    The Act of 20 July 2018 on Higher Education and Science is the eighth Polish normative act of statutory rank since 1920 to deal with matters concerning the title of professor, not counting separate acts and their amendments. It is also the first act based on the regulations in force before 1965 to regulate in a single act matters of higher education and science. Despite their new formulation, not all of the solutions implemented by this Act imply a full withdrawal from the regulations adopted in previous years. What is absolutely new in it, however, is the simplification of the procedure and conditions of the proceedings for conferring the title of professor through: (1) a new definition of fields of science (arts) and scientific disciplines (artistic disciplines) based, following the OECD classification, on the two-tier qualification of sciences (with some exceptions); (2) the constitution of the Council for Scientific Excellence, as a new institution, as of 1 January 2021 exclusively endowed with the right to initiate proceedings for the conferment of the title of professor (including refusal) and the subsequent process, ending with a positive or negative decision of that Council. Other solutions of this law have been subject to broader or narrower changes or have been retained in their current wording. Those of such a nature constitute answers to the following questions: (1) On whom may the title of professor be conferred, and in relation to whom, despite meeting the requirements for it, is this unacceptable, for other statutory reasons?; (2) What requirements does the legislator expect from a candidate for this academic title, and to what extent do the expectations placed on them – outstanding scientific (artistic) achievements – go beyond the framework of the previously binding standards in this regard?; (3) What determines the selection of candidates for reviewers in this procedure, and what is the procedure for selecting them?; (4) What are the conditions for a candidate’s legal protection against negative decisions by the Council for Scientific Excellence, taking into account (5) the conditions for the President of the Republic of Poland’s participation in this procedure, which have remained unchanged since 1990?

    Artykuł przedstawia rozwiązania przyjęte i stosowane w Państwowej Straży Pożarnej (PSP), których celem jest zorganizowane i systemowe identyfikowanie i rozwiązywanie problemów wynikających z codziennej działalności jednostek organizacyjnych PSP oraz identyfikowaniem i zaspokajaniem potrzeb w zakresie strategicznego zarządzania służbą, definiowania kierunków rozwoju oraz odnawiania wizji funkcjonowania służby. Wykorzystanie projektów i programów naukowo-badawczych zostało przedstawione jako rekomendowane narzędzie do rozwiązywania problemów i zaspokajania ww. potrzeb PSP. Artykuł dzieli się na sześć zasadniczych części. W części pierwszej przedstawiono misję, wizję Państwowej Straży Pożarnej oraz wspomagającą funkcję badań naukowych, prac rozwojowych i innowacyjnych. Ponadto w tej części został przedstawiony ogólny zakres działania i odpowiedzialności Państwowej Straży Pożarnej z uwzględnieniem znaczenia sposobu budowania zespołów badawczych, także w kontekście rozwiązywania problemów interdyscyplinarnych, obejmujących działania różnych służb, a w konsekwencji także różnych jednostek badawczych. W kolejnej części artykułu została omówiona metodyka identyfikacji potrzeb i wytyczania kierunków naukowo-badawczych ze szczególnym uwzględnieniem roli Rady Naukowo-Technicznej przy Komendancie Głównym PSP (RNT KG PSP). Kolejne części artykułu obejmują opis czterech priorytetowych obszarów prac naukowo-badawczych zdefiniowanych na lata 2012 - 2020, a także omówienie organizacji zespołów naukowo-badawczych i sposób finansowania projektów i programów naukowo-badawczych realizowanych na potrzeby PSP. Zwraca się w nich również uwagę na potrzebę traktowania działalności badawczej jako elementu, który stanowi jeden z głównych punktów odniesienia w działalności poszczególnych komórek i pionów Państwowej Straży Pożarnej. Artykuł kończą wnioski sformułowane z myślą praktycznego ich zastosowania.
    The article presents solutions accepted and applying in State Fire Service (SFS) which are aimed at organized and systematic identification and solving of questions meet in everyday activities of SFS organizational units as well as identification and providing for the needs in scope of our service strategic management, defining of development directions and renewing vision of the organization function. Employment of scientific and research projects and programs is declared as recommended tool in scope of solving of above mentioned questions and providing for the listed needs of SFS. The paper is divided into six essential parts. In first part the mission and vision of State Fire Service are described as well as helping function scientific research, development and innovative work. Moreover, this part covers general presentation of State Fire Service activities with taking into consideration significance of research teams establishing process among others in context of solving of interdisciplinary questions involving different services and in consequence different research units. Second part of the paper is devoted to description of methods of needs identification and setting out directions of scientific and research work with role of Scientific and Technical Council appointed by Chief Commandant of State Fire Service. Next parts include discussion of four priority scientific and research work areas that have been defined for years 2012 - 2020 and moreover description of scientific and research teams organization and ways of gaining financial resources for discussed activities. Also, they include suggestions that research work should be treated as integral part of activities of particular units of State Fire Service. Finally, some practical conclusions are formulated.

    Opis:
    Background: The subject of this analysis are the legal regulations laid down in the Law on Higher Education and Science concerning the granting the degree of doctor habilitated. The article is devoted to the following specific issues: the habilitation entity, the conditions for conferring a doctor habilitated degree, and procedural issues. With regard to these conditions, the following conditions have been examined in detail: possession of a doctoral degree; having made of a significant contribution to the development of a particular discipline; demonstration of significant scientific activity in more than one institution; a positive evaluation of the habilitation colloquium. Exploring the subject of a doctor habilitated degree is justified by the modifications which, compared to the previous legal situation, were introduced by the legislator in relation to it. Research purpose: The main objective of the research is to reconstruct the normative content of the most important regulations concerning the granting of the doctor habilitated degree as provided by the Law on Higher Education and Science. This makes it possible to determine the extent to which the rules on the granting of this scientific degree have been modified in relation to the pre-existing legal status. Methods: The studies carried out are basic studies and employ the dogmatic method. The research material primarily consisted of the relevant provisions of the Law on Higher Education and Science, as well as the case-law of administrative courts and the views of representatives of the doctrine. Conclusions: The analyses carried out revealed that the current rules on the granting the degree of doctor habilitated degree are essentially related to solutions already established in the Polish academic tradition. The fundamental changes include the possibility of taking into account the achievements obtained before the doctoral degree, as well as the restoration of the habilitation colloquium. The article also notes the non-compliance of the regulation’s restrictions on the re- -application for a doctor habilitated degree with the Constitution of the Republic of Poland.
    Przedmiot badań: Przedmiotem analiz są regulacje prawne dotyczące nadawania stopnia doktora habilitowanego zamieszczone w ustawie – Prawo o szkolnictwie wyższym i nauce. Artykuł poświęcony jest następującym zagadnieniom szczegółowym: podmiot habilitujący, warunki nadawania stopnia doktora habilitowanego oraz kwestie proceduralne. W zakresie wspomnianych warunków szczegółowym analizom poddane zostały następujące przesłanki: posiadanie stopnia doktora, posiadanie dorobku stanowiącego znaczny wkład w rozwój określonej dyscypliny, wykazywanie się istotną aktywnością naukową albo artystyczną realizowaną w więcej niż jednej instytucji, pozytywna ocena kolokwium habilitacyjnego. Podjęcie tematu nadawania stopnia doktora habilitowanego jest uzasadnione modyfikacjami, jakie – w porównaniu do poprzedniego stanu prawnego – zostały w odniesieniu do niego wprowadzone przez ustawodawcę. Cel badawczy: Podstawowym celem badawczym jest rekonstrukcja treści normatywnej najważniejszych regulacji dotyczących nadawania stopnia doktora habilitowanego zamieszczonych w ustawie – Prawo o szkolnictwie wyższym i nauce. Pozwoliło to określić, w jakim zakresie doszło do modyfikacji zasad nadawania wspomnianego stopnia naukowego w stosunku do wcześniej obowiązującego stanu prawnego. Metoda badawcza: Przeprowadzone badania mają charakter badań podstawowych i opierają się na metodzie dogmatycznoprawnej. Materiałem badawczym były przede wszystkim odpowiednie przepisy ustawy – Prawo o szkolnictwie wyższym i nauce, jak również orzecznictwo sądów administracyjnych oraz poglądy przedstawicieli doktryny. Wnioski: Przeprowadzone analizy pozwoliły stwierdzić, że obecne regulacje dotyczące nadawania stopnia doktora habilitowanego zasadniczo nawiązują do rozwiązań już utrwalonych w polskiej tradycji akademickiej. Do zasadniczych zmian należy natomiast możliwość uwzględniania w dorobku podlegającym ocenie osiągnięć uzyskanych przez habilitanta przed nadaniem mu stopnia doktora, jak również przywrócenie kolokwium habilitacyjnego. W artykule została również zwrócona uwaga na niezgodność regulacji dotyczących ograniczeń w zakresie ponownego ubiegania się o nadanie stopnia doktora habilitowanego z Konstytucją RP.1

    Niniejsze opracowanie dotyczy analizy ustawowych kryteriów dla przyznania tytułu profesora, w ramach tak zwanej Konstytucji dla Nauki. W treści artykułu postawiono nacisk na swobodę wyboru formy aktywności naukowej dla kandydata do tytułu profesora, jaka wynika z treści ustawy. Ustawodawca użył złożonej normy prawnej dla ustalenia kryteriów dla kandydata do tytułu profesora. Może ona budzić wątpliwości zarówno praktyczne, jak i teoretyczne.
    This study examines the statutory criteria for awarding the title of professor under the so-called Constitution for Science. The content of the article emphasizes the freedom to choose the form of scientific activity for a candidate for the title of professor, as provided for in the act. The legislator used a complex legal norm to establish the criteria for a candidate for the title of professor. It may raise both practical and theoretical doubts.

    The legal status of libraries in Poland was defined by the decree on libraries and the care of collections dated 17 September 1946. This decree was repealed by the Act on libraries, dated April 9, 1968, which was repealed by Article. 31 of Act on libraries, dated 27 June, 1997. The legislature didn’t define the concept of a library, but only pointed out the basic tasks of the library. Not every entity that uses its name in code “library” is a library within the meaning of the Act. Public libraries can’t be combined with other institutions, school libraries or pedagogical libraries. The Act regulates the notion of library materials, the National Resource Library, the competence of the Council for this resource, the tasks and functions of the National Library Council. The problem is in the library policy, which hasn’t been defined in the an appropriate manner. In addition to public libraries, there are scientific, school and pedagogical libraries. The law doesn’t regulate the status of library staff. The important role of libraries show numerous provisions of the Constitution
