February 2023 marked five years since the tragic assassination of Ján Kuciak, an investigative journalist from Aktuality.sk, and his fiancée Martina Kušnírová. The results of the investigation of the murders revealed the primary motive behind the murder was Kuciak’s dedicated pursuit of investigative journalism. This revelation sparked the consequential societal upheaval and tensions which triggered significant shifts within high-ranking politicians, later leading to governmental crisis. Furthermore, the murder garnered attention and prompted critical discussions within European institutions. As a result, Slovakia, which used to be one of the best countries when it came to Freedom of the Press, dropped down in rankings. This study delves into the farreaching consequences of this event, focusing on the profound political, legislative, and societal transformations that have unfolded in the wake of Kuciak’s murder. These changes have left an indelible mark on journalists, reshaped the landscape of journalism as a profession, and brought changes to Slovak media legislative.

W podsumowaniu autorzy zaproponowali możliwą optymalizację ustawowego brzmienia klauzuli GAAR w Republice Słowackiej. Badania opierały się na sformułowaniach prawnych obowiązujących w dniu 10 października 2023 r.
The paper discusses the issue of legal GAAR in the conditions of the Slovak Republic. The authors clarify how this legal instrument has developed over time in the context of the EU law, highlight its peculiarities and at the same time compare it with the minimum standard required by the EU legislator. In the conclusion, the authors propose a possible optimisation of wording of the statutory GAAR in the Slovak Republic. The research was based on the legal wording as of 10 October 2023.

The settlement procedure in Slovakia stems from three sources of inspiration: top-to-bottom (European Union law), bottom-up (incentive of an undertaking’s lawyer) and horizontal sources (Czechia). After more than ten years of application of this feature of Slovak competition law, there are several cases which were settled. These cases show a certain variety from the point of view of the legal basis, the stage of procedure as well as the character or relevance of the case. This makes it possible to assess their features, practice, effects, and consequences of settlements from the empirical point of view. The present paper analyses the legal framework and practice from a historical point of view. It provides a qualitative overview with evaluation of the settlement procedure in the context of European law and the Slovak legal order as well as a quantitative overview based on data extracted from the decisions of the Slovak NCA (PMÚ) and court rulings. In its conclusions it brings forward fresh suggestions de lege ferenda.
Il existe trois sources d’inspiration à la procédure de transaction en Slovaquie: de haut en bas (droit de l’Union européenne), de bas en haut (incitation de l’avocat d’une entreprise) et de sources horizontales (Tchéquie). Après plus de dix ans d’application de cette caractéristique du droit slovaque de la concurrence, plusieurs affaires ont été réglées. Ces affaires présentent une certaine variété du point de vue de la base juridique, du stade de la procédure ainsi que du caractère ou de la pertinence de l’affaire. Cela permet d’évaluer leurs caractéristiques, leur pratique, leurs effets et les conséquences des règlements amiables d’un point de vue empirique. Le présent article analyse le cadre juridique et la pratique d’un point de vue historique. Il fournit un aperçu qualitatif avec une évaluation de la procédure de transaction dans le contexte du droit européen et de l’ordre juridique slovaque ainsi qu’un aperçu quantitatif basé sur des données extraites des décisions de l’autorité slovaque de la concurrence (PMÚ) et des décisions de justice. Il conclut en présentant de nouvelles propositions de lege ferenda.

W artykule starano się scharakteryzować najważniejsze właściwości słowackiej spółki z ograniczoną odpowiedzialnością, próbując tym samym wytłumaczyć jej fenomen, polegający na tym, że ten rodzaj spółki jest najczęściej wybieranym przez przedsiębiorców na Słowacji. Tekst został podzielony na cztery zasadnicze części, w których przedstawiono przede wszystkim poszczególne zalety słowackiej spółki z ograniczoną odpowiedzialnością. W pierwszej części tekstu podano podstawowe informacje. W kolejnej zaprezentowano najważniejsze informacje dotyczące poszczególnych organów tej spółki. W części trzeciej podjęto próbę krótkiego wyjaśnienia braku zainteresowania prostą spółką akcyjną, która niejako miała być dużo bardziej przystępna dla przedsiębiorców. Z kolei w ostatnim, czwartym fragmencie zawarto podsumowanie, przedstawiające w punktach najważniejsze cechy słowackiej spółki z ograniczoną odpowiedzialnością, które czynią ją najbardziej atrakcyjną dla przedsiębiorców.
The article attempts to characterize the most important properties of a Slovak limited liability company, trying to explain its phenomenon, which is the fact that this type of company is most frequently selected by entrepreneurs in Slovakia. The text has been divided into four main parts, which present the individual advantages of the Slovak limited company. The first part of the text presents basic information. The second one presents the most important information on individual bodies of this company. The third part tries to explain briefly the lack of interest in a simple joint-stock company, which, in theory, is supposed to be more accessible to entrepreneurs. The last fourth fragment contains a short summary, presenting in points the most important features of the Slovak limited company, which make it the most attractive for entrepreneurs.

This article focuses on assessing whether the current Slovak legal framework provides animals with a sufficient level of protection against cruelty and maltreatment. Past and current Slovak legislation on animal protection was analyzed in light of the major animal welfare challenges that Slovakia faces today. Contrary to what the title of the study suggests, a different approach was chosen to strengthen the protection of animals – not through the concept of animal rights, but the concept of human rights to a favourable environment. In addition, the possibility of using the already existing environmental law legal instruments when the well-being of animal is threatened was discussed.
W artykule skupiono się na ocenie tego, czy obecne słowackie ramy prawne zapewniają zwierzętom wystarczający poziom ochrony przed okrucieństwem i złym traktowaniem. Analizie poddano dawne i aktualne słowackie ustawodawstwo dotyczące ochrony zwierząt w kontekście największych wyzwań w zakresie ochrony dobrostanu zwierząt, przed którymi stoi obecnie Słowacja. Wbrew temu, co sugeruje tytuł opracowania, wybrano inne podejście do kwestii wzmocnienia ochrony zwierząt – nie poprzez koncepcję praw zwierząt, lecz poprzez koncepcję praw człowieka do przyjaznego środowiska. Ponadto omówiono możliwość wykorzystania już istniejących instrumentów z zakresu prawa ochrony środowiska w sytuacji, gdy dobro zwierzęcia jest zagrożone.

This article deals with the fundamental form of direct democracy – a referendum in terms of its constitutional regulation and practical implementation in the Slovak Republic. It analyses the constitutional concept of the referendum with an emphasis on its legislative development and practical implementation within the functioning of the independent state after the year 1993. It points out some interpretative problems arising from the application practice and examines its constitutional implications relying on the relevant case law of the Constitutional Court of the Slovak Republic.
Tematem artykułu jest referendum jako podstawowa forma demokracji bezpośredniej, jego regulacja konstytucyjna i praktyczne zastosowanie w Republice Słowackiej. Poddano także analizie konstytucyjną koncepcję referendum, z naciskiem na jego rozwój legislacyjny i praktyczne wdrożenie w ramach funkcjonowania niepodległego państwa po 1993 roku. Wskazano na pewne problemy interpretacyjne wynikające z praktyki aplikacyjnej oraz jej konstytucyjne implikacje, opierając się na orzecznictwie Trybunału Konstytucyjnego Republiki Słowackiej.

Artykuł prezentuje zasadniczy przegląd problematyki źródeł prawa Republiki Słowackiej. Ukazuje poszczególne rodzaje źródeł prawa na Słowacji i ich konstytucyjnoprawne umocowanie, przy czym obejmuje także krytyczną analizę elementów procedury ustawodawczej i konstytucyjnej. Przybliża podstawowy kształt krajowego systemu prawnego, który w zamyśle tradycyjnej koncepcji ma kształt piramidy, a wierzchołek jej stanowi Konstytucja i ustawy konstytucyjne. Te tradycyjne rozumienie jest konfrontowane z rozwojem stosunków prawa międzynarodowego, prawa europejskiego i prawa krajowego na tle teorii międzysystemowego (intersystemowego) pluralizmu prawnego. W artykule także skupiono się na wytyczenie miejsca umów międzynarodowych w porządku prawnym Republiki Słowackiej ze szczególnym uwzględnieniem pozycji Europejskiej Konwencji o Ochronie Praw Człowieka i Podstawowych Wolności oraz Karty Podstawowych Praw i Wolności UE. W tym celu przybliżone zostało odpowiednie orzecznictwo Sądu Konstytucyjnego Republiki Słowackiej i podniesiono problematykę stosunku słowackiego prawa krajowego i prawa wspólnotowego UE. Jako graniczne kryterium uznawania zasady pierwszeństwa prawa UE na pierwszy plan wysuwa się niepisane materialne jądro słowackiej Konstytucji.
The article gives a comprehensive overview of the issues of sources of law in the Slovak Republic. It describes the different types of sources of law of Slovak Republic and their constitutional and legal regulation and also focuses on the analysis of the critical moments of constitutional and legislative process. The text explains the basic form of the national legal system, which in the traditional terms takes the form of a pyramid, the top of which are the Constitution and constitutional acts. This traditional concept is confronted with the current development of relations of the systems of international law, European law and national law, on the background of the theory of inter – system legal pluralism. The article is focused on the definition of the status of international treaties in the legal order of the Slovak Republic, with particular emphasis on the status of the Convention for the Protection of Human Rights and Fundamental Freedoms (European Convention on Human Rights) and the Charter of Fundamental Rights and Freedoms of the European Union. For this purpose the relevant case-law of the Constitutional Court of the Slovak Republic is demonstrated, and the issue of the concept of the relationship between the national law of the Slovak Republic and the European Union is raised. The unspoken material core of the Constitution of the Slovak Republic is to be considered as a criterion of recognition of the principle of the primacy of European Union law.

Uwzględniając dotychczasowe doświadczenia w badaniach nad systemami okupacji krajów Osi w trakcie II wojny światowej a szczególnie dominującej III Rzeszy niemieckiej, wydaje się, że występują w tym zakresie duże braki a stan tych badań można uznać za daleko niewystarczający. Słabością istniejących badań jest ograniczenie się do polityki okupacyjnej i struktur formalnych, czyli ich pewna wycinkowość. Rzadko uwzględnia się w nich dokumentacje porównawczą, ukazującą całościowe kształtowanie się struktur organizacyjnych zarządów okupacyjnych z uwzględnieniem całokształtu doświadczenia oraz zbiorczego mechanizmu funkcjonowania, przy wykazaniu także jego efektywności. Celem niniejszego artykułu jest, próba ustalenia, czy i o ile wypełnianie okupacji lub innych form władztwa przez III Rzeszę hitlerowską nad innymi terytoriami państwowymi czy narodami stanowiło system polityczno-prawny, jak kształtowały się różne postacie władania nad poszczególnymi terytoriami i wobec podbitej ludności w określonej sytuacji prawnej, społeczno-gospodarczej i politycznej. Należy przy tym podkreślić, że pojęcie „okupacja” używane powszechnie w historii politycznej tego okresu, nie wystarczy do poprawnego opisu zjawiska w języku nauki prawa. Jest ono zbyt ogólne i prawnicze nieadekwatne do stanu prawnego ziem zajętych lub kontrolowanych przez Niemcy i to zarówno tych anektowanych w sposób bezprawny (takich jak „eingegliederte Ostgebiete” w Polsce) jak i tych które zostały podporządkowane politycznie z pozbawieniem zamieszkałych tam narodów ich suwerennej władzy politycznej (takich jak Protektorat Czech i Moraw) i wreszcie tych, które zostały jedynie włączone przymusowo w orbitę wpływów III Rzeszy z utrzymaniem w nich rządów satelickich (np. Słowacja).
Taking into account previous experiences related to the investigation of occupation systems of the Axis powers during World War II, and in particular the dominant role of the Third Reich, it seems that there are large gaps in this area and the status of those studies can be considered largely insufficient. The weakness of the existing studies is their reduction to the occupation policy and formal structures, i.e. they are rather fragmentary. Only rarely do they take into consideration comparative documentation which shows the holistic development of organizational structures of invader’s administration along with its entire experience and collective functioning mechanisms as well as the demonstration of its effectiveness. This article is an attempt to determine whether and to what extent the exercise of occupation or other forms of governance by the Third Reich under Hitler’s rule over other territories or nations constituted a political and legal system, what were different types of governance over individual territories and conquered populations in a specific legal, socio-economic and political situation. It should be noted, however, that the term “occupation” used commonly in the political history of that period is not sufficient to properly describe this phenomenon in the language of law. It is too general and inadequate to the legal status of the territories occupied or controlled by Germany, including those illegally annexed (such as “eingegliederte Ostgebiete” [annexed Eastern territories] in Poland), those that have been politically subordinated with the deprivation of peoples living there of their sovereign political power (such as the Protectorate of Bohemia and Moravia), as well as those which were only forcibly incorporated into the orbit of influence of the Third Reich but with the maintenance of satellite governments (e.g. Slovakia).

The subject-matter of the article is the identification and analysis of the constitutional foundations of the legal provisions regulating the administrative procedure of public administration bodies in the Slovak Republic and analysis of decisions made by the Slovak Constitutional Court and Supreme Court. The administrative procedure represents an immanent process in which state and public administration bodies make decisions on rights, legitimate interests as well as obligations and duties in the field of state and public administration. The author aims to identify the most important provisions of the Slovak Constitution and to demonstrate their significance for the decision-making activities of domestic public administration bodies and at the same time to find out if the constitutional and legal basis is sufficient enough to make amendments regarding the decision-making processes of Slovak public administration bodies. The author's research hypothesis, resting on an enquiry to identify if the constitutional amendment is satisfactory and acceptable, is followed by an investigation of mutual relations between the current state of our society and its conditions being in a state of its rapid development and the contents of the constitutional amendment. It is argued that the Constitution as the basic piece of legislation must be adopted with accepted text so that potential changes would not entail having to change the Constitution.

The aim of this paper is to provide an overview of the application of competition law in the Slovak Republic since it became a member of the European Union 10 years ago. Special emphasis is placed on selected problems and questions which arose in the application of European competition rules and the need for an adjustment of Slovak competition legislation to EU requirements. The paper presents the relevant amendments in the Slovak Competition Act and analyses in detail their background. Slovak competition law has undergone many changes in the past 10 years, not always without problems. The aim of this paper is to identify the most important of those difficulties and explain why they have occurred. The correct application of national and EU competition rules by Slovak courts has proven to be one of the biggest challenge here, ultimately even causing the European Commission to intervene as amicus curiae. The actions taken by the European Commission in relation to competition matters within the Slovak Republic, and its resulting recommendations, will also be considered. The paper will outline how Slovak competition law has been step-by-step increasing its harmonisation with EU competition law over the last 10 years. Indeed, it is now possible to claim that Slovak competition legislation is fully harmonised with the rules of the European Union. The paper will thus mainly focus on those elements of Slovak law which can give a clear picture of the state of convergence of both legal systems. Nevertheless, the end of the road has not yet been reached. Further harmonisation of selected current topics within Slovak competition law will need to be assessed also. It will also be necessary to analyse which direction should Slovak competition law take in the future with regard to current EU trends. These issues include the need to find a balance between the protection of business secrets and the right of procedural parties to due process, especially in connection with the protection of leniency documents.
Cette contribution vise à fournir un aperçu de l'application de la loi sur la concurrence de la République slovaque au cours des 10 dernières années - depuis l'époque d’adhésion de la Slovaquie à l'UE. L’accent particulier est mis sur certains problèmes et questions qui se posent dans l'application des règles de concurrence de l'UE et sur la nécessité d'une adaptation du droit slovaque de la concurrence aux exigences de l'UE. Cet article présentera les changements pertinents dans la Loi slovaque sur la concurrence aussi qu’un analyse détaillé de l'arrière-plan de ces changements. Au cours des 10 dernières années, la loi slovaque de la concurrence a subi de nombreux changements – pas toujours sans problèmes. Le présent article tentera d'identifier les problèmes principaux et donner au lecteur une explication quant à la raison pour laquelle ils ont eu lieu. Dans ce sens-là, l'un des plus grands problèmes est la bonne application des règles nationales et communautaires de concurrence par les juridictions slovaques au moment de décider sur des affaires relatives à la concurrence. Cela a même abouti à la nécessité pour la Commission européenne d'intervenir comme un amicus curiae. Cet article vise également à fournir une analyse des actions de la Commission européenne en ce qui concerne les questions de concurrence en Slovaquie et les recommandations qui en découlent. Le présent article tente de présenter la manière dont le droit slovaque de la concurrence a suivi, étape par étape, un chemin vers l'harmonisation avec le droit communautaire de la concurrence au cours des 10 dernières années. Aujourd'hui, nous pouvons déjà affirmer que la réglementation juridique slovaque de droit de la concurrence est entièrement harmonisée avec la réglementation juridique de l'UE. Par conséquent, nous concentrerons notre attention sur les points dans la loi slovaque qui peuvent donner une image claire de la convergence de ces deux règlements juridiques. Néanmoins, nous ne sommes pas encore à la fin de la route. L'harmonisation supplémentaire de certains sujets actuels dans le droit slovaque de la concurrence devra être évaluée et il sera nécessaire d'analyser la direction vers l'avenir, en particulier ce qui sera le meilleur pour le droit de la concurrence slovaque en ce qui concerne les tendances actuelles dans le droit de la concurrence de l'UE. Parmi ces questions, il y a une nécessité d'un équilibre entre la protection des secrets d'affaires et le droit des participants à la procédure de concurrence pour un procès équitable, en particulier dans le cadre de la protection des documents de clémence.

Since the time when the first competition rules were adopted after the Velvet Revolution in early 1990s, Slovak competition law has undergone several changes. Three acts on economic competition were subsequently adopted (in 1991, 1994, 2001), each of them several times amended. Although Slovakia became a member of the EU in 2004, the convergence of national competition rules with the law of the European Union is evident in the significant changes that were introduced in 2004. The evolution of Slovak competition rules cannot be considered finished – major amendments are expected in 2014. The following paper will analyze in which aspects Slovak competition law is diverging from the rules of the European Union. Court jurisprudence reviewing administrative decisions issued in competition matters is also important in the assessment of the competition law environment. The paper will provide an overview of those features of Slovak competition law that shall be harmonised, as well as reasons for their harmonisations. Yet it must be stressed that European law is not the universal model of convergence and hence the paper will provide thoughts on which features of Slovak competition law might remain country-specific.
Depuis l'époque où les premières règles de concurrence ont été adoptées après la Révolution de velours en début des années 1990, le droit slovaque de la concurrence a subi plusieurs changements: trois actes sur la concurrence économique ont été adoptés par la suite (1991, 1994, 2001); chacun d'entre eux a également été modifié à plusieurs reprises. Bien que la Slovaquie soit devenue membre de l'UE en 2004, la convergence du droit slovaque de la concurrence vers des règles européennes de concurrence est évidente et des changements importants ont été introduits en 2004. Les modifications de la législation slovaque en matière de la concurrence ne peuvent pas être considérées comme terminées – les modifications considérables sont attendues en 2014. Le présent article analysera dans quels aspects le droit slovaque de la concurrence est divergent. De plus, la jurisprudence des tribunaux, examinant les cas en matière de la concurrence, est importante dans l'évaluation de l'environnement de la réglementation de la concurrence. Cet article offre un aperçu des caractéristiques du droit slovaque de la concurrence qui doit être harmonisé, ainsi que les raisons pour ces harmonisations. D'autre part, il faut souligner que le droit européen n'est pas le modèle universel de convergence et donc l’article présentera des pensées sur lesquelles les caractéristiques du droit national de la concurrence pourraient rester spécifique.

Criminal regulations in the Slovak Republic has changed approach of criminal capability to juventile offenders. Age qualification lowered from 15 years to 14 years. This is the reason of certain doubts, which concern with sanity of subject of crime. According provision of 338 Criminal Proceeding Act, in the case of juventile offender, who has less than 15 years in the time of crime, it is inevitable to observe, if this person was capable to recognise wrongfulness of act or if this person was capable command his actions. In the presence does not exist unified opinions in the question of expert. Expert proceeding is executed by experts in the branch of psychiatry or juventile psychology. In the comparision, in the conclusion of report, author deals with valid legal regulation of this issue in Czech Republic.

Subject of recodification of Slovak criminal law was institute of reduced sanity. In this report author analysis special provisions, which concern with this institute. Reduce sanity influences choice of sanction instruments with aim of security purpose of punishment. Court has duty to take account on fact of existence reduced sanity. In this issue, it is necessary to observe nature of mental illness or possible presence of habit forming substance. Asset of new legal regulation is unification of legal provisions of abandonment of punishment. Certain defect is absence of legal definition of reduced sanity.
