The paper undertakes a discussion on foreign subsidiaries of Polish companies. The scale of Polish foreign direct investment (FDI) continues to grow and this means that soon there may be a gap between business practice and knowledge of management science. The author proposes the hypothesis which states that Polish FDI do not run according to the processes proposed by the phase models (e.g. Uppsala model), but they have a certain degree of leapfrogging. The initial phase of internationalization of Polish enterprises and their motives led the author to the formulation of two other hypotheses regarding the roles foreign subsidiaries play within the Polish international companies. One is that foreign subsidiaries of Polish enterprises play, in most cases, a role called the implementer by typology of Ch.A. Bartlett and S. Ghoshal, and the second is, that in most cases, these are the entities that in the typology of A.K Gupta and V. Govindarajana are called implementor.

One of criteria for differentiating small-sized enterprises is the fact of belonging or not to a business group. It seems to be quite important for research in this size businesses. The paper presents the results of the study on the implementation of a strategy and the strategy formulation process in small-sized enterprises. The results showed quite significant differences depending on whether or not the enterprises were subsidiaries of a business group. These differences may become a starting point for a discussion on the importance of this feature in management science.

Foreign direct investment (FDI), its motives, modes and location choice constitute key subjects in theory and research in international business, due to their long-term consequences for firm competitiveness. The determinants of results achieved in foreign markets can therefore be described as a fundamental research area, which specifically includes studies on FDI performance. In spite of its long tradition and methodical advancement, extant research show numerous inconsist-encies and ambiguous findings. In both international and Polish literature, no complex summary of extant knowledge on FDI performance determinants can be found, which would allow for the consolidation and evaluation of earlier findings. The aim of this paper is to present the findings of a structured review of 95 studies on performance of foreign subsidiaries. Within extant studies, four main research streams were identified, focusing on FDI mode choice, resource determinants on a firm and subsidiary level, host-country characteristics and corporate strategy. Previous research has not adequately considered the role of expansion motives for evaluating FDI performance. Future studies should also to a greater extent account for a differentiated role of firm resources, particularly various types of international experience, as applied in host countries at different levels of economic and institutional development. Moreover, a more holistic FDI performance analysis requires a simultaneous consideration of financial and non-financial dimensions of a foreign subsidiary's competitive position. Based on the outcomes of the present review, areas for further studies have been proposed, especially as regards the context of outward FDI, increasingly undertaken by Polish companies, and its specific character.

Artykuł identyfikuje te problemy. Dodatkowo praca porusza zagadnienie planowanej reformy jednostek pomocniczych w Poznaniu.
The aim of the study is the presentation of subsidiary districts in the city of Poznań. Poznań’s division into districts has been created by its citizens and is a result of their perception of the urban space. Unfortunately differences in the population and size of those units are too big, and the whole structure is inconsistent. The administrative tasks and powers of these units are also diverse. This problem causes difficulties in the daily operation of the units. The study identifies these difficulties by focusing primarily on their spatial aspect. In addition, a planned reform of the subsidiary units in Poznań is presented. The author indicates also the integrating role of the district units. They should serve not only administrative tasks, but should also integrate a district’s population.

Opis:
Every company in the course of its existence faces a number of barriers to its further growth. In some situations, the company is not able to continue to grow, or a further increase may even become the cause of its downfall. Considerations carried out in the paper show that the way to overcome such barriers can be “disintegration” and transformation of the company into business group. The creation of the business group seems to be a natural stage in the evolution of the company, considered in terms of increasing its size and complexity.

A concept of the welfare state is based on the principles of equitable distribution of wealth and equality of opportunity. The state is responsible for the protection and promotion of the economic and social well-being of its citizens. Progressive taxation reduces the income gap between the rich and poor. However, the efforts to put principles of the welfare state into practice produced still unsatisfactory results. It was closely connected with violating the subsidiary principle and eroding the work ethics. That is just why the welfare state failed from the ethical and economic point of view.

W artykule przedstawiono założenia teoretyczne i wyniki badań dotyczące kierunków zmian w strukturze organizacyjnej krajowej spółki niemieckiego koncernu. Badania metodą wywiadu oraz analizy treści dokumentów organizacyjnych prowadzono w latach 2010 – 2017. W wyniku przeprowadzonych badań stwierdzono, że w badanym okresie zmienił się charakter struktury jednostki podporządkowanej z projektowo – koncepcyjno-operacyjnej na „czysto” operacyjną.
The article presents the theoretical assumptions and the outcomes of a study on the directions of changes in the organizational structure of a subsidiary of a German company. The research was carried out between 2010 and 2017 with the use of the interview method as well as the analysis of the content of organizational documents. As a result of the study it was found that there was a change in nature of the subsidiary’s structure from project-concept-operational to mainly operational within the researched period of time.

Celem niniejszego opracowania teoriopoznawczego jest wskazanie związku między rozwojem przedsiębiorczości a dostępem do subsydiów publicznych. Polska praktyka gospodarcza dostarcza licznych dowodów na to, że dostęp do szerokiego spektrum bezzwrotnych środków pomocowych przeznaczanych zarówno na realizację zadań publicznych, jak i dofinansowanie prywatnej działalności komercyjnej wpłynął na wykształcenie nowej formy aktywności gospodarczej w ramach „przedsiębiorczości zależnej” od zewnętrznych subsydiów. Studia literaturowe połączone z analizą ilościową świadczą o tym, że jest to problematyka mająca wyraźnie ekspansywne przełożenie na praktykę gospodarowania, a jednocześnie charakteryzuje się deficytem naukowego rozpoznania. Zaprezentowana analiza wpisuje się w nurt rozważań współczesnej ekonomii w ramach instytucjonalnych uwarunkowań gospodarki.
The aim of this paper is to show the relationship between the development of entrepreneurship and access to public subsidies. Polish economic practice provides evidence that access to a wide range of non-refundable aid, earmarked for the execution of tasks of public and private activity, gave rise to a new form of economic activity within the "entrepreneurship subsidiary" of external subsidies. Literature studies combined with quantitative analysis indicate that although the issue is of great interest among the potential beneficiaries of the wide range of offered subsidies, it is at the same time characterized by a deficit of scientific diagnosis. The presented analysis is part of the modern economic debate on the institutional framework of the economy.

Fixed establishment (FE) is one of the institutions of the EU value added tax system; its structure is essential to correctly determine the right tax jurisdiction of an EU Member State for the purpose of VAT settlement in situations of cross-border provision of services. However, the legal structure of a FE adopted by the EU legislator (and, consequently, adapted to national legislation of the Member States) causes uncertainty when it comes to its interpretation. In the absence of unambiguously defined conditions in EU law to consider a specific presence and activity of an enterprise to be a FE, interpretation rules contained in judicial decisions issued by the Court of Justice of the EU play an important role. Among attempts made by the CJEU to clarify the ‘blur areas’ resulting from the dynamics of modern business processes, one of the most interesting ones is the possibility of considering a subsidiary to be a fixed establishment for a parent company. The purpose of this paper is to analyse legal and economic factors, the fulfilment of which may constitute a condition for considering a subsidiary to be a fixed establishment for a parent company, with particular emphasis on the ruling of the Court of Justice of 7 May 2020 in the Dong Yang case (C-547/18).

Marxism accepted the notion of social justice, but realized it through liquidation of private property and violence of the totalitarian state. Liberalism and neoliberalism, in the name of maximal economic liberalism, reject the idea of social justice and postulate a minimal state. Republicanism and communitarianism accept ideas of common good and social justice. The social teaching of the Church proposes a subsidiary state which is not a protective one. Contemporary popes – Pius XI (Quadragesimo anno), John XXIII (Mater et Magistra), Paul VI (Populorum progressio), John Paul II (Sollicitudo rei socialis, Centesimus annus) – postulate participation of the state in social justice. The main of its obligations are: protection and financial aid for key sectors of economic life (including agriculture), profamily policy, fighting against unemployment and providing fair salary, limited economic intervention (while respecting the rules of the free market economy at the same time), medical and social care.

Recent years have belonged to the generation of people whose basic form of entertainment is the digital play. For some people games may be the source of entertainment, information, education or even religious life in a deeper form and evangelization, whilst for others this is the way leading to isolation from the family and society, addiction, deterioration of the marriage life, depravation of parental rights, illness or even crime. Thus we can speak about chances as well as threats for mankind the virtual reality games bring about. The latter stem from the fact that games occupy a substantial part of the player’s life: the world of games; the virtual world intrudes into the real world so much, that the player is deprived of a part of his real life and on numerous occasions deprived of his „here and now” identity. The virtual world makes it possible to escape from one’s own identity through the construction of some other identity; the identity that is often irresponsible and hypocritical. It appears that the dividing line of understanding what the virtual world and new media should be has been violated. Where are the borders of the real and the virtual world? The answers to the questions are to be found in the subsidiary principle and the moral order in the real and the virtual world.

Artykuł odnosi się do najważniejszych elementów instytucji oskarżenia subsydiarnego w polskim procesie karnym. Zwrócono uwagę przede wszystkim na procedurę prowadzącą do uzyskania przez pokrzywdzonego prawa do wniesienia subsydiarnego aktu oskarżenia, inne wymogi, których spełnienie warunkuje wejście w tę rolę procesową, oraz relacje pomiędzy oskarżycielem subsydiarnym a publicznym. Wyeksponowano także podobieństwa oskarżyciela subsydiarnego i jego skargi do oskarżyciela prywatnego, podkreślając jednocześnie specyficzne cechy publicznoskargowego trybu ścigania przestępstw. Poszczególne zagadnienia zostały przedstawione z uwzględnieniem zmian kodeksowych, także nowelizacji z lipca 2019 r. Ocena istniejących rozwiązań została dokonana przede wszystkim z punktu widzenia skuteczności realizacji praw pokrzywdzonego.
The article refers to the most important elements of the institution of subsidiary prosecution in Polish criminal trials. Attention is paid primarily to the procedure leading to obtaining the right to lodge a subsidiary indictment, other requirements which must be fulfilled to enter this procedural role, and the relationship between the subsidiary and public prosecutors. Similarities between the subsidiary prosecutor and his complaint and the private prosecutor are also emphasized. Attention is also paid to the specific features of the public-prosecution procedure. Particular issues are presented, including law changes, as well as the July 2019 amendment of Code of Criminal Procedure. The assessment of polish regulations is made from the perspective of the victims’ rights effectiveness.

Purpose: This elaboration aims at answering the question: Does a domestic subsidiary of a German company apply functional or process approach in management? The first part of the article characterizes the functional and process approach. The second part includes results of the studies on approaches applied in the managing of a subsidiary of a national German company of automotive industry. Design/methodology/approach: The article is based on the analysis of secondary sources (scientific literature and corporate documents of studied subsidiaries) as well as on the analysis of primary sources (the results of an interview with the director of the company). Findings: Deciding on a change of approach in the management of a multi-entity organization should be well considered and preceded by a comprehensive analysis of the solutions guaranteeing optimal execution of the tasks resulting in customer satisfaction. While the functional approach exhausts, in a sense, the possibility of its further modification to achieve tangible benefits for the organization, the process approach, despite many problems it can generate, its scale of complexity in implementation, gives greater benefits in terms of capacity to react to external imbalances. The traditional arrangement of functions based on the functional layout will continue to be of interest for the management of the parent unit and subsidiaries. Research limitations/implications: The elaboration of the approach to management does not fully address the issues and concerns that are presented here. However, they point to many areas that need to be taken into account in further theoretical and empirical studies. Practical implications: The traditional arrangement of functions based on the functional layout will continue to be of interest for the management of the parent unit and subsidiaries. The business practice provides many examples in this regard, including unsuccessful reorganizations in the "purely" process direction. One might even say that multi-entity organizations applying the parameters of the process organization in full are rather scarce. Social implications: Not applicable. Originality/value: It has been shown on the basis of the studies that despite the separation of processes and directing the staff towards the final product the traditional (functional) approach regarding management dominates in the company.
