Chamber concerning substantive criminal law passed in 2022 as a response to the so-called legal questions. The subject of the analysis covers such issues as: the crime of failure to report a crime (Article 240 § 1 of the Criminal Code); suspension of the statute of limitations for criminal offenses due to the Covid-19 pandemic; a student of the Faculty of Public Order of the Academy of Internal Affairs in Szczytno as a person not serving in the state security bodies; and revocation of a driving licence in the event its holder who is a member of a military unit performing tasks outside the country commits an act consisting in driving a motor vehicle under the influence of alcohol (Article 135(1) of the Road Traffic Act). The basic scientific research aim is to evaluate the legitimacy of this body’s interpretation of the regulations covering the legal issues referred to the Supreme Court for resolution. The main research theses consist in showing that the so-called legal questions referred to the Supreme Court play an important role in ensuring the uniformity of common and military courts’ judgements because the body’s stance is based on in-depth reasoning. The research findings are original in nature as they creatively develop the interpretation contained in the resolutions analysed. The research is mainly national in scope. The article is especially important for science because it contains a deepened dogmatic analysis and a big load of theoretical thought, as well as it is practically useful as it enriches the Supreme Court’s arguments or refers to circumstances justifying different opinions.

The scholarly and research-focused article aims to analyse resolutions and rulings of the Supreme Court Criminal Chamber concerning substantive criminal law passed in 2022 as a response to the so-called legal questions. The subject of the analysis covers such issues as: the crime of failure to report a crime (Article 240 § 1 of the Criminal Code); suspension of the statute of limitations for criminal offenses due to the COVID-19 pandemic; a student of the Faculty of Public Order of the Academy of Internal Affairs in Szczytno as a person not serving in the state security bodies; and revocation of a driving licence in the event its holder who is a member of a military unit performing tasks outside the country commits an act consisting in driving a motor vehicle under the influence of alcohol (Article 135(1) of the Road Traffic Act). The fundamental objective of this scientific research is to evaluate the legitimacy of this body’s interpretation of the regulations encompassing legal issues referred to the Supreme Court for resolution. The primary research theses aim to demonstrate that the so-called legal questions referred to the Supreme Court play an important role in ensuring the uniformity of common and military courts’ judgements, given that the body’s stance relies on in-depth reasoning. The research findings present an original perspective developing the interpretation found in the analysed resolutions in a creative way. While the research primarily focuses on national aspects, the article holds significant importance for the scientific community. This is due to its detailed dogmatic analysis and substantial theoretical discourse. Moreover, its practical utility is evident as it enriches the Supreme Court’s arguments and addresses circumstances that justify diverse opinions.

Tekst poświęcony jest ogólnej charakterystyce ograniczeń praw i wolności człowieka w czasie stanu wojennego w Ukrainie. Autorzy zwracają uwagę na to, że w czasie stanu wojennego prawa człowieka nie tracą priorytetowego znaczenia, a ich przestrzeganie świadczy o wysokim poziomie demokracji w państwie i jest wskaźnikiem uznania osoby za najwyższą wartość społeczną. Ważnym zadaniem jest zachowanie równowagi pomiędzy potrzebą utrzymania podstaw bezpieczeństwa państwa a funkcjonowaniem instytucji demokratycznych mających na celu zapewnienie i ochronę praw człowieka. W opracowaniu poddano analizie pojęcie, rodzaje i przejawy ograniczeń praw człowieka w stanie wojennym, a także określono wykaz praw i wolności osób fizycznych i prawnych, które mogą zostać ograniczone. Jednocześnie analiza regulacji prawnych, tak przypisów międzynarodowych, jak i krajowych, dotyczących ograniczeń praw i wolności człowieka w związku z wprowadzeniem stanu wojennego na Ukrainie, pozwoliła na wskazanie i podsumowanie zasad legalności takich ograniczeń, które muszą spełniać trzyczęściowy test proporcjonalności. Autorzy podkreślają znaczenie i konieczność sądowej kontroli konstytucyjnej nad ograniczeniami praw i wolności człowieka w czasie stanu wojennego.
This study devoted to the general characteristics of restrictions on human rights and freedoms during martial law in Ukraine. The authors note that during martial law, human rights do not lose their priority, and their observance demonstrates the high level of democracy in the state and is an indicator of the recognition of the person as the highest social value. An important task is to balance the need to maintain the foundations of state security with the functioning of democratic institutions aimed at ensuring and protecting human rights. The study analyzes the concept, types and manifestations of restrictions on human rights under martial law and identifies a list of rights and freedoms of natural and legal persons that can be restricted. At the same time, the analysis of legal regulations, both international and domestic notes on restrictions on human rights and freedoms in connection with the introduction of martial law in Ukraine made it possible to identify and summarize the principles of legality of such restrictions, which have completed the proportionality test. The authors emphasize the importance and necessity of judicial constitutional control over restrictions on human rights and freedoms during martial law.

W konferencji wzięli udział badacze z zakresu nauk o bezpieczeństwie, historycy, prawnicy, pedagodzy, ale także praktycy – przedstawiciele Sił Zbrojnych RP oraz Organów ochrony bezpieczeństwa i porządku publicznego.
The Jacob of Paradies University in Gorzów Wielkopolski on April 21-22, 2022 carried out the seventh edition of the national scientific conference entitled “National Security of Poland”. Threats and determinants of change”. The topic of this year focused on challenges of the state during 21st of century. The conference attended by security science researches, historians, lawyers, educators but practitioners as well – representatives of the Polish Armed Forces and Security and Law Protection Authorities.

Ponadto, wyciągnięcie wniosków i postawienie postulatów, których zastosowanie może wpłynąć na poprawę efektywności regulacji prawnych związanych z realizacją obowiązku obrony Ojczyzny. W pracy jako wiodąca wykorzystana została metoda dogmatyczna, a pomocniczo metoda historyczna i komparatystyczna.
This article presents considerations regarding the Homeland Defense Act adopted on March 11, 2022, which is intended to adapt the so-called military law to modern requirements and thus improve the quality of state security. The aim of the article is to attempt to answer the question to what extent the Homeland Defense Act constitutes a new and better quality of state security? Moreover, this goal is to develop conclusions and postulates, the implementation of which may improve the effectiveness of legal regulations related to the implementation of the obligation to defend the Homeland. The work uses the dogmatic method as the main method and the historical and comparative methods as auxiliary methods.
